Delivery is F.O.B. Destination, invoices should be submitted electronically to ALC-Fiscal@uscg.mil to the Chief, Fiscal Branch in Elizabeth City, NC, and all payments will be made electronically. Attachment 3

3052.212-70 Contract Terms and Conditions Applicable to DHS Acquisition of Commercial Items. (JULY 2023) (HSAR DEVIATION 25-09) (effective November 3, 2025) The clauses and provisions contained herein are applicable to any order awarded as a result of this solicitation. The terms and conditions set forth herein supersede all other terms and conditions. Acceptance of the order in accordance with (IAW) FAR 12.201 constitutes acceptance of all terms and conditions contained herein.

Service Contract Labor Standards

The Service Contract Labor Standards will apply to any task orders awarded through this solicitation. In accordance with (IAW) FAR 22.1009-4 all possible places of performance have not been identified. The Contracting Officer has determined two possible places of performance and has included a Wage Determination as an attachment to this solicitation. Wage determinations for additional possible places of performance will be provided if asked to do so in writing at Hartley.K.Askew2@uscg.mil. Offerors must request additional wage determinations no later than 2 days before solicitation close. Offerors who intend to perform in a place or area of performance for which a wage determination has not been attached or requested may nevertheless submit quotations. However, a wage determination shall be requested and incorporated in the resultant contract retroactive to the date of contract award, and there shall be no adjustment in the contract price.

Provisions

52.212-1 Instructions to Offerors—Commercial Products and Commercial Services (Aug 2025) (DEVIATION 25-21) (effective November 28, 2025) This Provision applies to this acquisition and paragraph (b) is tailored with the following addendum: (b) Period for Acceptance of Offers - The offeror agrees to hold the prices in its offer firm for 60 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

Addendum

Quotation Submission Requirements Quotations are required to provide the “Requirement” 70Z03826QB0000147” document with the highlighted areas completed.

52.212-2 Evaluation—Commercial Products and Commercial Services (Aug 2025) (DEVIATION 25-21) (effective November 28, 2025) is not applicable to this solicitation. In lieu of this provision, quotations will be evaluated in accordance with FAR 12.204(a).

Evaluation Criteria/Lowest Price Technically Acceptable (LPTA) Factor Recommendations: The Government will make award to the LPTA offeror. Only the lowest price offer will be evaluated for Technical Acceptability. Should the lowest price offer not receive an acceptable technical rating, the process will continue in order of lowest price offer until the lowest prices, technically acceptable offer is identified.

Factor 1: Technical Acceptability.

Technical Acceptability will be evaluated to determine an overall rating of “acceptable” or “unacceptable”. This will be determined by evaluating the ability of the offeror to provide a sound, compliant approach that meets all requirements listed in the Statement of Work (SOW) and demonstrates a thorough knowledge and understanding of the requirements. It is the contractor’s responsibility to ensure that their quotation clearly demonstrates their ability to perform these requirements. All offerors must provide the following minimum information and documentation with their quotations:

1. Ability of the offeror to meet the requirements listed in the SOW.

2. Detailed explanation of any requirement listed in the SOW that cannot be successfully accomplished by the offeror.

3. USCG certifications in accordance with (IAW) the SOW. Offerors that have completed work for the USCG in the past need only provide this information if it has changed or been updated since the last time work was performed.

Offerors must also provide the following additional documentation. Failure to provide all of the documentation with the quotation may result in the quotation being eliminated from evaluation.

4. Detailed explanation of the offeror’s ability to test water samples in accordance with the SOW. A simple statement of capabilities will not suffice. The offeror must address how they will accomplish the requirements of the SOW.

Technical Acceptability Ratings Descriptions Acceptable Based on the offeror’s quote, the Government has a high expectation that the offeror will meet the requirements identified.

Unacceptable Based on the offeror’s quote, the Government has low or no expectation that the offeror will be able to meet the requirements identified.

Factor 2: Price.

It is requested that the offeror provides “Requirements – 70Z03826QB0000147” excel sheet with their quotation. Prices will be evaluated to determine fair and reasonableness. The Government will evaluate prices for each contract period of performance including escalation rates between contract periods. The Government may determine that a quotation is unacceptable if the option period prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option.

52.209-5 Certification Regarding Responsibility Matters (NOV 2025) (DEVIATION 25-27) (effective November 28, 2025) (a)(1) The Offeror certifies, to the best of its knowledge and belief, that—

(i) The Offeror and/or any of its Principals—

(A) Are □ are not □ presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;

(B) Have □ have not □, within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) contract or subcontract; violation of Federal or State antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property (if offeror checks "have", the offeror shall also see 52.209-7, if included in this solicitation);

(C) Are □ are not □ presently indicted for, or otherwise criminally or civilly charged by a governmental entity with, commission of any of the offenses enumerated in paragraph (a)(1)(i)(B) of this provision; and

(D) Have □, have not □, within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds the threshold at 9.104-5(a)(2) for which the liability remains unsatisfied. Federal taxes are considered delinquent if both of the following criteria apply:

(1) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if a pending administrative or judicial challenge remains. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(2) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(ii) The Offeror has □ has not □, within a 3-year period preceding this offer, had one or more contracts terminated for default by any Federal agency.

(2) "Principal," for the purposes of this certification, means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).

(b) The Offeror shall provide immediate written notice to the Contracting Officer if, at any time prior to contract award, the Offeror learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.

(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the Government will consider the certification in connection with a determination of the Offeror's responsibility.

Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror nonresponsible.

(d) This provision does not require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a). The knowledge and information of an Offeror is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.

(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. If the Government later determines that the Offeror knowingly rendered an erroneous certification, in addition to other remedies available to the Government, the Contracting Officer may terminate the contract resulting from this solicitation for default.

(End of provision)

(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that suspension or debarment is not necessary to protect the interests of the Government; or

(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.
