52.212-2 EVALUATION—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV
2021)
The Government will award an agreement resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate quotes:
Factor 1 -Technical Approach o Subfactor 1 – Safety Shoe Samples.
o Subfactor 2 – Capabilities
Factor 2 – Past Performance Factor 3 – Price
Basis of Award
The Government intends to award multiple BPAs (up to three) resulting from this solicitation to the responsible quoter(s) whose quote(s) is based on the Lowest Price Technically Acceptable (LPTA) procedures in accordance with FAR Part 12 and 13 as supplemented. Award will be made to the acceptable quoter(s) with the lowest evaluated price, which is deemed responsible in accordance with the Federal Acquisition Regulation (FAR), 13.106-2 Evaluation of Offers, and whose quote conforms to the solicitation requirements. The Government will not award a contract on the basis of an unacceptable quote.
Options. The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that a quote is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). The Government will calculate any six (6) month extension, exercised under FAR 52.217-8 Option to Extend Services, based on the average price of the last six (6) months of the final Contract Line Item Number (CLINs) with a period of performance ending in 2030.
A written notice of award or acceptance of a quote, emailed or otherwise furnished to the successful quoter within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party. Before the quote’s specified expiration time, the Government may accept a quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
Selection of a Quoter for contract award will be based on evaluation of quotes against the factors identified in this section. Principles and procedures of Subpart 15.3 do not apply. The Government reserves the right to make an award based on initial quotes received, without discussion of such quotes in accordance with FAR provision 52.215-1, or the Government may make award after clarifications of some aspects of the quote.
Accordingly, the Government reserves the right to do any or all of the following:
a. Award on initial quotes, without discussion.
b. Ask clarifying questions during the question-and-answer period if needed. Clarification questions may include asking quoters to clarify their written technical quotes. As a result, the Government may have communications with some, but not all, quoters; these communications, however, will be clarifications and not discussions. In these situations, the Government will consider the quoter’s clarifying response(s) without allowing quote revisions.
c. Have communications; ask clarifying questions, request corrections relative to minor errors in the written quote or request substantiating documentation to facilitate the Government’s final evaluation with one or some quoters. These communications, clarifications, or requests for corrections or substantiating documentation will not materially change the quoter’s quote in terms of conformance to RFQ requirements, constitute discussions such as the removal of an unacceptable assumption.
Quotations shall set forth full, accurate, and complete information as required by this solicitation package (including Attachments). The penalty for making false statements in quotations is prescribed in 18 U.S.C. 1001.
TECHNICAL EVALUATION CRITERIA
The Government will evaluate technical quotes based on the following factors:
Factor 1 – Technical Approach The Government will evaluate quotes for technical acceptability. Proposed safety shoes must meet or exceed the specifications stated in the performance work statement and all factors and sub factors as stated in the solicitation.

Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.
Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
No recent/relevant past performance record is available, a meaningful assessment rating cannot be assigned
PRICE QUOTE EVALUATION
Factor 3 – Price The quoter’s price quotation will be evaluated to assess for price reasonableness in accordance with FAR 13.106-3(a). Specifically,
1. The principal basis for evaluating cost/price for award under this solicitation will be an evaluation of the fair and reasonableness of the quoter’s quoted price in response to Section 2, Supplies or Services and Prices/Costs. Cost/price quotes will be evaluated for completeness, accuracy, and reasonableness and to ensure that the quoter’s understand the scope of the work included in the solicitation. Quotes containing inaccurate pricing information will be deemed ineligible for an award and will not be further evaluated.
2. Cost/price quotes will not be rated adjectivally or scored. The cost/price that will be evaluated is the quoter’s “total proposed cost/price.” As such, the Government will use any combination of the quote analysis techniques stipulated under FAR Subpart 15.404 or FAR 13.106-3 to aid in the price evaluation process.
3. The Government will calculate any six (6) month extension, exercised under FAR 52.217-8 Option to Extend Services, based on the average price of the last six (6) months of the final Contract Line Item Number (CLINs) with a period of performance ending in 2030.
The Government reserves the right to reject any quotation that includes overtime or extended hours billing practices.
