Addendum to FAR 52.212-2, Evaluation

EVALUATION CRITERIA - BASIS FOR CONTRACT AWARD: The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will represent the best value to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

1. Past Performance, and;

2. Price.

Past Performance will be evaluated on a basis significantly more important than price.

By submission of its offer, the Offeror accedes to all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements. All offers shall be treated equally except for their prices and performance records (Failure to meet a requirement may result in the removal from competition or an offer may not be considered). Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The evaluation process shall proceed as follows:

A. Price Evaluation. Initially offers shall be ranked according to price from lowest priced offer to the highest priced offer. Pricing will be evaluated based on the Total Evaluated Price (TEP) as proposed. The TEP will be calculated by adding the total price of the base, all options years, and labor hour and material mark-up totals (as applied to quantities identified for evaluation purposes only). The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Offers determined to be unbalanced may be deemed ineligible for award by the Contracting Officer if a determination is made that the imbalance poses an unacceptable risk to the Government.

B. Past Performance Information Evaluation. The contracting officer shall seek recent and relevant performance information on the lowest priced Offeror based on (1) the past efforts provided by the Offeror and (2) data independently obtained from other Government and commercial sources.

i. Relevant performance includes performance of efforts involving Vertical Transportation Equipment (VTE) Maintenance & Repair services that are similar or greater in scope, magnitude and complexity than the effort described in this solicitation. The purpose of the past performance evaluation is to allow the Government to assess the Offeror’s ability to perform the effort described in this RFQ, based on the Offeror’s demonstrated past performance. The assessment process will result in an overall performance confidence assessment of Substantial Confidence, Satisfactory Confidence, Neutral Confidence, Limited Confidence, or No Confidence, as defined in the Department of Defense Source Selection Procedures, Table 1 – Performance Confidence Assessments Rating Method.

Past performance regarding predecessor companies, key personnel who have relevant experience, or sub-contractors that will perform major or critical aspects of the requirement will not be considered as highly as past performance information for the principal Offeror. Offerors with no relevant past performance history shall receive the rating "Neutral Confidence," meaning the rating is treated neither favorably nor unfavorably (neutral).

ii. In evaluating past performance, the Government reserves the right to give greater consideration to information on those contracts deemed most relevant to the effort described in this RFQ.

iii. If the lowest priced Offeror is judged to have a “Substantial Confidence” performance confidence assessment, that offer represents the best value for the Government and the evaluation process stops at this point. Award shall be made to that Offeror without further consideration of any other offers.

iv. If the lowest priced Offeror is not judged to have a “Substantial Confidence” performance confidence assessment, the next lowest priced Offeror will be evaluated, and the process will continue (in order by price) until an Offeror is judged to have a “Substantial Confidence” performance confidence assessment.

v. Offerors are cautioned to submit sufficient information in the format specified in 52.212- 1 – Instructions to Offerors to permit a meaningful assessment of past performance.

Offerors may be asked to clarify certain aspects of their offer (for example, the relevance

of past performance information) or respond to adverse past performance information to which the Offeror has not previously had an opportunity to respond. Adverse past performance is defined as past performance information that supports a less than satisfactory rating on any evaluation element or any unfavorable comments received from sources without a formal rating system. Communication conducted to resolve minor or clerical errors will not constitute discussions and the contracting officer reserves the right to award a contract without the opportunity for quotation revision.

To maximize the Government’s ability to obtain best value, based on the requirements and evaluation factors set forth in the solicitation, the Government reserves the right to conduct interchanges with one, some, all, or none of the responding vendors. Interchanges may be conducted either orally or in writing. The scope and extent of interchanges are a matter of the Contracting Officer’s judgement. Offerors may be restricted to a short turn-around (less than 24 hours) in responding to interchanges.

If interchanges are conducted, final proposal revisions will be required in determining the award of the contract resulting from this solicitation. However, the Government reserves the right to award a contract without interchanges or opportunity for proposal revisions, in which case, final proposal revision will not be required.
