MAINTENANCE AND REPAIR

OF

FIRE SUPPRESSION SYSTEMS

IN THE

1. 0. DESCRIPTION OF SERVICES.

This is a non-personal services contract, the Government shall not exercise any supervision or control over the contract service providers performing the services herein. The contractor shall provide all non-personal services, management, tools, supplies, materials, equipment, transportation and labor necessary to perform operational tests, maintenance and repairs of fire suppression systems at Ramstein Air Base, Construction and Training Squadron (CTS), Vogelweh, Einsiedlerhof, Bann and Kapaun Air Station in a manner that shall ensure safe and continuous operation. All maintenance and repair work shall be performed In Accordance With (IAW) National Fire Protection Association (NFPA) 17A, Standard for WET Chemical Extinguishing Systems Chapter7, Standard German commercial practices and local state, or federal applicable standards and codes, Verband Deutscher Sachversicherer (VDS) / German Insurers` Association guidelines, manufacturer recommendations and all required safety regulations from the German Social Accident Insurance / Deutsche Gesetzliche Unfallversicherungen (DGUV). The services required under this PWS are not mission essential.

1.1. QUALIFICATIONS.

Copy of current training certificates for Ansul Kitchen Fire Suppression Systems R102 certification required. The technician intended to work on Ansul Kitchen Fire Suppression Systems R102 under this contract shall carry an Ansul identification card as proof they have completed the required training.

Contractor technicians shall have knowledge of the current German safety and accident prevention regulations and the usage of guidelines and generally recognized rules of engineering IAW commercial practices, to be able to assess the proper condition of the equipment. The contractor shall be familiar with the different equipment used in this contract.

1.2. MAINTENANCE SERVICES.

1.3.1 The contractor shall perform operational tests and maintenance on all installed fire suppression systems listed in Appendix B, IAW manufacturer recommendations specifications/instructions or the regulations and standards listed in this PWS whichever is more stringent.

1.3.2 Maintenance shall be performed as Semi-annual maintenance in the months of October/November and April/May for equipment listed in Appendix B.

The amount of equipment listed in Appendix B, can vary by 20% up or down on an annual basis due to replacement or installation of new assets and does not result in a modification as long as it is within the 20% variance and within the scope of the contract.

1.3.3. Maintenance includes, but is not limited to all related system detection devices, system control panels and wiring up to the facility main fire alarm system.

1.3.4. The contractor shall submit a written maintenance report to the Contracting Officer Representative (COR) within eight (8) business days after completion of work. The contractor shall also include in the maintenance report, the year in which hydrostatic testing is required for all storage containers/cylinders. If the hydrostatic test date cannot be obtained from existing cylinders markings/labels, then the contractor shall annotate this in the report. The report shall include, but is not limited to:

(a) Date and time of the service

(b) Location, equipment/serial number and type

(c) Full operational test

(d) Overall condition including discrepancies cited and repairs needed

(e) Service performed and parts required

(f) Cost estimate for parts required to repair the apparent findings in accordance with Paragraph 1.4.1.,1.6., of this PWS.

(g) Amount of time spent on inspection

(h) Name of the technician performing the service

1.4. REPAIR SERVICE.

All repair work shall be IAW standard commercial practices using parts specified by the equipment manufacturers, upon no availability items use of equal or higher quality is permissible upon COR’s concurrence. Downtime of equipment shall be kept to an absolute minimum. The contractor shall notify the COR in writing (e-mail is acceptable) about the status of the repair service by the next business day.

When required parts are not available, the contractor shall notify the COR in writing (e-mail is acceptable) the next business day it is discovered. The contractor shall provide written documentation (for example, a letter/email from the parts manufacturer) to the COR explaining any delays in delivery of the parts, as described in paragraph 1.6. The contractor shall complete the repair within one (1) business day or as scheduled with the COR after receiving the required parts from the manufacturer. Travel time will not be reimbursed separately. All invoices for the repair work shall be annotated with call number, date and time of repair service call, labor hours, parts, building number, kind of system, malfunction, and description of work.

1.4.1 ROUTINE REPAIR SERVICE CALLS

(Monday – Friday and US Federal Holidays: 0700 – 1600).

The COR will notify the contractor of required repairs. The contractor shall report to the COR the equipment identified to be repaired within three (3) hours after verbal/written notification by the COR. The contractor shall survey the repair and provide for material costs only IAW with Paragraph 1.6 of this PWS. The repair quote shall include the following: a written documentation, requested price information/delivery time along with date of expiration of the offer. The contractor shall not make any repairs until written approval is received from the COR which can be issued by e-mail, letter, or by COR signing the repair estimate with date. The contractor shall notify the COR of date and time when repair work will be conducted. Upon parts availability contractor shall commence repair work within one (1) business day.

1.4.2 EMERGENCY REPAIR SERVICE CALLS (Monday – Friday and US Federal Holidays:

1600-0700; Saturday, Sunday, and German Federal Holidays: 24 Hours).

The contractor shall report to the COR the equipment identified to be repaired within two (2) hours after notification by the COR.

The contractor shall survey the failure and provide an on-spot repair if possible. In case of non-availability of replacement parts another call will be placed the next business day to initiate the repair. All other procedures remain as described in para 1.4.1.

1.5. REQUIRED DOCUMENTATION.

1.5.1. SCHEDULES.

The contractor shall coordinate/schedule with the respective Facility Manager (FM) for the date and time service will be rendered and furnish and submit a written maintenance schedule to the COR no later than 14 business days prior to the start date of the operational tests and maintenance service. The schedule shall include the estimated date, time, building number and location. Any schedule changes shall be coordinated in writing between the contractor, FM and the COR at least eight (8) business days prior to the original scheduled dates.

1.5.1.1 DEVIATIONS TO SCHEDULE. In the event the contract schedule must be modified for a specific facility, the Contractor and Facility Manager (FM)/Alternate must agree on the change and notify the COR in writing. The Contractor shall submit any deviations in scheduling to the COR before the date originally scheduled.

1.5.2 ROUTINE AND EMERGENCY REPAIR REPORTS.

The contractor shall provide repair reports to the COR within eight (8) business days after completion of work. The reports shall include:

(a) Date, time and call number of the service

(b) Location, equipment/serial number and type

(c) Full functionality test

(d) Service performed (malfunction and description of work) and parts used

(e) Amount of time worked

(f) Name of the technician performing the service

1.5.3 REPAIR STATUS

Contractor shall submit bi-weekly report on open calls in writing. A monthly status of open calls will be provided by the government to the contractor.

1.5.4. DELIVERABLES.

1.6. PARTS.

The contractor will be reimbursed for the cost of all parts needed for maintenance and repairs. The contractor shall attach a copy of the manufacturer/wholesaler’s original invoice, to include shipping charges, if applicable, to the invoice reflecting the amount paid, or to be paid, for all parts.

Reimbursement is limited to the actual cost/net price incurred (no handling charge). The net price is the price as paid by the contractor, nooverhead, general & administrative (G&A), mark-up or profit added.

Small parts per equipment in the amount up to 50.00 Euro will be reimbursed without the manufacturer/wholesaler’s original invoice.

1.7. WASTE DISPOSAL.

All trash and hazardous waste, generated as a result of maintenance, emergency or routine repairs, shall be disposed of off base, IAW the German Waste Disposal Law at no additional cost to the Government.

1.8 APPLICABLE GUIDANCE. The Contractor shall comply with all applicable regulations and requirements. Systems shall be checked IAW:

• Deutsche Unfallverhütungs Vorschriften (DGUV) / German Safety Regulations

• Betriebssicherheitsverordnung (BetrSichVO) / Ordinance on industrial safety and health

• NFPA 17A, Standard for Wet Chemical Extinguisher Systems, Chapter 7

• Ansul R-102 Maintenance Manual

2.0. GENERAL INFORMATION.

2.1. QUALITY CONTROL.

The contractor shall have and maintain a written quality control plan to ensure operation tests, maintenance and repair services are performed IAW this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure the non-recurrence of defective services. As a minimum, the contractor shall have quality control procedures that address the areas identified in Paragraph 3, Services Summary. A detailed quality control plan (QCP) shall be submitted as part of the proposal, three copies of a comprehensive written QCP shall be submitted to the KO and COR within 5 working days when changes are made thereafter. After acceptance of the quality control plan the contractor shall receive the contracting officer’s acceptance in writing of any proposed change to his QC system.

2.1.1 QUALITY ASSURANCE.

The government will inspect and evaluate the contractor’s performance to ensure services are IAW requirements set forth in this contract in accordance with the Quality Assurance Surveillance Plan. The COR will use the contractor’s work schedule or modified version thereof, to record validation results. Results of the validation then become the official Air Force record of the Contractor’s performance. When a performance threshold has not been met or contractor performance has not been accomplished, the COR will initiate and provide the CO with a Corrective Action Report (CAR) for issuance to the contractor. The contractor shall respond to the CAR IAW instructions provided and return it to the CO within 10 calendar days of receipt. The CO will forward the contractor’s response to the COR once received. The COR will perform re-inspection within 1 workday of receipt of contractor’s response.

2.2. UNACCEPTABLE PERFORMANCE.

The contractor shall report to the site location within two (2) hours after notification to correct unacceptable performance. The contractor shall re-perform at no cost to the government. Any re-performance and/or unacceptable performance will be documented by the COR and may result in the Government seeking equitable price reduction or adequate consideration IAW FAR clause 52.212-4, Contract Terms and Conditions – Commercial Items.

2.3. CONTRACT MANAGER.

The Contractor shall provide the name of a contract manager (primary and alternate) who shall be responsible for the performance of work and shall have full authority to act for the Contractor on all contract matters relating to daily operations of this contract. The contract manager shall be available during normal duty hours (0700-1600). The Contractor shall be able to meet with the COR to resolve any contract issues.

The contract manager and alternate shall be able to understand, read, speak, and write basic and technical English (to speak English with sufficient structural accuracy and vocabulary to participate in formal and informal conversations on practical, social, and professional topics). The Contractor shall provide to the CO and COR, five (5) business days after award, the names, addresses, and phone numbers of the contract manager’s supervisor, contract manager, and an alternate with authority to act for the Contractor if the contract manager cannot be contacted prior to starting performance. Any required changes to this listing shall be submitted in writing to the CO and COR, ten (10) business days prior to the change taking effect.

2.4. HOURS OF OPERATIONS

The Contractor shall coordinate all work to be accomplished IAW the PWS with the COR and Facility Manager (FM/Alternate) for each facility to be maintained and repaired. Emergency repairs may be required during non-business or off-hours (early AM or late PM), Monday through Sunday including holidays.

Business hours are 0700-1600, Monday-Friday. The time for maintenance and repairs to be performed shall be coordinated before any work is scheduled. Maintenance services for selected facilities in Appendix B, marked with an asterisk (*), shall be scheduled between the hours of 0500 - 0600, Monday- Friday.

2.5. PERFORMANCE OF SERVICES DURING MILITARY EXERCISES OR OPERATIONS.

Work stoppages may occur during the execution of this contract due to military exercises or operations.

During these times, access to areas supporting the exercise or operation may be curtailed or denied.

During scheduled and unscheduled exercises or operations, the contractor must be prepared to postpone performance in coordination with the COR until immediately after completion of the military exercise or operation. No additional cost to the Government for the waiting time until exercise or operation is over.

2.6. SECURITY REQUIREMENTS.

The contractor personnel shall comply with all requirements and procedures IAW AFFARS 5352.242-9000, Contractor Access to Air Force Installations.

2.6.1 CONTRACTOR/EMPLOYEE BASE PASS AND IDENTIFICATION, SPECIAL

CLEARANCES AND VEHICLE PASSES.

The Contractor personnel shall obtain Base Entry Identification, Installation Common Access Card ICAC not later than twenty four (24) Calendar days prior to the Period of Performance (PoP). In order to obtain the ICAC the Contractor is required to submit to the COR following

• USAFE IMT 79 (Request for Base Entry Identification)

• Memo of Base ID request

• Copy of Passport

• Security Questionnaire for simple security check

• Police Good Conduct Certificate (Polizeiliches Fuehrungszeugnis), USAFE IMT 79, Memo of Base ID request, and the Security Question forms will be provided by COR the 786 CES/CEOES COR.

Contractor personnel will take required documentation to Bldg #134 at Ramstein Air Base, to obtain Base Entry Identification. Contractor Personnel can only gain access to the KMC after the security check has been passed with positive result. It is the responsibility of the Contractor to collect and turn-in the ICAC within one (1) week for personnel no longer employed and in case contract is terminated and/or after end of PoP.

2.6.2 ACCESS TO RESTRICTED AREAS. Access to secure areas must be coordinated with the COR.

Restricted areas require notification through the COR to the FM/Alternate at least one (1) week prior to the start date to allow time for coordination. The following buildings are in secure or restricted areas:

• Ramstein Air Base – Buildings 543 and 2201

2.6.3 ESCORT. The contractor will be escorted for entry to area requiring escorted entry, as needed.

Arrangements for escorts will be made by the COR.

2.7 SPECIAL QUALIFICATIONS. Contractor employees performing services shall be able to speak sufficient English to communicate on a basic level with on-site personnel.

2.8 CONFORMANCE WITH ENVIRONMENTAL MANAGEMENT SYSTEMS.

The contractor shall perform work under this contract consistent with the relevant environmental policy and objectives identified in the installation environmental management system (EMS) applicable for your contract. The contractor shall perform work in a manner that conserves water, energy, and other resources to the maximum extent feasible and ensure minimum production of waste as possible, giving preference to recycling and reutilization opportunities. Furthermore, the contractor shall give preference to less toxic materials whenever available and still reliable for their work. In the event an environmental nonconformance or noncompliance of host nation and USAF environmental laws and regulations associated with the contracted services is identified, the contractor shall take corrective and/or preventative actions. In the case of a noncompliance, the contractor shall respond and take corrective action immediately. In the case of a nonconformance, the contractor shall respond and take corrective action based on the time schedule established by the EMS Coordinator. In addition, the contractor shall ensure that their employees are aware of the environmental management system on base and how these requirements affect their work performed under this contract. All on-site contractor personnel shall receive the installation EMS awareness level information.

2.8.1 CONFORMANCE WITH ENVIRONMENTAL REQUIREMENTS.

The contractor shall perform all work in accordance with applicable German and US Air Force environmental laws, regulations and operating standards, including but not limited to, the Final Governing Standards (FGS) for Germany. The contractor shall be immediately capable of understanding and addressing environmental laws and regulations as they pertain to work performed under this contract. The FGS for Germany and other important environmental laws and requirements applicable for all contractors working on base will be made available upon request.

2.8.2 DOD MISSION ESSENTIAL SERVICES DURING CRISIS. IAW DODI 1100.22, Policy and Procedure for Determining Work Force Mix, paragraph 5b, it is determined that none of the services as stated in this PWS are mission essential.

2.9 CONTRACTOR MANPOWER REPORTING. The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the PM, safety inspections and repairs of pop-up barriers, tire shredders, bollards, arm barriers and sliding gates doors via a secure data collection site. The contractor is required to completely fill in all required data fields at https://www.ecmra.mil. Reporting inputs will be for the labor executed during the period of performance for each Government fiscal year (FY), which runs 1 October through 30 September. While inputs may be reported any time during the FY, all data shall be reported no later than 31 October of each calendar year. Contractors may direct questions to the CMRA help desk.

2.9.1 USES AND SAFEGUARDING OF INFORMATION: Information from the secure website is considered to be proprietary in nature when the contract number and contractor identity are associated with the direct labor hours and direct labor dollars. At no time will any data be released to the public with the contractor name and contract number associated with the data.

2.9.2 USER MANUALS: Data for Air Force service requirements must be input at the Air Force CMRA link. However, user manuals for government personnel and contractors are available at the Army CMRA link at https://www.ecmra.mil.

3.0. SERVICES SUMMARY (SS). The SS provides information on contract requirements and the expected level of the contractor’s performance. The contract service requirements are summarized in performance objectives. The performance threshold briefly describes the acceptable levels of service required for each requirement. These thresholds are critical to mission success. During the first 30 calendar days of the contract, two (2) errors on each performance objective will be allowed in an effort to overcome normal phase-in problems.

4.0. NO GOVERNMENT FURNISHED PROPERTY AND SERVICES WILL BE PROVIDED.

4.1. DAMAGE TO GOVERNMENT PROPERTY. The Contractor shall report all damages to U.S.

Government property within one (1) hour after occurrence to the COR. The Contractor shall be responsible for reimbursing the U.S. Government no later than 30 business days of receipt of claim for all costs associated with damages to U.S. Government property in the performance of services in this contract.

(a) Each repair service call is estimated to be 8 hours. The Contractor shall invoice and will be paid by service call, regardless of the actual duration of the repair work per call. If the actual hours worked exceed the total estimated hours for Repair Service Calls in Appendix A, Estimated Workload Data Per Year, by more than 10% at the end of each performance period, upon the request of the Contractor, an adjustment may be made for the hours worked in excess of the 10%, in accordance with clause DFARS 252.243-7002, Request for Equitable Adjustment. (b) Each emergency repair service call is estimated to be 5 hours. The Contractor shall invoice and will be paid by service call, regardless of the actual duration of the repair work per call. If the actual hours worked exceed the total estimated hours for Emergency Repair Service Calls in Appendix A, Estimated Workload Data Per Year, by more than 10% at the end of each performance period, upon the request of the Contractor, an adjustment may be made for the hours worked in excess of the 10%, in accordance with clause DFARS 252.243-7002, Request for Equitable Adjustment. The basis for the adjustment are the total estimated hours for Repair Service Calls in Appendix A, Estimated Workload Data per Year.

(c) For each repair service call or emergency repair service call purchased in excess of or less than the annual estimated quantity identified in item 4 or 5 of the Estimated Workload Data Par Year, the annual estimated quantity in item 4 or 5 of the Estimated Workload Data Per Year may be increased or decreased accordingly.
