Performance Work Statement Naval Special Warfare Group EIGHT

Pool Chiller Services

1. BACKGROUND

1.1 Naval Special Warfare Group EIGHT (NSWG-8) requires pool chiller services which will chill 300,000 gallons of fresh water in a test tank (pool) from approximately 75 degrees Fahrenheit down to 35 degrees Fahrenheit. The test tank is located in Pearl City, Hawaii. The Government intends to lease the pool chiller equipment so that it can remain on-site for the life of the contract.

2. OBJECTIVES

2.1 Establish a five-year indefinite delivery indefinite quantity (IDIQ) contract for pool chiller services, to include lease of equipment, in Pearl City, HI.

3. SCOPE

3.1 The Contractor shall provide the personnel, management, materials, and equipment necessary to chill 300,000 gallons of pool water from approximately 75 degrees Fahrenheit down to 35 degrees Fahrenheit for durations specified at the task order level. The estimated duration per event is 46 days but may be required for longer or shorter periods. Contractor shall provide equipment with sufficient capabilities to chill the entire pool of fresh water to designated temperatures prior to the start of the event and maintain those temperatures for the duration of the event. Specific event dates will be provided to the Contractor an estimated 30 days prior to any required set-up and delivery as identified at the task order level. Shorter notifications may be required based on operational requirements.

4. REQUIREMENTS

4.1 Equipment Lease

4.1.1 Contractor shall provide all pool chiller equipment (refrigerated system) capable of chilling 300,000 gallons of fresh water from approximately 75 degrees Fahrenheit to 35 degrees Fahrenheit and maintain that temperature for durations specified at the task order level.

4.1.2 Pool chiller system shall be capable of maintaining any specified temperature between

35-75 degrees for specific intervals as designated by the Government (i.e. pool temperature may be required at 65 degrees for a two-day period, then 55 degrees for a 5-day period (or any other specific temperature/period), prior to being chilled down to 35 degrees).

4.1.3 The pool shall be chilled no more than eight (8) degrees per day. The pool chiller system shall include standalone piping with suction and discharge piping and hoses (i.e. cannot utilize current pool filtration system). The estimated duration of each event is 46 consecutive days but may be more or less as required.

4.1.4 The Contractor shall provide all equipment necessary to perform pool chiller services to include, but not limited to, chillers, coolant, hoses, pumps, heat exchangers, fasteners and hardware.

4.1.5 The Contractor shall provide all electrical cables and distribution panels to tie into 460V

– 3 Phase – 60HZ government-provided electrical power, as well as any other equipment required to perform these services.

4.1.6 The equipment required to support pool chiller services will be leased to the Government and remain on-site in Pearl City, HI.

4.1.7 The Contractor shall provide certificates of insurance for equipment at least 5 days prior to equipment delivery.

4.1.8 Contractor shall provide transportation and shipping for all equipment to and from SDVT-1 in Pearl City, HI. Equipment shall be delivered, set-up and operational upon delivery.

4.1.9 The Government will be responsible for off/on loading and placement of the equipment at the work site.

4.1.10 Delivery Dates and Usage:

4.1.10.1 Equipment Delivery: Pool chiller equipment shall be delivered and installed within 30 days of issuance of task order, unless otherwise identified at the Task Order level.

4.2 On-Site Maintenance:

4.2.1 The Contractor shall provide a minimum of one Service Technician onsite to accomplish assembly and startup of the pool chiller prior to required use and onsite for at least the first day of use. Specific dates will be identified at the task order level. On-site work is expected to last 5-7 days per start-up. Government personnel will support Contractor as necessary in the assembly of equipment.

4.2.2 Assembly and startup of the equipment shall include all tasks associated with making the pool chiller operational, including, but not limited to, establishing all mechanical and electrical connections, initial startup and testing, and training of onsite Government personnel in monitoring, shut down and emergency procedures associated with the leased equipment. Naval Facilities (NAVFAC) personal will be responsible for connecting Contractor supplied electrical cables to 460V – 3 Phase – 60HZ government-provided electrical power.

4.2.3 The Contractor shall provide use and care instructions for proper shut-down, break-down and storage of equipment after each usage event. The Government will shut down and store equipment in accordance with use and care instructions to include hazardous waste removal. NAVFAC personal will be responsible for disconnecting Contractor supplied electrical cables from 460V – 3 Phase – 60HZ government-provided electrical power.

4.2.4 Usage dates will be identified at the task order level.

6. CONTRACTOR MANPOWER REPORTING

6.1 The Contractor shall report ALL Contractor labor hours (including subContractor labor hours) required for performance of services provided under this contract for the NSWG8 via a secure data collection site. The Contractor is required to completely fill in all required data fields using the following web address: http://sam.gov. Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30.

While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year. Contractors may direct questions to the help desk on the sam.gov website.

7. CONTRACTOR TRAVEL

7.1 Contractor is responsible for all Contractor travel costs and shall be negotiated as a Firm-Fixed-Price on each Task Order. All travel shall be in accordance with FAR 31.205-46 and applicable travel regulations (Joint, Federal or Standardized). Contractor payment claims shall include applicable documentation to support actual costs incurred (e.g. airfare and hotel/lodging receipts) as well as any receipts valued at or above $75.00. Failure to provide appropriate documentation may result in loss of reimbursement of travel expenses.

8. SECURITY

8.1 Contractor shall make any necessary coordination for base access. The Government will provide escorts for onsite work to be conducted by Contractor.

8.2 Contractor personnel are required to be citizens of the United States.

8.3 Contractor shall be able to obtain personnel and vehicle access to military installations. Contractor is responsible for coordinating all necessary access through the local Military Pass and Decal Office.

9. SAFETY

9.1 Nothing in the Performance Work Statement (PWS), nor any Government action or failure to act in performance of the contract shall relieve the Contractor of its responsibility for the safety of the Contractor’s personnel and property, the Government’s personnel and property, and the general public.

Furthermore, nothing in this PWS shall relieve the Contractor of its responsibility for complying with applicable Federal, State, and Local laws, ordinances, codes, and regulations (including those requiring applicable licenses and permits) in connection with the performance of this contract.

10. MARKINGS AND LIMITED USE OF DATA

10.1 The Contractor shall refrain from using “Naval Special Warfare Command” (NSWC), reference to any NSWC personnel by title or position within NSWC, or this contract in any of its publications, websites, materials, media, or advertising media. The Contractor shall not use or reproduce the Department of the Navy’s trademarks or trade secrets with respect to Naval Special Warfare, Naval Special Warfare training, and the Navy SEALs/SWCCs (i.e., there are several U.S. trademark registrations in connection with the words NAVY SEALS, the Trident logo, and the SWCC logo).

11. INSURANCE / WAIVERS

11.1 The Contractor (and any Subcontractor) shall comply with all applicable laws, rules, and regulations applicable to its performance under this contract. The Contractor/Subcontractor shall have in place all required and appropriate Liability Insurance coverage at the minimum commercial industry standards to be used in the event of accident, injury, and/or damage related to activities under this contract. If requested by the Government, the Contractor shall furnish a Certificate of Insurance evidencing required coverage.

11.2 Transportation provided by the Contractor (and any Subcontractor) shall, at minimum, meet all commercial industry standards for safety and reliability. Transportation shall only be provided by fully licensed/certified/approved vendors and individuals. If requested by the Government, the Contractor shall furnish evidentiary evidence to support the above including, but not limited to, a Certificate of Insurance.

11.3 Contractor shall not require Government personnel to sign any waiver/non-liability forms under this contract. If any forms/permissions are signed, those documents are not valid nor enforceable.

12. QUALITY CONTROL

12.1 The Contractor shall implement and maintain a Quality Control Plan (QCP) to ensure work performed conforms to the scope of work and meets the requirements under this PWS. The QCP shall, at a minimum provide a method for performing inspections; identifying, correcting, and preventing problems/defective service; addressing customer complaints, and improving the quality of services over the life of the contract.

13. QUALITY ASSURANCE

13.1 The Government reserves the right to perform inspections and surveillance to evaluate the

Contractor’s compliance to the contract terms and performance of the requirements in the PWS. The Government will make every effort to ensure that the surveillance methods used are conducted in an objective, fair, and consistent manner.

13.2 Contract Discrepancy Report (CDR). In the event of unsatisfactory Contractor performance, the Contracting Officer will issue a CDR that will explain the circumstances and findings concerning the incomplete or unsatisfactory service. The Contractor shall acknowledge receipt of the CDR and respond in writing as to how he/she shall correct the unacceptable performance and avoid a recurrence. The Government will review the Contractor’s corrective action response to determine acceptability and will use any completed CDR as part of an overall evaluation of Contractor performance when determining present or future contractual actions.
