In addition, the Contractor will notify the Contracting Officer of any spill via email within four (4) hours of the spill or discovery of the spill.
C. A spill is defined to be any release of a material from its primary container (i.e. the container that has an intimate contact with the material) that results in any loss of material (i.e. asset), and the need to recoup, repackage, reissue or dispose of the asset whether or not the spill needs to be reported to a regulatory body under the various international, national, and local laws, rules, regulations and directives regarding environmental or occupational concerns.

The Contractor will not assert a privilege or other reason to withhold any such document or electronic media. This paragraph applies to all work under this contract.
3.0 ESTABLISHMENT OF GFP CYLINDER POOL
In accordance with Section 1.2 U.S. Government Responsibilities, the U.S. Government will provide cylinders as GFP to establish the initial GFP cylinder pool. The GFP is approximately 11,500 cylinders.
A. The Contractor shall be required to establish and maintain, at the Contractor;s designated locations(s), a pool of GFP cylinders subject to FAR Part 45 and the GFP clauses of this contract. The pool shall consist of a sufficient quantity of various types of empty compressed gas cylinders (new cylinders, refurbished cylinders and cylinders requiring refurbishment).
B. The transfer of cylinders for the cylinder pool will be accomplished in accordance with Section 9.0 Transition. Cylinders requiring refurbishment or damaged in transition will be refurbished by the Contractor in accordance with Section 5.2. Maintenance of GFP Cylinder Pool. The transfer of cylinders in the cylinder pool must be accomplished within the timeframes set forth in the transition plan.
C. It is the Contractor’s responsibility to maintain adequate stock in the cylinder pool at all times in order to meet customer demands and delivery requirements. After the initial pool has been established, the stock level of empty cylinders with the pool shall be maintained primarily through customer pick-ups, refurbishment by the Contractor, as necessary, cylinder conversions or transfer of stock from Government CONUS sources. As a last resort, the Government will purchase additional cylinders to replenish the pool.
D. Customer pick-ups and returns include full, empty, used, partially used, unused and excess items. The Contractor shall maintain an aggressive customer return program that encourages pick-ups and returns. Subsequent shipments inside the Contractor’s network will be at the Contractor’s expense.
E. The Contractor shall notify the Contracting Officer in a timely manner (at least 120 days before need will arise) if customer pick-ups are insufficient to maintain the required stock level in the cylinder pool, indicating both the quantity and the empty cylinder NSN required to bring the cylinder pool stock level back into an acceptable range. Upon notification from the Contractor, the Contracting Officer will review the request and determine whether additional empty cylinders are necessary and provide the required type and number of empty cylinders deemed appropriate. All shipment of GFP provided/arranged by DLA Aviation will be shipped to one location, identified by the Contractor in its proposal, for the duration of the contract. Costs of distribution beyond that point will be borne by the Contractor. If the Contractor has delivery orders which cannot be filled because of U.S. Government has failed to provide sufficient empty cylinders, the delivery date will be extended until the empty cylinders arrive, or the order will be cancelled and filled through an alternate contract.
F. In the event that a customer has excess cylinders at their site, the customer will initiate the pick-up of these cylinders with the Contractor. After verification that the excess cylinders are supported by this contract, coordination for pick-up will be made with the Contractor or designated U.S. Military activity. If the excess cylinders are not supported by this contract but are GFP (DOT cylinders from another Industrial Gas Program (IGP) contract), they may be transported back to the Contractor’s facility to be stored for future shipment per the Contracting Officer’s direction.
G. The Contractor will be required to accept and process material returns from customers. Material returns include returns of unused and partially used excess quantities of the items listed in Attachment 1. Material returns do not include empty cylinders for use in the GFP cylinder pool. Recovery bottles are not part of the contract, however, in the event a customer returns recovery bottles, the Contractor shall contact the Contracting Officer for instructions on where to send the recovery bottle.
H. As directed by the Contracting Officer, the Contractor may be required to pick-up empty GFP from a designated location and transport them back to the Contractor’s designated location(s) at the U.S. Government’s expense.
I. The Contractor shall coordinate with the local area supporting Movement Control Team for the return of empty U.S. Government shipping containers to the designated container holding facility.
J. The Contracting Officer may, as needed, direct the Contractor to prepare for and ship excess GFP cylinders from the cylinder pool to meet requirements outside the Contractor’s designated support area at the U.S. Government’s expense via a DD form 1149 – REQUISITION AND INVOICE/SHIPPING DOCUMENT, issued by the Contracting Officer or designated representative.
K. In the event a customer inquiries about returning Ozone Depleting Substances (ODS) cylinders, the Contractor shall instruct the customer to contact the ODS office via email at avnodsreserve@dla.mil. The Contractor shall not accept ODS cylinders from the customer. Should the Contractor receive ODS cylinders returned in error, the Contractor shall use the same contact information listed above to have the cylinders removed from their property as soon as possible.
