1.0 SCOPE
The Small Task Order Construction Contract (STOCC) basic contract Statement of Work (SOW) defines the scope of a full range of design, construction and engineering activities projects at John F. Kennedy Space Center (KSC), FL and NASA/KSC facilities located at Cape Canaveral Air Force Station, FL. The STOCC basic contract SOW will be tailored to identify specific requirements at the Task Order (TO) level.
The STOCC SOW provides maximum flexibility in the use of this contract vehicle. Basic requirements described in the SOW will be further refined in individual TOs. TOs will be issued in support of minor construction, renovation and repair projects, and design-build projects at various stages of development. General performance requirements for construction activities are described throughout the SOW. Depending on the project development stage and level of design required, TOs will be issued for construction work plans based on the SOW, Design-Build (D-B) or Design-Bid-Build (D-B-B) Construction as determined by the Government. Each method is separately described in Section 6.0 of this SOW. Stand-alone design is not included in the scope of the STOCC. The Contractor shall comply with the Whole Building Design Guide when constructing new permanent facilities or major renovations/repairs of existing facilities designed using D-B procedures.
Individual TOs will vary in size; with the majority expected to be between $2,000.00 to $5,000,000.00. The TOs will include tasks in a variety of trades, such as carpentry/wall construction, roofing, interior and exterior electrical, mechanical/HVAC, fire protection, plumbing, sheet metal, painting, demolition, concrete, masonry, welding, road repair, excavation, and site improvements. The Contractor shall be required to furnish all materials, equipment and personnel necessary to plan, design, manage, and accomplish the work. The need also includes a design, build component to address urgent projects.
Prior to issuing any TO under the STOCC, the Government will develop Statement of Objectives (SOOs). The SOOs will clearly define the project requirements in terms of performance, appearance, criteria and/or specification with sufficient detail to permit the Contractor’s to provide a proposal with reasonable performance, cost and schedule.
The Contractor shall perform as an integral team member in support of KSC and NASA/KSC facilities. To include sharing information with other contractors and cooperation with communities and other Government entities.
The Contractor shall provide efficient management of all issued TOs including, but not limited to, the submission of accurate, on time, quality contract deliverables, timely identification and solution of impediments to successful project execution. The Contractor shall utilize sound technical judgement including, but not limited to the development of the most cost-effective and technically sound approach or solution. The Contractor shall provide expertise in recognizing and addressing problematic issues and successful execution of each TO.
2.0 APPLICABLE DOCUMENTS
The Contractor shall identify and comply with applicable federal, state, and local laws; statutes;
Executive Orders; NASA/KSC manuals, handbooks, regulations, guidance, and policies to include Technical Reference 001, Technical References. The Contractor shall comply with the National Institute of Building Sciences, Whole Building Design Guide Construction Criteria Base (CCB), Unified Facility Criteria (UFC) and all of the related libraries. The Unified Facilities Guide Specifications (UFGS) is the mandatory starting point for all specifications, and shall not be deleted, materially modified, or made less stringent without Government approval.
The Contractor shall identify and comply with all applicable requirements. The Contractor shall serve as the Designer of Record (DOR) to identify any design/construction criteria waivers that are warranted for the TO and to accomplish all necessary coordination activities to obtain approval of these proposed waivers through the Contracting Officer (CO), and/or Contracting Officer Representative (COR).
3.0 GOVERNMENT FURNISHED INFORMATION (GFI)
GFI will be specified in each TO, to include delivery, management, accountability and disposition (if needed).
To the extent, available, the Government will provide information in the form of available conceptual design plans, reports, maps, drawings, and as-built drawings as necessary to facilitate accomplishment of the work required in the TO SOO. However, any GFI is to be utilized by the Contractor as guidance to facilitate a project and are not warranted to show conditions as they actually exist. The Contractor shall verify (by field investigation and/or through design development) accuracy of all GFI (relevant to the project) to ensure technical adequacy of the design.
4.0 GOVERNMENT-FURNISHED EQUIPMENT (GFE) GOVERNMENT FURNISHED
PROPERTY (GFP) AND MATERIALS (GFM)
GFM will not be furnished to the Contractor as a general rule. However, the Government reserves the right to provide GFM and/or GFE to the Contractor on any TO. In such cases, GFM and/or GFE shall be receipted for by the Contractor and the line item material cost shall be excluded from the price of the TO. The Contractor shall follow the instructions of the CO/COR regarding the disposition of all GFP not consumed in performance of the TO.
Contractor Transporting: The Contractor with his own forces, shall transport all GFM and/or GFE, if any, included in the TO, from the Government storage area to the work site indicated in the TO.
Risk and Responsibility: Once accepted, the Contractor assumes the risk and responsibility for the loss or damage to any GFM/GFE.
Location: The location (as well as the type, quantity, and description) of GFM/GFE will be identified in each TO.
5.0 MANAGEMENT, PLANNING, AND REPORTING REQUIREMENTS
The Contractor shall implement a full range of design, construction and engineering activities as specified in each TO and in accordance with all applicable compliance documents. The Contractor shall supply all labor, equipment, and materials necessary to accomplish the work assigned unless otherwise specified in each TO. The Contractor shall perform management and planning functions, including performance measurement and status reporting to effectively secure and monitor prime and sub-contract work, as required in each TO.
5.1 Schedule and Planning Requirements
The Contractor shall provide a construction schedule for each task order issued.
5.1.1 Project Planning Chart (PPC)
The Contractor shall prepare and submit a PPC as needed for approval unless CO approves otherwise. The plan shall detail the project schedule and status through the use of Gantt Charts or other Government approved software, which shall depict percent complete for each task.
5.1.2 Schedule
The Contractor shall submit an updated schedule within 10-calendar days of award or as otherwise directed by the CO for Government review, evaluation, and approval. The schedule shall be based on the schedule presented in the Contractor’s accepted proposal. The schedule shall be cost loaded according to contract award most current Construction Specification Institute (CSI) Divisions and include major cost/schedule drivers such as, major material submittals and/or long lead-time items, work plans, and project close-out. The schedule shall include an advanced level of detail and include all necessary activities, tasks, and subtasks to reflect all remaining construction activities. The schedule must provide 10 business days for Government review and approval of construction material submittals. The schedule shall be provided by the Contractor and approved by the Government before progress payments can be made and in some cases before work can commence. The approved schedule shall not be re-baselined by the Contractor without approval by the CO. In the event of a contract change, the Contractor shall provide a re-baselined schedule, showing any new activities created by the change. Also, with the new re-baselined schedule, a narrative must be provided detailing how any tasks in the previous schedule were altered.
The Government shall use the schedule to measure the progress of the work based on earned value and aid in evaluating all progress payments. The Contractor shall update the schedule monthly unless otherwise directed by the CO. At a minimum, the submittal shall be derived from the schedule and be structured by major CSI divisions and assigned appropriate value in relationship to overall work and contract value. The Contractor shall submit the updated progressed schedule (in native format and .pdf), as needed. Upon acknowledgement of the NTP and continuing throughout the contract, the Contractor shall record on the daily report, the occurrence of adverse weather (i.e. Phase I and Phase II lightning warning times), launch critical day impacts, and resulting impact to normally scheduled work.
5.2 Meeting and Conference Requirements:
The Contractor shall attend and support periodic meetings and/or teleconferences through the various design and/or construction phases of the contract. Frequency of periodic meetings will be specified in the TO. Reference section 17 “Task Order Administration”
5.2.1 Meeting/Teleconference Support
The Contractor shall prepare and submit for review, presentation materials for meetings and an agenda. Sample agenda is attached Technical Reference 002.
5.2.2 Red Zone Meeting
The Contractor shall support “Red Zone Meetings” as part of the closeout of the project if indicated in TO. The “Red Zone” shall commence at 80-percent of construction completion. At this meeting, the Contractor and the project stakeholders shall discuss, define, and achieve consensus on actions necessary to complete construction, support user occupancy, and project closeout.
5.2.3 Monthly Progress Meetings
The Contractor shall meet with the CO, COR and other Government representatives, once a month to review the Contractor’s performance and provide percentage completion status on all individual TOs. The Contractor shall take meeting minutes of all items discussed at the meeting and provide those meeting minutes electronically to the CO, COR and PM.
5.2.4 Nuts and Bolts Meeting
The contractor shall request a Nuts and Bolts meeting within 10 days before construction start, but no later than 4 working days before construction start date. Meeting will include Inspector, NASA Safety and Environmental Point of Contact. The contractor shall ensure the meeting is attended by all personnel who will be working on the project. For subcontractors who are unavailable, another meeting may be requested when they become available.
5.3 Notification Requirements
The Contractor is required to notify the CO, COR and PM of anything the Contractor feels is outside their scope of work and/or beyond their control that could impact cost, schedule, or quality via a Request for Information (RFI) (Reference section 22.0 “Request for Information).
Additionally, the Contractor is required to notify the CO, COR and PM of critical issues that may affect the contract performance and/or human health and the environment. These types of issues that require notification include, but are not limited to, health risks, spills, or changes in critical or key personnel.
5.4 Permits
The Contractor shall develop, coordinate, and, apply for and obtain all applicable permits, access (including off-base easements and leases), agreements, licenses, and certificates required to perform and complete effort as specified under each TO. Local construction permitting procedures shall be followed for any work at KSC. Specific permits shall be cited in individual TOs and may include KSC siting, excavation, burn, construction stormwater and environmental resource, utility outage, electrical work, and Florida Department of Environmental Protection permits. The Contractor shall maintain a library of these documents at the Contractors site office, as well as, the corporate facility handling each TO, and in the Data Collaboration Site (Reference section 5.14.3) to be readily available to the Government. The Contractor shall comply with all applicable permit conditions and shall keep all permits “current” until construction is 100% complete.
The Contractor shall plan and detail any work of this nature sufficiently in advance of the proposed work and shall allow a minimum of 10 business days to process the permit request in accordance with KNPR 8500.1, KSC Environmental Requirements. Work shall not begin until all relevant construction permits have been processed, returned to and approved by the CO/COR.
Utility Outage Requests and Electrical Work Permits are detailed in section 14.0 “Utility Outage, Energized Electrical Work, Electrical Hazard Analysis, And Excavation Permits”.
5.5 Photo Documentation
The Contractor shall prepare digital photo documentation, including site(s) and building(s) under construction, field activities, and sample locations if applicable. Digital photos shall be submitted using a minimum five (5) mega pixel photograph in JPEG format. The Contractor shall provide an index for each set of photographs submitted, identifying the base or facility, project number, Contractor, and a brief description. Photography of any kind must be coordinated through the installation, customer, or facility POC. Photo documentation shall be loaded to the Data Collaboration Site (Reference section 5.14.3) as specified at the TO level, as requested by the base POC or directed by the CO, COR and/or PM.
5.6 Remote and/or Austere Sites
The Contractor may be requested to perform construction as specified at remote and/or austere locations. The Contractor shall be responsible for all personnel, security, supplies, equipment, and infrastructure (including, but not limited to, potable water, utility systems, etc.) when these facilities and services are not available. This shall include providing these facilities and services to a limited number of Government personnel or other contractor personnel present or visiting to oversee or assess the work.
5.7 Installation Regulations and Requirements
The Contractor shall abide by all installation regulations and requirements included in Exhibit 1.
5.8 Site Access Badges
The Contractor shall obtain and monitor assigned security badges or passes (used by both contractor and subcontractor personnel) for the duration of this contract. All security badges or passes shall be returned to the base POC upon expiration of the badge, upon completion of the project, or when possession of the badge is no longer necessary (e.g., upon removal of contractor personnel from specific projects). Specifics on site access will be included in the Preconstruction Conference, at a minimum all Personal Identifiable information (PII) will have to be submitted via an encrypted e-mail.
5.9 Security Requirements
If existing facility security features are impacted in the performance of work required under this contract, the Contractor shall provide temporary measures to assure security is maintained at the level existing prior to construction or in advance request the required support (if available). This may include such security items as fencing around a facility or closing all openings in a structure during non-working hours.
5.10 Work in Secure Areas
Select Government facilities and areas have been designated as having restricted or controlled access and require special procedures for entering, exiting, or performing operations within those areas. Secured areas will be clearly identified in the Government developed SOO for each TO.
All work inside restricted/controlled area(s) is inherently subject to brief delays due to security processing, as well as, interruptions to the normal work schedule to protect mission essential operations. If the Contractor experiences any undue delay in performance of a TO outside the Contractor’s control, the Contractor shall immediately address the delay with the CO/COR.
The Contractor shall clearly identify, in the technical and/or cost proposals, specific items of work to be accomplished in any secured area identified in the TO.
5.11 Sub Contract Management
The Contractor shall be responsible for their subcontractors to include but not limited to scheduling, site superintendent, and Quality Control (QC). The Government shall not allow additional time for project completion due to the non-availability/non-performance of subcontractors.
5.12 Safety - Coordination of Worksite Activities
The Contractor shall be responsible for protecting the lives and health of employees and other persons on the work site; preventing damage to property, materials, supplies, and equipment;
avoiding work interruptions; and complying with Occupational Safety and Health Administration (OSHA) safety, as well as, local safety and environmental office requirements. The Contractor shall perform all operations in a prudent, conscientious, safe and professional manner and conform to the safety and environmental requirements contained in the contract for all activities related to the accomplishment of the work.
The Contractor shall assume full responsibility and liability for compliance with the applicable regulations pertaining to the health and safety of personnel during the execution of work. The Contractor is required to comply with all OSHA requirements with respect to worker health, safety, materials and equipment used in all projects.
The Contractor shall develop and provide a Site Specific Safety Plan (SSSP) in accordance with KNPR8715.7 KSC Construction Contractor Safety and Health Practices Procedural Requirements. A Site Specific Safety Plan (SSSP) for each TO is due within 10 calendar days after TO award for review and approval. The Contractor shall upload the SSSP to the Data Collaboration Site (Reference section 5.14.3). The SSSP shall address all work to be performed by the Contractor and its subcontractors for the specific TO. On-site work shall not commence until the SSSP is approved by the CO. Job Hazard Analysis (JHA) of hazardous tasks specific to the jobsite are to be included in the SSSP. JHAs arising after the approval of the SSSP shall be submitted as an addendum to the SSSP to the COR and approved via the Data Collaboration Site prior to commencement of any hazardous work.
The Contractor shall maintain documentation supporting training records on site and have the approved Site Specific Safety Plans (SSSP) with all the addendums (if any) on site and available for workers and/or regulatory review.
In the event of an accident/mishap, the Contractor shall take reasonable and prudent action to establish control of the accident/mishap scene, prevent further damage to persons or property, preserve evidence until released by the accident/mishap investigative authority through the CO, and immediately report the incident using the most expedient communication means (e.g., dialing 911). In the event that medical treatment is refused, the Contractor shall require the victim(s) to sign an appropriate “refusal of treatment” form.

If the Government elects to conduct an investigation of the accident/mishap, the Contractor shall cooperate fully and assist Government personnel in conducting the investigation until it is completed. The Contractor shall record and report promptly (within 1 hour) by telephone, email or other direct means to the CO, COR, PM, and the installation POC(s), all available facts relating to each instance of damage to Government property or third party property or injury to either contractor, Government, or third party personnel in accordance with KNPR 8715.3-1, KSC Safety Procedural Requirements Volume 1, Safety Procedural Requirements for Civil Servants/NASA Contractors.
The Contractor agrees that all personnel and equipment are subject to safety inspections by Government personnel while on federal property. The job site shall be subject to inspection by KSC Safety and Health personnel at any time. KSC construction safety specialists perform site visits of all NASA/KSC Construction project sites in accordance with KNPR 8715.7 Section
2.15 Inspections.
5.13 Environmental - Coordination of Worksite Activities
5.13.1 Environmental Protection
(1) The Contractor shall assume full responsibility and liability for compliance with the applicable environmental regulations during the execution of work.
(2) All Contractor work and operations shall comply with KNPR 8500.1, KSC Environmental Requirements.
(3) The Contractor shall remove all refuse from each respective installation for work performed under each TO.
(4) All items having any apparent historical or archaeological interest, which are discovered in the course of any construction activities shall be carefully preserved by the Contractor.
(5) The Contractor shall leave the archaeological find undisturbed and shall immediately report the finding to the CO and COR so that the proper authorities may be notified.
(6) The Contractor shall ensure that asbestos is not to be used in any construction materials including insulation, floor tiles, felts, adhesives, sealant, or for any structural use. The Contractor shall contact the Government if asbestos is encountered during work execution.
(7) The Contractor shall procure products made from recycled or recovered materials and other environmentally preferable products whenever possible. (Ref. FAR Subpart 23.1, Sustainable Acquisition Policy, and NPR 8530.1, NASA Sustainable Acquisition). The contractor shall also procure energy efficient and water efficient products including, but not limited to, Energy Star, WaterSense, Federal Energy Management Program (FEMP) approved products and energy efficient standby power devices where life-cycle cost effective.
5.13.2 Spills
The Contractor shall make all reasonable and safe efforts to contain and control any spills or releases that may occur. The Contractor shall immediately report (by phone) any occurrence of a pollution incident or spill, first to the Emergency 911 (321-867-7911 from a non-867/861 exchange), then to the CO/COR and PM. The Contractor shall document the incident or spill on KSC Form 21-555, "Pollution Incident Report," and submit it to the CO and NASA Environmental Assurance Branch (EAB), SI-E2C1, within 24 hours of the incident.
5.13.3 Hazardous Wastes
The Contractor shall manage all hazardous and controlled waste in accordance with all applicable statutes, rules, orders, and regulations which may include but are not limited to 40 CFR Parts 260
- 268, 273, 279, 761 and KNPR 8500.1 KSC Environmental Requirements. All hazardous waste generated during the execution of this contract shall be disposed of by the Government. Unless directed by the CO, in no case shall the Contractor or the Contractor’s representative transport hazardous waste from KSC. The Contractor’s representative or “Handler” of hazardous waste shall be trained for the proper waste handling and emergency response procedures. Attendance at the KSC training course QG-211 “EPA RCRA Hazardous Waste Processing at KSC” will satisfy the above. KSC50-409 EPOC Project RCRA Contingency Plan shall be completed and submitted prior to Hazardous Waste generation The Contractor shall provide to the CO training records of any “handler” of hazardous waste upon request of the CO.
KSC has established policies and procedures in place to assist the Contractor for characterization, handling and storage of wastes generated on KSC. Any request for assistance shall be in writing and submitted to the CO.
UNKNOWN WASTES If during the course of this contract unidentified waste is discovered by the Contractor or subcontractors, The Contractor shall immediately report (by phone) any occurrence of a unidentified waste is discovered, first to the Emergency 911 (321-867-7911 from a non-867/861 exchange), then to the CO/COR and PM. The Contractor shall not attempt to move, open or test any unknown commodities.
UNIVERSAL WASTES (UW) For items meeting the definition of UW, the Contractor shall handle, collect and manage in accordance with 40 CFR 273 and Chapters 62-730 and 62-737 FAC and KNPR 8500.1. The Environmental Protection Agency (EPA) established Universal Waste regulations to ease the requirements for managing hazardous wastes that can be recycled.
Waste streams currently adopted by the State of Florida for management as UW are rechargeable batteries, mercury-containing lamps and devices, capacitors, and certain pesticides.
The Contractor’s representative or “Handler” of UW shall be trained for the proper waste handling and emergency response procedures. Attendance at the KSC training course QG-211 “EPA RCRA Hazardous Waste Processing at KSC” will satisfy the above. The Contractor shall provide to the CO training records of any “handler” of UW upon request of the CO.
HAZARDOUS WASTE SATELLITE ACCUMULATION AREAS This clause applies to FDEP/EPA Satellite Accumulation Areas that are the responsibility of the contractor. For these areas, the following apply (request examples of documentation from the contracting officer, if needed):
A contingency plan is required to be submitted to the contracting officer for review at least 30 calendar days prior to use of a 40 CFR Part 262 Subpart M applies to Satellite Accumulation Area.
Waste must be managed in accordance with the RCRA regulations – ensure proper handling.
The Satellite Accumulation Area is required to be roped off with signs saying, “Hazardous Waste Danger – Unauthorized Personnel Keep Out,” posted on each side of the roped off area. The sign must also include name and phone number for the contractor’s responsible person(s).
No smoking signs are required to be posted conspicuously on each side of this roped off area.
At least 7 calendar days prior to initial use, the contractor shall hold a site specific training/meeting about the Satellite Accumulation Area to inform government, contractor, and subcontractor personnel associated with the project that the waste they generate may be hazardous, ensure proper handling of the hazardous waste, the correct processes for storage, and the correct processes to access/inspect the area, and be able to understand and implement the site specific contingency plan. Documented Proof of this training is required.
5.13.4 Solid Waste
The Contractor shall be responsible for the proper management of all solid waste generated at KSC from the execution of this contract. The Contractor shall segregate and transport all solid waste to disposal locations designated in the Contract Documents. The Contractor shall police work areas daily for loose trash and debris. The Contractor shall collect and properly dispose of wind-blown debris daily to prevent migration of debris/trash offsite.
Trash items not requiring special handling, or which cannot be resold or recycled, shall be disposed of in receptacles slated for disposal in either the KSC Landfill or the Brevard County Landfill. KSC has numerous policies and processes in place to properly categorize, handle, store and dispose of waste streams generated during the project. It is the contractor’s responsibility to make every effort to reduce the impact of the project on the environment. This includes utilizing all practical means to reduce the amount of waste that is landfilled or incinerated.
5.13.5 Schwartz Road Landfill Operations
The KSC Landfill is an unlined Class III landfill. Any waste permitted by FDEP regulations for disposal in a Class III landfill as defined in Rule 62-701.200(14), FAC can be accepted at the landfill (excluding friable asbestos). For the purpose of meeting recycling, waste diversion and reuse goals, KSC has restricted certain solid waste from landfill disposal (See Recycling and Salvaging Materials Section of PWS) Landfilling of waste shall be the Contractor’s last option for disposal.
The physical dimensions of the waste shall be within the handling capabilities of the landfill disposal equipment. The physical dimensions for the landfill handling capabilities are 8 feet in length x 8 feet in width. Only the following items listed will be accepted at the landfill:
(1) Asphalt: Asphalt removed from parking lots, driveways, and roadways.
(2) Blast Media: The blast media must be as free from debris as possible and determined nonhazardous for acceptance into the KSC Landfill. The Spent Sandblast Media Disposal Form must accompany the blast media to the landfill and will be reviewed by the landfill operator. Blasting media determined to be a hazardous waste must be managed as hazardous waste.
(3) Carpeting
(4) Construction and Demolition Debris: Materials considered not water soluble and non-hazardous in nature, including but not limited to steel, brick, glass, concrete, asphalt, pipe, gypsum wallboard and non-pressure treated or unpainted lumber. This also includes rocks, soils, tree remains and other vegetative matter, which normally result from land clearing or development. Scrap metal from demolition projects should be managed according to guidance provided under article entitled “Recycling and Salvaging Materials”. The landfill may not accept any painted materials that test above the lower Toxicity Characteristic Leaching Procedure (TCLP) detection limits for barium, cadmium, chromium, lead, and mercury. If TCLP results are above the lower TCLP detection limits, the Contractor shall submit a PWQ for evaluation per article entitled “Hazardous Wastes.”
(5) Fiberglass
(6) Glass (except light bulbs or lamps).
(7) Non-Friable Asbestos: Non-friable asbestos, also referred to as Non-Regulated
Asbestos Containing Materials (NRACM) is handled on a case-by-case basis. KSC policy allows for the disposal of NRACM only. In order to dispose of non-friable asbestos, the Contractor shall complete and submit the KSC/Schwartz Road Landfill Non-Friable Asbestos form (KSC 28-1084 NS), which can be obtained from the
Contracting Officer (CO) or the CO’s designee. The form shall be sent to NASA EAB.
The following scheduling procedures shall be followed before NRACM wastes are accepted at the landfill:
a. The waste generator/hauler shall make arrangements with the landfill operator a minimum of 24 hours before disposal of NRACM waste and shall inform the operator of the quantity of the waste and the scheduled date the shipment will arrive at the landfill.
b. NRACM will be accepted at the landfill with prior arrangement with the scale house attendant (minimum of 24 hours notification) Tuesday and Thursday, excluding holidays, from 0700 hours to 1100 hours and from 1300 hours to 1500 hours.
(8) Pallets (Unserviceable Wood and Plastics): Pallets that are not reusable or recyclable are accepted.
(9) PCB Bulk Product Waste: Refer to Clause “PCB Management.”
(10) Wood: Miscellaneous non-pressure treated wood items are accepted.
(11) Yard Waste (Vegetation): Vegetation from maintenance and land clearing activities is accepted.
5.13.6 Confined Space
The Contractor's designated safety professional shall coordinate with the COR to complete a confined space hazard assessment (KSC Form 28-750NS) in accordance with KNPR 1840.19, Kennedy NASA Procedural Requirements for each confined space entry and schedule a job-site inspection meeting with KSC Environmental Health and Safety personnel.
5.13.7 Silica Dust Control
OSHA standard (29 CFR 1926.1153) requires employers to limit worker exposure to respirable crystalline silica and to take appropriate steps to protect workers. A written Silica Exposure Control Plan shall be prepared by the Contractor to address work performed on silica containing building components as well as any other site work with the potential to generate silica dust. The Silica Exposure Control Plan must address methods used to determine the levels of respirable crystalline silica that employees are exposed to for specific work tasks; address the engineering and work practice controls, to the extent feasible, to limit employee exposures to the PEL; and establish procedures to restrict access to work areas where silica dust may be generated.
Respiratory protection should only be proposed after a determination that work control practices and engineering controls are not adequate to reduce exposure. A Competent Person must be designated for in the Silica Exposure Control Plan. The Competent Person must have sufficient work experience to identify potential hazards and implement appropriate controls from the plan.
Records of employee exposure to respirable crystalline silica will be provided with closeout documents.
5.13.8 Recyclable Waste Diversion Reports
The Contractor shall provide monthly weight tickets of recyclable material diverted from the KSC landfill from TOs as a Transmittal via the Data Collaboration Site (Reference Section 5.14.3). Tickets shall be in excel or pdf format and weight must be measured in tons.
5.13.9 Recycling and Salvaging Materials
The Contractor shall divert all of the following Construction and Demolition (C&D) waste items including cardboard, aluminum cans, plastic beverage bottles, glass (non-industrial), and white paper/mixed paper from disposal at landfill and incinerator to facilitate recycling or reuse. The Contractor shall require all subcontractors, vendors, and suppliers to participate in this recycling or reuse efforts. These C&D waste items require coordination with the NASA recycling manager.
NASA has recycling containers placed throughout KSC. The Contractor shall collect, segregate and transport these materials to the closest receptacle. NASA may provide containers to the Contractor’s job-site for projects generating large volumes of materials in this category.
5.13.10 Restoration of Grassed Areas Disturbed By Construction
The Contractor shall, prior to completion of the contract, grass all areas disturbed by construction activities by seeding and mulching or, when erosion may occur, by sodding, except where specifically directed otherwise in the drawings and specifications.
5.14 Project Data/Project Deliverables
Project data and deliverables, as specified in each TO shall be provided to Government personnel by the Contractor to support multiple projects with real-time or near real-time access.
Deliverables may include, but are not limited to, shop drawings, transmittals, submittal tracker or register, RFI tracker, change order tracker, photographic log, status reports and project schedule(s).
5.14.1 Protecting Unclassified and Government Data
All Government data that is shared, stored or created on non-government information systems by the Contractor shall be protected and any breach or loss of that data must be reported. See NWR 1400-4 and NASA FAR Supplement (NFS) clause 1852.237-72 Access to Sensitive Information.
5.14.2 Security Breach Notification
The Contractor shall comply with all applicable laws that require the notification of individuals in the event of unauthorized release of personally identifiable information (PII) or other event requiring notification. In the event of a breach of any of the Contractor’s security obligations, or other event requiring notification under applicable law, the Contractor shall:
(1) Notify the CO by telephone and e-mail of such an event within 24 hours of discovery, and
(2) Assume responsibility for informing all such individuals in accordance with applicable law, and
(3) Indemnify, hold harmless and defend the United States, its trustees, officers, enlisted, and employees from and against any claims, damages, or other harm related to such event.
5.14.3 Data Collaboration Site
The Contractor shall use the Government provided SharePoint as the Government Data Collaboration Site for project documents submissions. The Contractor will be provided access to this site after they have been in processed to access KSC IT systems.
5.15 Technical Plans and Reports
The Contractor shall provide technical plans, specifications, and reports as defined below and implemented at the TO level. Some of these may include, but are not limited to, the following:

The Contractor shall prepare a construction work plan that may include, but is not limited to, any or all of the following subsections as identified in each TO.

6.0 FACILITY CONSTRUCTION TASK ORDER DELIVERY METHODS
The Contractor shall perform a full range of activities to meet all customers’ construction requirements as designed and/or specified in the TO. The primary purpose of the STOCC is to expedite award of construction and repair requirements.
STOCC TOs initiated by the Government will be 1 of 4 Work types:
Type 1: Initiated via the SOO developed by the Government which may be accompanied by a sketch. This work will predominately be minor construction and repair work and require limited engineering support including: engineering drafting, construction submittal development and post construction as-built drawings. The Government expects the majority of the work to fall into this category.
Type 2: Initiated via 100% design and specifications package.
Type 3: Initiated via the SOO developed by the Government to be used by the Contractor to execute a design-build project. This work will require intermediate engineering support to develop a 40% design package prior to construction implementation. This work will also require engineering drafting, construction submittal development and post construction as-built drawings. NOTE: A 40% design is defined as: A 30% design and specification document developed by the STOCC Contractor, which has incorporated design review comments generated from a 30% design review meeting.
Type 4: Initiated via a SOO developed by the government to be used by the Contractor to execute a Design-Build project. The contractor will use the 30% design as a concept design. The contractor will then collaborate with the government and the contractor’s Architect-Engineering firm to develop a 50%/90%/Final design packages to meet the SOO requirements. This work will also require engineering drafting, construction submittal development and review, and post construction as-built drawings. The design and specifications will be incorporated into the contract via modification at the end of the design portion of the project.
7.0 TASK ORDER INITIATION PROCESS
Initiation of a TO will start with a Request for Proposal (RFP) from the CO. The RFP shall consist of a SOO, describing the scope in general terms. The Contractor may also be provided GFI (if available), a list of users/technical points of contact, and a list of GFE and/or GFM.
(1) The CO or government representative will schedule with all the Contractor’s an initial site visit no later than five business days upon receipt of the RFP.
(2) The initial site visit meeting shall include the Contractor’s, CO/COR, Project Manager, and/or Facility Manager. At a minimum, the following items shall be discussed:
a. Methods and alternatives for accomplishing the work.
b. Definition and refinement of requirements.
c. Detailed SOO.
d. Government as-built drawings: The Contractor’s shall verify that as-built drawings provided by the Government are current and accurate. All dimensions and elevations indicated on the as-built drawings shall be field verified by the Contractor’s. The Government does not guarantee the accuracy or adequacy of existing as-built drawings. The Contractor’s shall verify all existing site conditions prior to the issuance of each TO. All Contractor’s observed discrepancies between drawings, specifications and existing conditions shall be submitted as a pre proposal question for disposition before affected work is performed.
e. Environmental Compliance. The Contractor’s shall adhere to the environmental requirements identified in the resultant Record of Environmental Consideration.
8.0 CONTRACTOR PROPOSAL PROCESS
Upon completion of the “Task Order Initiation Process”, the Contractor shall submit to the CO a proposal that includes a cost proposal, technical proposal, and a proposed performance period.
The Contractor’s proposal shall be submitted via e-mail in accordance with the proposal schedule below.

An RFP is not to be construed as the Contractor’s authority to commence work. Additionally, submission of a proposal by the Contractor shall not constitute an obligation by the Government to issue a TO. The Government may issue an RFP and conduct negotiations without obligating the Government to issue a TO for the work described in the submitted proposal. The CO may withdraw the RFP at any time.
9.0 COST PROPOSAL
All modifications/changes and TO awards not based on adequate price competition shall be fully transparent for open negotiations. The Contractor’s proposal for each TO must be supported by a detailed breakout of all material quantities/unit prices, labor hours/rates and equipment duration/rate. A Time Impact Analysis should be included documenting how the change will extend the critical path of the project to justify any additional time to add the scope to the project. The proposal shall be in Microsoft Excel format. All proposals shall be valid for 90 calendar days.
10.0 CONTRACTOR’S TECHNICAL PROPOSAL
The Contractor’s technical proposal shall be supported by documentation demonstrating that all planning, engineering, and construction efforts have been identified to successfully complete all work under the TO. The technical proposal shall consist of the following:
(1) Task Plan: The Contractor, in response to the Government’s SOO, shall develop a task plan to describe the Contractor’s understanding of the SOO.
(2) Supporting Documentation: Supporting Documentation shall include a proposed schedule, but is not limited to, product cut sheets, or any other documentation to justify the proposal.
(3) Incidentals: A discussion on the types of incidental engineering support to be provided by the Contractor.
11.0 GOVERNMENT PROPOSAL PROCESS
The Government’s technical evaluation of the contractor’s proposal may lead to a fact-finding meeting for clarification purposes. After fact-finding and evaluation, negotiations, if required, will be conducted.
12.0 EXECUTION
Upon successful negotiation or acceptance of a proposal, a task order will be issued. The TO will incorporate the results of any negotiations and supporting documentation for contractual requirements. The Contractor shall not begin any physical work until a Notice to Proceed (NTP) is issued by the CO. The performance of STOCC requirements shall meet the standards as denoted in Technical Reference 001, Technical References.
13.0 PRE CONSTRUCTION ACTIVITIES
(1) The Contractor shall submit to the CO, a Site Specific Safety Plan (SSSP) for each TO no later than 10 calendar days after TO award. The SSSP shall address all work to be performed by the Contractor and its subcontractors. On-site work shall not commence until the SSSP is approved by the CO. Job Hazard Analysis (JHA) of hazardous tasks specific to the job site are to be included in the SSSP. JHAs arising after the approval of the SSSP shall be submitted via the Data Collaboration Site (Reference section 15.14.3) and approved prior to commencement of any hazardous work.
(2) The Contractor shall submit, via the Data Collaboration Site for disposition, a schedule as drafted within 10 days after the TO award.
(3) The CO shall schedule and conduct a pre-construction or pre-design meeting to discuss site specific issues defined below. The Pre-Construction meeting shall be attended by the Contractor, Subcontractors, CO, COR, NASA Safety Representatives, and Government Environmental representatives (if necessary).
The pre-construction or pre-design meetings shall:
i. Include a discussion of the Contractor's SSSP and implementation of all safety and health provisions pertinent to the work to be performed under the TO. The Contractor shall be prepared to discuss, in detail, the measures to control any unsafe or unhealthy conditions associated with the work to be performed. The level of detail for the safety meeting is dependent upon the nature of the work and the potential inherent hazards.
ii. Include a discussion of Environmental permitting and/or compliance issues and the method with which the Contractor intends to address them.
iii. Include a discussion of Facility & Operational impacts and the method with which the Contractor intends to address or mitigate them.
iv. Include a discussion of expected Site and Dig Permits. (The Contractor, in conjunction with the PM/Inspector, shall complete an excavation permit request (KSC FORM 26-312V3 UTILITY LOCATE/EXCAVATION PERMIT REQUEST) for any work which requires excavation in order to have underground utilities located.)
v. The Contractor will be thoroughly briefed on utility locations at the pre-construction meeting as applicable. The Contractor/subcontractor shall be present during utility locates at the job site. It should be noted that the locations of utilities are an approximate measure therefore the Contractor shall take appropriate caution when excavating, or penetrating the surface, including hand digging as directed. The Contractor shall be responsible for any damages that occur during the performance of the work, if the utility was identified and within the general area of the work site.
vi. Include a discussion of Maintenance of Traffic plans (applicable to roadway construction projects).
vii. Include a site inspection to document general and specific site conditions of the facility or site. If necessary, the Contractor, in conjunction with the Government, shall complete a siting request per KDP-KSC-P-1303 to validate that the proposed site for the construction is approved by the KSC Master Planning Office.
