Performance Work Statement (PWS)
Naval Special Warfare Command Marine Reconnaissance Vehicle (MRV) Training
1.0. BACKGROUND
1.1. Naval Special Warfare Groups require Maritime Reconnaissance Vehicle (MRV) training in order to operate their vehicles in high surf environments. Group Training Detachments are responsible for training its Naval Special Warfare (NSW) personnel for combat deployments. NSW organizations routinely conduct littoral and Over the Beach (OTB) training in high surf environments. Training shall provide personnel with the skills to operate their vehicles as rescue (personnel recovery), insertion, and extraction platforms in extreme water conditions.
2.0. OBJECTIVES
2.1. The objective is to issue a firm fixed price Indefinite Delivery Indefinite Quantity contract for MRV
OTB and littoral training in a location with consistently high surf (greater than 8 feet above sea level).
The Contractor shall provide a curriculum designed to test drivers’ skills learned throughout the course of instruction (COI) as follows.
2.1.1. Fully test the NSW personnel MRV driver skill sets.
2.1.2. Test the driver’s ability to adapt to adverse training scenarios.
3.0. SCOPE
3.1. The Contractor shall provide the personnel, management, and materials necessary to provide training to NSW personnel at locations which support all scheduled waterborne evolutions and events associated with OTB MRV Course of Instruction as outlined below and at the task order level.
Training is anticipated to consist of 5 days for each evolution. COI evolutions are anticipated to have a minimum count of 10 students and a maximum count of 16 students, to be determined at the Task Order Level.
4.0. REQUIREMENTS
4.1. Basic Support Requirements:
4.1.1. The Contractor shall conduct training at locations which have consistent surf conditions of eight feet or higher. (Unless otherwise specified at the task order level)
4.1.2. The Contractor shall ensure training does not violate any local, State or Federal laws at chosen training sites. (otherwise specified at the task order level)
4.1.3. The Contractor shall provide any required permits for the conduct of training at the chosen training sites. (Unless otherwise specified at the task order level)
4.1.4. The Contractor shall provide course materials to include:
4.1.4.1. Training schedule (A001);
4.1.4.2. Training and Maintenance booklets (A002)
4.1.4.3. Certificate of Training (A003)
4.1.5. The Contractor shall maintain a 1 to 4 ratio of instructor to students and be able to support up to 16 students per training evolution. (Unless otherwise specified at the task order level)
4.1.6. The Contractor shall provide any equipment necessary to execute curriculum and training, to include sleds for students and night vision goggles (NVGs) for Contractor and sub-Contractor personnel.
4.1.6.1. The Contractor shall provide one MRV with sled per two (2) students unless otherwise specified at the task order level.
4.1.6.2. Provision of any other required training items will be defined at the task order level.
4.1.7. The Course of Instruction shall be a mix of classroom instruction and practical exercise with a minimum of 25 hours actively operating MRV’s on the water.
4.1.8. The Contractor shall provide up to 1 hour of basic in-field level maintenance and troubleshooting class conducted by a certified Jet Ski mechanic.
4.1.9. The Contractor shall follow guidelines for US NAVY Operational Risk Management (ORM) Instruction OPNAVINST 3500.39 (series).
4.1.10. When conducting COI off Government property, the Contractor shall dedicate 1 medical personal of the instructors provided, for basic life support until emergency medical response team (911- ambulance) arrives on scene.
When conducting COI on Government/federal property, Government shall provide one dedicated medic for emergency response team.
4.2. Specific Requirements: The Contractor shall provide a block of instruction on the following subjects, unless otherwise specified in the task order. The content of the instruction is subject to change at no additional cost to the Government (to be determined at the task order level); however, courses that deviate considerably from the following content will be negotiated at the task order level as a custom course under this contract.
4.2.1. Mandatory Curriculum (but not limited to)
4.2.1.1. Students shall complete Marine Awareness Training, NAVFAC-MRSG-MSAT-
5.0, or equivalent prior to participating in course.
4.2.1.2. Basic operator-level jet-ski equipment, maintenance and troubleshooting, repair.
(1 hour)
4.2.1.3. Analyze topography of beach floor based on water surface visual clues.
4.2.1.4. Analyze different shorelines and risks involved based on topography, risks involved and how to navigate in most all conditions.
4.2.1.5. Adapt, analyze and access water and wave conditions to minimize risk for MRV use.
4.2.1.6. MRV Pre-Op/Post-Op, launching, and Basic MRV familiarity.
4.2.1.7. Unassisted night vision techniques and familiarization. (Without the use of
Night Vision Devices)
4.2.1.8. Daily Post-Op overview and discussion.
4.2.1.9. MRV Operator Skills Training. (24 hours – see subtasks)
4.2.1.9.1. Basic Skills/Flat surf. (8 hours)
4.2.1.9.1.1. Trailering and launching (boat ramp, shoreline)
4.2.1.9.1.2. Reversing maneuvers
4.2.1.9.1.3. High speed turns
4.2.1.9.1.4. Figure 8 course

4.2.1.9.5.1. Navigation safety familiarization in compliance with the International Regulations for Preventing Collisions at Sea
1972 (COLREGS).
4.2.1.9.5.2. Flat Water familiarization and Navigation.
4.2.1.9.5.3. Small surf familiarization and Navigation.
4.2.1.9.5.4. Shoreline navigation and risk management of surging water on to dry reefs and shore.
4.2.1.9.6. Optional Curriculum

4.3. Miscellaneous training
4.3.1. Courses that deviate considerably from the following content will be negotiated at the task order level as a custom course under this contract.

6.0. CONTRACTOR MANPOWER REPORTING
The Contractor shall report ALL Contractor labor hours (including subContractor labor hours) required for performance of services provided under this contract for the NSWG8 via a secure data collection site. The Contractor is required to completely fill in all required data fields using the following web address:
http://sam.gov. Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year. Contractors may direct questions to the help desk on the sam.gov website.
7.0. CONTRACTOR TRAVEL
7.1. N/A
8.0. SECURITY
8.1. Contractor shall establish appropriate administrative, technical, and physical safeguards to protect any and all nonpublic Government data to ensure the confidentiality, integrity, and availability of Government data.
8.2. All Contractor personnel are required to be citizens of the United States.
9.0. SAFETY
9.1. Safety in all training events shall be paramount. The Contractor shall comply with and maintain appropriate safety instructions and qualification standards in accordance with references located in paragraph 16.
9.2. Senior Military Member
9.2.1. The Senior Military Member shall provide the Contractor with applicable safety doctrine as appropriate. Additionally, the Senior Military Member will have the authority to stop any training being provided when he or she determines that the safety of students, Contractor employees or other personnel are at risk.
9.3. Contractor Responsibility
9.3.1. Nothing in the performance work statement (PWS), nor any Government action or failure to act in performance of the contract, shall relieve the Contractor of its responsibility for the safety of the Contractor's personnel and property, the Government's personnel and property, and the general public. Furthermore, nothing in this PWS shall relieve the Contractor of its responsibility for complying with applicable Federal, State, and Local laws, ordinances, codes and regulations (including those requiring applicable licenses and permits) in connection with the performance of this contract.
9.3.2. Contractor shall not advertise their support to Naval Special Warfare on their website or in their brochures.
9.3.3. Contractor shall not share or publicly release any photos/videos or media created during the course.
9.4. Risk Controls
9.4.1. Risks are incurred during the conduct of this training. This training requires implementation of risk controls. Government organizations will ensure a certified medic is on station at each training event and there is a designated vehicle identified to support casualty evacuation.
9.5. Mishaps
9.5.1. The Government process must be in place that will ensure any mishaps are reported, investigated and recorded. This information will be input into the Web Enabled Safety System (WESS) by the Government.
9.5.2. Safety and training related problems or mishaps involving or observed by the Contractor shall be addressed immediately to the designated RSO or ROIC. A formal written report http://sam.gov/ shall be prepared and submitted to the Safety Officer within 2 working days of the incident
9.6. Contractor Responsibility.
9.6.1. Nothing in the PWS, nor any Government action or failure to act in performance of the contract shall relieve the Contractor of its responsibility for the safety of the Contractor's personnel and property, the Government's personnel and property. Furthermore, nothing in this PSW shall relieve the Contractor of its responsibility for complying with applicable Federal, State, and Local laws, ordinances, codes and regulations (including those requiring applicable licenses and permits) in connection with the performance of this contract.
10.0. MARKINGS AND LIMITED USE OF DATA: The Contractor shall refrain from using “Naval Special
Warfare Command” (NSWC), reference to any NSWC personnel by title or position within NSWC, or this contract in any of its publications, websites, materials, media, or advertising media. The Contractor shall not use or reproduce the Department of the Navy’s trademarks or trade secrets with respect to Naval Special Warfare, Naval Special Warfare training, and the Navy SEALs/SWCCs (i.e., there are several U.S. trademark registrations in connection with the words NAVY SEALS, the Trident logo, and the SWCC logo).
11.0. INCLEMENT HEAVY WEATHER PLAN
11.1. In order to ensure that Contractor personnel, NSW operators and Government civilian employees are protected during gales, storms, hurricanes, and destructive weather, the Contractor is required to have an inclement heavy weather plan (IHWP) which assigns responsibilities and prescribes actions to be taken on the approach and during heavy weather conditions. Heavy weather-related delays and impacts will be negotiated or rescheduled on a case-by-case basis at the task order level unless otherwise stated. NSW on a case-by-case basis may reimburse the Contractor for all reasonable, allowable and allocable costs resulting from the Contractor’s implement of the IHWP based on such NSW direction. The plan shall include but not limited to, definition of inclement weather, notfication, responsibilities, and procedures, safety, insurance, and any additional considerations.
12.0. INSURANCE / PERMITS / WAIVERS
12.1. The Contractor (and any SubContractor) shall comply with all applicable laws, rules, and regulations applicable to its performance under this contract. The Contractor/SubContractor shall have in place all required and appropriate Liability Insurance coverage at the minimum commercial industry standards to be used in the event of accident, injury, and/or damage related to activities under this contract, in accordance with FAR Subpart 28.3 Insurance. The Contractor shall furnish a Certificate of Insurance evidencing required coverage upon request.
12.2. The Contractor shall, without additional expense to the Government, be responsible for obtaining any necessary licenses and permits applicable at the task order level.
12.3. Contractor shall not require Government personnel to sign any waiver/non-liability forms under this contract. If any forms/permissions are signed, those documents are not valid nor enforceable.
13.0. GOVERNMENT FURNISHED PROPERTY/EQUIPMENT/INFORMATION (GFP/GFE/GFI):
13.1. Students will provide approved helmets (OPSCORE, PROTEC, etc.) and associated gear as described in Attachment 2 – MRV COI Gera List, the vendor will provide the remaining gear to complete the training.
13.2. The use of night vision devices is optional. If night vision devices are used, the helmet must have the appropriate night vision mount, and lanyard system.
13.3. Fuel will be provided by the Government for use on student MRVs only.
13.4. Contractor shall provide fuel for Contractor owned MRVs.
14.0. QUALITY CONTROL
14.1. The Contractor shall implement and maintain a Quality Control Plan (QCP) to ensure work performed conforms to the scope of work and meets the requirements under this PWS. The QCP shall, at a minimum, provide a method for performing inspections; identifying, correcting and preventing problems/defective service; addressing customer complaints, and improving the quality of services over the life of the contract.
15.0. QUALITY ASSURANCE
15.1. The Government reserves the right to perform inspections and surveillance to evaluate the
Contractor’s compliance to the contract terms and performance of the requirements in the PWS. The Government will make every effort to ensure that the surveillance methods used are conducted in an objective, fair, and consistent manner. The Government will assign a Contracting Officer’s Representative (COR) who will be responsible for monitoring performance in accordance with the requirements of the PWS and the Quality Assurance Surveillance Plan (QASP). The COR will make every effort to ensure that the surveillance methods used are conducted in an objective, fair, and consistent manner.
15.2. Contract Discrepancy Report (CDR). In the event of unsatisfactory Contractor performance, the CO will issue a CDR that will explain the circumstances and findings concerning the incomplete or unsatisfactory service. The Contractor shall acknowledge receipt of the CDR and respond in writing as to how he/she shall correct the unacceptable performance and avoid a recurrence. The Government will review the Contractor's corrective action response to determine acceptability and will use any completed CDR as part of an overall evaluation of Contractor performance when determining present or future contractual actions.
