About this file
This document is an Indian Economic Enterprise Representation Form issued by the Department of Health & Human Services (HHS), Indian Health Service, Division of Acquisition Policy. It serves as a self-certification template for offerors responding to federal contract opportunities issued under the Buy Indian Act authority.
The form requires offerors to self-certify whether they meet the definition of an "Indian Economic Enterprise" with Indian ownership as defined in HHSAR 326.601. Offerors must maintain eligibility throughout three critical periods: at the time of offer submission, at the time of contract award, and during the full contract performance period. Any loss of eligibility during these periods requires immediate written notification to the Contracting Officer. Successful offerors must also maintain registration with the System of Award Management (SAM). The form includes a representation section where offerors check a box indicating whether they do or do not meet the Indian Economic Enterprise definition, and requires signature by the 51% owner along with submission of the federally recognized tribal entity name, business name, and Unique Entity Identifier (UEI) number. Contracting Officers may require documentation of eligibility before awarding set-aside or sole source contracts, and awards may be subject to protest. False or misleading information submitted in conjunction with this certification violates federal law and is subject to penalties under 18 U.S.C. 1001, 31 U.S.C. 3729-3731, and 18 U.S.C. 287.
