About this file
This document is a solicitation (W912JA26QA001) for commercial products and services that outlines the evaluation criteria, contract terms, and federal acquisition requirements. The solicitation will award a contract to the most advantageous responsible offeror based on three key evaluation factors: Technical (acceptable/unacceptable rating based on meeting Performance Work Statement specifications), Price (total evaluated price), and Past Performance. Technical and past performance, when combined, are approximately equal to price in importance.
The document includes numerous federal acquisition clauses covering areas such as small business representation, cybersecurity, supply chain security, labor standards, and various prohibitions on contracting with specific entities. Notable requirements include compliance with safeguarding covered defense information, reporting on telecommunications equipment, and representations regarding business operations with certain international regimes. The solicitation appears to be a competitive procurement that allows small businesses to compete, with specific provisions for various small business categories including veteran-owned, women-owned, and disadvantaged business concerns.

Evaluation-Commercial Products and Commercial Services (Nov 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Technical, Price, Past Performance
Factor 1: Technical – the quote will be considered technically acceptable if it meets the specifications of Attachment 1 - Performance Work Statement (PWS). Quotations that do not meet these requirements will be considered unacceptable and therefore under the evaluation process will not be considered for award. The following ratings will be used for Technical:
Acceptable - Quote meets the requirements of the solicitation
Unacceptable - Quote does not meet the requirements of the solicitation
Factor 2: Price – Only the total evaluated price submitted in the quote will be evaluated.
Factor 3: Past Performance – Past performance will be evaluated in accordance with FAR 13.106-2 (b)(3).
Technical and past performance, when combined, are approximately equal to price.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
