PERFORMANCE WORK STATEMENT (PWS)
Department of the Interior University Introduction to Tribal Consultation
PART 1 - GENERAL INFORMATION
1 General: This is a non-personnel services contract to introduce tribal consultation for employees of the Department of the Interior. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn, is responsible to the Government.
1.1 Background: On December 1, 2011, Secretary Salazar signed Secretarial Order 3317 - Department of the Interior Policy on Consultation with Indian Tribes, which formally authorized the Department of the Interior Policy on Consultation with Indian Tribes as the official policy of the Department. The two documents represent the culmination of two years' work by the Department and tribal representatives to comply with Executive Order 13175, signed by President Clinton in 2000, and a Presidential memo signed by President Obama in November 2009 directing all departments and bureaus to implement Executive Order 13175.
Secretarial Order 3317 and the new Policy launched a new era of enhanced communication with American Indians and Alaska Native tribes - one that emphasizes trust, respect, and shared responsibility in providing tribal governments an expanded role in informing federal policy that impacts Indian country.
The policy creates a framework for synchronizing Interior's consultation practices with its bureaus and offices by providing an approach that applies in all circumstances where statutory or administrative opportunities exist to consult with tribes - including any regulation, rulemaking, policy, guidance, legislative proposal, grant funding formula change or operational activity that may have a substantial and direct effect on a tribe. Through this policy, the Department strives to strengthen its government-to-government relationship with Tribes and begin a new era· of consultation
1.1.1 The policy addresses the need for a consistent approach to training on Effective Tribal Consultation and designates DOI University (DOIU) as the lead for this initiative.
