1. General

1.1. Scope of Work. This is an Indefinite Delivery, Indefinite Quantity (IDIQ) contract for construction at US Army Garrison Carlisle Barracks. The Contractor (KTR) shall provide all materials, equipment, and personnel necessary to accomplish the multidisciplinary work for a broad range of maintenance, repair, and minor construction work. Each Task Order shall vary in size and complexity and will include tasks in a variety of trades to include interior finishes, carpentry, drywall, structural steel, mechanical, HVAC, excavating, interior and exterior electrical, high voltage electrical, plumbing, painting, paving, concrete and masonry. All work performed by the KTR shall be in strict accordance with all the terms, clauses, conditions, general and special contract requirements, specifications, attachments, etc., contained herein or incorporated by reference. In addition, the KTR shall furnish ancillary professional engineering services in cases where required per the line item in the Construction Task Catalog (CTC), and shall provide as-built drawings in .dwg format, which conform to the Directorate of Public Works’ (DPWs) Computer Aided Drafting and Design (CADD) software. All work performed by the KTR shall be in strict accordance with current, published industry and trade organization standards, adopted building and other applicable codes and standards, Carlisle Barracks requirements (i.e., fire department and environmental requirements). As new standards and codes are published, they will become the mandatory reference criteria incorporated, and control subsequent work performed under this contract, without requirement of further notice or negotiation.

1.2. eGordian Group Construction Task Catalog. The eGordian CTC and eGordian JOC Management Tool is the estimating software to be used with this contract. Job Order Contract (JOC) CTC, modified for Carlisle Barracks, Pennsylvania, is the pricing catalog to be used for all Task Orders (TO). The CTC contains:

1.2.1. Unit pricing data to be used by the KTR in development of price proposals for each TO.

The pricing data is presented as basic items and as price adjustment modifiers to the basic item.

1.2.2. Descriptions of work to be accomplished for each line item, in the unit of measure specified.

1.2.3. Divisions 01 through 43 that are applicable to Divisions 01 through 43 of the JOC Technical Specifications.

1.2.4. Unit prices for demolition include all labor, equipment and material required for the complete removal of the items; clean-up of the area; and transporting the demolished items up or down 2 stories into a truck, dumpster, or to an owner designated area, located within 125' of the project sites. Unit prices for demolition exclude costs for hauling, dump fees, dumpsters, and trash chutes, these items will be a separate line-item.

1.3. Technical Specifications. The purpose of specifications is to furnish concise standards for work and/or materials used in the maintenance and repair, or construction of Government facilities. The specifications will be used to define and enforce minimum requirements during the construction phase of each order. The Technical Specifications to be utilized under this contract for construction/ renovation of military facilities shall consist of the following:

1.3.1. Unified Facilities Guide Specifications (UFGS). These specifications may be accessed on the Internet at http://www.wbdg.org/ccb/browse_cat.php?c=3. These Specifications are numbered and organized by the Construction Specification Institute's (CSI) Master Format. The KTR shall note however, that there is not necessarily a direct correlation between a particular specification number and a particular UFGS number (e.g., UFGS 26 60 13 40 Low-Voltage Motors, and CTC Section for Motors), so the content of each applicable specification and CTC section will be reviewed for logical and reasonable applicability. These specifications may be further supplemented with industry specifications, and result in no additional cost to the Government, provided that in the Government’s view the supplemental specification supports and does not conflict with or clearly exceed the work described in the applicable CTC line item(s).

1.3.2. Industrial/ Commercial Specifications. Specifications written by standards organizations (ASTM, ISO, CEN, etc.), trade associations, corporations, or others to define an explicit set of requirements to be satisfied by a specific material, design, product, or service may be used in the absence of applicable UFGS specifications. However, installation of all products and equipment shall conform to the specific product/ equipment manufacturer’s instructions.

1.3.3. Job Order Contract CTC and Technical Specifications. All work shall be accomplished per the line-item descriptions contained in the CTC and in accordance with the JOC Technical Specifications, which furnish concise industrial and/ or commercial standards for construction, maintenance, and repair of Government facilities.

1.3.4. Statement of Work, Site Visit Memorandum and Project Drawings. Government provided Statement of Work (SOW), project site visit and Government furnished project drawings (when provided) shall establish minimum requirements for construction. Conflicts, omissions, or items that are unclear shall be brought to the attention of the Contracting Officer’s Representative (COR) during the proposal stage. All work performed shall be in accordance with these documents.

1.4. Contractor Responsibility. The KTR's work and responsibility shall include all planning, programming, administration, and management necessary to provide work as specified. The work shall be conducted in accordance with the contract and all applicable Federal, State, and local laws, regulations, codes, or directives, to include applicable documents listed. The KTR shall ensure that all work meets critical reliability rates or tolerances specified or included in applicable eGordian Technical Specification, SOW and Government supplied drawings. The KTR shall perform all related KTR administrative services necessary to perform the work including, but not be limited to, the following: supply, quality control, KTR financial control, and maintenance of accurate and complete records, files, and libraries of documents to include Federal, State, and local laws, regulations, codes, technical manuals, and manufacturer's instructions and recommendations. The KTR shall provide related services such as formatting data for automated systems inputs and database maintenance, preparing and providing required reports, compiling historical data, performing administrative activities, and submitting necessary information as specified. The KTR shall be responsible for making an onsite review of the site where the work is to be performed, prior to the start of any work, list any damaged areas and turn them into the COR, to preclude any responsibility for damages present that are not a result of the performance of work required in the TO. Any other damages found after the work is completed will be investigated by the COR. If caused by the KTR, damages shall be corrected by the KTR at no additional cost to the Government.

1.4.1. The KTR shall commence all operations required by the contract as of the first day of the contract period. Therefore, on the initial day of performance, the KTR shall provide a work force which is fully qualified and capable of performing all work required under this contract. Prior to contract start date, the Contracting Officer (KO) will provide, to key KTR management and supervisory personnel, an orientation to properly familiarize the KTR and KTR's key personnel with the installation facilities and pertinent regulations.

1.4.2. Transition Period. During the twenty (20) working days prior to contract start, the KTR's key personnel shall be available to process TO or TO estimate requests to be executed on contract start date. The cost for this staff shall be included in the KTR’s coefficient bid item.

1.4.3. Start-Up Period. Prior to contract start date, the KO will provide, to key KTR management and supervisory personnel, orientation to properly explain the work and familiarize the KTR and KTR's key personnel with the installation facilities and pertinent regulations. The KTR is responsible to orient or train all KTR personnel at the KTR's own expense.

1.5. Real Property Maintenance Activities (RPMA) Organization.

1.5.1. Directorate of Public Works. The DPW acts as the Commander's installation principal staff officer, for all matters pertaining to facilities engineering activities, and plans, programs, prioritizes, and coordinates all facilities engineering activities, including Real Property Maintenance Activities (RPMA), and Government buildings & structure repairs.

1.5.2. Contract Management. The Contract will be managed by Mission Installation Contracting Command (MICC), Carlisle Barracks PA. The KO will appoint a KOR to direct, supervise, coordinate activities required under the contract, and to inspect the KTR’s performance.

1.6. Guaranteed Minimum. The guaranteed minimum quantity of work which will be required under this contract for TOs, will not be less than One Hundred Fifty Thousand Dollars ($150,000) for the basic contract period and One Hundred Fifty Thousand Dollars ($150,000) for each of the (4) remaining option years that the option is exercised. The estimated maximum dollar value of the contract is Three Million Five Hundred Thousand Dollars ($3,500,000) for the first 12-month period and Three Million Five Hundred Thousand Dollars ($3,500,000) per year for each of the four (4) years that the option is exercised. Bonding must be sufficient to cover the stated estimated annual maximum contract value. All costs associated with bonding (specifically including bond premiums) shall be included in the coefficient.

2. Definitions and Acronyms

2.1. Definitions As used throughout this contract, the following terms shall have the meaning set forth below:

2.1.1. Coefficient. “Coefficient” means a numerical factor that represents costs (generally indirect costs) not considered to be included in “CTC” unit prices (e.g., general and administrative and other overhead costs, insurance costs, bonding and alternative payment protection costs, protective clothing, equipment rental, sales tax and compliance with tax laws, and also KTR’s profit). Coefficients proposed by offerors are multiplied times the unit prices in the CTC to price a job or project on individual orders. Coefficients shall be expressed in decimal format (1.0 = 100%). The coefficient(s) proposed by the offeror and accepted by the Government are incorporated in the JOC.

2.1.2. Complete, In-Place Construction. Work having all necessary or normal parts, elements, components, appurtenances, and/or steps provided at its specified location resulting in products that are fully functional, without the need for additional labor, materials, and/or equipment to reach it’s fully functional and useable state.

2.1.3. Construction Task Catalog (“CTC”). The CTC is a comprehensive listing of specific construction related tasks published by Gordian, together with a specific unit of measurement and a unit price. This pre-established source of Unit Prices is to be incorporated within the JOC as the base prices for all Pre-Priced work items within the contract. CTC price is adjusted by coefficients to derive a total price for each Job Order.

2.1.4. Contracting Officer (KO). A person duly appointed with the authority to enter into and administer contracts on behalf of the Government.

2.1.5. Contracting Officer’s Representative (COR). An individual designated in writing by the KO to act as an authorized representative of the KO to perform specific contract administrative and execution functions.

2.1.6. Contractor (KTR). The JOC KTR who has contracted with the government that is responsible for the acceptable performance of all work under a JOC.

2.1.7. KTR Planner/ Estimators. KTR planner/ estimators who develop Price Proposals in response to TO RPFs shall use the CTC Estimating procedures, commonly referred to as the Big Note.

2.1.8. Statement of Work (“SOW”). A document setting forth the work the KTR is obligated to complete for a particular TO. The SOW includes a narrative description of the work, as well as partial design documents or full design documents, as necessary.

2.1.9. Directorate of Public Works. The DPW acts as the Garrison Commander's installation principal staff officer for all matters pertaining to facilities engineering and housing activities. This directorate plans, programs, prioritizes, and coordinates all facilities engineering and housing activities, including RPMA, and Government buildings & structure repairs.

2.1.10. Hazardous Materials. Refer to hazardous and toxic materials/substances included in Sub-parts H and Z of 29 CFR 1910 and to others as additionally defined in Fed. Std. 313. Those most encountered material include asbestos, polychlorinated biphenyl’s (PCB), solvents, petroleum and paints but does include others. The most likely products to contain asbestos are sprayed-on fireproofing, floor tile, insulation, siding, roofing, boiler lagging/gaskets, and pipe covering.

2.1.11. Incidental Scope Documentation Services. KTR provided services to assist in documenting the SOW, including sketches, minor calculations, shop drawings, and material specifications. The cost of these services is included in the KTR’s Coefficient.

2.1.12. Task Order (TO). A project-specific authorization to accomplish the work. Multiple TOs may be issued to the JOC KTR throughout the term of the contract.

2.1.13. TO Completion Time. Each TO shall set forth the TO Completion Time which is the amount of time allotted for the KTR to complete the SOW.

2.1.14. Job Order Contracting. A type of indefinite delivery / indefinite quantity (IDIQ) construction project delivery method. Contract pricing includes a combination of pre-established unit prices and competitively bid coefficients. JOC is an acronym for Job Order Contract.

2.1.15. Task Order Request for Proposal (RFP). The KO’s notification to the KTR of an upcoming project, the RFP is a document sent to the KTR requesting the KTR to prepare a Price Proposal Package for the Detailed Scope of Work of a specific Job Order. The Request for Proposal will contain the SOW, and the requested timeline and dates for accomplishment of the work.

2.1.16. Task Order Work Schedule. The KO will recommend a timeline for completion of each TO. The KTR shall submit a Task Order Work Schedule as a component of each TO Proposal. As with the Price Proposal, the Work Schedule must be mutually agreed upon prior to authorization of a TO.

2.1.17. JOC Contract. all work and obligations required of the KTR under the terms of this contract including providing construction bonds, developing Task Orders, performing work, paying subcontractors etc.

2.1.18. Joint Scope Meeting. A meeting at the site of the proposed work during which the Project Manager, KTR, and appropriate other stakeholders to determine the SOW to be performed and other issues related to the Project.

2.1.19. Non-Prepriced Task. A unique item or unit of work that is not easily defined within the CTC or not included in the CTC but is within the SOW and intent of a TO and for which the pre-priced cost data will not be appropriate to be used in TO pricing.

2.1.20. Normal Working Hours. The hours of 7:00 a.m. until 4:30 p.m. Monday through Friday, except Holidays.

2.1.21. Notice to Proceed (NTP). The written direction from the government for the KTR to commence performance on a TO.

2.1.22. Option-Year Coefficient(s). This coefficient will be used only if or when the Government exercises the option year clause within the contract. Coefficient(s) for option periods serve as an economic price adjustment to the KTR’s indirect costs. Direct costs of materials, labor, & equipment shall be adjusted by the incorporation of the latest Gordian CTC cost data in each subsequent option year.

2.1.23. Other Than Normal Working Hours. This is an optional coefficient that will be used only when the Government specifies the requirement to complete a project during non-standard hours.

The hours of 4:30 p.m. until 7:00 a.m. Monday through Friday, and anytime Saturday, Sunday, and Holidays.

2.1.24. Pre-priced Task. A unit of work that is included in the CTC and for which a unit price has been established. This includes all work which may be described with a line item or combination of line items within the CTC.

2.1.25. Task Order Price Proposal Package. The KTR’s firm fixed price proposal for an individual TO based upon the Project Description, SOW, sketches/ design drawings and other information contained within the RFP. The Price Proposal shall include a quantified list of all line items of work that are necessary for completion of the project. The KTR prepared package that contains (1) the KTR’s Price Proposal; (2) a proposed Work Schedule for completing the work; (3) drawings, sketches or other Incidental Scope Documentation Services; and (4) other required submittals, such as catalog cuts, technical data, and material samples. The Price Proposal shall include all applicable Task Order Coefficients and shall be mutually accepted by the Government prior to TO authorization.

2.1.26. Project. All construction work required by a Contractor to accomplish a specific and identified work requirement or distinct construction objective, which may be comprised of one or more TOs.

2.1.27. Project Manager. The KTR’s construction project manager responsible for a Project and/ or a TO.

2.1.28. Quality Assurance. Those actions taken by the Government to assure that the quality of purchased work is acceptable and in accordance with the specified requirements of the contract/

TO.

2.1.29. Quality Control. Those actions taken by the KTR to control the execution of the specified work so that it meets the requirements of the contract/ TO.

2.1.30. Supplemental Task Order. A TO issued to add or delete work from an existing, related TO.

Commonly referred to as a MOD, a supplemental TO must contain a SOW, a price proposal, a revised schedule, and a complete proposal package prior to acceptance.

2.1.31. Task Order. Identifier for each awarded project action under this contract. The project-specific written obligation document under the Job Order Contract. Each individual Project will be accomplished through the issuance of one or more TOs. Multiple TOs may be issued to the JOC KTR throughout the term of the contract. Each TO will reference a SOW and state a firm fixed price (Task Order Amount), time duration for the completion of the Work (Task Order Completion Time), and any special conditions that might apply to that specific TO, such as liquidated damages or applicable wage determinations. The TO, together with the NTP, authorizes the KTR to begin construction on a TO.

3. Management and Personnel.

3.1. General. The KTR shall designate a Project Manager and provide written notice of such designation to the COR. The Project Manager shall conduct overall management coordination and shall be the central point of contact with the Government for performance of all work under the contract. A Site Superintendent/ Foreman (KTR employee) shall be designated to act for the Project Manager when work is being performed during the Project Manager’s absence or at hours other than those listed above. The KTR shall provide written, 48-hour advance notice of such designation to the COR. The Project Manager, and any individuals designated, shall have full authority to bind the KTR contractually for prompt action on matters pertaining to execution of the contract. The Project Manager and any individuals designated shall be able to understand, speak, read, and write the English language. The KTR shall submit a Management Plan (See Deliverable Schedule) with the proposal that reflects an understanding of all tasks specified and describes an approach to satisfy these requirements. As a minimum, the plan shall include management of all resources, i.e. equipment and staffing plan. The KTR shall submit a complete report on the Management of sub-contractors in his past construction contracts. The KTR shall submit a list of sub-contractors, with addresses and telephone numbers of sub-contractors he has engaged to work on construction projects. A current copy of the Management Plan shall be provided to the KO and COR on the contract start date and thereafter as changes occur, at a minimum annually. The plan shall be implemented on the contract start date. The KTR shall not hire off-duty or former Government employees whose employment would result in a conflict with the Joint Ethics Regulation.

3.2. Personnel. The KTR shall provide necessary personnel to accomplish all contract work within specified time frames. All personnel shall be legal residents of the United States. The

KTR shall submit, within five (5) calendar days of contract award, in writing to the COR, a current copy of an organization chart and identify personnel proposed to perform the contract requirements (See Deliverable Schedule); and any changes within five (5) working days of the change. The KTR shall submit a monthly report to the COR that identifies positions and the current employee responsible for performing that function.

3.3. Contractor In-House Workforce. The KTR shall perform on the site, and with its own in-house workforce, work equivalent to at least 15 percent of the total amount of work to be performed under the contract.

3.4. Contractor Employee Compliance. The KTR shall ensure that KTR employees observe and comply with all local installation and higher headquarters' policies, regulations, and procedures concerning fire, safety, environmental protection, sanitation, security, traffic, parking, flag courtesy, “off limit” areas, and possession of firearms or other lethal weapons.

3.5. Conduct of Personnel. The KO may require the KTR to remove from the job site any employee working under this contract for reasons of misconduct, security, or found to be or suspected to be under the influence of alcohol, drugs, or other incapacitating agent. Such removal from the job site shall not relieve the KTR of the requirement to provide sufficient personnel to perform the services as required by the contract.

3.6. Qualifications/ Certifications. The KTR shall submit, within five (5) working days of contract award, in writing to the KO and COR, the individual(s) tasked as key personnel who will execute the work that may be awarded under this contract and provide a summary of the minimum acceptable qualifications and experience (See Deliverable Schedule). Any changes to the working status of these key personnel shall be transmitted to the KO and COR within five (5) working days of the change. Key personnel include the following: Project Manager, Deputy Project Manager/ Superintendent, Quality Control Manager, and those individuals responsible for managing the work in each functional area of the contract.

3.7. Planner/ Estimators. KTR planner/estimators who accomplish job cost estimates for indefinite quantity work shall use the JOC CTC Estimating procedures.

3.8. Equipment Operators. The KTR shall maintain records of licenses and other required qualifying documentation of KTR personnel operating construction equipment/ vehicles. The Government has the right to review these records at any time.

3.9. Specialized Training Requirements. The KTR shall require employees performing task that are commonly recognized as requiring specialized training or experience to be trained/ certified in the appropriate tasks. Examples of these task include, handle asbestos, handle hazardous materials, high voltage electrical work, confined space entry or other tasks as required.

3.10. Identification of Employees.

3.10.1. Common Access Card (CAC). The KTR Project Manager, Deputy Project Manager/ Superintendent, QC Manager shall be required to obtain a CAC issued by the government. The COR will electronically forward the form to the KTR. Each KTR employee is required to electronically fill out the CAC request form within five (5) working days of contract award.

Once the form is properly filled out, the COR will verify that they are authorized and required to have a CAC. The KTR employee will be directed to go to the designated in-processing facility and obtain the CAC. Failure, inability, or delay in obtaining the CAC does not relieve the KTR from performing under the terms of the contract. Should an employee leave prior to the contract expiration, the KTR is responsible for ensuring the employee turns-in their CAC at that time.

Any new CAC required employee shall the CAC request form to the COR within five (5) working days of the change.

3.10.2. Contractor ID. The KTR shall be responsible for furnishing to each employee, and for requiring each employee to display or possess appropriate identification. The KTR shall provide each employee at minimum logo shirt or identification (ID) badge on contract start date or on employment start date. The ID badge shall be made of nonmetallic material to prevent electrical shock. The ID badge shall be easily readable and include the employee’s name, KTR’s name, and color photograph. The logo shirt shall include the KTR’s name, employee’s last name. If the logo uses stylized lettering, a separate KTR’s name shall be printed on the shirt to ensure legibility when read. Sub-contractor employees are required at minimum to have a logo shirt type identification. The use of a high visibility vest with the same information is also acceptable form of identification.

3.10.3. Display of ID Badges. KTR personnel shall always wear the ID badge/ logo shirt unless it presents a safety hazard. ID badges shall be worn when performing work under this contract to include attending Government meetings and conferences. Unless otherwise specified in the contract, each KTR employee shall wear the ID badge in a conspicuous place on the front of exterior clothing and above the waist except when safety or health reasons prohibit such placement.

4. Contingencies. Sudden or unusual events could result in a great impact upon KTR performance and contract requirements. If an unusual condition develops, the KTR shall continue, and expand performance if necessary. In all cases, the KTR shall assume that the Army cannot provide any supplemental forces and continue to need the same or additional performance under contract, which the KTR shall be required to meet.

4.1. Examples of Contingency Events:

4.1.1. A sudden build-up of military forces that increases contract requirements.

4.1.2. A natural disaster that impacts upon the KTR's ability to perform.

4.1.3. A labor strike that impacts upon the KTR's ability to perform.

4.1.4. Special circumstances identified by the KO.

4.2. Contingency Plan. The KTR shall submit with the proposal an outline covering the methods the KTR will use to meet the contract requirements in the above-cited emergencies. Upon award the plan shall be submitted (See Deliverable Schedule). After award, this plan shall be formalized and submitted to the KO for approval prior to start of work.

5. Quality Control (QC). The KTR shall establish and maintain a quality control program that has been reviewed/ accepted by the Government for compliance with contract specifications and in accordance with the inspection system required IAW FAR clause 52.246-12 entitled the "INSPECTION OF CONSTRUCTION" clause, Section E. The KTR shall submit a Draft copy of the QC Plan with the KTR’s Proposal. Acceptance, in part, of the program shall not be construed to mean acceptance of the program in total. Work will only be permitted after review of the quality control plan, or at least a review of that portion of the plan applicable to the specific features of work. The final QC Plan shall be submitted to and approved by the KO and COR within twenty (20) working days of contract award, and changes/ revisions made (See Deliverable Schedule). All work shall conform to the referenced Clauses, Technical Specifications and Manufacturers Recommendations. When there is a question the most stringent shall apply.

5.1. Quality Control Plan. The KTR's QC Plan shall include a separate section that addresses the KTR's proposed method of managing quality of Individual TO work. The plan shall include, but not limited to the following:

5.1.1. The KTR's organizational structure.

5.1.2. The names and minimum acceptable qualifications of individuals tasked to perform inspections and the extent of their authority. Their functional role shall be depicted in the organization chart. No lead person or first line supervisor shall be considered a QC Manager.

5.1.3. Frequency and manner which inspections are to be conducted.

5.1.4. Method of identifying deficiencies in the quality of work to be performed before the level of performance becomes unacceptable.

5.1.5. Method of documenting and enforcing quality control operations of both prime and sub-contractor work, including inspection and testing.

5.1.6. Key control as required by paragraph C.9.

5.1.7. Special safety equipment/ clothing required. The KTR shall provide all supplies, tools, and clothing (including personal protective clothing and equipment for KTR employees when required by OSHA regulations, 29 CFR 1910, SUBPART I) required to meet the terms of the contract.

5.1.8. Detailed specifics as to how the KTR shall ensure that all personnel take required safety precautions when working with steam, chemicals, electricity, vehicles, power tools, welding equipment, etc., and when entering or working in confined spaces.

5.2. Contractor Quality Control Organization/ Staffing. The QC staff shall be functionally separate from the KTR's production or supervisory staff. The organization shall include, but not be limited to, a full-time QC Manager, responsible for managing the KTR's QC & Safety Programs, and to meet contract and project specifications quality requirements. This responsibility includes but is not limited to ensuring inspections are planned and accomplished for all work under construction to ensure compliance with contract requirements, and developing and maintaining QC files and reports. QC personnel shall be a part of the prime KTR's staff and not members of the staff of a sub-contractor. The QC personnel shall be empowered to direct KTR and/or sub-contractor personnel to correct deficiencies. For line items that require inspection and if the QC manager lacks the experience or training, the KTR will utilize qualified third-party inspection sub-contractor. All QC operations are part of the KTR coefficient.

5.2.1. Quality Control Manager. The QC Manager shall possess the following minimum experience and/or training. Formal QC education and/or experience in building construction inspection. A minimum of five years’ experience as a QC manager and/ or senior QC inspector in the building construction industry.

5.3. QC Files and Reports.

5.3.1. Files. The KTR shall maintain a file of all inspections and/ or tests conducted by the KTR to include any corrective actions taken. This file shall be subject to review upon demand by the Government.

5.3.2. Reporting. The KTR shall submit a Weekly Quality Control Summary (See Deliverable Schedule) to the COR by 10:00 a.m. each Monday (or Tuesday if Monday is a Government holiday) for each on-going TO. The report shall cover each TO that have been given a NTP and it shall address KTR activities for each day of the covered week, regardless of performed work. The reports submitted shall address the work performed the previous week to the date of submission. The report shall include dates covered by the report, and date of submission; project name and task order number; estimated overall project completion status (%); and a thorough narrative of work performed each day and issues encountered and their resolutions during the week, names of KTR/ sub-contractor personnel working on site; weather conditions, and applicable QC and/ or progress photographs to support statement of progress and balance of narrative. The report narrative shall be in sufficient detail to fully describe work accomplished on any given day during the covered week. Reports submitted that are considered insufficient or inaccurate will be returned to the KTR at the joint QC/ project management meeting with the requirement for correction and resubmission by COB that day.

5.4. Joint QC/ Project Management Meeting. Bi-Weekly the KTR shall meet with the Government to discuss on-going project reporting, performance, and quality issues. The COR may require formal/ informal meeting at greater frequency on any TO if the COR believes additional oversight is required. Minimum attendees for this bi-weekly meeting are: KO or designated Contract Specialist (Optional), COR, KTR Project Manager, and KTR QC Manager.

Any requirements identified for action during this meeting shall be recorded, and suspense established for accomplishment. Failure to satisfy an identified tasker from this meeting by the identified suspense shall be addressed at the meeting immediately following the applicable suspense.

5.5. Acceptance. The work and any construction performed shall be accepted only when in full compliance with the contract specifications, applicable Clauses, and the SOW. The QC Plan shall be subject to acceptance throughout the term of the contract. The KTR shall notify the KO/ COR of any proposed change to the QC program. No change shall be implemented prior to review and approval of the change by the KO/ COR.

6. Other

6.1. Installation Closures. When an unforeseen installation closure occurs on a regularly scheduled day of work, the Government will have the following options:

6.1.1. Reschedule the work to be performed the following day unless the following day is a Saturday, Sunday, or a legal public holiday and routine work is not scheduled for that day.

6.1.2. Reschedule the work on any day mutually agreed upon by the Government and the KTR.

6.1.3. No additional payments will be due the KTR for unscheduled closures. Additional time to accomplish the TO will be granted to coincide with the days of installation closure.

6.2. Hours of Operation. All work shall be accomplished during normal duty hours from 7:00 am to 4:30 pm, Monday through Friday (excluding federal government holidays). The KTR shall also perform work outside of normal working hours as directed by the KO. Work required outside normal duty hours will be specified prior to TO award.

6.3. Federal Holidays. Except as otherwise specified, routine work shall not be scheduled on holidays or holidays observed in lieu thereof. Federal Government holidays are:

6.3.1. When one of the above designated Federal holidays falls on a Sunday, the following Monday will be observed as a Federal holiday. When a Federal holiday falls on a Saturday, the proceeding Friday is observed as a Federal holiday. See Federal Holidays (opm.gov) for a complete listing of observed Federal Holidays.

6.4. Key Control. The COR is the only persons authorized to issue keys to the KTR. Building Manager or building occupants are not authorized key issuers. The KTR shall establish a control system to ensure that keys issued are not lost, misplaced, or used by unauthorized persons.

Government keys shall not be duplicated by the KTR. Procedures developed to control Government keys shall be included in the KTR's QC Plan. The KTR shall comply with FM

3419.30 and AR's 190-13 and 190-51, applicable to key and lock control.

6.4.1. The KTR shall reimburse the Government for replacement of locks or for re-keying required because of KTR losing any key. In the event a master key is lost or duplicated without authorization, all locks and keys for that system shall be replaced at the KTR’s expense.

6.4.2. The KTR shall report to the COR any occurrence of a lost key within one hour of discovery of the loss.

6.4.3. The KTR shall prohibit the use of Government issued keys by any person other than authorized KTR employees. The KTR shall not permit entrance to locked areas to any person other than KTR personnel engaged in the performance of work in those areas, or personnel assigned to the activity where the KTR is performing work, without written authorization by the COR. The KO/ COR shall always be allowed access to any KTR controlled point providing entry to any Government owned property at any time.

6.5. Administrative Office Areas. TO may require work in buildings with Government personnel working in office areas during working hours. KTR work shall not unduly interfere with Government work in the area. In the event a Government building supervisor so requests, the KTR shall temporarily cease work in the area and report the instructions, to include name of the Government person involved, to the KO and COR immediately by the most expedient means.

7. Security, Safety, Anti-Terrorism Emergency Services.

7.1. General. This standard language is for KTR employees with an area of performance within an Army-controlled installation, facility, or area. The KTR and all associated sub-contractors’ employees shall comply with applicable installation, facility, and area commander installation and facility access and local security policies and procedures, including but not limited to;

Information Security Program, ADP and DoDIIS Programs, Physical Security Program, and Industrial Security Program per AR 350-1. The KTR shall also provide all information required for background checks to meet installation access requirements to be accomplished by the installation Provost Marshal Office, Director of Emergency Services, or Security Office. The KTR workforce must comply with all personal identity verification requirements as directed by Department of Defense (DoD), HQDA, and local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in KTR security matters or processes. The KTR shall submit to the COR the name and address of each employee working under this contract within five (5) working days after contract award/ prior to the start of work, and fill out questionnaires or other forms as may be required for security purposes, as required by Industrial Security Manual, DOD 5220.22-M.

7.1.1. The KTR shall comply with all applicable DOD security regulations and procedures during the performance of this contract. The KTR shall not disclose and must safeguard procurement sensitive information, computer systems and data, privacy act data, and Government personnel work products that are obtained or generated in the performance of this task order. All contract employees must adhere to the Carlisle Barracks guidelines for Security, Force Protection, Information Disclosure, and Conduct.

7.1.2. At all times during the performance of work within a facility, the KTR and its employees shall remain cognizant of the security restrictions existing within the facility. The KTR’s employees shall ensure that any doors, windows, or access panels which may have been opened for them during the course of the work period are secured at the end of the day. Circumstance which appears unusual, unhealthy, or otherwise hazardous shall be reported to the COR immediately.

7.1.3. It is the responsibility of the KTR to obtain entrance clearances for all KTR personnel working on DOD installations and facilities. The installation/ facilities will honor all reasonable requests for entrance clearances of essential KTR staff members working at installations, conditioned only upon presentation of proper credentials and in conformance with the installation security regulations. The KTR shall ensure that all access is conducted in a manner to minimize interference with military operations at the installation/ facility.

7.2. Gate & Visitor Center Access

7.2.1. The KTR shall submit a CBKS form 228 – Carlisle Barracks Installation Access Control Application for each KTR and sub-contractor employee requiring access under this contract. The KTR shall submit the application to the COR for signature, once returned the KTR shall submit the forms to the Visitor Center for processing. The CBKS form 228 has electronic signatures for the COR. The preferred method of submitting to the COR for signature prior to submitting to the visitor center for processing via email.

7.2.2. All KTR, sub-contractor, delivery vehicles at 2 ½ ton or larger must go through the truck lane at the Claremont Access Control Point. The driver must have the Registration, Insurance Card and a Bill of Lading if delivering anything. The vehicle will be inspected and then parked for the driver to proceed to the Visitor Center to get their background check and issue a pass for up to 30 calendar days if no government sponsor signature on our CBKS Form 228. If the driver has a current pass the vehicle must still pass through the truck lane at the ACP and is subject to random inspection. Small vehicles, i.e. automobile or pickup, will proceed to the Visitor Center to obtain the pass.

7.2.3. Visitor Center hours are 07:00 to 17:00 daily Monday thru Friday. In the event the Visitor Center is closed the guard can process the background check and issue pass, the guards do not have the 228 forms. Visitor Center Phone # 717-245-3733. Website:

7.3. Facility Security Officer (FSO). The KTR shall appoint a FSO to coordinate all background investigations activity with the Defense Security Services (DSS/Industry).

7.4. Favorable National Agency Check with Inquiry (NACI). Carlisle Barracks requires all KTR personnel working at a DOD facility to have a current favorable National Agency Check with Inquiry (NACI), in accordance with AR 380-67; at a minimum a Background Investigation shall be initiated in Joint Personnel Adjudication System (JPAS).

7.5. Restricted Areas. Certain buildings and other facilities are "restricted" to the general public.

KTR personnel shall not enter any "restricted" facilities without specific permission from the COR. The KTR shall comply with restricted area procedures and instructions. KTR personnel working in restricted areas such as computer rooms shall be required to sign in and out and state the nature of business at the entrance desk. All work in restricted areas shall be coordinated with the respective area Security Officer through the COR.

7.6. Secure Areas. Portions of the work under the contract are performed in secure areas, and all persons requiring access to a secure area must possess the minimum security clearance required for access to that area and will be escorted by activity or government personnel. In the case of escort, 48 hours advance notice to the activity will be required except in emergency or urgent work. KTR employees must be free of felony convictions, and prior military service members must have an honorable discharge. No cell phones or other electronic devices will be allowed in Secure Areas.

7.7. Antiterrorism and Operations Security. In the event of a National Defense Emergency affecting Carlisle Barracks, KO or COR will immediately notify the KTR Project Manager. At that time, the KTR shall take immediate steps to cease all activities on the installation and will cause all personnel to leave the installation property until notice is given by the installation and KO or COR that National Defense Emergency conditions are no longer in effect. Also, the Mass Notification System may also be used to put out information of such emergencies. The KR shall comply with any direction given on the Mass Notification System. Once the KTR has complied with any direction the KTR will notify the KO or COR of their status and compliance with directions. Carlisle Barracks will coordinate with the KTR and adjust the milestone schedule accordingly.

7.8. Training Requirement. KTRs performing on this contract at military installations are required to conduct command and unit specific security training (Initial/Refresher INFOSEC, OPSEC, AT/FP, TARP, Etc.). All required training shall be completed within five (5) working days of contract award and within five (5) working days of new employees’ commencing performance. The KTR shall maintain certificates of completion for each affected KTR employee and sub-contractor employee. The KTR shall submit certificate within five (5) working days upon request to the COR (See Deliverable Schedule).

7.8.1. iWATCH Training. This standard language is for KTR employees with an area of performance within an Army-controlled installation, facility, or area. The KTR and all associated sub-contractors shall brief all employees on the local iWATCH program (training standards provided by the requiring activity ATO). This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the COR.

7.8.2. OPSEC Training. Per AR 530-1, Operations Security, KTR employees must complete Level I OPSEC training. At minimum the Project Manager, Superintendent, QC Manager shall perform the training. Additional training requirements for KTR employees, sub-contractor employees will be addressed in applicable TOs.
