Brand Name Justification (LSJ) For orders or BPAs exceeding the Simplified Acquisition Threshold

This brand name justification is provided in accordance with FAR 13.5 Simplified Procedures for

Certain Commercial Products and Commercial Services and specifically under FAR 13.501 Special

Documentation Requirements, where acquisitions conducted under Simplified Acquisition

Procedures are exempt from the requirements of FAR Part 6 but still require a justification using the format of FAR 6.303-2. As provided under FAR 13.501, this justification is modified to reflect that the procedures under FAR subpart 13.5 were used in accordance with 41 U.S.C. 1901 – Simplified

Acquisition Procedures.

1. Agency and Contracting Activity. Identification of the agency and the contracting activity, and specific identification of the document as a "Limited-Sources Justification."

Department of Homeland Security (DHS), Federal Emergency Management Agency

(FEMA), Office of Chief Procurement Officer (OCPO), proposes to award an order or

BPA pursuant to Brand Name Kalmar manufactured Ottawa T2s.

2. Nature and/or description of the action being approved. Describe the action being approved, and include the name and address of the proposed contractor(s).

The DHS/FEMA intends to limit the number of sources solicited pursuant to FAR13.501 for the procurement of six (6) Yard Spotter Tractors one (1) for DC

Atlanta, one (1) for DC Greencastle, two (2) for DC Fort Worth, one (1) for DC Guam and one (1) for Bayamon Annex. FEMA intends to solicit the Yard Spotter Tractors on

SAM.gov to small business resellers to ensure a fair and reasonable price. Kalmar Ottawa

T2 was chosen as they are consistent with the current yard spotter tractors in the fleet.

Only Kalmar Ottawa T2 parts can be swapped interchangeable between the current stock. The majority of Distribution Centers including those requesting this requirement currently have the Kalmar Ottawa T2 Yard Spotter Tractors, all employees are trained and familiar with this brand. Using any other supplier will result in excessive maintenance and repair parts costs in addition to a potential increase in injuries and loss of productivity as staff becomes familiar using new equipment. Request limiting sources to vendors who can provide the Kalamar Ottawa T2 brand to ensure consistency amongst parts and personnel training. No other manufacturer can modify their equipment or parts to be interchangeable with the current equipment being used by FEMA.

3. Description of Supplies/Services. Describe the supplies or services to be acquired. Provide the estimated total value (including options, if any).

Atlanta, one (1) for DC Greencastle, two (2) for DC Fort Worth, one (1) for DC Guam and one (1) for Bayamon Annex at a total estimated cost of

The Distribution Centers currently uses Kalmar Ottawa T2 Yard Spotters to conduct mission operational work. Purchasing the same yard spotter not only maintains consistency throughout the DCs, but also saves the government time and money. Because the mechanics are already trained on how to use the yard spotter, there is no time needed after the yard spotter is delivered for the mechanics to review the manuals and understand how to use the equipment. Also, all DCs have the parts in stock to provide maintenance on the equipment saving the government money from needing to purchase additional equipment for other brand name yard spotters. It should be noted that the parts for the

Kalmar Ottawa yard spotter are not compatible with other brand name yard spotters and vice versa. Therefore, additional parts would need to be purchased if another brand name were to be purchased. In the event that a Kalmar Ottawa T2 yard spotter should need maintenance, mechanics are already trained to replace parts and have the parts needed on hand from previous purchases. In turn, this saves the government time from providing training to mechanics. To conclude, should the yard spotter need maintenance beyond the mechanics expertise, there are local dealers that are able to provide on island maintenance and parts as needed with no down time waiting on parts to DC Guam and Bayamon

Annex located on the island of Puerto Rico. FEMA research concluded that the Kalmar

Ottawa T2's are consistent with purchases made, mechanics trained on, and parts purchased by DC Atlanta, DC Greencastle, DC Fort Worth and Annex Bayamon and are the preferred machines going forward to save the government time and money.

5. Determination by the ordering activity contracting officer that the anticipated purchase order represents the best value consistent with FAR 15.101.

The contracting officer will determine that issuing the proposed Purchase Order for yard spotter tractors represents the best value and will result in the lowest overall cost, considering price and administrative costs, to meet the Government's needs. FEMA will solicit competition from authorized small business resellers to ensure a fair price.

FEMA intends to post this Limited Source Justification with the request for quote on

SAM.gov pursuant to FAR 6.302-1(c)(ii)(C).

6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.

Department of Homeland Security (DHS), Federal Emergency Management Agency

Yard Spotter Tractors with other FSS holders. The results of the market research indicates other companies' similar products lack the particular feature(s) required and do not meet, or cannot be modified to meet, the needs of DHS.
