1. RFP Form 1442 Block 10 Question:
Block 10 of the SF 1442 states that “competition will be limited to 8(a) firms located within the geographical area of the State of Florida and other 8(a) construction firms with a “bona fide place of business” within the State of Florida.” In the past, we have seen out of state companies simply rent office space in order to have a Florida address and to qualify as a bona fide Florida business. We have also seen other RFP’s require that they have a 5‐year track record of having an established business in Florida. Please clarify the requirements to be considered a “bona fide place of business within the State of Florida.”
Answer: The procedures for establishing a bonafide place of business in a particular geographical location are outlined in 13 CFR 124.507 (c)(2)
(2) Construction competitions. Based on its knowledge of the 8(a) BD portfolio, SBA will determine whether a competitive 8(a) construction requirement should be competed among only those Participants having a bona fide place of business within the geographical boundaries of one or more SBA district offices, within a state, or within the state and nearby areas. Only those Participants with bona fide places of business within the appropriate geographical boundaries are eligible to submit offers.
(i) A Participant may have bona fide places of business in more than one location.
(ii) In order for a Participant to establish a bona fide place of business in a particular geographic location, the SBA district office serving the geographic area of that location must determine if that location in fact qualifies as a bona fide place of business under SBA's requirements.
(A) A Participant must submit a request for a bona fide business determination to the SBA district office servicing it.
(B) The servicing district office will forward the request to the SBA district office serving the geographic area of the particular location for processing.
(iii) The effective date of a bona fide place of business is the date that the evidence (paperwork) shows that the business in fact regularly maintained its business at the new geographic location.
(iv) In order for a Participant to be eligible to submit an offer for a 8(a) procurement limited to a specific geographic area, it must receive from SBA a determination that it has a bona fide place of business within that area prior to submitting its offer for the procurement.
2. RFP Form 1442 Block 13(b) Question:
Block 13 b of the SF 1442 states that an offer guarantee is required. The RFP states that this is a proposal for phase 1 only and no pricing is required, is this correct? We would anticipate any offer guarantees would only be required under phase 2 task orders. Please clarify.
Answer: An offer guarantee is not required for Phase 1 proposals. For Phase 1 no pricing is required. The Offeror shall provide a letter, from an approved surety, stating the offeror has, as a minimum, both a current bonding capacity for this acquisition of at least $5 million (per project) and at least $10 million for the aggregate project amount. The letter shall include the name and telephone number of the Bonding Company(s). Such bonding capacity should meet the requirements of FAR 52.228‐15, Performance and Payment Bonds ‐ Construction.
3. RFP Section H Page 21 Question:
Paragraph 5.0 under Design/Build (100%) and Minimal Design Build state that the contractor shall provide either a 15% or 35% design package. Will this design requirement apply only to a contractor selected for a specific task order or will it apply to all contractors competing for those design/build or minimal design/build task orders?
Answer: The full ordering procedures are defined in paragraph H.2. The requirements are defined in paragraph 5.0. All task orders will be competed unless an exemption applies within paragraph H.3. The design/build requirements of paragraph 5.0 will apply to all contractors awarded an IDIQ responding to each
Task Order RFP.
4. RFP Section L Page 66 Question: Are the Past Performance Questionnaires sent to two points of contact for each project?
Answer: The Government requests the offeror send out the questionnaire (see Attachment 4) for each contract they list listed in their Volume III. Offerors shall request the customer to complete the questionnaire.
The Past Performance Volume shall include a list of questionnaire recipients to include two current POCs and phone numbers for each contract reference provided.
5. RFP Attachment 4 and RFP Section L Page 66 Question: Should the PPQs be sent to both Benjamin Crafton and Jacqueline Brooks? There are conflicting instructions on the Attachment and the RFP.
Answer: The completed PEQs shall be emailed by respondent directly to Benjamin.p.crafton@nasa.gov and Jacqueline.a.brooks@nasa.gov; however, the PPQs sent only to Benjamin.p.crafton@nasa.gov per the attachment 4 instructions will be forward to Jacqueline.a.brooks@nasa.gov by Benjamin.p.crafton@nasa.gov
6. RFP Section L.13 Paragraph 3(c) Question:
The RFP states that "A cover letter for transmitting the questionnaire to each POC is included." We cannot locate the referenced cover letter, please provide.
Answer: Everything is combined within Attachment 4 already, there is no separate letter.
7. RFP Section L. Volume III Factor 2 Question:
Do projects need to be 100% completed to be used for past performance? If not, what percentage complete can be used to support using a project?
Answer: Refer to the Recency Assessment on pages 72 and 73. ….efforts that have not yet been completed shall have had at least six months of performance prior to the date of issuance of this solicitation.
8. RFP Section L. Volume III Factor 2 Question:
Can we use a project as past performance for a project if the current JV managing member is part of another
JV and is also the managing member?
Answer: Refer to the page 67 & 72. ….Joint venture partners’ past performance shall be part of the aggregate performance evaluation. Past performance of other teaming partners or subcontractors shall not be considered; When providing past performance information, consideration should be given to those aspects of an offeror’s, teaming partner’s, and joint venture participant’s contract history that would give the greatest ability to measure whether the offeror will satisfy the current procurement.
9. RFP Section L. Volume III Factor 2 Question:
If a project has a completed CPARS in the government system can we use it in lieu of a NASA PPQ form? And
Can we use previously completed PPQs from other proposals versus trying to obtain another PPQ from a client?
Answer: No. The PPQ is tailored to address specific questions based on risks/challenges of performing the requirements included within this solicitation. CPARS will be assessed as well, however, some of the questions in the PPQ address different performance areas than what is included in CPARS.
10. RFP Section M. Relevancy Assessment Question:
Will NASA consider lowering the (1) design‐build project with a value of $2.5M to $1.0M?
Answer: No. But a $1M design build project can be combined with 2 other projects that were performed simultaneously.
11. RFP Section Block 13a. Question:
Will NASA consider extending the due date to September 1, 2020? If no, will NASA considered changing the due date to Tuesday, August 25, 2020 which will allow us to finalize the proposal over the weekend and ship out Monday August 24. With the Aug 24th due date ‐ we will need to ship by Friday Aug 21st for a Monday
Aug 24th delivery.
Answer: No. Not for this reason; however, the RFP is being amended to extend the proposal due date to
Wednesday, August 26, 2020 to support KSC Mail Services due to the COVID‐19 Pandemic.
12. RFP Section L Past Performance Question:
Construction Project Listing ‐ if the JV only has 2 completed projects between them ‐ do each of the JV partners need to provide a Construction Project Listing for the last 3 years?
Answer: Refer to the page 67 & 72. ….Joint venture partners’ past performance shall be part of the aggregate performance evaluation. Past performance of other teaming partners or subcontractors shall not be considered; When providing past performance information, consideration should be given to those aspects of an offeror’s, teaming partner’s, and joint venture participant’s contract history that would give the greatest ability to measure whether the offeror will satisfy the current procurement.
13. Proposal Delivery Question:
Will be a way for me to hand deliver our proposal response on 8/24?
Answer: No. due to the COVID‐19 Pandemic, KSC personnel are teleworking and only Mission Critical/Essential personnel are authorized on KSC at this time.
14. RFP Attachment 6 Volume III Past Performance, Item 1
The attachment reads that an entire project listing for the last 3 years is to be included for the Prime. This however is not mentioned elsewhere in the RFP, Is a comprehensive list required? I realize a list of 10 past projects is needed in the proposal.
Answer: No. The purpose of the Checklist is to refer back to the requirements of the Past Performance
Volume; which is to provide a summary of recent and relevant efforts essentially comparable to this acquisition. The Government will use this information to perform a past performance evaluation as described in Section M. Current contracts or subcontracts performed, in whole or part, within the past three (3) years immediately preceding the issuance of this solicitation will be considered RECENT. RELEVANCY is described in detail in Section M. See Section M paragraph 4(c). Recent and Relevant Contracts. Provide a comprehensive list of up to ten recent and relevant contracts to include the information listed below as stated in Section L.
