USIBWC American Dam Lighting Project Statement of Work

International Boundary and Water Commission United States and Mexico

United States Section

STATEMENT OF WORK (SOW)

FOR THE AMERICAN DAM LIGHTING DESIGN AND INSTALLATION

I. BACKGROUND

The United States Section of the International Boundary and Water Commission (USIBWC) is a federal government agency and the U.S. component of the International Boundary and Water Commission (IBWC), which applies the boundary and water treaties of the United States and Mexico. Our mission is to provide binational solutions to issues that arise during the application of United States - Mexico treaties regarding boundary demarcation, national ownership of waters, sanitation, water quality, and flood control in the border region.

Carlos Marin Field Office/American Dam

The American Dam was constructed to regulate the quantity of water delivered to Mexico and the United States irrigators from the Rio Grande under the 1906 Convention by diverting the United States allotment of water to the American Canal for United States irrigators and releasing to the river downstream the waters allotted to Mexico.

The diversion dam, constructed in 1937-1938, is 284 feet long and contains thirteen radial gates. Water enters the American Canal over a weir, which is parallel to the general course of the river. Intake control into the American Canal is by means of two radial gates.

Downstream of the intake structure, the canal follows the left bank of the river 2.0 miles downstream to connect with the Rio Grande American Canal Extension (RGACE). Water for the portion of the Rio Grande Reclamation Project is carried through the RGACE. The RGACE terminates at Riverside Canal Heading, just downstream of the Ysleta-Zaragoza International Bridge, a distance of approximately 12 miles.

Location:

The American Dam, constructed wholly within the United States, is located on the Rio Grande about 3.5 miles upstream from the business center of El Paso, Texas and about

140 feet above the point of beginning of the Western Land Boundary between the United States and Mexico.

Condition of Project:

The facility has a perimeter fence with gates and some lighting. There are no additional security measures employed at the facility. The facility is located within the city in a residential/commercial neighborhood.

The hours of operation for the facility are Monday through Thursday, 7:00 AM to 5:30 PM.

Except on Federal holidays.

The areas along the US-Mexico border are plagued with human and narcotics smuggling and violence surrounding these activities. It is not within the USIBWC’s scope or desires to directly attempt to control, enforce, or prevent these activities. However, USIBWC is committed to upgrading an effective physical security system to enhance its abilities to effectively delay, deter, and deny access to unauthorized persons, vehicles, and decrease its susceptibility to criminal and terrorist action upon its properties.

Contractor personnel must maintain government (federal, state, local-drivers license or other photo ID) issued identification on their person at all times while on USIBWC property.

II. SUMMARY

The purpose of this project is the design and installation of four (4) high mast lighting systems with 10 LED lights per head/pole.

The Contractor shall provide all work plans, designs, investigations, studies, permits, project supervision, equipment, labor, materials, installation/implementation, testing, training, annual maintenance estimates, and travel required to meet the security requirements under the requirements established by the USIBWC Security Services Division (SSD) and this SOW.

The work supplied under this specification shall be complete in every detail for the purpose required. The Contract shall include the supply of materials and services not specifically mentioned herein, but which may be necessary to complete any portion of the work in compliance with the requirements of this SOW.

III. APPLICABLE CODES, RULES, AND REGULATIONS

The Contractor shall comply with the most updated or recent version of all applicable laws, standards, codes and regulations while designing, manufacturing, finishing, and installing the measures at the American Dam and Carlos Marin Field Office; including but not limited to the following:

D. Safety: The Contractor shall comply with all applicable provisions of the “U.S. Army Corps of Engineers Safety and Health Requirements Manual”, EM385-1-1, 2014 edition with April 9, 2015 update, and the Occupational Safety and Health Administration 29 CFR 1926 – Construction Standards. In cases of conflicts between the two requirements, the most stringent requirement will apply. Contractor shall be responsible for subsurface utility survey prior to installation.

IV. ADMINISTRATIVE TASKS

The Contractor shall install all recommended components in accordance with this Statement of Work (SOW)). This SOW includes a conceptual design that will be available after Contract is awarded. The end result shall be a turn-key operation. The Contractor shall provide all workplans, designs, equipment, labor, materials, installation, testing, annual maintenance estimates, and training required to meet the security requirements under this SOW.

A. The Contractor will have the opportunity to attend a Pre-proposal Site Visit at the American Dam and Carlos Marin Field Office. The dates of the site visit will be scheduled with the Contracting Officer (CO) after solicitation of the RFP. The Contractor will have the opportunity to walk around during the site visits; no other opportunity will exist for Contractors to visit the site. Each participant shall attend at their own expense. The Government will not pay for any site visits.

B. The Contractor shall appoint a Project Manager (PM) to serve as the single point-of-contact and liaison between the Contractor, the CO, and the Contracting Officer's Representative (COR) for all work under the Contract. Upon receipt of the Notice to Proceed (NTP), the Contractor shall immediately furnish in writing for approval, the name of the designated individual who will act as the PM to the CO. The Project

Manager will be responsible for the complete coordination of all work developed under the Contract. The PM shall be the liaison between the workplan drafting phase and installation of the work and must promote a “team” approach for the project and monitor its progress. The PM must stay involved, be knowledgeable about the project, perform periodic regular visits, and be proactive in dealing with issues that may arise.

C. The Contractor selected shall have 3 years of experience working with Federal agencies on security projects. The Contractor shall be very familiar with Interagency Security Committee (ISC) standards for federal facilities.

D. All work will be accomplished with adequate internal controls and review procedures which will eliminate conflicts, errors and omissions, and ensure the technical accuracy of all designs, drawings, and specifications.

E. Schedule: The Contractor shall prepare a detailed project schedule that identifies all tasks and milestones for presentation and discussion at the kickoff meeting. The schedule shall be prepared in a graphical format using the critical path method, which depicts the order and interdependence of tasks, subtasks, milestones, and deliverables for each of the requirements identified herein. The Contractor shall ensure that all tasks and work sequences in the schedule are logical and show a coordinated plan of the work. The agreed upon Project Schedule shall be used by the USIBWC to measure the progress of the work, to aid in evaluating time extensions, and to provide the basis for payments and performance.

F. Monthly Reports: Contractor shall prepare and submit to the USIBWC a monthly update report by the fifth (5th) of every month on the work performed the previous month. The report shall include major accomplishments for the reported period, significant problems and proposed solutions, and any issues with contractual requirements. The report, along with an updated schedule, shall be submitted by email.

G. Meetings

1. The Contractor shall conduct one (1) project kickoff meeting. The location of the kickoff meetings will be at the USIBWC Headquarters, 4191 N. Mesa, EL Paso, Texas 79902. Due to pandemic precautions, a teleconference may be acceptable upon request to the USIBWC. The USIBWC has video teleconference capabilities at the El Paso Headquarters Office and American Dam and Carlos Marin Field Office. Depending on the CDC and USIBWC guidance, the kickoff meeting may be held via teleconference. This will be determined at a later date. The date and time of the meeting shall be scheduled with the USIBWC's Contracting Officer or COR. The Contractor shall prepare an agenda and minutes of the kickoff meeting.

2. The Contractor shall participate in workplan consensus, status and team building meetings with all appropriate participants at the start, on a monthly basis during the project development period, and as needed to maintain the project schedule.

If requested by the COR, the Contractor shall act as the lead. The Contractor shall attend and participate in all review conferences pertinent to the work under the Contract. Project Manager shall attend all conferences and meetings.

3. The Contractor shall submit the draft minutes of all meetings to the USIBWC and to any primary stakeholders that participated in the meeting within three (3) business days after the day of the meeting. The USIBWC will provide comments within three (3) business days, of receipt of the draft minutes. The Contractor shall address the comments and submit the final minutes to the USIBWC and primary stakeholders within three (3) business days, after receipt of all comments.

H. The Contractor shall appoint a project superintendent for the American Dam and Carlos Marin Field Office project that shall be onsite at all times during installation activities. The Superintendent is the first point of contact for the USIBWC Inspectors on the project. The Superintendent is responsible for the safety and execution of the project on a daily basis and reports to the Project Manager.

I. Coordination with Stakeholders: The Contractor shall be responsible for coordination with all required stakeholders during the design and installation of the project.

Stakeholders include, but are not limited to, utilities, local, state, and Federal permitting agencies, etc. Contractor shall cc COR on all communications with stakeholders. Coordination with USIBWC’s Environmental Management Division (EMD) may be required during the design process. EMD will coordinate with the Texas Historical Commission (THC) and other resource agencies for NEPA. The Contractor will be required to coordinate with EMD should additional information be needed during this review. A Programmatic Agreement (PA) has been in place since 2016 with THC and Texas Parks and Wildlife Department for the Management of Historic Properties relating to the American Dam and Carlos Marin Field Office.

J. The Contractor shall coordinate work activities with any and all other ongoing contracts to minimize any disruptions to work and USIBWC facilities, if there are any.

Work shall be coordinated so access to job sites under all contracts and access to USIBWC facilities is maintained. The Contractor shall keep the COR informed of all ongoing coordination activities and shall cc the COR on all coordination communications. The Contractor shall immediately notify the CO and COR, if there are any deviations from the approved workplan or coordination issues that may affect work requirements, period of performance, and/or cost. Adjustments to the conceptual design provided may occur and shall be presented to the CO through the COR if they arise before performing any tasks associated with the adjustment.

K. The Contractor shall include provisions for accessibility in the installation of the project: New systems and alterations to existing facilities are to be installed to meet the requirements of the Americans with Disabilities Act Architectural Guidelines (ADAAG), and the Uniform Accessibility Standards (UFAS), with the most stringent standards applied in the event of conflicts.

L. The Contractor shall address all questions regarding the Contract from the Project Manager to the CO in writing. The COR shall be copied on all communications with the CO.

M. Establish, furnish, and maintain suitable installation office facilities in the vicinity of the American Dam and Carlos Marin Field Office (within 50 miles), to serve as the project office for the duration of the project in the location specified in the Contractor's

Technical Proposal. A nonpermanent office (trailer, CONEX) may be positioned at the facility if coordinated with the COR and space is available.

N. The Contractor shall maintain an adequate staff of qualified support personnel to perform the work necessary to complete the project. Subcontractors awarded by the Contractor will be required to sign a Non-Disclosure Agreement prior to beginning any work.

O. The Contractor shall establish internal accounting methods and procedures for documenting and monitoring project costs.

P. The Contractor shall establish and maintain Contract administration procedures, which shall include preparation of supplemental agreements and requests for time extensions as well as administration of subcontracts.

Q. The Contractor shall include the complete project name and number on all correspondence related to this Contract.

R. The Contractor shall assume complete responsibility for the accuracy and completeness of Installation Documents prepared under this project.

S. The Contractor shall furnish written and electronic (pdfs) documentation of communications between the Contractor and any party pertaining specifically to this project to USIBWC for their records within one week of the communication.

V. WORKPLAN REQUIREMENTS

A. Examination of Site:

1. Prior to submitting a Proposal for Work, it is recommended the Contractor perform the following:

a. The Contractor and Installer shall visit the Project site to become familiar with existing site conditions, including the site location and size, and review of the conceptual drawings report and plans.

b. At time of site visit, contractor shall request and confirm receipt of existing USIBWC Asbestos and Lead Based Paint surveys from facility staff for consideration in development of contractor Workplans.

B. The workplan consisting of first draft, second draft, and final workplans, and other supplemental installation documents as needed for the comprehensive Physical Security Improvements Installation at the American Dam and Carlos Marin Field Office shall comply with the following:

1. The workplan shall meet all applicable requirements as recommended in this SOW. The plan shall comply with all applicable codes, standards, and regulations.

2. The workplan shall follow industry standards in respect to format and content. The workplan shall outline the plan for installation for each item outlined in this SOW.

3. The workplan shall include product data sheets for all equipment to be installed under this Contract.

4. The workplan shall include product maintenance requirements and annual opinion of probable costs.

5. The workplan shall include all survey control maps/data required for installation of the project.

6. Drawings shall be provided in AutoCAD 2018 or greater and shall be geo-referenced to the American Dam and Carlos Marin Field Office. In addition, the Contractor will also provide a copy in Adobe PDF format.

7. The Contractor shall prepare a workplan report for the project to include the basis for the installation, existing conditions within the project limits, survey information compiled for the project, datum information for the drawings, product data sheets, product maintenance requirements and yearly estimated costs, designs to include drawings and details as required, and any other data found to be pertinent by the Contractor.

C. Site Investigation and Design Data Research: The Contractor shall perform field reconnaissance, surveys, and site investigations as required to complete the installation project. The Contractor shall be required to make his own field investigations to verify dimensions and other information shown on USIBWC furnished reference drawings. The Contractor is responsible for all travel, reproduction costs, permitting costs, and work required to obtain engineering information and design data for the accomplishment of the Contract documents of the project in accordance with requirements of this SOW.

1. The Contractor shall become familiar with existing site conditions, including location of existing utilities.

2. The contractor shall document in the plan any confirmed or potential asbestos or lead based paint facility features that may be impacted by the proposed work including drilling, cutting, or cabling activities and all contract worker and USIBWC personnel safety precautions that may be required. Any asbestos or lead based paint hazard abatement or mitigation plans prepared by the Contractor must be submitted to USIBWC for safety and environmental compliance review and concurrence prior to initiation of material disturbing activities.

D. Submitted workplans will reference all applicable laws, standards, codes and regulations and will be subjected to review and approval by USIBWC. In order to accomplish the USIBWC’s commitment to the protection and preservation of the environment and historical sites, the Contractor shall provide all drawings and supporting design analysis based on the requirements set forth in this SOW and in compliance with National Environmental Policy Act (NEPA). USIBWC’s Environmental Management Division (EMD) will coordinate NEPA compliance. Areas to be avoided (historical sites, etc.) shall be provided to the Contractor prior to the start of work.

E. EMD will coordinate with THC and other resource agencies, as needed, based on the first draft of the workplan submittal for NEPA clearance. Contractor will be required to coordinate with EMD if additional project information is required by the resource agencies. The Contractor shall be required to coordinate, schedule, and conduct all necessary meetings with the regulatory agencies in order to accomplish the installation of the project. The Contractor shall coordinate with the COR prior to commencing review and compliance confirmation with regulatory agencies.

F. The COR shall be kept informed of all coordination efforts and communications with outside agencies and shall be provided with design comments and any pertinent documentation, and approval letters for each review submittal to all regulatory agencies.

G. The Contractor shall be responsible for incorporating revisions requested by the regulatory agencies. The Contractor will coordinate with the COR prior to incorporating such revisions. The Contractor shall present its preliminary design to the COR at the first draft stage and shall discuss with the COR alternative approaches to installation of the project, including the feasibility of incorporating environmentally responsible approaches. The Contractor shall reach an understanding with the COR regarding the requirements of the project.

H. The Contractor will make every effort to develop drawings to include materials that are resource-efficient and sustainable. The Contractor shall incorporate these principles into the workplan at the first draft submittal and clearly indicate these inclusions using bold-italicized lettering. A narrative shall also be provided in the workplan analysis which clearly identifies these areas of the specifications.

I. EMD will submit the first draft workplan and applicable drawings provided by the Contractor to THC and other resource agencies. No work will begin prior to notification from EMD that clearance for installation to proceed has been given from these agencies.

J. The Contractor shall ensure that a migratory bird survey is conducted in this area.

Approved U.S. Fish and Wildlife protocols this shall be conducted prior to initiating any work during the period of 1 March through 31 August. Appropriate documentation and avoidance measures shall be taken to identify any active nests. Coordination with the USIBWC’s EMD may be required in advance.

K. Due to identified heavy metals in the soil (arsenic, cadmium, and lead), soil remediation of the project location was completed in 2014. The depths of the soil remediation are shown in drawing “26425-6 AD Soil Remediation Island AS BUILT.pdf.” Any excavation proposed for greater than the depths remediated shall have soil testing. Contractor is responsible for any soil testing to be conducted. Any project work proposing to impact the groundwater management zone, including any dewatering activities, shall be required to coordinate with the Texas Commission on Environmental Quality (TCEQ). Dewatering activities shall require water quality sampling and may require groundwater remediation to meet Texas surface water quality standards

L. The Contractor shall be aware that the backfill material used on the island on the soil remediation project was sugar sand. The top six inches (6”) is gravel, followed by geotextile, and then sugar sand to the depth of remediated soil. Below the sugar sand is native material that may be contaminated.

VI. REVIEWS AND OVERSIGHT VISITS

A. The workplan will be reviewed by the project team including representatives of USIBWC technical divisions for conformity with USIBWC procedures and the terms of the Contract according to the QC Plan requirements. Review by USIBWC does not include detailed review or checking of design of major components and related details or the accuracy with which such designs are depicted on the plans.

1. The review by the USIBWC’s Representative of the design work in order to verify that all the requirements of this Contract are adequately met.

2. The Contractor has complete responsibility for the accuracy and completeness of all design documents as well as the installation documents prepared under this project.

B. USIBWC may also make periodic visits to the Contractor’s offices to discuss and verify progress and the Contractor’s QC plan. USIBWC will give the Contractor (2) calendar days advance notice of intent to make an oversight visit.

C. Throughout the process, the Contractor may request additional oversight visits by USIBWC to discuss and verify progress and to assist the Contractor and/or its installers(s) in resolving questions and issues. The Contractor shall give USIBWC three (3) calendar days’ notice of any requested oversight visit.

D. USIBWC Review of Workplan: If USIBWC at any time determines that the Workplan or Installation is proceeding which does not conform to Contract requirements, USIBWC reserves the right to suspend work for cause until resolution of the issue at no additional cost to the government.

E. Workplan Quality Review

1. Prior to the release of final Workplan Documents and Installation Documents, the Contractor shall complete review with personnel experienced in the appropriate disciplines(s).

2. The review shall verify that the Workplan Documents and Installation Documents were prepared in such a manner as to ensure that they will be acceptable to USIBWC, as well as the Management/Installation Team.

3. The criteria used in such review shall include:

a. Conformity of the final Workplan documents and Installation Documents with the Contract Provisions.

b. Assurance that all materials, equipment and elements of the Work provided for in such documents which shall be incorporated into the Project have been provided to perform satisfactorily for the purpose intended.

c. The appearance, organization, technical and grammatical accuracy of such documents.

d. Verification that such documents have been checked and signed by the drafter, designer, checker and reviewers.

4. Assurance that such documents fully provide for proper installation, compatibility of materials and conformity to acceptance criteria for inspections and tests as provided in the Contract and in accordance with all documents listed in Section III

APPLICABLE CODES, RULES, AND REGULATIONS.

F. Once the USIBWC has accepted the workplan, any item within the accepted work that the Contractor desires to subsequently change must be identified by Contractor through a written request identifying and requesting such change, and the change shall not be incorporated into the project until the USIBWC has agreed to the change.

VII. QC REQUIREMENTS

A. Quality Control Plan Requirements: The Contractor is responsible for accuracy and completeness of the plans and related design prepared under this Contract and shall provide QC measures defined in this SOW.

B. The Contractor shall prepare a Quality Control (QC) Plan. The QC Plan must be compliance confirmed by USIBWC prior to Contract execution. No activities may proceed until the Contractor’s Quality Control Plan has been compliance confirmed in writing by USIBWC. The plan shall detail how the Contractor will provide quality control (QC) for both the workplan and installation elements of the project, obtain samples for quality control testing, perform tests for Contractor quality control, provide inspection, and exercise management control to ensure that work conforms to the Contract requirements.

C. The Contractor QC Plan shall include a description of the quality control organization, including the number of full-time equivalent employees with specific quality control responsibilities and including a chart showing lines of authority and reporting responsibilities. The persons and organizations performing quality control functions shall have sufficient authority and organizational autonomy to identify quality problems, and to initiate, recommend, and verify implementation of solutions. All key personnel performing Quality Control functions shall be exclusively designated to such and shall not be assigned to perform conflicting duties.

D. The USIBWC reserves the right to require the Contractor to make changes in the quality control staff, including removal of personnel, as necessary, to obtain the quality specified.

E. Acceptance of the Work by the Installation QC Manager does not mean the USIBWC accepts the Work.

F. Control of Phases of Work: Prior to the start of any work activity the Contractor shall hold a meeting to ensure that all project personnel have a thorough understanding of work to be done. The meeting shall include discussions relating to what will be accomplished, by whom it will be performed, and where, when, and how the work will be done. These meetings are to ensure that all parties have the same understanding of the installation intent, have the appropriate plans and any special details, and are aware of safety regulations and procedures that need to be followed. At this time the QC inspection checklist for this activity shall be reviewed.

G. Installation QC Documentation: The Contractor, Project Manager, Installation Contractor, and/or subcontractor shall maintain current records providing factual evidence that required quality control activities and/or tests have been performed.

These records shall include the work of subcontractors and suppliers.

H. These records shall indicate a description of trades working on the project; the number of personnel working; weather conditions encountered; and any delays encountered.

These records shall cover both conforming and deficient features and shall include a statement that equipment and materials incorporated in the work and workmanship comply with the Contract.

I. IBWC Form 163, Contractor's Daily Quality Control Report shall be used to document this data. The original Form 163 with copies of these records in report form shall be hand carried to the USIBWC weekly after the date(s) covered by the report, except that reports need not be submitted on calendar days on which no work is performed.

As a minimum, one (1) report shall be prepared and submitted for every seven (7) calendar days of no work and on the last day of a no work period. All calendar days shall be accounted for throughout the life of the Contract. The first report following a day of no work shall be for that day only.

1. IBWC Form 163 shall be signed and dated by the Installation QC Manager. The report from the Installation QC Manager shall include copies of test reports and copies of reports prepared by all subordinate quality control personnel. All of these items shall also be provided to the COR in electronic format. IBWC Form 163 can be provided as a pdf scan of the original or as a pdf or word document containing a scanned electronic signature. All test reports and other items attached to the daily report shall also be scanned into pdf format.

2. The minimum scan resolution shall be 400 dpi.

3. Color documents shall be scanned in color.

4. Test reports, QC reports, inspections, minutes, etc. shall all be submitted in separate electronic files.

5. The file names for the electronic files shall always start with the Contract day number and shall also contain a brief description as well as the calendar date. For example, 065 DR Contractor Name IBM16C0012 12-13-2016.pdf or 065 QC IBM16C0012 12-13-2016.pdf.

J. Notification of Noncompliance: The USIBWC will notify the Contractor of any detected noncompliance with the foregoing requirements. The Contractor shall take immediate corrective action after receipt of such notice. Such notice, when delivered to the Contractor at the worksite, shall be deemed sufficient for the purpose of notification.

K. Contractor Responsibilities: The Contractor shall be responsible for the quality of installation and materials incorporated into the project. The Contractor’s Quality Control measures are to ensure that operational techniques and activities provide material of acceptable quality. Contractor sampling and testing shall be performed to control the processes and determine the degree of material compliance with the Contract Provisions.

VIII. INSTALLATION TASKS

Installation shall not commence until after USIBWC review and compliance confirmation of design and NEPA review.

The Contractor shall furnish all services, materials, supplies, equipment, investigations, studies, project supervision, and travel as required in connection with this SOW and as outlined in the items listed below.

A. The Contractor will install four (4) high mast lighting systems, three (3) on the island on the island and one (1) on the west side of the dam structure of the American Dam/Carlos Marin Field Office.

1. The lighting heads must be able to be lowered by agency personnel (automated/manually controlled halo lowing device).

2. The lighting heads will be LED lights.

3. Install separate electrical meter source.

4. Each new installed lighting system must be able to provide light across a minimum of 250’ around the installation point. The poles must be high enough to meet the minimum illumination distance from the installation point.

5. Each head will have ten (10) lights.

B. The Contractor will have an opportunity to review the American Dam and Carlos Marin Field Office and conceptual drawings after RFP is issued. In addition, after award, the Contractor will be able to review the documents to draft the Workplan and perform the subsequent installation.

C. The Contractor shall obtain all required installation related permits including Stormwater Pollution Prevention Plan permit as applicable.

D. Prior to commencing installation, the Contractor shall become familiar with existing site conditions, including location of existing utilities. The Contractor shall be responsible for locating all underground utilities at the site prior to commencing installation. Contractor shall contact a utility locator company and if necessary, contact any utility directly. Prior to utility outages, the Contractor shall submit request for an outage, in writing, a minimum of 10 calendar days before with an estimated duration, to the Contracting Officer or his/her designated representative and notify facility that will be affected. This will give the facility ample time to basically shut down and save works in process.

E. The Contractor shall keep the work site and staging area free from accumulation of waste material and rubbish during the Contract. The work site shall be cleaned daily.

F. The Contractor shall be responsible for the cleanup and disposal/recycling of solid, liquid, and electronic waste materials and rubbish from the installation site, field office(s) and staging area(s). Methods of disposal/recycling and all related service agreements shall be provided in the Workplan.

1. The disposal of waste materials and rubbish shall be in accordance with applicable federal, state and local laws and regulations and with the requirements in these Contract documents. Should a conflict exist in the requirements for cleanup and disposal of waste materials, the most stringent requirements shall apply. All waste be disposed of at a licensed landfill or waste disposal facility.

2. No excess materials shall be deposited within USIBWC property, unless compliance confirmed by the USIBWC. Excess materials not compliance confirmed by the USIBWC for placement on Government property shall be disposed of or reused by the Contractor.

3. The Contractor shall keep records of the types and amounts of waste materials produced and of the disposal of all waste materials. These records shall be kept current and accurate and shall be available for review by the USIBWC.

4. The Contractor shall maintain work and storage areas free from accumulations of waste materials and rubbish and before completing the work, shall remove all temporary facilities, including, buildings, unused materials, concrete forms and other like materials, which are not a part of the permanent work.

5. Hazardous Materials: All hazardous materials or wastes used or generated by the Contractor or discovered in work or storage areas defined as hazardous by 40 CFR 261.3, or other federal, state or local laws or regulations shall be disposed of by the Contractor in accordance with these Contract documents and applicable Federal, State and local laws and regulations.

a. Unknown waste materials that may be hazardous shall be tested and the test results shall be submitted immediately to the USIBWC for review.

b. A copy of all hazardous waste manifests shall also be submitted immediately to the USIBWC for review.

6. Non-Hazardous Materials: All non-hazardous materials or wastes used or generated by the Contractor to include, but not limited to, refuse, garbage, sanitary wastes, industrial wastes, paints, sealers, adhesives, oil and other petroleum products shall be disposed of by the Contractor in accordance with these Contract documents and applicable federal, state and local laws and regulations.

a. Disposal of materials shall be by removal from the installation site, Contractor’s field office and staging area(s).

b. All materials within the work site, Contractor’s field office and staging area(s) shall be removed prior to completion of the work under these Contract documents. All materials removed shall become the property of the Contractor.

7. In the event of the Contractor’s failure to perform the Work required by this Specification, the Work will be performed by the USIBWC and the Contractor shall be responsible for the cost of such work. The costs for temporary controls provided by the USIBWC shall include both direct labor costs and other direct costs associated with the Work.

G. Record Drawings

1. The Contractor shall keep one current and updated record copy of all Contract documents (workplan) at the Contractor’s field office. Specifications, plans, supplementary drawings, and shop drawings shall be annotated to show all changes made during the installation process. These shall be available to the USIBWC on a monthly basis to inspect for accuracy and completeness.

2. Record Drawings Requirements/Deliverables:

a. Record drawings are an official record of the project at the time of installation completion. The original "as-designed" Contract drawings are modified to show all additions, deletions and other changes made during installation. Accurate record drawings are very important for project operation and maintenance as well as future modifications.

b. Any deviations from plan design elevations, layout, quantities, coordinates, slopes, dimensions, workmanship, material and method of installation shall be clearly noted on the record drawings.

c. Cross out words like "equal to" or "similar to" and replace them with the specific information used during the installation process.

d. Detail locations and description of any utilities encountered during installation.

e. Stamp sheet with "RECORD DRAWING" and include Contractor’s name, USIBWC Contract number and date.

f. Record drawings are required to reflect the same degree of detail as the original plans.

g. The record drawings shall contain a certification similar to: "I certify that the locations, elevations, depths and comments regarding installation accurately reflect existing field conditions."

h. "As-Designed" items that are not shown on the record drawing shall be frozen instead of deleted.

i. Final record drawings shall be submitted as electronic copies:

a. While files for review may be provided via email or IBWC provided

SharePoint site, two (2) copies of the final, compliance confirmed record drawings shall be provided.

b. The set of drawings in pdf format shall contain all signatures and stamps.

i. Pdf files shall be configured to allow for high quality printing.

ii. Pdfs shall be generated from AutoCAD with a minimum of 600 dpi although 1200 dpi is preferred.

iii. Embed all fonts in the pdfs.

iv. Pdfs shall be rotated to drawing/sheet orientation.

v. A "set" of drawings includes both the full size and half size drawings.

1. One (1) pdf shall be full size (22"x34").

2. One (1) pdf shall be half size (11"x17").

vi. Pdf files shall allow extraction of sheets.

c. Drawing Files

i. AutoCAD 2018 Civil 3D or newer shall be used to create all drawing files and converted to .pdf for USIBWC review. Finalized, “As-Built” drawings will be provided in both AutoCAD 2018 Civil 3D or newer and .pdf format.

ii. All other references to AutoCAD within this document refer to Civil 3D version.

iii. At this time, USIBWC will not accept drawings in Revit.

H. Contractor's Daily Report The Contractor shall maintain daily records of installation activities in the form of a Contractor's Daily QC Report. It shall provide a complete word picture of the project, covering both the normal work process and anything unusual that occurs on the project.

I. Installation Contractor’s Record of Safety The Contractor shall maintain a record of all safety meetings, incidents, near misses, and accidents.

J. Materials Certification The Contractor shall submit a materials certification package to USIBWC which contains a checklist and supporting documentation. The supporting documentation shall consist of a summary of all documentation practices utilized for material acceptance and explanations of any deficiencies noted on the checklist. Material certifications shall ensure that all items meet the Buy American Act (41 USC 10a - 10d).

K. Other Records Other records are comprised of all relevant installation records. These records shall be attached to the daily reports. Examples of these records include but are not limited to the following: quantity delivery tickets, material acceptance test reports, concrete placement records, source of materials documentation, shop drawings; earthwork calculation data; progress photographs etc.

L. Final Installation Record Report’ The Contractor shall prepare for review a summary report of all installed equipment, product data sheets, training documentation, OPC of yearly maintenance Costs, list of maintenance activities required, and frequency required, record drawings or plans showing all installed components.

M. Completion of Work Inspections

1. Contractor Inspection.

At the completion of all work or any increment thereof established by a completion time stated in the special clause in Contract Section F.1 FAR Clause 52.211-10, entitled "Commencement, Prosecution and Completion of Work," or stated elsewhere in the Contract documents, the Installation QC Manager shall conduct an inspection of the work and develop a "Contractor’s Punch List" of items of work which do not conform to the Contract documents. Such a list of deficiencies shall be included in the QC documentation and shall include the estimated date by which the deficiencies will be corrected.

a. The Installation QC Manager or staff shall make a second inspection to ascertain that all deficiencies have been corrected and so notify the USIBWC.

b. These inspections and any deficiency corrections required by this paragraph will be accomplished within the time stated for completion of the entire work.

2. Contractor and USIBWC Pre-Final Inspection.

The Installation QC Manager, Contractor's superintendent, or other primary management person and the USIBWC will be in attendance at this inspection. The Pre-Final Inspection will be formally scheduled by the USIBWC based upon notice from the Contractor. This notice will be given to the USIBWC at least fourteen (14) calendar days prior to the Pre-Final Inspection. The notice must include the Contractor’s assurance that all deficiencies listed in the "Contractor’s Punch List" developed during the Contractor Inspection phase have been corrected and all Installation Work is complete and acceptable by the date scheduled for the Pre- Final Inspection.

a. Failure of the Contractor to have all Installation Work acceptably complete will be cause for the USIBWC to cancel the inspection and bill the Contractor for the USIBWC’s additional inspection costs in accordance with the Contract clause entitled, "Inspection of Installation."

b. At this inspection the USIBWC will develop a "USIBWC’s Punch List" of incomplete and/or unacceptable work performed under the Contract and will subsequently furnish this list to the Contractor.

c. Failure of the USIBWC to detect and list all incomplete and/or unacceptable work during this inspection will not relieve the Contractor from acceptably performing all work required by the Contract documents.

d. The USIBWC, at its option, may accept this inspection as the final acceptance inspection if in its opinion, the completion status of the inspected facilities and other work performed under the Contract, warrant this consideration.

3. Contractor and USIBWC Final Acceptance Inspection.

The Installation QC Manager, the superintendent or other primary management person and the USIBWC will be in attendance at this inspection. The final acceptance inspection will be formally scheduled by the USIBWC based upon notice from the Contractor. This notice will be given to the USIBWC at least fourteen (14) calendar days prior to the final acceptance inspection. The notice must include the Contractor’s assurance that all items in the "USIBWC’s Punch List" developed during the Contractor and USIBWC Pre-Final Inspection phase have been corrected.

a. Failure of the Contractor to have all Contract Work acceptably complete for this final acceptance inspection will be cause for the USIBWC to cancel the inspection and bill the Contractor for the USIBWC’s additional inspection costs in accordance with the Contract clause in Section E.1 FAR Clause 52.246-12, entitled "Inspection of Installation."

b. This inspection will be considered another Contractor and USIBWC Pre-Final Inspection and the Contractor must schedule another Contractor and USIBWC Final Acceptance Inspection after all items have been corrected.

c. Otherwise, this inspection will be considered a Contractor and USIBWC Final Acceptance Inspection if all items in the "USIBWC’s Punch List" and all other work are considered acceptably complete by the USIBWC.

IX. CONTRACT CLOSEOUT

The Contractor shall complete/submit the following for the Contract to be closed and prior to final payment:

A. 100% completed project in accordance with the SOW and final Installation Record Report prepared by the Contractor.

B. All installation management and administrative items as specified in this SOW are completed.

C. The installation site and all work shall pass all final inspections.

D. All punch list items shall be completed and inspected by the USIBWC Inspector and

COR.

E. The entire work site shall be cleaned.

F. The Contractor shall submit all reports for testing and inspections of the work.

1. QC tests and reports shall be organized by type of material, type of test and location.

2. Original minutes from all preparatory phase inspections and initial inspections shall be provided.

3. The Contractor shall indicate by manner of testing, material tested, and locations tested how the quality control requirements of the Contract were met. This shall be provided in a written report signed by the Contractor that contains a certification that all work was constructed per Contract requirements.

G. All submittals required shall have been submitted to the COR.

H. The Final Installation Record Report including record drawings shall have been submitted and compliance confirmed.

I. Submit Operation and Maintenance (O&M) Data/Manuals.

1. O&M Manuals shall contain data specifically applicable to this Contract and a complete and concise depiction of the provided equipment, product, or system, stressing, and enhancing the importance of system interactions, troubleshooting and long-term preventative maintenance and operation.

2. The Contractor shall compile and prepare data and deliver to the COR prior to the training of USIBWC personnel.

3. Data for each system shall include operating instructions, safety precautions, normal operations, operator service requirements, preventative maintenance, lubrications data, preventative maintenance plan and schedule, corrective maintenance (repair), maintenance and repair procedures, removal and replacement instructions, spare parts and supply lists, testing requirements, and special tool information, manufacturer’s instructions, parts identifications, warranty information, personnel training requirements, and Contractor information.

J. The Contractor shall provide a comprehensive project specific USIBWC personnel training program of the systems and equipment designed and installed under this Contract. The trainers shall be qualified in providing all required training and have expert knowledge of the all aspects of the operation and maintenance of their systems and associated components.

1. The Contractor shall furnish all necessary training materials. Contractor must be prepared to accommodate and provide materials for up to 10 USIBWC staff members.

2. The training shall be scheduled during regular working hours 7:00 am to 3:30 pm;

Monday through Thursday and shall exclude USIBWC holidays.

3. The Contractor shall coordinate with USIBWC to schedule the training sessions.

K. All training and commission of systems shall have been completed by the Contractor.

L. Warranty and Maintenance of Systems: The Contractor shall warranty all systems, products and services provided under this Contract for a period of at least one (1) year commencing on the date of written…
