STATEMENT OF WORK

1. Scope The scope of work is to provide 7,000 gallons of #2 Diesel Fuel Oil Clear for the Bureau of Indian Affairs, Cheyenne River Agency in Eagle Butte, South Dakota.

Preferable delivery time will be during normal working hours, Monday through Friday, 8:00 am to 5:00pm Mtn. (Except Holidays)

2. Description of Task Delivery of 7,000 gallons of #2 Fuel Oil Clear to Cheyenne River Agency Transportation Department

Planning:

Fuel will be delivered to the following location:

BIA, Cheyenne River Agency, Br. of Transportation 2011 Willow Street Eagle Butte, SD 57625

Place of Performance:

Fuel oil will be delivered to 10,000 gallon above ground fuel storage tank.

3. Special Requirements

Tribal Business Licensing The Cheyenne River Sioux Tribe (CRST) requires that businesses operating on the reservation attain and maintain a tribal business license. The vendor and their subcontractor(s) shall be responsible for complying with these requirements. Licensing is governed by the CRST Revenue Department.

4. Inspection and Acceptance Inspection and acceptance of services shall be performed by the Agency POCs.

5. Correspondence To promote timely and effective administration, correspondence shall be subject to the following procedures:

Technical correspondence where technical issues relate to compliance with the requirements herein shall be addressed to the Agency POC with an information copy (Cc)to the Contracting Officer.

All other correspondence, including invoices, that which proposes or otherwise involves waivers, deviations, modification of the requirements, or terms & conditions, shall be addressed to the Contracting Officer with an information copy (Cc) to the Agency POC.

6. Non-payment for Unauthorized Work No payments will be made for any unauthorized supplies or services or for any unauthorized changes to the work specified herein. This includes any services performed by the vendor of their own volition or at the request of an individual other than a duly appointed Contracting Officer. Only a duly appointed Contracting Officer is authorized to change the specifications, terms, and conditions under this effort.

7. Contractor Interfaces The contractor and subcontractors may be required, as part of the performance of this effort, to work with other contractors working for the Government. Such other contractors shall not direct this contractor or their subcontractors in any manner. Also, this contractor and their subcontractors shall not direct the work of other contractors in any manner.

No personal services shall be performed under this contract. No contractor employee shall be directly supervised by the Government. If the contractor believes any Government action or communication has been given that would create a personal services relationship between the Government and any contractor employee, the contractor shall promptly notify the Contracting Officer of this communication or action.

The contractor shall not perform any inherently governmental actions under this contract. No contractor employee shall hold themselves out to be a Government employee, agent, or representative. No contractor employee shall state orally or in writing at any time that they are acting on behalf of the Government. In all communications with third parties in connection with this contract, contractor employees shall identify themselves as contractor employees and specify the name of the company for which they work.

8. Technical Direction Technical direction provided by the Agency POC shall be within the general scope of this effort. The Agency POC does NOT have the authority to and may NOT issue any technical direction which:

a. Constitutes an assignment of work outside the general scope;

b. In any way causes an increase or decrease in cost or the time required for fulfilment of this Order

c. Changes any of the terms, conditions, or other requirements of this effort; and

d. Suspends or terminates any portion of this effort.

A warranted Contracting Officer is the only individual with the authority to financially obligate the government and modify terms and conditions of this contract. The vendor shall be responsible for notifying the Contracting Officer of any potential issues or concerns - technical, scope or financial - concerning this contract.
