About this file

This document is an evaluation provision for commercial products and commercial services procurements dated November 2021.

The Government will award the contract to the responsible offeror whose offer is most advantageous based on two evaluation factors: Technical Capability and Price. Technical acceptability is determined by reviewing the Technical Capabilities Statement Attachment, Rigging Sketches, initialed Vendor Certification, Technical Data Sheet/Brochure, and any other items requested in the Statement of Work. Vendors receive one of two ratings: "Acceptable" if the quote meets all identified requirements, or "Unacceptable" if it does not. Price will be evaluated for reasonableness in accordance with FAR 12.203, and price quotes must remain firm and valid for sixty days.

The Government will conduct a Lowest Price Technically Acceptable (LPTA) source selection by ordering all quotes from lowest to highest total price, then reviewing submissions for acceptability beginning with the lowest priced quote. If the lowest priced quote is deemed acceptable, award will be made with no further review of other quotes. If unacceptable, the next lowest priced quote will be evaluated, continuing this process until either an acceptable quote is found or all quotes are determined unacceptable. For solicitations with options, the Government will add option prices to the base requirement total for evaluation purposes and may reject offers with significantly unbalanced option pricing. Submission of all required documents constitutes the vendor's unconditional agreement to the solicitation terms and conditions. A written notice of award mailed to the successful offeror within the specified acceptance period creates a binding contract without further action.

Evaluation-Commercial Products and Commercial Services (Nov 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

1. Technical Capability

2. Price

Technical acceptability will be determined by reviewing, as applicable, the Technical Capabilities

Statement Attachment, Rigging Sketches, initialed Vendor Certification, Technical Data Sheet/Brochure, and any other items requested in the Statement of Work.

Price will be evaluated in accordance with FAR 12.203.

Technical Evaluation Ratings:

Rating Description

Acceptable Quote/Proposal meets all identified requirements

Unacceptable Quote/Proposal does NOT meet all identified requirement

The Government will conduct a Lowest Price Technically Acceptable (LPTA) source selection. To determine LPTA, the Government will place all quotes in order of lowest total price to highest total price. Starting with the lowest total priced quote, the Government will review the non-price submission for acceptability. If the quote is found to be "Acceptable," no other quotes will be reviewed, and award will be made. However, if the quote is found to be "Unacceptable," the next lowest total priced quote will be considered. This process will continue until either a quote is considered "Acceptable" or until all quotes have been considered "Unacceptable."

The Vendor's proposed price will be evaluated based on price reasonableness. All prices must be considered fair and reasonable as determined by the Government. Price quote shall be held firm and valid for sixty (60) days.

The completion and submission of the above items will constitute a quote and will be considered the Vendor's unconditional assent to the terms and conditions of this solicitation and any attachments and/or exhibits.

Failure to provide all documents by the required date and time may preclude a quotation from award consideration at the discretion of the

Government.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.

Before the offer's specified expiration time, the

Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
