Items intended for public release shall be processed through the AFRL RD/RV approval process 45 days prior to requested release date in order to comply with DFARS 252.204-7000, Disclosure of Information. Per AFI 10- 701, all requested released items must have an OPSEC security and policy review and AFRL/PA release approval prior to release to the public. The Technical Point of Contact will load the requested public release requested document for the Contractor to the AFRL internal review process in the OPSEC Tool application to meet the OPSEC security and policy review requirement. Once approved, the document will receive a Public Affairs review and release number. Final approval must occur prior to release outside of government channels. Items submitted through the review process must derive from a government representative if being released by a DoD contractor. Unclassified information does not equal publically releasable. Information requiring AF or DoD-level review will be forwarded by the entry-level public affairs office through the AFIMSC Public Affairs Office to the Secretary of the Air Force, Office of Public Affairs, Security and Review Division (SAF/PAX), 1690 Air Force Pentagon, Washington DC20330- 1690. MAJCOM/DRUs will send information requiring AF or DoD-level review directly to SAF/PAX. NO PUBLIC RELEASE IS AUTHORIZED FOR NON-SCI or SCI.
Item 13. (Continuation):
Contractor shall follow security classification guidance on information, hardware and equipment as provided in the following security classification guides: List Applicable SCGS, Title, Version and date.. The Contracting Officer will provide other Security Classification Guides under separate cover as tasks are assigned. Revised Security Classification Guides will be provided under separate cover and will require revising the DD Form 254. The Contractor shall comply with any revisions to that Security Classification Guide. Document classification markings will be done in accordance with E.O. 13526 and DoDM 5200.01, Volume 2, Marking of Classified Information, 24 Feb 2012, and supplements thereto. The contractor must comply with special OPSEC requirements contained in the contract or addendum thereto. The requirements, restrictions and other safeguards prescribed by the National Industrial Security Program Operating Manual (NISPOM), 32 CFR Part 117 and its supplements apply to all classified performance. The prime contractor must contact AFRL/RDOSC at (505) 846-0536, AFRL Industrial Security Oversight Office for execution of the Visitor Group Agreement (VGA), and submit a company letter identifying on-site key personnel management officials or company representatives and a security focal point of contact for security related matters (normally FSO) prior to on-base operations. Prime contractor is responsible to ensure on-base subcontractors execute a VGA with AFRL/RDOSC prior to on-base operations. The prime contractor must include a provision in each on-base Contract requiring subcontractors to contact AFRL/RDOSC and execute a VGA prior to beginning on-base operations.

10.a.: The Contractor will need administrative access to classified COMSEC material. The contractor will not receipt, copy, or generate classified COMSEC material.
10.b.: The contractor is permitted access to RESTRICTED DATA (RD) in the performance of this contract. Access to RD requires a final U.S. Government clearance at the appropriate level.
10.c.: The contractor is permitted access to Critical Nuclear Weapons Design Information (CNWDI) in performance of this contract. The government project manager or designated representative will ensure the contractor is briefed for CNWDI prior to access being granted. DCSA briefs the contractor for access to CNWDI, upon request.
10.d.: The contractor is permitted access to Formerly Restricted Data (FRD) in the performance of this contract. Access to FRD requires a final U.S. Government clearance at the appropriate level.
10.e.(1): The contractor requires access to SCI intelligence materials. Prior approval of the contracting activity is required for subcontracting. Access to intelligence information requires a final U.S. Government clearance at the appropriate level and will only be done at authorized government facilities. SCI requires a TS facility clearance. Addendum will be provided upon award.
10.e. (2): The contractor requires access to NON-SCI intelligence materials. Prior approval of the contracting activity is required for subcontracting. Access to intelligence information requires a final U.S. Government clearance at the appropriate level and will only be done at authorized government facilities. Non-SCI Intel can be at the SECRET level. Addendum will be provided upon award.
10.f.: Special Access Requirements (SAR) procedures apply. User Agency Managers of Special Access Programs will grant access when the need-to-know is required to accomplish the required efforts under this contract. See attached SAP Supplement.
10.g.: The contractor is permitted access to North Atlantic Treaty Organization (NATO) information in performance of this contract. The government project manager is the designated representative that will ensure the contractor Facility Security Officer and concerned employees are NATO briefed prior to access being granted. Prior approval of the contracting activity is required for subcontracting. Access requires a final U.S. Government clearance at the appropriate level. Forward NATO classified materials needed by the contractor only from an Air Force Sub-registry directly to the contractor concerned.
10.h.: The contractor is permitted access to Foreign Government information. Access to Foreign Government information requires a final U.S. Government clearance at the appropriate level.
10.j.: The contractor shall comply with DoDI 5200.48, Controlled Unclassified Information, AFI 16-1404 Air Force Information Security Program, Air Force Guidance Memorandum 2020-16-01, Air Force Guidance Memorandum for CUI, 23 Jul 20, and DoDM 5400.7-Air Force Manual 33 302, DoD Freedom of Information Act (FOIA) Program. The contractor shall monitor CUI aggregation and compilation based on the potential to generate classified information pursuant to security classification guidance addressing the accumulation of unclassified data or information.
10.k.: Access to JWICS and SIPRNET are required in performance of this contract. NATO S briefing is required prior to having access to the JWICS. NATO awareness training is required prior to having access to the SIPRNet.
11.a.: All work performance on base will be performed by to be determined upon award of this contract. Contractor performance is restricted to (enter name and address of the government activity in Item 8.a.). Using contractor or activity will provide security classification guidance for performance of this contract. The contractor requires access to classified source data up to and including (TOP SECRET in support of the work effort. Any extracts or use of such data requires the contractor to apply derivative classifications and markings consistent with the source documents. Use of “Multiple Sources” on the “Derived From” line necessitates compliance with the NISPOM, 32 CFR 117.13, and use of bibliography, classification, declassification, and markings will be in accordance with EO 13526 and the DoDM 5200.01, Volume 2, Marking of Classified Information, 24 Feb 2012, and supplements thereto.
11.g.: The contractor is authorized to use the services of Defense Technical Information Center (DTIC) and is required to register at https://discover.dtic.mil/dtic-registration-benefits/dtic-registration/. You may be required to complete a DD Form 2345, Military Critical Technical Data Agreement. The contracting activity must be involved in certifying need-to-know to DTIC. Provide the specific SCI Intelligence access justification for this contractual effort (Provide details): The contract is focused on research and development Multi-Domain Awareness, Decision, and Exploitation capabilities to include space domain awareness (SDA), on-orbit spacecraft autonomy, and hypersonics.
1. Reference Block 12: Public Release of Sensitive Compartmented Information (SCI) is not authorized.
2. Reference Block 14: This contract requires access to Sensitive Compartmented Information (SCI). The following references (use current versions) are offered to provide the necessary guidance for physical, personnel, information, information systems security measures and is part of the SCI security specifications for the contract:
National Security Act of 1947, as amended; Executive Order (EO) 12333, as amended; EO 13526; EO 134549; EO 12829; EO 12968, as amended; 32 CFR Part 2001; 32 CFR Part 2003, 32 CFR Part 2004; and other applicable provisions of law; DoD Manual 5105.21 Vols 1-3; AFMAN 14-403; AFMAN 14-401; 32 CFR Part 117, Dec 12 2020 (NISPOM and Supplement); ICD 701; ICD 703; ICD 704/ICPGs 704.1, ICPG 704.2, ICPG 704.3, ICPG 704.4; ICD 705; ICS 705-1; ICD 710; ICD 503; provides the necessary guidance for physical, personnel, information, and information systems security measures and is part of the SCI security specifications for the contract.
3. SCI will not be released to contractor employees without the specific release approval by the originator of the material as outlined in the governing directives and based on prior approval and certification of “need-to-know” by the SCI COR identified above.
4. Names of contractor personnel requiring access to SCI and justification for SCI positions will be submitted for coordination and action to SSO Kirtland after the SCI COR approval/concurrence. Upon receipt of written approval from the SCI COR, the Facility Security Officer and/or Contractor Special Security Officer (CSSO) may submit the necessary forms to Defense Counterintelligence and Security Agency (DCSA) for a Tier 5 investigation for those personnel nominated for SCI access in accordance with the National Industrial Security Program Operating Manual (NISPOM). The FSO and/or CSSO will monitor DISS for status changes affecting adjudication and eligibility for personnel under their cognizance and notify the SSO when changes are noted.
5. This contract will require XXX SCI positions in order to fulfill contractual obligations incurred. SCI access is subject to US Government review and approval as outlined in the aforementioned SCI security guidance. Upon completion or cancellation of the contract, the SSO will debrief all personnel not required for contract closeout and those positions will be disestablished.
6. Access is restricted to only those individuals who possess the necessary security clearance and who are actually providing services under the contract. Further dissemination to other contractors, sub-contractors, other government agencies, private individuals or organizations is prohibited unless authorized in writing by the releasing agency.
7. SCI materials furnished in support of this contract remain the property of the DoD department or command that released it. Upon completion or cancellation of the contract, all SCI materials furnished will be returned to the direct custody of the originator of the materials or the SCI COR.
8. Classified foreign intelligence materials must not be released to foreign nationals or immigrant aliens whether or not they are also consultants, US contractors, or employees of the contractor, regardless of the level of their security clearance, except with advanced written permission from the originator.
9. The CSSO must not reproduce classified foreign intelligence without advance approval of the releasing agency. If permission is granted, each copy will be controlled in the same manner as the original. The CSSO must not destroy any classified foreign intelligence without advance approval of the releasing agency.
10. Contractor personnel must maintain accountability for all intelligence (to include foreign intelligence) material released to their custody.
11. Inquiries pertaining to classification guidance on SCI will be directed to the SCI COR listed above. SCI security management issues shall be directed to SSO Kirtland, phone (505) 846-5017, DSN prefix 246.
12. All DD Form 254s prepared for subcontracts involving access to SCI under this contract must be forwarded to the SCI COR for approval and then to SSO Kirtland for review and concurrence prior to award of the subcontract. Inquiries pertaining to classification guidance on SCI will be directed to the SCI COR listed above. SCI security management issues shall be directed to SSO Kirtland.

14. A SCI Facility (SCIF) meeting the physical security requirements outlined in ICD 705 is required for this contracting effort. 15. Reference Block 15: This contract requires access to SCI. SSO Kirtland maintains security cognizance for all SCI requirements on this contract. The Defense Counterintelligence and Security Agency (DCSA) is relieved of security oversight for SCI performance.
16. Visits. The contractor will submit the written request for SCI visit certifications through the SCI COR for approval of the visit. The certification must arrive SSO Kirtland at least five working days prior to the visit.
17. Access to JWICS is required.

1. Requirements for access to non-SCI intelligence:
a. Contractor will require access to Non-SCI intelligence information and must comply with directions provided by the COR. The COR has determined that disclosure does not create an unfair competitive advantage for the contractor or a conflict of interest with the contractor’s obligation to protect the information. The COR/Program Manager will identify what Non-SCI intelligence information is required to satisfy contract requirement.
b. All intelligence material release to the contractor remains the property of the U.S. Government and may be withdrawn at any time. Contractors must maintain accountability for all classified intelligence released into their custody.
c. The contractor must not reproduce intelligence material without the written permission of the originating agency through the Intelligence Support Office. If permission is granted, each copy shall be controlled in the same manner as the original.
d. The contractor must not destroy any intelligence material without advance approval or as specified by the Program Manager identified under Item 13 of the DD Form 254. EXCEPTION: Classified waste shall be destroyed as soon as practical in accordance with the provision of the Industrial Security Program.
e. The contractor must restrict access to only those individuals who possess the necessary security clearance and who are actually providing services under the contract with a valid need-to-know. Further dissemination to other contractors, subcontractors, other government agencies, private individuals or organizations is prohibited unless authorized in writing by the originating agency through the Program Manager identified under Item 13 of the DD form 254.
f. The contractor must ensure each employee having access to intelligence material is fully aware of the special security requirements for this material and shall maintain records in a manner that will permit the contractor to furnish, on demand, the names of individuals who have had access to this material in their custody.
g. Intelligence material must not be released to foreign nationals or immigrant aliens whether they are consultants, U.S. contractors, or employees of the contractor and regardless of the level of their security clearance, except with advance written permission from the originator. Requests for release of foreign nationals shall be initially forwarded to the contract monitor and shall include:
(1) A copy of the proposed disclosure.
(2) Full justification reflecting the benefits to U.S. interests.
(3) Name, nationality, particulars of clearance, and current access authorization of each proposed foreign national recipient.
g. Upon completion or termination of the classified contract, or sooner when the purpose of the release has been served, the contractor will return all classified intelligence (furnished or generated) to the source form which received unless retention or other disposition instructions (see AFMAN 37-139) are authorized in writing by the Program Manager identified under Item 13 of the DD Form 254.
h. The contractor must designate an individual who is working on the contract as custodian. The designated custodian shall be responsible for receipting and accounting for all classified material. The inner wrapper of all classified material dispatched should be marked for the attention of a designated custodian and must not be opened by anyone not working directly on the contract.
i. Within 30 days after the final product is received and accepted by the procuring agency, classified intelligence materials released to or generated by the contractor, must be returned to the originating agency, through the Program Manager identified under Item 13 of the DD Form 254, unless written instructions authorizing destruction or retention are issued. Requests to retain material shall be directed to the Program Manager identified under Item 13 of the DD Form 254 for this contract in writing and clearly indicate the justification for retention and identity of the specific document to be retained.
j. Classification, regrading, or declassification markings of documentation produced by the contractor shall be consistent with that applied to the information or documentation from which the new document was prepared. If a compilation of information or a complete analysis of subject appears to require a security classification other than that of the source documentation, the contractor shall assign the tentative security classification and request instructions from the contract monitor. Pending final determination, the material shall be safeguarded as required for its assigned or proposed classification, whichever is higher, until the classification is changed or otherwise verified.
2. Intelligence material carries special markings. The following is a list of the authorized control markings of intelligence material:
a. “Dissemination and Extraction of Information Controlled by Originator (ORCON).” This marking is used, with a security classification, to enable a continuing knowledge and supervision by the originator of the use made of the information involved. This marking may be used on intelligence which clearly identifies, or would reasonably permit ready identification of an intelligence source or method which is particularly susceptible to countermeasures that would nullify or measurably reduce its effectiveness. This marking may not be used when an item or information will reasonably be protected by the use of other markings specified herein, or by the application of the “need-to-know” principle and the safeguarding procedures of the security classification system.
b. Authorized for Release to (Name of the Country(ies)/International Organization).” The above is abbreviated “REL .” This marking must be used when it is necessary to identify classified intelligence material the U.S. Government originator has predetermined to be releasable or has been released through established foreign disclosure channels to the indicated country(ies) or organization.
3. The following procedures govern the use of control markings.
a. Any recipient desiring to use intelligence in a manner contrary to restrictions established by the control markings set forth above shall obtain the advance permission of the originating agency through the Program Manager identified under Item 13 of the DD Form 254. Such permission applies only to the specific purposes agreed to by the originator and does not automatically apply to all recipients. Originators shall ensure that prompt consideration is given to recipients’ requests in these regards, with particular attention to reviewing and editing, if necessary, sanitized or paraphrased versions to derive a text suitable for release subject to lesser or no control markings.
b. The control marking authorized above shall be shown on the title page, front cover, and other applicable pages of documents, incorporated in the text of electrical communications, shown on graphics, and associated (in full or abbreviated form)‚ with data stored or processed in automatic data processing systems. The control marking also shall be indicated by parenthetical use of the marking abbreviations at the beginning or end of the appropriate portions. If the control marking applies to several or all portions, the document must be marked with a statement to this effect rather than marking each portion individually.
c. The control markings shall be individually assigned at the time of preparation of intelligence products and used in conjunction with security classifications and other marking specified by E.O. 13526 and its implementing security directives, in addition to previous Executive Orders. The marking shall be carried forward to any new format in which the same information is incorporated including oral and visual presentations.

10e.2.: Contractors will complete the customer-provided Intelligence Oversight training as required by customer requirements and will report any questionable Intelligence Activity (QIA), Significant/Highly Sensitive Matter (S/HSM), and/or Federal Crimes IAW procedures established in DoD Directive 5148.13, Intelligence Oversight, and AFI 14-104, Intelligence Oversight. For contracts involving cryptographic matters in addition to DoDD and AFI reference, USSID 18, Legal Compliance and US. Persons Minimization Procedures.
10.f.: The requirements for Special Access Programs (SAP) are established in the Air Force Special Access Program Security Directive. Requirements for Special Access Materials are indicated in attachment Special Access requirements/Procedures.
11.j.: OPSEC. The contractor shall provide operations security (OPSEC) protection for all sensitive/critical information in accordance with AFI 10-701 and the (RV/RD OPSEC Plan or specific Program OPSEC Plan). The applicable Critical Information and Indicator List (CIIL) will be provided under separate cover. It is incumbent upon the contractor to request this document via the contracting officer or directly to the OPSEC Program Office. The contractor shall describe the steps necessary to protect sensitive and Critical Program Information (CPI) to their staff and communicate any sensitivity to the government for the work they complete. The contractor will include OPSEC awareness, Program Protection, and Counter Intelligence education and awareness training to all personnel as part of their standard security program on an annual basis. New contracted employees shall be trained within 90 days. Technology Protection unique security measures may apply. The contractor must also adhere to any Program Protection Plans (PPP) that may cover the protection of sensitive and/or CPI under their respective contract. On-site/on-base contractors will participate in the ongoing efforts and requirements laid out by the PRS OPSEC Program and Program Protection Lead.
Items intended for public release shall be processed through the internal AFRL RD/RV review process (OPSEC Tool). Final approval must occur prior to release outside of government channels. Items submitted to the OPSEC Tool must derive from a government representative if being released by a DoD contractor. Unclassified information does not equal publically releasable. All information deemed CUI or unclassified must be marked according to the originating office's instructions and AFI 61-201.
FOIA requests for information are to be worked by the government Office of Primary Responsibility (appointed by the 377th FOIA Office) and the AFRL FOIA office. An OPSEC assessment will be completed on all information being released via the FOIA.
Proprietary information must be protected in accordance with non-disclosure and other applicable contractual (if any) agreements.

10.f. User Agency Program Managers have exclusive security oversight for all Special Access Program material released or developed under this contract. Defense Counterintelligence and Security Agency (DCSA) retains security oversight responsibility for all Non-SAP material released or developed under this contract off government installations.
Defense Counterintelligence and Security Agency (DCSA) is relieved of inspection responsibility for portions performed on Kirtland AFB more than 90 days a year. AFRL/RDOSC has security oversight for collateral work conducted on Kirtland AFB at the Phillips Research Site. The servicing security activity (SSA), AFRL/RDOSC, will maintain oversight, control and supervision of the contractor's work performance at Kirtland AFB, NM.
Security oversight and inspections for Special Access Programs will be provided by OSI PJ, or other organizations as appropriate
