About this file

This is a Justification and Approval for Other Than Full and Open Competition document issued by the Defense Logistics Agency (DLA) Headquarters. The contracting activity is DLA Contracting Service Office-Philadelphia, and the agency requiring the products is DLA Information Operations (J62XDA) located in Battle Creek, Michigan. The justification authorizes procurement of two (2) licenses for Rockwell Emulate3D Ultimate Edition with 8x5 maintenance and support as a Firm Fixed Price delivery order. The software will be acquired as perpetual licenses with maintenance and support included for the first 12 months, followed by yearly maintenance and support renewals for a total 3-year period covering a base year (7/1/2026-6/30/2027) and two option years (7/1/2027-6/30/2028 and 7/1/2028-6/30/2029).

The requirement qualifies for single-source procurement under Title 10, U.S.C. 2304(c)(1) and FAR 6.302-1 because Rockwell Automation owns the exclusive intellectual property rights to the Emulate3D software. The software is essential for supporting the deployment of SAP Material Flow Services at Red River and Tinker facilities, providing digital twin simulation of warehouses that replicate Programmable Logic Controller (PLC) functionality and SAP connections. Kendall Electric is identified as the only authorized regional reseller for this product, although market research included quotes from two additional resellers (SIRC and Strictly Teck). The procurement rationale emphasizes technical compatibility with the Allen Bradley-Rockwell automation hardware and control systems already in use, ensuring seamless integration and accurate system representation. Fair and reasonable pricing will be determined using price comparison techniques including comparison with published price lists and market research quotes from regional partners.

DEFENSE LOGISTICS AGENCY

HEADQUARTERS

8725 JOHN J. KINGMAN ROAD

FORT BELVOIR, VIRGINIA 22060-6221

JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

1. IDENTIFICATION OF AGENCY AND CONTRACTING ACTIVITY:

Agency Requiring Activity:

Defense Logistics Agency (DLA) Information Operations (J62XDA) 74 Washington Ave N Battle Creek Mi 49037

Contracting Activity:

DLA Contracting Service Office-Philadelphia 700 Robbins Avenue Philadelphia, PA 19111-5092

2. NATURE AND DESCRIPTION OF THE ACTION BEING APPROVED:

This justification authorizes the use of other than full and open competition to award a Firm Fixed Price delivery order to purchase two (2) brand-name specific “Rockwell Emulate3D Ultimate Edition with 8x5 support”.

3. A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET

THE AGENCY’S NEEDS/ESTIMATED DOLLAR AMOUNT:

The Agency has a requirement for the following Rockwell products: 2 licenses for Rockwell Emulate3D Ultimate Edition with 8x5 maintenance/support for a 3-year period. The software is sold as a perpetual license with maintenance/support included for the first 12 months. Additional out years will require the purchase of yearly maintenance/support. See below for a breakdown.

4. IDENTIFICATION OF STATUTORY AUTHORITY:

The statutory authority permitting other than full and open competition is Title 10, U.S.C. 2304 (c) (1) as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, only one responsible source as referenced by the name brand citation, “Rockwell Automation.”

5. DEMONSTRATION THAT NATURE OF ACQUISITION REQUIRES USE

OF CITED AUTHORITY:

This software and support are essential to the Government’s requirements, and market research indicates other companies’ similar products do not and cannot be modified to meet the agency’s needs. A brand name item, whether available on one or more contracts, is an item particular to one manufacturer, which may be procured by brand name specification if essential to the Government’s requirements.

The Rockwell Emulate 3D Software is needed to support the deployment of the SAP Material Flow Services (MFS) at Red River and Tinker. This software provides a digital twin of the warehouses, replicating PLC functionality and connections to SAP.

This will allow us to develop and test our solution with the software before we move to physical testing of the solution with the equipment. The delivery team will be the primary users of this software. Once the solution is delivered, the digital twins will provide the sustainment team with a platform to test patches or code that may impact the MFS solution.

6. DESCRIPTION OF EFFORTS TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS PRACTICABLE:

This requirement is limited to one source because Rockwell Automation owns the intellectual property rights to Emulate 3D software that DLA requires. Because Rockwell Automation is the sole provider for software, and Kendall Electric is the only authorized regional reseller, limited market research was conducted. There are

Option Year 1: 7/1/2027 - 6/30/2028

Option Year 2: 7/1/2028 - 6/30/2029 other resellers of this product, but for the region we are in, Kendall Electric is the only reseller.

7. DETERMINATION BY CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND

REASONABLE:

The Government will attempt to obtain offers from as many vendors as practicable.

Proposals will be analyzed in accordance with FAR 15.404-1. It is anticipated that the Government will use various price analysis techniques including, but not necessarily limited to: 1) comparison of proposed prices received in response to the solicitation (reference FAR 15.404-1(b)(2)(i); 2) comparison with competitive published price lists (reference FAR 15.404-1(a)(2)(iv); and 3) comparison of proposed prices with prices obtained through market research for the same or similar items (reference FAR 15.404-1(b)(2)(vi)) in order to obtain a fair and reasonable price.

8. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND THE

RESULTS:

Rockwell does not sell the software directly and goes through regional partners to resell their software. The market research involved reaching out to those different regional partners for quotes on 2 licenses for Rockwell Emulate3D Ultimate Edition with 8x5 maintenance/support for a 3-year period. As the pricing is not publicly available, the following regional partners provided accurate quotes for the above products: Kendall Electric, SIRC and Strictly Teck.

The decision to utilize Rockwell Emulate software is directly aligned with the project’s use of Allen Bradley- Rockwell automation hardware and control systems.

Rockwell Emulate provides a native simulation environment specifically designed to replicate the behavior of Rockwell Programmable Logic Controllers (PLC) and control architectures. Because the system hardware is built on Allen Bradley platforms, using Rockwell’s own emulation software ensures full compatibility with the control logic, firmware structures and communication protocols already in use.

This alignment offers several key advantages, seamless integration, accurate system representation, risk reduction and standardization

9. A LISTING OF VENDOR SOURCES, IF ANY WHICH EXPRESSED, IN

WRITING, AN INTEREST IN THE ACQUISITION:

Authorized Regional Seller: Kendall Electric Other resellers: SIRC and Strictly Teck

10. A STATEMENT OF ACTIONS, IF ANY, THE AGENCY MAY TAKE TO

REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE

ANY SUBSEQUENT ACQUISITION FOR SUPPLIES OR SERVICES:

DLA has and continues to exercise competition as often as possible and is required to conduct ongoing reviews to keep abreast of new technology, both in industry and in the Government. As a continuing effort DLA always uses a variety of vendors, manufacturers, and contracts to fulfill its requirements and will continue its practice of surveying the market to ensure full and open competition.
