STATEMENT OF WORK

Title: Greenhouse Panel Replacement

1. Background:

The Agriculture Research Service (ARS) is the chief in-house agency of the United State Department of Agriculture (USDA) located on Colorado State University (CSU) campus. The USDA ARS Facility department is responsible for providing an adequate and safe work environment supporting crops research and genetic resource preservation. The U.S. Department of Agriculture, Agriculture Research Service requires Greenhouse panel replacement from hail damage and warranty work related to Crops Research Laboratory (known as CRL) at 1701 Centre Avenue, Fort Collins, Colorado 80524.

2. Objective:

The intent of this solicitation is to obtain replacement and repairs to greenhouse panels under warranty for designated research projects conducted at Crops Research Laboratory (CRL). The repairs requested is to safeguard and ensure all areas maintained in a manner consistent with proper operations that support the USDA ARS mission requirements. All work shall be performed in a professional manner using equipment and techniques to meet accepted industry installation standards.

3. Scope:

The contractor shall perform full replacement of damaged roof panels on the west side of each sloped roof.

There are approximately 240 roof panels affected and will need to be remedied for repairs on the greenhouses.

Rubber seals will be reutilized when installing new panels. 1,000 linear ft. of new rubber gasket material will be required to repair or replace torn or cracked gasket material around new panels. The U.S. Department of Agriculture, Agriculture Research Service requires The Contractor shall furnish all labor, supervision, equipment, tools, transportation, and rental equipment necessary (unless otherwise specified herein) to perform the services required in accordance with commercial standards, local, state, and federal laws, and the requirements of this project.

Note: Government will furnish panel materials from manufacture but cost of shipment will be included with bid for shipping of panels.

3.1. PERIOD OF PERFORMANCE: Performance period will be for 120 days starting March 1, 2023.

3.2. Recognized Holidays. Holidays to be observed are as follows. When scheduled services fall on an observed federal holiday contractor shall perform services on next business day.

3.3. HOURS OF OPERATION: The contractor is responsible for conducting business between the hours of 0730 to 1630 hours Monday through Friday, except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. The Contractor must always maintain an adequate workforce for the uninterrupted performance of all tasks defined within this SOW when the Government facility is not closed for the above reasons.

3.4. Campus closures. When an unforeseen closure occurs on a regularly scheduled day of work, the Government shall have the following options:

3.4.1. Reschedule the work to be performed the following workday.

3.4.2. Reschedule the work on any day mutually satisfactory to both the contractor and Contracting Officer or his designated representative.

4. PREMISES TO BE SERVICED:

4.1 The work to be performed under this contract will be performed at the Crops Research Laboratory building, 1701 Centre Avenue, Fort Collins, Colorado. Approximate roof replacement is 8,200 sq. ft.

Project is defined as:

4.1.1. The contractor shall Replace damaged greenhouse panels on Greenhouses A, B, C, D, & Aisles on west sloping roofs. The Contractor shall re-utilize existing rubber gasket (glazing material) as specified Section 13123, for greenhouses A, B, C, D, and Aisles.

4.1.2. The contractor will be required to submit all materials for review prior to acceptance from the government.

4.1.3. Contractor shall supply an additional 1,000 linear feet of gasket material for torn or damaged rubber gasket material.

4.1.4. Contractor will be responsible to coordinate efforts for warranty material to be shipped to the site. If the lead time is needed, the contractor will notify the CO and request additional time related to the project. Information will be provided to the awarded vendor with warranty information.

4.1.5. The contractor shall field verify measurements of panels to ensure proper installation and correct fit of roof panels.

4.1.6. Contractor will be responsible for the cost of delivery of greenhouse panels, rubber gasket materials and any anchoring devices needed for panel installment.

4.1.7. The government has added recommendations from worksheet specification 13123 for acrylic glazing around panels. The contractor will use this document as a guide for installation and quality assurance specifications related to panel replacement.

4.1.8. 240 panels are to be replaced on the west side of greenhouses A, B, C, and D.

4.1.8.1. Greenhouse “A” requires 18 panels sizes 45”X 188”: 18- 48”X48”.

4.1.8.2. Greenhouse isle between “A and B” – 18- 36”x36”; 18- Topside panels 18- “36x48”;

Lower panels- 18- 32”x48”

4.1.8.3. Greenhouse “B” requires 18 panels- 188 ½”x 48”: small panels 18-48”x48”

4.1.8.4. Greenhouse panel “C” 18 panels – 188”x 48”; small panels 18- 48”x48” size.

4.1.8.5. Greenhouse isle between “C&D” – 22-36”x48” panels; upper panels – 22 panels – 23”x48” size.

4.1.8.6. Greenhouse “D” panels- 22- 189”x48”; top ridge panels 22-48”x48” size.

Note: Contractor shall field verify panel sizes to ensure proper fitting. Manufacturer will be required to verify warranty panels and sizes for proper fitting.

5. SCHEDULE: All work shall be carried out in accordance with the below schedule:

5.1. Coordination and Assistance between the Contractor, Contractor's personnel and Sub- Contractors, Contracting Officer, Contracting Officer's Representative, Location Monitor, and Research Personnel on the following items will keep all appropriate personnel involved to expedite this project for everyone’s benefit.

5.1.1. A Pre-construction Conference with the Contracting Officer’s Representative and government representatives are required to attend the following meetings below:

5.1.2.1. Attendees shall include the Contracting Officer, Contracting Officer's Representative, the Contractor, Contractor's superintendent, Location Monitor. Coordinate construction activities with the Contracting Officer's Representative to follow the Scheduling Requirements. Coordination meetings shall be held once a week usually, but the COR can change the time depending on the amount of activity by the Contractor. The agenda shall include milestones, challenges, and solutions since the previous meeting. The Contractor shall prepare and distribute minutes of progress meetings. No later than 3 days after each meeting, the Contractor shall provide a copy of the minutes to the CO and COR. Agenda shall include the following:

5.1.2.2. List of Attendees, by the Contracting Officer’s Representative and the Contractor.

5.1.2.3. Allowable Contractor’s use of Premises, Office, Work, and Storage areas with safety, housekeeping, and security procedures.

5.1.2.4. Contractor’s Progress Schedule and coordination items for any utility outages or hazardous material handling and storage.

5.1.2.5. Monitoring the Progress Schedule: The Contractor or the COR shall inform the CO if the Contractor is behind on the schedule, why and what is planned to get back on schedule, so the CO can take appropriate action if needed.

5.1.2.6. Correspondence between the Contractor, Contracting Officer, and Contracting Officer’s Representative shall be dated, logged, and copies kept at the originator’s office.

5.1.2.7. Due to the size of this Project, the Materials, Products, Installation Procedures, Testing Procedures, etc. shall meet commercial standards and shall be reviewed if requested by the Contractor or the Contracting Officer’s Representative requests a specific item, otherwise review will be at the Final Inspection.

5.1.2.8. Contractor’s Inspection Procedure, including field inspections and approvals with a remedial process for any deficiencies will be addressed at weekly meetings.

5.2. Government’s Quality Assurance Program of random inspections and notifying the Contractor of any noted deficiencies does not relieve the Contractor from requirements of the Contract.

6. Safety:

6.1. Contractor’s Safety Competent Person designation will be made at the Pre-Construction Conference. The contractor shall submit a Safety plan prior to start of work on location.

6.1.2. Past safety record will be used as an evaluating factor in future contracts.

6.1.3. Request a copy of any OSHA training course documentation for contractor and his/her employees.

6.1.4. All relevant PPE as dictated by the hazards present must be worn by the contractor and all employees working on the job site.

6.1.5. Possible Hazards of this Contract are:

6.1.5.1. Ladder Use.

6.1.5.2Forklift and boom lift equipment

6.1.5.3. Loading and hauling of material and debris.

6.2. Cleaning Up

6.2.1. Debris and rubbish shall be removed from the site daily. Upon the end of the workday, the entire area of the contract work shall be cleaned of all excess materials, dirt, rubbish, and debris.

6.2.2. Transportation of debris shall be in a manner as to prevent spillage on street or adjacent areas. The contractor is responsible for the removal of debris and materials on-site.

7. SUPPLIES AND MATERIALS FURNISHED BY THE GOVERNMENT: The Contractor shall maintain an adequate inventory of Government furnished supplies by giving the Contractor Officer’s Representative advance notice so that orders can be placed and received on a timely basis. The following are supplied by the Government:

7.1. Water, gas, electricity is available on the site. Protection of Existing Equipment, Utilities, and Improvements. Note: Contractor is responsible for protection and restoration if damage occurs. See Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements (FAR 52.236-9) (APR 1984) in Section H - Special Contract Requirements. Contractor’s use of Premises for sanitation, work, and storage areas with safety, housekeeping, and security procedures.

7.2. Restrooms and break areas: The government will allow access to restrooms, break areas within the facility. Contractor may supply his or her toilet facilities, wash facilities, drinking water, and all necessary disposable materials. Coordination of services will be agreed upon pre-conference meeting and location (laydown areas) for material storage.

8. SUPPLIES AND MATERIALS FURNISHED BY THE CONTRACTOR:

The government will supply warranted panels from manufacturer. Manufacture Company information is as follows: Roehm America LLC. 1796 Main Street. Stanford, Maine 04073. The Contractor shall supply any additional PPE such as nitrite gloves, goggles, and face masks. All supplies and materials shall be of a type and quality that conform to applicable Federal specifications and standards. All supplies and materials to be used in the performance of work described herein are subject to the approval of the Contracting Officer Representative (COR).

The Contractor shall maintain an adequate inventory of Government furnished supplies by giving the Contractor Officer’s Representative advance notice so that orders can be placed and received on a timely basis.

The Contractor shall utilize products and material made from biobased materials (e.g., biobased greases, biobased hydraulic fluids, biobased absorbents) to the maximum extent possible without jeopardizing the intended end use or detracting from the overall quality delivered to the end user. All supplies and materials shall be of a type and quality that conform to applicable Federal specifications and standards. All supplies and materials to be used in the performance of work described herein are subject to the approval of the Contracting Officer Representative (COR).

Biobased products that are designated for preferred procurement under USDA’s Bio Preferred program must meet the required minimum biobased content as stated in the USDA Final Rule available at www.biopreferred.gov. The Contractor should provide data for their biobased products such as biobased content. In addition to the biobased products designated by the U.S. Department of Agriculture in the Bio Preferred Program, the Contractor is encouraged to use other biobased products.

The Contractor must comply with the Agricultural Act of 2014; the Food, Conservation and Energy Act of 2008 (FCEA), 7 U.S.C. 8102; the Farm Security and Rural Investment Act of 2002 (FSRIA), 7 U.S.C.

8102; the Federal Acquisition Regulation; Executive Order (EO) 13514, “Federal Leadership in Environmental, Energy and Economic Performance,” dated October 5, 2009; EO 13423, “Strengthening Federal Environmental, Energy, and Transportation Management,” dated January 24, 2007; and Presidential Memorandum, “Driving Innovation and Creating Jobs in Rural America through Bio-based and Sustainable Product Procurement,” dated February, 2012 to provide bio-based products. Biobased products that are designated for preferred procurement under USDA’s BioPreferred program must meet the required minimum biobased content as stated in the USDA Final Rule available at www.biopreferred.gov.

The Contractor should provide data for their biobased products such as biobased content. In addition to the biobased products designated by the U.S. Department of Agriculture in the BioPreferred Program, the Contractor is encouraged to use other biobased products.

All equipment shall have bumpers and guards to prevent marking or scratching fixtures, furnishings, or building surfaces. Equipment deemed by the COR to be of improper type or design, or inadequate for the purposes intended, shall be removed from the premises, and replaced with satisfactory equipment.

Contractor shall store and preserve all cleaning solvents in accordance with commercial instructions.

All commercial markings shall remain on items for identification and medical instruction. If items should require transfer to another container, that container shall be clearly marked as to its content and its medical instructions.

9. Responsibilities:

9.1 SUPERVISION OF EMPLOYEES. Contractor shall provide for supervision of employees. Prior to commencement of services under this contract, the Contractor shall furnish to the COR a list of employees who will work on-site performing the services, and the name of the individual who will be responsible for supervision of such employees and who will function as the Project Manager. The Project Manager shall:

9.1.1. Have the Contractor’s full authority to act on matters pertaining to the performance of services.

9.1.2 Be on-site or on-call whenever work is being performed.

9.1.3Report damage to Government property, loss of keys, personal injuries and/or hazardous conditions to the COR within twelve work hours after occurrence.

10. PROPERTY. Except for reasonable wear and tear, the Contractor assumes full responsibility for and shall indemnify the Government for any and all loss or damage of whatsoever kind and nature to any and all Government property including any equipment, supplies, accessories, or parts furnished while in the Contractor’s custody and care for storage, repairs or services to be performed under the terms of this Contract, resulting in whole or in part from the negligent acts or omissions of Contractor, and subcontractor, or any employee, agent or representative of Contractor or subcontractor.

11. PERSONS. The Contractor will be responsible for any negligent or wrongful acts or omissions of the Contractor, his employees or agent’s incident to the performance of this contract. The Contractor will hold and save the Government harmless from all liability for any death or damage to all persons (other than the liability of the contract as provided under the Federal Employees Compensation Act) or to real or personal property, which results from the operation of, or incident to, equipment furnished by the Contractor. The Contractor will not be responsible for any negligent or wrongful acts or omissions of the U.S. Department of Agriculture; its employees, the U.S. Department of Agriculture’s Cooperators, or their employees.

12. LIABILITY INSURANCE. The Contractor shall maintain such insurance as will protect him/her from claims under Workmen’s Compensation, General Liability, Property Damage and from any other claims for damages for personal injury including death which may arise from operations under this Contract, whether such operation by himself or by any subcontractor or anyone directly or indirectly employed by either of them.

13. LOST AND FOUND PROPERTY. The Contractor shall ensure that all articles of possible personal or monetary value found by the Contractor’s employees on the premises of this installation are turned over to the COR. At the time of their discovery, such items shall be tagged to identify the location at which they were found.

14. SECURITY: Only authorized Agricultural Research Service, Agricultural Research Service Cooperator employees, the Contractor and Contractor’s employees shall be allowed in the building during performance of this contract. The Contractor will close any open windows, turn off lights (except those left on for security), and lock designated interior and all exterior doors. The building is considered closed for business from 4:30pm to 7:30am daily, all weekend hours, and Federal Holidays. Doors to laboratories and offices will be unlocked only during the period of cleaning services. They will not be left unattended and open.

14.1. SECURITY CLEARANCES: Upon contract award, all contractor personnel who will be working in the building will be required to complete a background investigation. Upon clearance, contractor personnel will work with the designated USDA, Agricultural Research Services employees to obtain a Linc Pass, which will serve as a permanent ID and authorize building access after normal business hours.

14.7 CONDUCTION OF CONTRACTOR AND EMPLOYEES: Contractor personnel shall not smoke or use vaporizing tobacco products in the building, as this is a non-smoking/non-vaporizing building.

Contractor personnel shall comply with the installation traffic laws and other regulations and instructions pertaining to conduct of persons on Government facilities.

14.7.1 Contractor personnel shall not disturb plant material, equipment or tools located in greenhouses.

14.7.2 Contractor personnel shall in no event, enter any area to which access is restricted, unless such an area has been specifically identified as an area in which services are to be rendered.

14.7.3 Contractor shall place his/her employees on notice that infraction of any of the above rules, regulations or prohibitions may be grounds for removal from Federal Property.

15. Inspections

15.1. Definition: “Services” includes services performed, workmanship and materials furnished or utilized in the performance of services.

15.2. All work shall be performed in a skillful manner. The COR may require the Contractor to remove from work any employee the COR deems incompetent, careless, or otherwise objectionable.

15.3. The COR will review the performance of services and receive complaints related to non-performance. The COR, or other designated representative, will make random inspections of parts of the building where services are to be performed. Inspections will not interfere with or delay the Contractor’s work.

15.4. Required Submittals will be noted in the Statement of Work or in the Specification section that is applicable. Contracting Officer can request additional submittals on contract items when needed.

15.5. Inspector’s Daily Reports are recommended with the Contractor’s standard form. The Contractor shall complete and submit the daily reports to the COR weekly, on the first working day of the following week. The COR can waive the requirement for daily reports, at their discretion.

16. Deficiencies

16.1. Any deficiencies in performance found will be brought to the Contractor’s attention. The Contractor is required to correct the deficiencies identified by the inspector. Should the same deficiencies be found during inspections, a meeting will be held with the Contracting Officer, COR, and Contractor to determine a course of action.

16.2. If any service performed does not conform to the contract, the Government may require the Contractor to perform the services again to conform to requirements, at no increase to the contract amount. When defects in performances cannot be corrected by re-performance, ARS may (1) require the Contractor to take necessary action to ensure that future performance conforms to requirements, and

(2) terminate the contract for default.

17. Payments

16.1. For payment, all invoices must be submitted to the Department of Treasury's Invoice Processing Platform (IPP) via the electronic Invoice Processing Platform. This is a mandatory requirement initiated by the U.S. Department of Treasury and you can find more information at this website https://www.ipp.gov/index.htm.

Please make sure that your company has registered at https://www.ipp.gov/vendors/enrollment-vendors.htm to establish your account. Payments shall be made in arrears, upon electronic submission of invoices to the IPP.
