This document is a federal contract solicitation (Document Number W912JA26QA013) for AXON X26P Tasers and X26P Taser Batteries issued by the U.S. Army Corps of Engineers, Fort Worth District (contracting activity W912JA). The Government will evaluate total price for ITEM 0001 and ITEM 0002, with technical and past performance factors combined being approximately equal to price in importance.

The contract incorporates 40 federal clauses and provisions by reference, including requirements for small business set-aside compliance, prohibited telecommunications equipment, whistleblower protections, cybersecurity incident reporting, item unique identification for items valued at $5,000 or more, and electronic payment submission via the Wide Area WorkFlow (WAWF) system. Payment will be processed through WAWF using routing data including Pay Official DoDAAC HQ0670, Issue By DoDAAC W912JA, Admin DoDAAC W912JA, and Service Acceptor DoDAAC W31BXS. Offerors must maintain a System for Award Management (SAM) registration and provide representations regarding covered defense telecommunications equipment, foreign procurement tax compliance (IRS Form W-14 if applicable), and non-discrimination in diversity and inclusion activities. The solicitation uses Deviation 2026-O0038 for certain FAR clauses and indicates the Government intends to award without discussions, though it reserves the right to conduct discussions if necessary.

Specified Federal procurement payment means any payment made pursuant to a contract with a foreign contracting party that is for goods, manufactured or produced, or services provided in a foreign country that is not a party to an international procurement agreement with the United States. Any exemption claimed and self-certified on the IRS Form W-14 is subject to audit by the IRS. Any disputes regarding the imposition and collection of the 26 U.S.C. 5000C tax are adjudicated by the IRS as the 26 U.S.C. 5000C tax is a tax matter, not a contract issue. The IRS Form W-14 is provided to the acquiring agency rather than to the

52.212-2 Evaluation-Commercial Products and Commercial Services.

(Deviation 2026-O0038) 2026-02

Evaluation-Commercial Products and Commercial Services (Feb 2026) (Deviation 2026-O0038)

(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

[Insert evaluation factors in the relative order of importance. For requests for proposals, state:

Evaluation factors other than price when combined are [significantly more important than price /approximately equal to price/significantly less important] than price. For invitations for bids, list only price and price-related factors.]

Factor 1: Technical The quote will be evaluated on an Acceptable / Unacceptable basis. Acceptable:

The quote meets all the specifications and requirements outlined in Attachment 1 - AXON X26P Tasers and X26P Taser Batteries Statement of Requirements. Unacceptable: The quote does not meet the specifications of Attachment 1. Quotations found unacceptable will not be considered further for contract award.

Factor 2: Price The Government will evaluate the total evaluated price submitted in the quote comprising ITEM 0001 and ITEM 0002.

Factor 3: Past Performance Past performance will be evaluated on demonstrated history of delivering similar equipment and and quality and timelessness of previous deliveries. There is no specific ranking or assigned mathematical importance among individual evaluation factors. However, when combined, Factor 1 (Technical) and Factor 3 (Past Performance) are approximately equal to Factor 2 (Price).

The Government intends to evaluate offers and award a contract without discussions with offerors.

Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

(b) . The Government will evaluate offers for award purposes by adding the Options (if applicable) total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).

(c) . A written notice of award or acceptance of an offer furnished to the successful Notice of award Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
