About this file

This document outlines procedures for on-ramping, benching, and off-ramping contractors from two blanket purchase agreements to provide construction management and project management support services to multiple federal agencies. Contractors may be added to the agreements through periodic open seasons to solicit new contractors. Existing contractors are eligible to compete for orders but may only hold one agreement. Underperforming contractors may be temporarily benched from competing for new orders until performance improves, and contractors may be permanently removed, or off-ramped, for reasons including debarment, termination for default, an established pattern of unsatisfactory performance, or failure to be awarded any orders over a two-year period.

ATTACHMENT 3 - BPA On and Off Ramp Procedures

On-Ramping, Off-Ramping, and Benching

The Contacting Officer has determined that it is in the government's best interest that at all times during the term of the BPAs, there remain an adequate number of contractors eligible to compete for orders. Adding to the number of contractors eligible to compete for orders is defined here as on-ramping. Over time, the total number of contractors may fluctuate due to various reasons, including industry consolidation, significant changes in the marketplace or advances in technology, general economic conditions, and the government's exercise of the off-ramp process. Recognizing this, the government intends to periodically review the total number of contractors participating in the Ordering Process and determine whether it would be in the government's best interest to initiate an open season to add new contractors to the BPA pool.

On-Ramp Procedures If it is determined that it would be in the government's best interest to open a new solicitation to add new contractors to the BPA pool, the Contacting Officer may do so at any time provided that:

(a) The solicitation is issued under then-applicable federal procurement law;

(b) The solicitation identifies the total approximate number of new awards that the Contacting Officer intends to make. The Contacting Officer may decide to award more or fewer BPAs than the number anticipated in the solicitation depending upon the overall quality of the offers received;

(c) Any contractor that meets the eligibility requirements set forth in the new solicitation may submit a quote in response to the solicitation; however, existing BPA contractors may not hold more than one BPA at any time;

(d) The award decision under any solicitation is based upon substantially the same evaluation factors as the original solicitation (except for changes made to improve the quality of offers received and the evaluation process as a result of lessons learned from the previous solicitation process);

(e) The terms and conditions of any resulting BPAs from a new solicitation are materially identical to the existing BPA.

Benching At the discretion of any authorized callers, a vendor who fails to fill two orders (not necessarily consecutively) or does not have enough dogs pass the required testing to meet the order requirement two times may be temporarily benched for future orders. These two events need not be consecutive. This is intended to enable the government to solicit orders from other vendors to fill its requirements while giving the vendor a chance to remedy the situation. Any authorized callers may un-bench a vendor and they will be able to compete on future orders. If performance decreases again, the vendor risks being off-ramped at the discretion of the government.

Off-Ramp Procedures The government reserves a unilateral right to discontinue offering an opportunity to compete for orders, i.e., off-ramp to non-performing or non-satisfactorily performing contractors. Contractors that are off-ramped will have no active orders under their BPA at the time of the off-ramping.

Off-ramping may result from one of the following:

(a) Contractor Debarment, Suspension, or Ineligibility as defined in FAR Subpart 9.4.

(b) BPA is terminated for a reason defined in FAR 52.212-4(l) and (m)

(c) Contractor establishes a pattern, i.e., two or more instances of less than satisfactory performance as that term is defined in FAR 42.1503

(d) No awarded orders for two (2) years

(e) A vendor consistently does not fill orders after evaluation of dogs. After being “Benched” the vendor remains inconsistent in their ability to fill orders. Determination to be made by authorized ordering official.
