3. BACKGROUND
3.1. The TS STATE OF MAINE was originally constructed as the USNS TANNER (T-AGS-40) at the
Bethlehem Steel Shipyard in Sparrow’s Point, Maryland in 1990. The TANNER served as an oceanographic research ship for the U.S. Navy. Ownership was later transferred to the USDOT-
Maritime Administration which converted the ship to a Public Nautical School ship at the
Colonna’s Shipyard in 1997, where it was renamed, TS STATE OF MAINE. That conversion involved replacing the existing two Enterprise diesel propulsion engines with one MAK 6M601 diesel engine and one electric propulsion motor. This conversion also involved replacement of the existing fixed pitch propeller with a controllable pitch propeller to include modifications to the propulsion shafting. In addition, numerous compartments were modified to create classrooms and berthing for cadets as well as providing for the expanded hotel services required.
3.2. TS STATE OF MAINE is currently in service as the Training Ship for the Maine Maritime
Academy, Castine, Maine. The ship is also part of the National Defense Reserve Fleet (NDRF).
3.3. The TS STATE OF MAINE maintains a U.S. Coast Guard Certificate of Inspection (COI) and
American Bureau of Shipping (ABS) Classification with the following designations and notations:
3.3.1. USCG Service / ABS Description: Public Nautical School ship.
3.3.2. SOLAS Category: Cargo Ship.
3.3.3. MARPOL Category: Not an Oil Tanker.
3.3.4. ABS Class Notations are as follows:
3.3.4.1.
3.4. As both a Public Nautical School Ship and Cargo Ship (non-tanker), the regulations of 46 CFR
167, in addition to ABS Rules and SOLAS Regulations for a Cargo Ship (non-tanker), govern all work performed aboard.
3.5. The Contractor, therefore, shall ensure that all work performed by their company and subcontractors, shall be in conformance with these Regulations and Rules and shall not compromise the ship’s Certificate of Inspection (COI) and/or ABS Classification. If the Contractor is aware of anything, either stated within this SOW or missing from this SOW, that shall compromise that compliance, they shall make it known immediately, and in writing, to the COR. If there are differences in the requirements of the CFRs, ABS Rules and SOLAS Regulations as they relate to the work being performed, the more stringent requirement shall apply.
3.6. The TS STATE OF MAINE is enrolled in a Continuous Hull and Continuous Machinery Survey with ABS.
4. SCOPE, PURPOSE, AND INTENT
4.1. The primary scope, purpose, and intent of this Statement of Work (SOW) is to accomplish the following:
4.1.1. A USCG Drydock Exam, Internal Structural Exam and Tail Shaft Inspection in accordance with 46 CFR Part 61. (The tail shaft was pulled at the last drydocking in 2017. It is not expected to be pulled during this 2022 drydocking).
4.1.2. An ABS Special Periodical Survey #7 for a Non-ESP Cargo Ship (non-tanker, which is greater than 15 years of age) which desires to continue in a UWILD program.
4.1.3. Underwater hull and freeboard coatings.
4.1.4. Miscellaneous tank coatings.
4.1.5. Installation of four new lifeboats and davits.
4.1.6. Installation of a Ballast Water Treatment System to include ballast water piping modifications.
4.1.7. Installation of a new Fire Detection System.
4.1.8. Stability Test.
4.2. All work performed by the Contractor shall serve to accomplish the requirements of 46 CFR
Part 61 and ABS Rules 7-3-2/5 as they relate to the various ITEMs in this SOW.
5. AVAILIBILITY PERIOD
5.1. The TS State of Maine will be conducting a Training Cruise with cadets of the Maine
Maritime Academy during the spring and summer of 2022. Given that the ship’s Special Survey #7 is due on June 30, 2022, it is Maine Maritime Academy’s plan to complete its training cruise (upon return to Castine, ME) and then sail to the shipyard arriving just prior to June 30, 2022. Due to the need for the ship to be back in Castine, ME to serve as a cadet training platform, the completion date for this availability period (departure from the shipyard) has been set at September 30, 2022.
The availability period, therefore, shall be June 29, 2022 thru September 30, 2022.
6. INTER-PORT DIFFERENTIAL
6.1. When comparing pricing from the various shipyards/drydocks, an Inter-Port Differential shall be applied to the offeror’s total price to account for MARAD’s cost to deliver/return the ship between its homeport of Castine, ME and the shipyard/drydock. This differential shall be calculated based on a daily operating cost of $30,000.00, a speed of 13 knots, and distances between ports taken from the National Geospatial-Intelligence Agency Publication 151, “Distances
Between United States Ports”.
7. LIQUIDATED DAMAGES
7.1. Liquidated Damages (as defined in FAR 52.211-11) shall be applied, if warranted, to compensate the government for actual costs/harm resulting from failure of the Contractor to perform the work in this SOW within the performance period of the contract as follows:
7.1.1. If the Contractor fails to deliver the supplies or perform the services within the time specified in this contract, the Contractor shall, in place of actual damages, pay to the
Government, liquidated damages of $30,000 per calendar day of delay. This amount is equivalent to the ship’s full mission capable (FMC) operating cost per day.
7.1.2. If the Government terminates this contract, in whole or in part, under Federal Acquisition
Regulation Clause 52.212-4(m) – Termination for Cause, the Contractor is liable for liquidated damages accruing until the Government reasonably obtains delivery or performance of similar supplies or services. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.
7.1.3. The Contractor will not be charged with liquidated damages when the delay in delivery or performance is beyond the control and without the fault or negligence of the Contractor.
8. ACCURACY OF INFORMATION
8.1. Dimensions and measurements in this SOW are provided in good faith but are not guaranteed. The Contractor shall verify the accuracy of dimensions, measurements, sizes, etc., provided in any sketches, drawings, plans and specifications within this SOW prior to quoting, fabricating, ordering, etc., anything required in this SOW.
8.2. Any drawings provided, whether they are considered “as-builts” or not, should not be scaled to determine the actual location of existing piping/wiring runs, etc. in hidden areas such as bulkheads and/or joinery.
8.3. The COR shall assist, in as much as possible, by providing access to any requested drawings or manuals. These drawings and manuals shall not leave the ship but may be copied on board with the written approval of the Chief Engineer.
8.4. Most of the ship’s drawings and manuals aboard the ship have been electronically copied to a pdf format. Electronic copies of drawings and manuals shall be provided to the Contractor upon request.
8.5. The Contractor shall be aware that numerous drawings and manuals represent the ship’s configuration prior to the conversion in 1997 and as such, may no longer accurately represent the ship’s current configuration. For this reason, it is important to determine whether a drawing or manual being reviewed represents the pre or post conversion configuration. In some instances, it may be necessary to combine information from both pre and post conversion drawings to determine the current configuration of a system or compartment.
8.6. Material Lists provided in a drawing may not accurately reflect the full extent of materials required. The Contractor shall be responsible for determining the actual quantities/types of materials required.
9. MINIMUM DRAFT REQUIREMENTS
9.1. The ship’s stability and trim booklet, section 2.4.6, provides a maximum air draft of 128.72 feet which equates to a minimum arrival draft of 26.28 feet. Shipyards and/or drydocks which require the ship to be at less than a draft of 26.28 feet (to cross the sill of the dock and/or to maneuver in and out of the dock/yard), will not be capable of drydocking this ship.
10. SAFETY
10.1. The ship’s crew and COR shall abide by the safety requirements of the shipyard. The
Contractor shall provide a copy of the safety requirements of the shipyard as part of their technical submission. To help ensure the safety of all personnel aboard, the Contractor shall comply with the OSHA standards for shipyard employment in accordance with 29 CFR 1910 and 1915 as applicable.

10.3.2. Maintain Unobstructed Escape Routes: The Contractor shall not obstruct egress routes
(doors, hatches, scuttles, passageways, etc.) in a manner which endangers the safe entry or evacuation of personnel. At least two gangways or brows shall be in place to ensure access/egress to/from the ship. One of these gangways/brows shall be placed between the dock and the ship’s main deck fantail. This gangway/brow shall have a hinged gate at the dockside end which is to be kept closed unless contract work is taking place aboard. The other gangway/brow shall be placed between the dock and the 01 quarterdeck area where the Contractor’s security guard(s) will be stationed.
10.4. Slips, Trips and Fall Hazards: The Contractor shall take all necessary precautions to ensure that:
10.4.1. Areas being worked on shall be well lit.
10.4.2. Ladders and rails shall not be removed without sufficiently encircling the openings with sturdy line AND yellow caution tape.
10.4.3. Openings in the deck where work is to be performed shall be sufficiently encircled with sturdy line AND yellow caution tape.
10.4.4. Open manholes on a horizontal deck shall have a U-shaped, sturdy metal, flat bar fastened to the manhole bolt circle which permits access beneath the bar (without removal) but serves to prevent an inadvertent fall into the manhole.
10.4.5. Decks shall be kept free of oils and greases.
10.4.6. Welding leads, oxy-acetylene hoses, extension cords, etc., are not strung across ladders, egress paths, etc., in a manner which creates a tripping hazard.
11. JOB SAFETY ANALYSIS (JSA) AND/OR JOB HAZARD ANALYSIS (JAH)

Person” using a certified gas monitor. The Competent Person shall hold certification for satisfactory completion of an NFPA approved course for shipyard competent persons. A copy of this certification shall be provided with the Contractor’s technical submittal. All hot work shall require that the Contractor fill out one of the ship’s hot work permits and obtain the signature/acknowledgement of one of the ship’s officers each day that hot work is being performed. This permit is used to inform both the ship’s crew and contracted security guards of the location of hot work being done each day. Precautions shall be taken to ensure that overheads, bulkheads, decks, wiring, piping, insulation, etc., are properly protected from burning, welding, cutting or similar activities, by covering them with fire retardant board or cloth, as appropriate. A Contractor supplied fire watch shall be employed on each side of a bulkhead or deck where hot work is taking place. Use of the ship’s portable extinguishers is not permitted.
The Contractor’s extinguishers shall be kept full and in good working condition. The Contractor’s fire watch must remain in place for at least ½ hour after any hot work is performed, to include standing by during break and lunch periods, if hot work was performed within ½ hour prior to the start of the break/lunch. All hot work must cease at least ½ hour prior to the end of the workday to provide the Contractor’s fire watch ample time to ensure that the area is safe before departing the ship. These periods are a good time to accomplish clean-up of the areas involved.
14. OXYGEN AND ACETYLENE
14.1. All oxygen and acetylene bottles shall be kept ashore and tied off along the dock. All oxygen and acetylene hoses shall be disconnected at their bottles at the end of each workday.
Hoses used within the ship shall be coiled up such that no hoses are left passing through any doors at the end of the workday. Hoses shall be kept in good condition. Hoses deemed in need of replacement by the COR shall be replaced by the Contractor at the COR’s direction.
