About this file
This document is a Blanket Purchase Agreement (BPA) Terms and Conditions document for a safety footwear procurement by the Bureau of Engraving and Printing. The BPA will provide DCF personnel with comfortable, quality safety footwear that meets specific American Society for Testing Materials (ASTM) standards for foot protection, performance requirements, and slip resistance. The government anticipates awarding up to three multiple award BPAs with an estimated total purchase volume of $487,361.00 over a 5-year period, with five one-year ordering periods.
Key terms include that only a duly appointed Contracting Officer from the Bureau of Engraving and Printing's Office of the Chief Procurement Officer can issue purchases, and individual purchases cannot exceed the simplified acquisition threshold. The BPA does not obligate the government to purchase any specific quantity, and the government is only obligated to the extent of authorized calls made under the agreement. Delivery tickets must include specific information such as supplier name, BPA number, purchase date, itemized list of supplies, quantities, and delivery date. Invoices must be submitted at least monthly or upon BPA expiration.

BLANKET PURCHASE AGREEMENT
(Terms and Conditions)
This procurement is being conducted in accordance with regulations at FAR Part 12, Acquisition of Commercial Items, FAR Part 13, Simplified Acquisition Procedures, and FAR 13.303, Blanket Purchase Agreements. The Contractor agrees to the following terms and conditions of a Blanket Purchase Agreement (BPA) with the Bureau of Engraving and Printing:
The following terms and conditions are mandatory:
1. Description of agreement. The vendor will provide DCF personnel with comfortable, quality safety footwear. Safety footwear must meet, at a minimum, American Society for Testing Materials (ASTM) F2412-18 standards for foot protection, F2413-18 specifications for performance requirements, and F3445-21 for slip resistance. The vendor shall furnish supplies or services, as described herein, if and when requested by the contracting officer (or the authorized representative of the contracting officer) during the time period from date of award through twelve (12) months or until the vendor is provided with a written notification of completion from the contracting officer, or whichever comes first, within the simplified acquisition threshold. The BPA shall have five (5) one (1) year ordering periods for a total of five (5) years.
2. Extent of obligation. The Government is obligated only to the extent of authorized purchases actually made under the BPA.
3. Purchase limitation. The Government anticipates this solicitation will result in a multiple award BPA (up to three). The Government estimates, but does not guarantee, that the total volume of purchases through these agreements will be $487,361.00 in capacity over a 5-year ordering period unless earlier termination.
4. Individuals authorized to purchase under the BPA. Only a duly appointed Contracting Officer from the Bureau of Engraving and Printing, Office of the Chief Procurement Officer (OCPO) is authorized to issue purchases under this BPA. Individual purchases shall not exceed the simplified acquisition threshold.
5. Delivery tickets. All shipments under the agreement shall be accompanied by delivery tickets or sales slips that shall contain the following minimum information:
a. Name of supplier.
b. BPA number.
c. Date of purchase.
d. BPA Call number.
e. Itemized list of supplies or services furnished.
f. Quantity, unit price, and extension of each item, less applicable discounts (unit prices and extensions need not be shown when incompatible with the use of automated systems, provided that the invoice is itemized to show this information).
g. Date of delivery or shipment.
6. Invoices.
a. An itemized invoice shall be submitted at least monthly or upon expiration of this BPA, whichever occurs first, for all deliveries made during a billing period and for which payment has not been received. These invoices need not be supported by copies of delivery tickets.
The terms and conditions included in this BPA apply to all purchases made pursuant to it. In the event of an inconsistency between the provisions and terms and conditions of this BPA and the Contractor's invoice, the provisions and terms and conditions of this BPA shall take precedence.
The BPA shall be reviewed by the Contracting Activity at least annually before the anniversary of each ordering period and revised as necessary to conform to the requirements of the Federal Acquisition Regulation and applicable supplements or statutory requirements.
This BPA does not obligate any funds, and it does not authorize any work. The Government is under no obligation to the BPA holder to purchase any specified quantity or dollar value of services. The Government is obligated only to the extent of authorized calls made under the BPA. It is the responsibility of the individual ordering entities under the BPAs to ensure adequate funds are available.
Individual call orders under this BPA shall not exceed the simplified acquisition threshold.
The BPA may be modified only by mutual agreement of the parties. Any change shall be effective only through written modification to this Agreement and not by individual orders issued hereunder.
Modifications to this Agreement shall have no retroactive effect on orders previously issued.
