STATEMENT OF WORK

ARCHITECT & ENGINEERING SERVICES

B&F Project 1C5C Mid Atlantic Regional Office

1. DESCRIPTION OF SERVICES:

The Contractor shall provide miscellaneous Architectural and Engineering (A&E) services required with various repair and improvement projects on new and existing structures at the Federal Bureau of Prisons’ institutions within the Mid Atlantic Region, which encompasses the States of Maryland, West Virginia, Kentucky, Tennessee, Virginia, North Carolina, and Delaware. The following is a list of correctional facilities, by State:

Maryland: FCI Cumberland;

West Virginia: FCC Hazelton, FCI Morgantown, FCI Gilmer, FPC Alderson, FCI McDowell, and FCI Beckley;

Kentucky: FCI Ashland, USP Big Sandy, FMC Lexington, FCI Manchester, and USP McCreary;

Tennessee: FCI Memphis;

Virginia: FCC Petersburg, and USP Lee;

North Carolina: FCC Butner;

Delaware: None.

The Contractor shall provide A&E services that fully cover all disciplines required for a complete job. Services shall include but not be limited to: Architectural, Civil Engineering, Structural Engineering, Mechanical Engineering, Electrical Engineering, and all consultant work called for in Each Task Order. All Architecture and Engineering firms performing work must be licensed in the state in which the specific Task Order is located.

The Contractor shall provide A&E services to include but not be limited to: Studies, Master Planning, Environmental Assessments, Site investigation, Utility Studies, Project Programing, Design Concepts, Design, Construction Documents, Cost Estimates, Pre Bid Meetings at sites, Assistance in Bid Evaluation, Pre Construction Conferences at sites, Construction Administration Services, Submittal Review, Construction Contract Modification Assistance, Site Visits During Construction, Project Closeout Services.

The Performance Period for this contract shall be one year from date of award, with options to extend for up to four (4) additional one year option periods.

2. REQUIREMENTS – SPECIFIC TASK ORDERS:

2.1 The Contractor will develop procedures, produce construction documents/work statements, develop long range master plans, and evaluate regulatory compliance for various activities as requested.

The Contractor will be tasked with providing assistance to the Government in preparing Specifications/ Statements of Work, Drawings, Independent Government Estimates, assisting in the review of bids/ proposals/quotations, and reviewing submittals. The Contractor shall develop construction specifications which promote full and open competition, in accordance with Federal Acquisition Regulation (FAR), Part

11.04. Specifications shall be suitable for competitive bidding, as sealed construction bids will generally be solicited for the construction contract. The Contractor is hereby informed that no construction contract can be awarded to the firm that designed the project, except as provided in FAR 36.209.

The Contractor will submit paper hard copy and electronic files on disc for all projects awarded. The Statement of Work for individual Task Orders will indicate requirements for progress printings, Bid Documents, and final Record Documents, which will vary according to the nature of the task. Unless otherwise specified in the Statement of Work for the individual Task Order, for each printing, one paper copy of drawings, specifications, cost estimates, and reports, and a compact disc containing PDF of all

Statement of Work Architect & Engineering Services Project No. 1C5C Mid Atlantic Regional Office June 23, 2020 documents are to be sent to the Contracting Officer’s Representative in the Mid Atlantic Regional Office.

Final printings shall include a second compact disc, which shall contain all documents in PDF format, plus editable AutoCAD files for all drawings, and editable Microsoft Word files for all specifications. For all printings sent to the Regional Office, a PDF copy of the transmittal shall be sent to the Contracting Officer via e mail.

2.2 Solicitation Phase During the solicitation phase for the construction requirement, the awarded A&E Contractor may be responsible to answer the questions of potential bidders or those submitting proposals, attend Pre Bid Site Visits, answer pre bid questions sent by the Contracting Officer, and conduct evaluation of bids/proposals if asked by the Contracting Officer.

Task Orders Information As projects are identified, they will be negotiated with one of the Contractors awarded A&E Services contracts by the Field Acquisition Contracting Officer. Procedures for award of individual Task Orders are in accordance with the FAR and contract documents. Each RFQ may include:

1. Statement of Work

2. The time required to complete the services (period of performance)

3. Acceptance criteria, if any

4. Reporting requirements and list of deliverables (submission requirements)

5. Quotation due date and time

Quotation Procedures Upon receipt of the RFQ, the A&E will be given the opportunity to visit the site in question (if work is required) to develop a better understanding of the Task Order scope and aid in the preparation of their quotation. Each quotation response from the A&E shall include:

1. A narrative description of procedures the A&E will follow to accomplish the task(s) along with a list of key personnel assigned to the Task Order.

2. A price quotation offering to perform the work at a firm fixed price.

3. The A&E’s and any consultants’ detailed breakdown of the offered price, to include itemization for direct labor, materials, equipment, overhead, profit, bonding, and travel, if necessary.

4. Any additional information specifically requested in the quotation. The Government shall evaluate the quotation to ascertain that the A&E has a complete understanding of the task(s) required, will perform the task(s) effectively, and complete the project in an economical and efficient manner.

The Contracting Officer may request the A&E clarify his quotation, or justify the proposed labor hours or labor mix, or discuss any other items to assure that both parties have a complete understanding of the construction project.

Award Determination Procedures Upon determination by the Government that the quotation is acceptable and the price is fair and reasonable, the Contracting Officer shall issue a Task Order awarding the project to the A&E. Each Task Order shall include the following:

1. Description of work

2. The requestors name and location

3. Reporting requirements and list of deliverables

4. Completion time frame

5. Acceptance criteria

6. Awarded price to complete the requirements of the project

7. Appropriate funding information

A&E Contractors who do not receive award of the individual Task Order will not be compensated for their

2.3 Construction Phase During the construction phase for the requirement, the awarded A&E Contractor will be responsible to provide construction administration services. Construction administration services include, but are not limited to the following:

1. Attending a Pre Construction Meeting at the institution site to assist the Government in dealing with the construction contractor’s issues, including initial proposed Construction Schedule, work schedules, request for substitutions, etc.

2. Attending Monthly Progress Meetings at the institution site, to monitor construction progress and assist the Government in assuring that the construction contractor is maintaining the project schedule, and that work performed is within contract requirements.

3. Checking and approving, annotating, referring, or rejecting shop drawings, equipment lists, material samples, and similar data.

4. Reviewing and approving, annotating, referring, or rejecting certifications, laboratory reports, and test data.

5. Responding to construction contractor Requests for Information (RFI’s).

6. Performing (or engaging qualified inspectors to perform) Special Inspections, as required by Chapter

17 of the International Building Code.

7. Performing post construction certifications of designated life safety systems, including but not limited to fire protection and fire alarm systems, as defined in the individual Task Orders.

The individual Statement of work that accompanies the respective RFQ and subsequent Task Order award will provide exact requirements.

2.4 General Requirements The following are general requirements for services applying to all Task Orders issued:

1. The Construction Documents shall demonstrate compliance with the latest edition of the International Building Code, except where local codes are more stringent. Documents shall also show compliance with NFPA, Federal Bureau of Prisons Technical Design Guidelines (TDG’s) and ACA Requirements.

2. The Construction Documents shall demonstrate compliance with relevant Environmental regulations, such as hazardous waste management, air and water quality provisions, as well as compliance with OSHA, NFPA, RCRA, CERCLA, TSCA, State and local requirements.

3. Coordinate with Federal, State and local regulatory agencies.

4. As part of the paperwork reduction act, unless specified in a particular Task Order all Drawings shall be submitted in the latest edition of AutoCAD and PDF format. Likewise, Specifications and Reports shall be submitted in Microsoft Word and PDF format unless specified otherwise in a particular Task Order.

5. Construction cost estimates shall be arranged according to CSI Divisions, and into individual CSI Sections if so specified in the Task Order, and broken down to show labor, materials, equipment, overhead, profit, sales tax, insurance, and bonds. They shall be submitted in Microsoft Excel and PDF formats.

6. For Task Orders that involve remodeling or new construction provide Pre and Post Construction certification of compliance with NFPA Life Safety Code, sprinkler, and fire alarm requirements.

7. All final construction documents shall bear the seal and signature of the Architect or Engineer responsible for the content. The Architect or Engineer shall be licensed in the State where the construction work will be performed.

8. Provide review of and recommendations for approval or rejection of documents including, but not

Mid Atlantic Regional Office June 23, 2020 limited to, construction contractor shop drawings, submittals, quotations, and change proposals.

9. Provide analysis, investigations, interpretations, technical and/or regulatory reports, specifications, operating plans, and permit applications as required, including but not limited to, Environmental Assessments and Preliminary Assessments. Include the payment of fees, if so specified in the Task Order.

10. Coordination with Federal, State and local regulatory agencies.

3. REQUIREMENTS MISCELLANEOUS SERVICE TASK ORDER:

3.1 A Miscellaneous Service Task Order is a Task Order that calls for the A&E to furnish up to a “Not to Exceed” total number of hours for particular professional services. This kind of Task Order is used to cover a number of small service orders until the total number of hours contracted for are reached. The government reserves the right to close the Task Order before the total number of hours per discipline is reached. The hours called for will be by specific disciplines the A&E furnishes. The hourly rates for services will be per the A&E’s contract quoted rates. A Miscellaneous Service Task Order is for services that need to be performed quickly, don’t require more than a few hours each and that can be simply delineated. A Miscellaneous Service Task Order will be broken down into two areas, Office hours and Travel if required.

3.2 Office hours will be billed at the hourly contract rate quoted by the Contractor. Hours required for the travel services will be billed per the contract quoted. Travel hours will be a “not to exceed” total figure and will be billed as follows:

1. Hourly rates and will be based on a 8 hour day maximum;

2. Travel costs will be billed up to GSA travel rates for the particular location called for. These include the lodging rates, per diem, mileage rates, etc., published by the General Services Administration

(GSA).

3.3 Service Orders Each service order placed against the Miscellaneous Services Task Order will be in the form of a service order placed by the Contracting Officer. Service Orders cannot exceed the total hours or travel totals agreed to in the Miscellaneous Service Task Order by the Contracting Officer. The Contracting Officer’s Representative in Regional Office will call the A&E and discuss the services required first. He/she will then write a Service Order, if the A&E can provide the services required. Each Service Order will contain:

1. A brief Statement of Work.

2. The requestors name and location.

3. The number of office hours required by discipline and resulting cost.

4. The travel cost including hours and GSA travel costs required for the work.

5. Reporting requirements.

6. The performance time for the services.

7. A place for the Regional Facilities Administrator to sign and date the Service Order.

8. The Contracting Officer will issue the Service Order to the A&E for review and signature.

9. The A&E will sign and date the Service Order to indicate acceptance, and return a copy to the

Contracting Officer.

10. Once the Service Order has been signed by the Contracting Officer, required services will start. Each

Service Order will be billed separately to Miscellaneous Service Task Order.

4. TASK ORDER INVOICES:

4.1 The Contractor shall include the following information, as a minimum, on ALL invoices submitted for payment:

1. Contractor’s name, invoice number, Task Order #, and date;

2. Description, cost and quantity, of services actually rendered.

3. Project Number and Title;

4. Payment terms;

5. Such other substantiating documentation as is required by the contract documents;

6. Name, title, phone number, and complete mailing address of the responsible official to whom payment is to be sent;

7. The following certification shall be cited on each order/invoice submitted for payment:

”I certify that all records concerned with this invoice are current and complete as of the date of this invoice, and that all payments requested are for appropriate purposes and in accordance with the contract terms.”

5. DESIGN CRITERIA

1. All work required shall be performed in accordance with the International Building Code (IBC), NFPA 13, NFPA 101 Life Safety Code, and International Energy Conservation Code (IECC), latest editions.

2. All electrical work shall conform to the National Electrical Code (NEC), latest edition.

3. All plumbing and mechanical work shall conform to the International Plumbing Code (IPC), International Mechanical Code (IMC), ASME Boiler & Pressure Vessel Codes, National Board Inspection Codes (NBIC, NBIB, & NB 23 & 370), ANSI/ASME CSD 1, and SMACNA requirements, latest editions.

4. All structural work shall conform to the seismic design requirements of the International Building Code

(IBC).

5. All environmental work shall conform to the current applicable EPA and State regulatory requirements. The A&E shall prepare any required environmental permit applications, and also pay the associated permit fees if so indicated in the individual Task Order. Note that this requirement applies to environmental related permits only. Building Permits are not required for BOP projects.

6. The Government shall retain full rights and privileges to use all documents prepared under this contract. The Government shall have unlimited rights in all drawings, designs, specifications, and other works developed in the performance of this contract; including the right to use same without any additional compensation. All designs, drawings, specifications, and other works developed and submitted in accordance with the contract shall become the property of the Government.

7. All documents prepared under this contract(s) are to reflect the actual minimum needs of the Government and the market available to satisfy such needs. All documents shall be developed in such a manner to promote full and open competition, consistent with the FAR Parts 6, 11, and 36.

8. Whenever possible, specifications should be written generically, and references in specifications are to be widely recognized standards promulgated by governments, industries, or technical societies.

9. If it is determined that listing manufacturers brand names is necessary for any required equipment items, product or material such listing shall include at least three (3) alternative sources and all known sources. Specifications must also clearly identify and describe the essential physical and functional characteristics of the equipment item, product or material considered necessary to satisfy the requirement, as will be considered to evaluate proposed substitutions. When the A&E cannot identify the minimum three (3) possible alternative sources for a particular item, the A&E shall advise the Contracting Officer, documenting the specific requirements and the efforts taken to locate such

Mid Atlantic Regional Office June 23, 2020 sources, and make any recommendations regarding specifications. The Contracting Officer shall determine the appropriate and practicable method of specifying the item.

10. References in the specifications to equipment, material, articles, or patented processes by trade name, make or catalog number, shall be regarded as establishing a standard of quality and shall not be construed as limiting competition. This shall be so stated in the specifications.

11. The Government reserves the right to perform any portion of these services or similar services itself, or employ others to perform them.

12. The Government, at its option, may reproduce additional copies of drawings, reports, or other documents furnished under this contract. Otherwise, additional reproduction may be done on a reimbursable basis to the A&E.

13. All miscellaneous services required in connection with the services described herein, shall be evaluated on an “AS REQUIRED” basis, and costs shall be established prior to the Contractor beginning work. The costs of all travel in connection with services to be provided under the contract(s) shall be agreed to by the A&E and the Government, and established for each order prior to final approval and Notice to Proceed by the Contracting Officer. Compensation for travel expenses shall be based on actual costs and travel allowances of contract employees in accordance with FAR 31.205 46 and applicable Government travel regulations. Such transportation cost shall not be in an amount greater than the cost of coach class commercially scheduled air or ground travel by the most expeditious route, unless coach or ground travel space is not available. The Contracting Officer shall evaluate and approve all proposed travel costs.

6. DIRECT LABOR RATES AND EXTENDED LABOR RATES

1. Labor rates to be utilized for this contract shall be as listed in Section B. Supplies or Services/Prices and Costs.

2. Labor rates proposed shall include the hourly rate for each category of labor, and the applicable overhead and profit rates proposed and allowed under the contract(s).

7. ASSIGNMENT OF CONTRACTING OFFICER’S REPRESENTATIVE

1. The contract resulting from this requirement will be assigned a Contracting Officer’s Representative (COR) responsible for oversight for ONLY this contract. Each individual Task Order issued under the resulting contract will be assigned either the same or different COR by the Regional Facilities Administrator. The assignment will be based on expertise. The Contractor will only communicate with the COR assigned per Task Order.

8. DEFINITIONS

1. Contracting Officer (CO): An employee of the Federal Bureau of Prisons, designated as Contracting Officer, or their duly appointed successor, with the authority to enter into, administer, modify, and/or terminate contracts; and to make related determinations and findings; and to act with the authority to obligate funds on behalf of the Government. The Contracting Officer may designate authorized representatives to act for him/her, in which case, he/she shall notify, in writing, the affected parties specifying the limits of authority and responsibility so delegated.

2. Contracting Officer’s Representative (COR): An employee of the Federal Bureau of Prisons, designated by the Contracting Officer to be his/her authorized representative for a specific contract within the limits of the authority and responsibility so delegated, specified.
