About this file

This document outlines the terms and conditions of a Blanket Purchase Agreement (BPA) solicitation for bunker demolition services at the Midewin National Tallgrass Prairie in Illinois. The Forest Service seeks to establish multiple award BPAs with technically capable contractors who can provide reasonably priced quotes for seed projects and future bunker demolition work. A pre-bid site visit will take place on August 24, 2023 and quotes are due based on the schedule in each individual call. Awards will be made to the lowest priced technically acceptable offerors on a call-by-call basis. The period of performance for the BPAs is five years and the maximum value of individual calls is $1.5 million. Invoicing will be done through the Invoice Processing Platform. Contractors must have an active SAM registration to receive calls and the government may remove contractors who perform inadequately or provide unrealistic pricing.

Multiple Award BPAs

ATTACHMENT 3

INTENT OF THIS BLANKET PURCHASE AGREEMENT (BPA) AND WHAT IS A BPA

(INCLUDING ORDERING INSTRUCTIONS)

SECTION I – INTENT BEHIND THIS SOLICITATION

The intent behind this solicitation is to establish Blanket Purchase Agreements (BPAs) for contractors who are technically capable, have relevant experience within the past five years performing bunker demolition, and provide reasonably priced quotes for the seed projects (if applicable). These BPAs will be for the Midewin National Tallgrass Prairie (MNTP) located in

Illinois.

This solicitation will establish a set of Contractors who are technically acceptable to the Forest

Service to perform work as established by the solicitation. When the Forest Services has a bunker demolition project, the Contracting Officer (CO) will send each BPA awardee, unless exempted as identified below, a Schedule of Items, Statement of Work, Maps and other documents (as necessary). The CO will provide a due date for each Call and identify what needs to be returned with the proposal/quote. A pre-bid site visit is scheduled for August 24, 2023 at 10:00 AM Central

Time. Late proposals may be deemed unresponsive and not accepted. The availability of the

Contractor may be a consideration if the Contractor cannot perform the work during the period of performance requested. Price reasonableness will be the determining factor. The award of each individual BPA Call will be based on the Technically Acceptable Lowest Price or “Best Value” to the Government. The first six (6) anticipated Calls have been added to the solicitation as “Seed

Projects” to allow for same-time quoting (for expedience).

Every Contractor that will be awarded a BPA from this solicitation will have the opportunity to send in pricing on each Call, with the exception of the following:

1. The Contractor identified areas in which they do not wish to be considered a source for (if applicable). These identified areas are geographical areas and/or types of work they are not interested in. This will be determined from Attachment 3 of this solicitation (not applicable to this BPA).

2. The Contractor has not provided relevant experience or technical capability relevant to the

Call’s project. This will be determined by the background information and relevant experience documents the Contractor provides with their proposal (see Attachments 5 & 6).

3. The Contractor has not performed adequately on previous Calls.

4. The Contractor or Government terminated the BPA by written notice. At least 30 days written notice must be provided before the BPA is terminated.

5. The Contractor’s System for Award Management (SAM) registration is no longer active.

Contractors must have an active SAM account to be awarded a project. SAM is a free website;

do not pay anyone to activate or reactivate your SAM account. Simply go to www.sam.gov.

SECTION II - INTRODUCING THE BPA

6. A Blanket Purchase Agreement, or BPA, is a simplified method of filling anticipated repetitive needs for supplies or services with qualified sources. BPA's are designed to reduce administrative costs in accomplishing small purchases by eliminating the need for issuing individual purchase documents.

7. A BPA is an agreement between the government and a contractor, which allows the government to purchase supplies or services quickly. BPAs are agreements, not contracts. Either side may opt out of the BPA at any time by giving at least a 30-day notice in writing. All the conditions of the sale are negotiated when the BPA Call is placed.

8. BPA's Calls are made when it is determined a service or supply is required. The Contracting

Officer will place the call to the contractor to request pricing for delivery of required items or services.

SECTION III – BPA TERMS AND CONDITIONS

1. Description of agreement. A Statement that the supplier shall furnish supplies or services, described in general terms, if and when requested by the contracting officer (or the authorized representative of the contracting officer) during a specified period and within a stipulated aggregate amount, if any.

2. Extent of obligation. The Government is obligated only to the extent of authorized purchases actually made under the BPA.

3. Purchase limitation. The dollar limit for each Call shall not exceed $1,500,000 unless agreed to by both parties.

4. Individuals authorized to purchase under the BPA. Only Forest Service Contracting

Officers, Contract Specialists and Purchasing Agents working projects for, or on behalf of, the

Midewin National Tallgrass Prairie (MNTP) in IL, may place Calls under this BPA.

5. Invoices. A summary invoice shall be submitted upon the completion of each Call. Invoicing shall be placed through the Invoice Processing Platform at www.ipp.gov. An IPP account will be established at the time of the Call (if the Awardee does not already have an IPP account). All payments under this BPA will be NET 30.

6. Securing maximum discounts. Price, experience, technical capability and availability are all considerations for establishing these BPAs.

7. The Government reserves the right to award additional BPAs from this solicitation for the duration of the BPA term. During the 5-year period of the contract, the Contracting Officer may determine a need to reduce or augment the original pool of awarded contracts for a variety of reasons.

http://www.ipp.gov/

8. Acceptance of the deliverables will be evaluated by the Contracting Officer (CO) or the appointed Contracting Officer Representative (COR) according to the Quality Assurance

Surveillance Plan (QASP).

9. Off-Boarding: Contractors with performance issues or unrealistic pricing will be terminated with a 30-day notice from the Government at any time during the contract period.

10. On-Boarding: The Government reserves the right to solicit from a limited number of additional contractors to be included in this multiple-award contract, at any time. The solicitation, terms and conditions, and source selection procedures will be the same as under this original solicitation.

11. Any new awardees will compete with the existing or remaining contractors for all subsequent

BPA Calls. The period of performance for the new awardees will not exceed the overall maximum term of the original BPA.

SECTION IV – ORDERING INSTRUCTIONS

BPA Calls - Request for Quote (RFQ) Procedures

1. A (BPA) Call is a contractual instrument issued by an authorized and warranted government

Contracting Officer to order work for the government.

2. As the need arises for performance under the terms of this BPA, any warranted Forest Service

Contracting Officer may solicit quotes and issue calls against this BPA.

3. The CO will issue a written Request for Quote (RFQ)/Proposal that may include:

a. Schedule of Items (SoI)

b. Statement of Work (Specific Per BPA Call)

c. Period of Performance

d. Map(s) and/or coordinates of work

e. Additional Specifications

f. RFQs will be transmitted primarily via e-mail.

g. RFQs may include evaluation criteria; All RFQs shall specify the method for award determination and indicate the required response documentation.

h. Upon receipt of an RFQ from the Gov’t, the Contractor shall respond as specified.

i. Multiple Award BPA holders will receive fair opportunity to be considered for each

RFQ unless one of the exceptions in FAR Subpart 16.505(b)(2) applies.

4. The Contractors will be provided a number of days to review the package and submit Pricing.

The Government is not obligated to accept prices and may resolicit the requirement outside of this BPA.

5. The applicable Contracting Officer Representative (COR) will be identified on each, individual
