13. SECURITY GUIDANCE
The security classification guidance for classified information needed for this effort is identified below. If any difficulty is encountered in applying this guidance or if any other contributing factor indicates a need for changes in this guidance, the contractor is authorized and encouraged to provide recommended changes; to challenge the guidance or the classification assigned to any information or material furnished or generated under this contract;
and to submit any questions for interpretation of this guidance to the official identified below. Pending final decision, the information involved shall be handled and protected at the highest level of classification assigned or recommended.

This DD254 is for solicitation purposes only; therefore, it shall be returned to the NUWCDIVNPT Industrial Security Office to be updated before the contract DD254 can be issued to the contractor.

All classified data and hardware shall be protected I.A.W. Part 117 of Title 32, Code of Federal Regulations (CFR).
All contract personnel shall have a favorably adjudicated background investigation or interim clearance granted per established DoD personnel security requirements for routine and privileged access to government information systems and physical access to facilities and locations supporting the contract.
Classified or unclassified technical papers to be presented at a classified symposium shall be approved by the NUWCDIVNPT Contracting Officer's Representative (COR) prior to the presentation.
Security classification guides and controlled unclassified information (CUI) (e.g., legacy FOUO, distribution statement controlled) are not authorized for public release; therefore, they cannot be posted on a publicly accessible web-server or transmitted over the internet unless appropriately encrypted. Request for public release cannot be transmitted via the internet until the contractor receives final approval from NUWCDIVNPT Code 00.
All reports of contractor security violations associated with this contract shall be sent by the DCSA field office directly to NUWCDIVNPT Industrial Security Team at nuwc_npt_indsec3.fct@navy.mil.
All security related issues, requests, or incidents, pertaining to this contract, shall be submitted in writing by the contractor’s Facility Security Officer (FSO) to NUWCDIVNPT Industrial Security Team at nuwc_npt_indsec3.fct@navy.mil. The contractor shall abide by other reporting requirements outlined in Part 117 of Title 32, CFR.
All classified information involved in security incidents shall be retained and a synopsis of the incident shall be provided to the NUWCDIVNPT Industrial Security Team at nuwc_npt_indsec3.fct@navy.mil for review.
The Contractor shall submit a letter of request, on company letterhead, for sharing of classified and other sensitive information or data between prime contracts to the NUWCDIVNPT Industrial Security Team at nuwc_npt_indsec3.fct@navy.mil. Each request shall reference contract number N66604-26-R-0063 (to be updated upon award) to identify the specific information for which approval is being sought, a justification for needing to share the information, the name of other contractor and its contract number under which the requested information will be shared.
The Contractor shall submit a letter of request, on company letter, to flow down security access to NUWCDIVNPT Industrial Security Team at nuwc_npt_indsec3.fct@navy.mil. Each request shall reference contract number N66604-26-R-0063 (to be updated upon award) to identify the specific information for which approval is being sought, a justification for needing to share the information, the name of other contractor, CAGE Code, and the subcontract number.
The contractor shall provide a copy of subcontractor DD254s issued under this contract to NUWCDIVNPT Industrial Security Team at nuwc_npt_indsec3.fct@navy.mil.
Personnel designated as derivative classifiers shall receive derivative classification training prior to access from the contractor's Facility Security Officer (FSO). The FSO shall ensure personnel receive initial and biennial training during the life of this contract. Evidence of completion, training certificates or equivalent, shall be provided to the Information Assurance Manager no later than the individual's due date.
All classified documents shall be destroyed using a National Security Agency (NSA) approved high security crosscut shredder listed on the NSA/CSS evaluated products list (EPL) for high security crosscut paper shredders, or other approved method for destroying classified information.
The contractor shall adhere to NUWDIVNPT Security Manuals, Instructions, Directives, and Standard Operating Procedures (SOP) while working onboard NUWCDIVNPT, NUWCDIVNPT Facilities onboard NAVSTANPT, or any NUWDIVNPT Detachment.

Item 10(a): SOW contains tasks that require access to COMSEC material, safe or space. Contractors requiring COMSEC access are required to hold a final U.S.G. clearance within scope and at the appropriate level, and shall adhere to all policies, instructions, and OPSEC doctrines pertaining to COMSEC, which include but are not limited to the following: NISPOM, NSA and Central Security Service Policy Manual (NSA/CSS 3-16), applicable COMSEC equipment Operational Security Doctrine (OSD), OPNAVINST 2221.5, Department of the Navy (DON) COMSEC Policy and Procedures Manual (CMS-1), NUWCDIVNPT Local Handling and Accountability of COMSEC Material (NUWCDIVNPTINST 2280.1) and NUWCDIVNPT Emergency Action Plan (EAP) (NUWCDIVNPT 2280.2).

Item 10(a) Continued: COMSEC access is only granted by the NUWCDIVNPT Commanding Officer upon completion of training provided by a COMSEC Account Manager (CAM). Also, the contractor are required to execute a COMSEC Briefing and Acknowledgement Form, Cryptographic Access Certification and Termination Briefing (SD FORM 572), Controlled Cryptographic Item (CCI) Briefing (DD FORM 2625), and adhere to the applicable sections of Title 18 and 50 of the U.S. Code prior to being granted COMSEC access as well as prior to being removed from COMSEC access. Contractors shall not remove any COMSEC materials from any NUWCDIVNPT designated COMSEC space without approval of the Primary CAM. Disclosure of any COMSEC information by a contractor, to include subcontractors, requires prior approval of the Commanding Officer or the Primary CAM.
Items 10(b), 10(c), and 10(d): Contractor will receive and come into contact with Restricted Data (RD), Critical Nuclear Weapons Design Information (CNWDI) and Formerly Restricted Data (FRD) on classified capabilities, operational and technical performance specifications, parameters and test data. RD/CNWDI/FRD information shall be handled and controlled in accordance with the requirements of Part 117 of Title 32, CFR. Contractor is permitted access to RD/CNWDI/FRD in performance of the contract.
Items 10(b), 10(c), and 10(d): RD/CNWDI/FRD access requires a final U.S. Government clearance at the appropriate security level prior to access to RD/CNWDI/FRD. The highest level of classification is SECRET, with access requirements to program related information.
Program related accesses, however, shall require Contractor employees to have a current T5. FRD access is handled in the same manner as NSI. Prior to accessing CNWDI, contractor employee must be briefed by the FSO, and the briefing must be annotated in the DoD System of Record (DISS/NBIS). A Government representative shall initially brief the FSO.
Item 10(b), 10(c), and 10(d): Prime contractor must receive approval from the GCA prior to granting CNWDI, RD, and/or FRD access to a sub-contractor. The request must be submitted in writing to the individual identified in Item 17(a) of this DD 254. Access to CNWDI for this contract requires a final U.S. Government National Security Clearance at least at the Secret level and must have a CNWDI security briefing.
Item 10(b), 10(c), and10(d): Access to Critical Nuclear Weapon Design Information (CNWDI), for this contract by prime contractor and/ or sub-contractor personnel, requires prior a) Government Contracting Officer certification that access to Restricted Data (RD), CNWDI, and Formerly Restricted Data (FRD) is necessary to satisfy contract objectives, and b) approval by and initial security training from the NUWC CNWDI Control Officer. Prior to granting CNWDI access to a sub-contractor, the prime contractor must submit a written request to and receive approval from the GCA individual identified in Block 17a of this DD 254.
Item 10(e)(1): This task requires access to TS/SCI by contractor personnel. NUWCDIVNPT SSO has exclusive security responsibility for all SCI classified material released to the contractor. Defense Counterintelligence & Security Agency (DCSA) is relieved from security/ inspection responsibilities for all SCI material, but retains responsibility for all other classified material. The CSA for SCI material is Office of Naval Intelligence.
Item 10(e)(1): Intelligence Information, TS/SCI: SCI requirements are hereby authorized. Questions regarding Item 10e (1) and requests for retention or release of intelligence shall be thru the Office of Naval Intelligence NUWCDIVNPT SSO.
Item 10(e)(1): SCI Accredited Information Systems: Contractor personnel will require access to SCI Accredited Information Systems.
Access to these networks require appropriate clearance and SSO approval prior to access.
Item 10(e)(2) 1: Intelligence Information, Non-SCI: Access to non-SCI information/material is authorized contingent up compliance with the below guidance.
Item 10(e)(2) 2: OPNAVINST 3811.1F, Threat Support to the Defense Acquisition System, of 16 May 2016.
Item 10(e)(2) 3: OPNAVINST 3880.6B, Scientific and Technical Intelligence Liaison Officer (STILO) Program and Intelligence Support for the Naval Research, Development, Test and Evaluation, and Acquisition Communities, of 10 APR 2020.
Item 10(e)(2) 4: Guidance governing handling and protection of information/ material derived from intelligence community sources and methods:
• Requests for intelligence data/material necessary to satisfy contract requirements shall be coordinated with the NUWCDIVNPT STILO (Code 60D), via the Government Contracting Authority (GCA).
• Intelligence data/material does not become property of the contractor and shall be returned upon GCA request or contract expiration.
• Contractors shall not release intelligence data/material to any person or activity, whether internal or external to the contractor organization, not assigned to and engaged in providing direct support to this contract without prior approval from the NUWCDIVNPT STILO (60D), via the GCA.
• Intelligence data/material shall not be released to foreign nationals or immigrant aliens, regardless of security clearance level or access
PREVIOUS EDITION IS OBSOLETE. Page 5 of 7DD FORM 254, APR 2018 authorization, and regardless of affiliation with the contractor, organization, without prior explicit permission from the originating intelligence community organization, coordinated through the NUWCDIVNPT STILO (60D), via the GCA.
• Intelligence data/material shall not be reproduced without prior approval from NUWCDIVNPT STILO (60D), via the GCA. All intelligence data/material shall bear a prohibition against reproduction while in the custody of the contractor.
• Contractors shall maintain records sufficient to enable the ability of GCA or NUWCDIVNPT STILO (60D) to review, upon request, the names of personnel that have/had access to intelligence data/material.
• The GCA may designate one or more government employees, with adequate program insight (e.g. PM, TPM, COR, ACOR), to coordinate with the NUWCDIVNPT STILO (Code 60D) as required to fulfill the above GCA responsibilities, and to ensure contractor compliance.
Item 10(g): Access up to NATO SECRET is authorized for this contract. Protection of NATO information shall be in accordance with USAAAN 01-07 and its applicable enclosures. Access to NATO requires a final U.S. Government National Security Clearance the FSO shall provide an initial NATO security briefing along with initial and annual derivative classification training during the life of this contract. Evidence of completion, training certificates or equivalent, shall be provided to the NATO control officer or alternate no later than the individual's due date. The contractor shall not use the SIPRnet for anything except that which is required for this contract. The prime contractor shall receive approval from the individual identified in Item 17a of this DD254 to impose NATO requirements or grant NATO access to a sub-contractor. Requests shall be submitted in writing.
Item 10(h): The Contractor will require access to foreign government information in performance of this task and shall protect such information per the guidance provided by the Task Sponsor.
Item 10(h): Foreign Government Information (FGI).
• Access to FGI does not include NATO information.
• Access to FGI shall be provided by the Task Sponsor. The Contractor shall protect such information pursuant to the guidance received from the Task Sponsor and authority granted by the originating government.
• Prior approval of the Task Sponsor is required prior to subcontracting. Requests for approval shall be submitted in writing via the certifying official of this DD Form 254.
• Access to FGI requires a final U.S. Government personnel security clearance at the appropriate level.
Item 10(j): All Controlled Unclassified Information (CUI) associated with this contract must be protected per the guidance provided for Item 11(l) of this DD Form 254.
Item 10(k) SIPRnet: Personnel assigned to the contact who require access to SIPRnet and/or SIPRnet Backbone equipment shall receive a NATO security briefing and derivative classification training prior to access from the contractor's Facility Security Officer (FSO). The FSO must provide an initial NATO security briefing along with initial and annual derivative classification training during the life of this contract. Evidence of completion, training certificates or equivalent, shall be provided to the NATO control officer or alternate no later than the individual's due date. The contractor shall not use the SIPRnet for anything except that which is required for this contract.
Item 11(c): The contractor requires access to classified source data up to and including the level identified in item 1a of this DD254.
Classified material generated in support of this contract shall be classified in accordance with the source material of the Security Classification Guidance, which will be provided by GCA. Automated Information Systems (AIS) shall be certified and accredited by the Cognizant Security Agency (CSA) prior to processing classified information associated with this contract.
Item 11(g): DD Form 1540 “Registration for Scientific and Technical Information Services” shall be completed for registration with DTIC. The contractor shall also submit DD Form 2345 “Militarily Critical Technical Data Agreement” (after registration with DTIC) to the Defense Logistics Services Center for access to unclassified, militarily critical technical data from other DoD sources.
Item 11(j): The contractor shall protect critical information associated with this contract to prevent unauthorized disclosure. The NUWC Division Newport (NUWCDIVNPT) Critical Information and Indicators List (CIIL) is identified under separate cover. The CIIL shall be reviewed annually by NUWCDIVNPT to ensure current relevancy and disseminated as required.
Item 11(j): Performance under this contract requires the contractor to adhere to OPSEC requirements. OPSEC requirements are additional to the requirements Part 117 of Title 32, Code of Federal Regulations (CFR)., therefore, the Contractor may not impose OPSEC requirements on its subcontractors unless NUWCDIVNPT approves the OPSEC requirements. The contractor will assign an OPSEC point of contact for this contract at no additional cost to the Government. This individual may be the Facility Security Officer (FSO).
Item 11(j): During the period of this contract, the Contractor may be exposed to, use, or produce, NUWCDIVNPT Critical Information (CI) and/or observables and indicators which may lead to discovery of CI. Item 11(j): CUI correspondence transmitted internally on the contractor's unclassified networks or information systems, and externally, shall be protected per NIST SP-800-171, Protecting Controlled Unclassified Information in Non-federal Systems and Organizations.
Item 11(j): Assembled large components/systems being transported to and from testing areas, other production or government facilities (whether or not on public roadways) shall be in an enclosed van trailer or covered flatbed trailer. Component/System outside storage, staging, and test areas shall be shielded/obscured from public view wherever physically possible.
Item 11(j): NUWCDIVNPT's CI shall not be publicized in corporate wide newsletters, trade magazines, displays, intranet pages or public facing websites. Media requests related to this project shall be directed to NAVSEA/NUWCDIVNPT Public Release Authority listed in Item 12 of this DD Form 254.
Item 11(j): Any attempt by unauthorized third parties to solicit, obtain, photograph, or record, or; incidents of loss/compromise of government Classified or CI, Business Sensitive, Company Proprietary information related to this or other NUWCDIVNPT program must be immediately reported to the Facility Security Officer and Defense Counterintelligence and Security Agency and/or the Naval Criminal Investigative Service, and the NUWCDIVNPT Information, Industrial, and Operations Security POCs identified on this DD-254.

Item 11(k): Only certain classified information qualifies for shipment by Defense Courier Service (DCS). Prior approval by GCA is required before the contractor can authorize its subcontractor to use the services of DCS.

Intelligence Component Assistance to Law Enforcement Agencies and Other Civil Authorities
Contractor’s will comply with all regulations/manuals/directives stated therein which provide the necessary security and classification guidance for personnel, information, physical, automated information security (AIS), and technical security measures and is a part of the SCI security specifications for the contract. Inquiries pertaining to SCI classification guidance or interpretations shall be directed to the Contracting Officer/Contracting Officer Representative (COR) identified on the attached DD Form 254.
1. Requirements for access to SCI:

a. All SCI will be handled in accordance with special security requirements, which will be furnished by the designated Special Security Officer (SSO).
b. SCI will not be released to contractor employees without specific release approval of the originator of the material as outlined in governing directives; based on prior approval and certification of "need-to-know" by the designated COR.
c. The contractor must restrict access to only those individuals who possess the necessary security clearance and who are actually providing services under the contract with a valid need to know. Further dissemination to other contractors, subcontractors, other government agencies, private individuals or organizations is prohibited unless authorized in writing by the originating agency through the COR.
d. Names of contractor personnel requiring access to SCI will be submitted to the COR for approval. (The COR is identified on the DD Form 254.) Upon receipt of written approval from the COR, the company security officer will submit request(s) for special background investigations, in accordance with the NISPOM, to the Defense Security Service (DSS).
e. SCI material must not be released to foreign nationals or immigrant aliens whether they are consultants, U.S. contractors, or employees of the contractor and regardless of the level of their security clearance, except with advance written permission from the originator. Requests for release to foreign nationals shall be initially forwarded to the COR and shall include:
i. A copy of the proposed disclosure.
ii. Full justification reflecting the benefits to U.S. interests.
iii. Name, nationality, particulars of clearance, and current access authorization of each proposed foreign national recipient.
f. Contractor personnel must maintain accountability for all intelligence materials released to their custody.
g. SCI material will not be reproduced without prior approval of the originator of the material.
All SCI material shall bear a prohibition against reproduction while in the contractor’s custody.
h. Inquiries pertaining to classification guidance on SCI will be directed through the CSSO to the responsible COR as indicated on the DD Form 254.
i. SCI released to cleared-DoD Contractors, all reproductions thereof, and all other information generated based on, or incorporating data from, in support of this contract, remains the property of the U.S. Government. Upon completion or cancellation of the contract, all SCI material furnished
Navy SCI Addendum, Sep 2020 Page 3 will be returned to the direct custody of the supporting SSO, or destroyed IAW instructions outlined by the COR.
j. SCI will be stored and maintained only in properly accredited facilities meeting the physical security requirements in ICD 705, SCI Facilities and ICS 705, Technical Specifications for Construction and Management of SCI Facilities.
k. The NUWCDIVNPT SSO will recognize the above noted estimated completion date (ECD) as the completion date for the contract. The SSO will initiate action to debrief contractor personnel with access to this contract unless extensions or modifications to the contract are received by the SSO office no later than 30 days after the established completion date.
l. The contractor is governed by ICD 704, ‘Personnel Security Standards and Procedures Governing Eligibility for Access to Sensitive Compartmented Information (SCI) And Other Controlled Access Program Information’ and may be supplemented by SSO Navy guidance.
Contractor personnel, assigned to this contract, that are eligible for access to SCI or currently possess an SCI personnel security clearance with another non-DoD agency must have their SCI eligibility adjudicated by the DoD Consolidated Adjudications Facility (CAF) prior to having access to SCI information retained by NUWCDIVNPT, unescorted access to NUWCDIVNPT spaces, and receipt of an NUWCDIVNPT issued contractor badge. The contractor will identify, in writing, contractor personnel assigned to this contract by NAME, SSN, Date and Place of Birth, and provide this documentation to the CO/COR identified on the DD 254. The CO/COR will identify the SCI caveats for the contract and forward a copy of this documentation to the SSO for processing. This documentation will be marked and protected under the Privacy Act of 1974.
m. Electronic processing of SCI must be accomplished on equipment accredited in accordance with DoDM 5105.21 Volumes 1- 3, ICD 503, Information Technology System Security Risk Management, Certification and Accreditation, and the DoDIIS Joint Security Implementation Guide (DJSIG), Appendix D.

CLASSIFICATION GUIDES AND PROGRAM SPECIFIC SECURITY GUIDANCE THAT
DEFINE TECHNICAL AND SAFEGUARDING REQUIREMENTS IDENTIFIED IN THE
SOW/PWS/SOO.
2. In compliance with DoDD 5148.13 paragraph 4.1.e and SECNAVINST 3820.3F, all contractor personnel conducting Intelligence or Intelligence-related activities or supporting those efforts under Department of Defense authorities shall report any Questionable Intelligence Activity (QIA) or Significant or Highly Sensitive Matter (S/HSM) to the Office of Naval Research Contracting Officer Representative/Program Officer and the Senior Intelligence Officer.
a. Intelligence-Related Activities: Activities that are not conducted under the authority of Executive Order 12333 that involves the collection, retention, or analysis of information, and the activities’ primary purpose is to:
(1) Train intelligence personnel.
(2) Conduct research, development, or testing and evaluation for the purpose of developing intelligence-specific capabilities. Activities that use intelligence funding (e.g., Military Intelligence Program or National Intelligence Program) are presumed to be intelligence or intelligence-related activities.
NOTE: Specifically excluded from this definition are operational security activities, such as own force monitoring, force protection, maintenance of technologies or systems, cyberspace surveillance and reconnaissance operations. This is not an exhaustive list. See DODM 5204.01 Section 3.1.a (3) for additional information.
3. Questionable Intelligence Activity (QIA): Any Intelligence or Intelligence-related activity when there is reason to believe such activity may be unlawful or contrary to an Executive Order, Presidential Directive, Intelligence Community Directive, or applicable DoD policy governing that activity.
4. Significant or Highly Sensitive Matter (S/HSM): An Intelligence or Intelligence-related activity (regardless of whether the Intelligence or Intelligence-related activity is unlawful or contrary to an Executive Order, Presidential Directive, Intelligence Community Directive, or DoD policy), or serious criminal activity by Intelligence personnel, that could impugn the reputation or integrity of the Intelligence Community, or otherwise call into question the propriety of Intelligence activities.
Such matters might involve actual or potential:
Congressional inquiries or investigations.
Adverse media coverage.
Impact on foreign relations or foreign partners.
Systemic compromise, loss, or unauthorized disclosure of protected information.

a. An activity or conduct that qualifies as either a Questionable Intelligence Activity (QIA) or a Significant or Highly Sensitive Matter (S/HSM) is reportable without waiting for substantiation, completion of an investigation, formal adjudication, or final resolution of the issue.
b. No adverse action will be taken against DoD contractor personnel because they intend to report to the appropriate authorities what they reasonably believe is a QIA or S/HSM.
c. The above requirements do not preclude, supersede, or limit the existing authorities and policies governing reporting of criminal or counterintelligence matters to the Defense Criminal Investigative Organizations (DCIO) and Military Department Counterintelligence Organizations (MDCO). NCIS is the DON DCIO and MDCO.
Intelligence Oversight
1.
