About this file
This document is an Addendum to FAR 52.212-1, providing instructions to offerors for submitting offers on commercial products and commercial services.
Offerors must submit signed and dated offers on the SF1449 form to the designated office by the exact time specified in Block 8 of the solicitation. At minimum, offers must include the solicitation number; receipt deadline; offeror's name, address, and phone number for both company and representative; a technical description of items with sufficient detail to evaluate compliance; express warranty terms; itemized price breakdown; total price with discount terms; remit-to address if different from mailing address; current SAM.gov registration validation; completed FAR 52.212-3 representations and certifications; mandatory Cage Code; optional DUNS number; and acknowledgment of any solicitation amendments. Offers lacking required representations, information, or rejecting solicitation terms and conditions may be excluded from consideration. By submitting an offer, offerors consent to all solicitation requirements, terms, conditions, representations, and certifications identified as evaluation factors.
For offers of "equal" products, offerors must meet the salient physical, functional, or performance characteristics specified in the specification's attachment; clearly identify the item by brand name and make or model number; include descriptive literature or reference previously furnished data; clearly describe any modifications to ensure conformance; and explicitly indicate the product is an "equal" product or provide the brand name product referenced in the solicitation. Offerors must hold prices firm for a minimum of 60 calendar days from the offer receipt date unless a different period is specified in an addendum, and offers must clearly display the expiration date.
