Thomas Life Estate

1. PROJECT LOCATION

The Allegheny National Forest, Marienville Ranger District is awarding a contract for the removal of an underground fuel storage tank. The tank is located at the house formerly owned by Marian Thomas, at 11624 River Road, Sigel, PA 15860. The site is located in Millstone Township, Elk County, Pennsylvania. It is approximately 3.0 miles westerly along River Road (T-301) from the intersection of River Road and Spring Creek Road (SR 3002) in the Village of Hallton, PA and is just south of Painter Run. The approximate coordinates are Latitude: 41° 22’ 18.8” North; Longitude: 78° 57’ 53.9” West.

The underground fuel oil tank is on the eastern side of the building.

2. GENERAL REQUIREMENTS

a. Work must be performed by a Pennsylvania Department of Environmental Protection certified remover following the closure checklist for closing underground storage tanks.

b. Disconnect, remove, and legally dispose of the existing underground storage tank and associated piping for oil heating system serving the Thomas house including environmental sampling and a closure report. The closure report is to include disposal manifests, laboratory analytical results, and site photos. Work must be completed by a DEP certified tank remover and in accordance with all Federal, State, and Local requirements. The site shall be backfilled with suitable material and seeded to match existing lawn.

c. Assume no contamination and no need for remediation during excavation. In the event that evidence shows prior tank leakage and soil contamination, notify the CO immediately. If additional excavation and disposal of soil around the site is required, additional pricing will be negotiated.

d. The Contractor shall, without additional expense to the Government, be responsible for obtaining any necessary licenses and permits. The Contractor shall also be responsible for any and all damage to persons or property that occurs as a result of the Contractor’s fault or negligence. Care shall be taken during excavation near the building. The Contractor shall also be responsible for all materials delivered and work performed until completion and acceptance of the entire work, except for any completed unit of work which may have been accepted under the contract.

e. Personnel shall have Hazardous Waste Operation (HAZWOPER) certification.

f. Davis Bacon wage rates apply to the on-site construction phase of this project.

g. Time of performance shall be: 30 days

h. The Government and the public may occupy the site during construction and may require use of the area. Coordinate with the Government’s representatives during construction operations to minimize conflicts and facilitate usage. Perform the Work in a manner that does not interfere with the site’s operations. The Work of this Contract may require additional coordination of activities with the Forest Service and other Contractors that may be working on other projects in the area.

3. STATEMENT OF WORK FOR BID ITEMS

Item 1 Mobilization: This work shall consist of preparatory work and operations necessary for the movement of personnel, equipment, supplies, and incidentals to the project site, and for all other work and operations that must be performed or that cause costs to be incurred prior to beginning work on various items on the project site. The cost of premiums paid for performance and payment bonds are considered incidental to this item and will not be paid for separately. The maximum price bid for mobilization may not exceed 10% of the total contract price.

Item 2 Thomas Life Estate Underground Fuel Storage Tank

This work shall consist of the complete removal of the underground fuel storage tank and associated piping serving a previous heating system for the residence.

The exact size of the tank is unknown. There are approximately 11 inches of liquid remaining in the tank and may contain some water.

a. Pumping Tank: Contractor will pump out all remaining material from tank prior to excavation and removal. Pumping will be completed as per standard industry practices. Pumped material will be tested and then disposed of in accordance with local, state, and federal regulations.

b. Removing Tank: Contractor will excavate tank carefully ensuring integrity is not compromised. Disconnect the piping at the building and remove piping including vents from the tank to the disconnect location. Tank will be placed in a secure location providing secondary containment. Backfill excavation with suitable material. Any contaminated soil discovered will be excavated and placed in a proper container in accordance with local, state and federal regulations at costs to be negotiated. The disturbed area will be raked, finished with topsoil, seeded with a suitable lawn mix, and mulched.

c. Testing: Testing of the tank contents and surrounding soil samples is required to verify hazardous characteristics and determine proper disposal. Testing will include volatile and semi-volatile organic chemicals, by a qualified testing company. Testing protocol will be approved by the Contracting

Officer’s Representative (COR). This item also includes any testing that may be required by the disposal site where the material is taken after removal from the forest.

d. Disposal: Tank, contents, piping and any contaminated soil will be disposed of in accordance with local, state, and federal regulations. Shipment will be properly manifested if applicable. Otherwise, indicate receipt and acceptance of items by a landfill facility licensed to accept hazardous waste.

Item 3

Closure Report: The report shall include, at minimum, a description of the work, sampling protocol, laboratory analytical results, disposal manifests, site photos, and a summary or conclusion section.

4. SAFETY AND HEALTH

a. References: In addition to publications referenced in the Contract and FAR 52.236-13, the following Code of Federal Regulations (CFR) publications designate and define hazardous materials and conditions, and establish procedures for handling these materials and conditions.

i. 29 CFR, Part 1910: Occupational Safety and Health Administration (OSHA) General Industry and Health Standards.

ii. 29 CF, Part 1926: OSHA Construction Industry Standards

iii. 40 CFR, Part 61: National Emission Standards for Hazardous Air

Pollutants

iv. 40 CFR, Part 261: Environmental Protection Agency (EPA)

Characteristics of Hazardous Waste.

v. 40 CFR, Part 761: EPA Polychlorinated Biphenyls (PCBs), Manufacturing, Processing, Distribution in Commerce and Use Prohibitions.

b. Contractor Responsibility: The Contractor shall assume full responsibility and liability for compliance with all applicable codes, standards and regulations pertaining to the health and safety of personnel during execution of the Work. The Contractor shall have safety and health programs in compliance with 29 CFR Parts 1910 and 1926.

c. Emergency Suspension of Work In accordance with FAR 52.236-13, when the Contractor is notified by the Government, of non-compliance with safety or health provisions of the Contract, the Contractor shall immediately, correct the unsafe or unhealthy condition. In accordance with FAR 52.242-14, if the Contractor fails to comply promptly, all or part of the Work will be stopped by Government notice. The Contractor shall not be allowed any extension of time or compensation for damages in connection with a work stoppage for unsafe or unhealthy conditions.

d. Protection of Personnel

The Contract shall take all necessary precautions to prevent injury to the public, occupants, or damage to property of others.

e. Environmental Protection

i. Dispose of solid, liquid and gaseous contaminants in accordance with local codes, laws, ordinances and regulations.

ii. Comply with applicable federal, state and local noise control laws, ordinances and regulations, including but not limited to 29 CFR 1910.95 and 29 CFR 1926.52.

iii. Ensure that all heavy equipment transported to the project area is free of invasive plant propagules and contaminated soil. Clean heavy equipment prior to entering the project area.

UNDERGROUND STORAGE TANK SYSTEMS

"Underground Storage Tank System Installation/Closure Notification Form" submitted to appropriate DEP regional office with copy sent to Pennsylvania Department of Labor and Industry (or appropriate office in Philadelphia or Allegheny County) at least 30 days prior to initiating permanent closure."

"Storage Tanks Registration/Permitting Application Form" submitted to appropriate DEP regional office, if the UST systems are required to be registered and they are not.

Pennsylvania "One-Call" contacted (1-800-242-1776) to have utilities mark their lines.

Local municipality contacted to obtain any necessary permits or approvals for UST system closure.

DEP certified remover hired to perform tank handling activities.

Arrangements made for site assessment and laboratory analysis of samples collected.

Safety Data Sheets (SDS) obtained for all hazardous substances stored in the UST systems to be closed.

Arrangements made for treatment/disposal of any contaminated soils encountered.

NOTE: Unless this item is specified in the contract, it can remain a continuing burden of the owner/operator.

"Storage Tanks Registration/Permitting Application Form" obtained to amend facility status, validated by the DEP certified remover and submitted to the Division of Storage Tanks after UST system closure is completed.

NOTE: Registration fee and USTIF billing will continue until an amended “Storage Tanks Registration/Permitting Application Form” is submitted to the Division of Storage Tanks.
