Statement of Work Yuma Area Office

Crushing, and Stockpiling Gravel

1. The Requirements

The work to be performed under this Statement of Work (SOW) consists of mobilizing to the designated quarry, processing, and excavating rock into gravel and hauling gravel into Bureau of Reclamation stockpile sites along the Colorado River.

Mobilize to Ehrenberg quarry to crush 1-4-inch material to gravel then load, weigh, haul and stockpile material at site A120.8, 139.4 and A144.2. Contractor will be also maintaining all roads used access and hauling the gravel.

Contractor will be following all the requirements stated in this SOW to perform the work.

2. Locations of Work

Ehrenberg Quarry is located in SE ¼ of NW ¼ in Section 35, T4S, R21W, Gila and Salt River Meridian (GSRM), La Paz County, Arizona.

Stockpile site A120.8 is located in RM A120.8 SEC. 15, T3N, R22W, GSRM Reclamation Withdrawn Land, is approximately 9.5 miles from Ehrenberg Quarry in Arizona.

Stockpile site A139.4 is located in RM A139.4 SEC. 2, T5N, R22W, GSRM Reclamation Withdrawn Land, is approximately 20.8 miles from Ehrenberg Quarry in Arizona.

Stockpile site A144.2 is located in RM A144.2 SEC. 23, T6N, R22W, GSRM Reclamation Withdrawn Land, is approximately 24.5 miles from Ehrenberg Quarry in Arizona.

3. Description of the Work

Work shall conform to the Reclamation Safety and Health Standards; take all necessary precautions to ensure the safety of the public.

The period of performance will be 90 days from the date of award.

Work may include, but is not limited to, any or all of the following tasks:

a. Standard move-in to identified quarry sites.

1. The Contractor’s equipment move-in at Ehrenberg quarry site shall include but not limited to moving into the quarry the required loading equipment, rock crusher, material screening equipment, setting up certified scales, and mobilizing the necessary number of haul trucks. Also, removal of all the equipment at the completion of the contract, at the quarry.

b. Contractor shall reduce 1-4-inch material to gravel.

1. The gravel to be processed for stockpiling shall consists of quarry materials, with fine grained binder, obtained and furnished by selective development of materials from the quarry. The Contractor shall be responsible for the specified quality of all such materials used in processing the gravel material. Government will conduct random gradation testing during the performance of the work, no payment will be made for any material which does not meet the specification gradation requirements. The materials shall be of a maximum size of 1-1/4 inch, shall be free from organic matter, lumps of clay, soft rock, or other deleterious substances and shall be graded uniformly to meet the following grading requirements, by weight, as determined by laboratory sieves listed below:

c. Load, haul, and weigh gravel materials and stockpile 20,800 tons at the stockpile sites indicated in this SOW.

d. Maintain quarry and stockpile roads and haul roads as identified in this SOW.

e. Contractor shall prepare and submit Notice of Intent (NOI) to Arizona Department of

Environmental Quality (ADEQ).

The contractor shall supply all utilities which includes but not limited to water, electric, and fuel during the performance of work. Government will assist the contractor in locating a possible water source, but it will be the responsibility of the contractor to make arrangements to provide it.

4. Measurement and Payment for Processing Gravel Base Materials.

Measurement, for payment, for processing gravel base will be made in tons. Weighing shall be on platform scales, of sufficient length to weigh the entire hauling vehicle at one time.

The Contractor shall furnish the scales. Test the scales as often as the Contracting Officer deems necessary to ensure their accuracy. Determine the tare weight of each truck twice during each 8-hour shift, at such times as designated by the Contracting Officer. The Contractor’s weighmaster shall weigh all materials required to be weighed as herein provided. No direct payment will be made for furnishing and maintaining the scales; include the cost for the scales in your quoted price per ton for items for which measurement for payment by weight is specified. Contractor shall also turn in weigh sheets at the end of each week for verifying quantities in the inspection reports by Government Inspector.

Payment for quarrying, reducing 1- to 4-inch materials to gravel will be made at their respective price per ton, as quoted. The price quote shall include all the labor, material, equipment, and incidentals necessary to process the designated quantities of materials. The unit prices quoted shall include the costs of developing and operating the quarry, implementing the necessary safety requirements as outlined in the Reclamation Safety and Health Standards (RSHS) and Mining Safety and Health Administration (MSHA) quarrying, processing gravel base of the required gradations and all incidentals necessary for quarrying and processing the designated materials.

The Contractor’s quarry move-in price shall include the costs of moving all equipment and tools, setting-up all equipment, and other costs associated with mobilization and the removal of the equipment at the completion of the contract for quarrying and processing, gravel base, and 1- to 4-inch material.

The Contractor’s equipment move-in quoted price shall include the costs of prepping staging area for equipment, moving the required loading equipment, mobilizing the necessary number of haul trucks and the removal of the equipment at the completion of the contract, at a designated stockpile site within the specified time frame.

Payment for quarry move-in will be made at the respective unit prices quoted. De-mobilization costs are included in the move-in quoted prices. The line item for these will be used by the

Government to make payment to the Contractor for its operations, including but not limited to movement of personnel, equipment, supplies, and incidentals to, and from, the project site.

Measurement for payment for loading, weighing, hauling, and stockpiling or placing gravel base based upon the actual weight of materials multiplied by the haul distance to the stockpile or placement site. Weight of the material will be made as specified above and the haul distance will be as shown in section 2 of this document. The distance shall be measured to the nearest 0.1 mile by the Contractor and approved by the Contracting Officer.

Payment for delivering material will be made at the applicable prices per ton-mile. The unit price shall include all the labor, materials, equipment, and incidentals necessary for loading, hauling, weighing, and stockpiling or placing the designated quantities of materials denoted on the line items.

5. Rock Sources

a. General. Gravel, and 1- to 4-inch material shall be obtained from a quarry. The limits of excavation shown on the quarry drawings supplied with contract depicts the Government’s estimate of the volume of materials needed to excavate and process to obtain the material quantities. The Contractor shall develop the quarry’s area, as shown on the drawings, to produce the materials required by the contract unless an alternate area is approved by the Contracting Officer. The actual volume of materials required for excavation and processing to obtain the required quantities of gravel, and 1- to 4-inch material may vary from the limits of excavation shown on the drawings due to the nature of the materials encountered.

The sole purpose of the quarry drawings is to show the location of the quarry and where past work has occurred. It is the contractor’s responsibility to visit the quarry locations to determine the complexity of the work and site working conditions. The contractor will be responsible for determining what area within designated quarry limits will produce the quantity and type of material required for the contract.

The Contractor is responsible for any conclusions as to the nature of the materials to be quarried and the difficulties of performing the quarrying operations. Approval of a deposit (the actual location of the rock as shown on the site plan provided by BOR) is not an approval of all materials taken from the deposit. The Contractor shall be responsible for the specified quality of all such materials used in the work. No payment will be made for any material which does not meet the specification requirements.

The Government reserves the right to change the limits of the work area in the Contractor’s quarrying operations within the general riprap source area in order to obtain suitable materials.

b. Quarry operation. Maintain access roads within the quarry as required for your operations. During the quarrying operation, the height of the working face may exceed 40 feet.

Excess, stripped material, and material that doesn’t meet the specifications remains the property of the BOR. Dispose of waste material in existing small washes at the quarry site, in locations designated by the Contracting Officer. Waste materials shall be graded to a generally uniform surface to blend with adjacent ground surfaces. All suitable material produced in excess of that required shall be left in stockpiles at the quarry site.

c. The Contractor will be responsible for obtaining all of the necessary permits including the ADEQ requirements as determined by the individual management districts.

The Contractor shall notify the appropriate district manager of Mine Safety and Health Administration (MSHA), in accordance with 30 CFR 56.1000, before commencing quarry operations falling within the jurisdiction of MSHA. In the event of conflict between any safety requirement of the Department of Labor and BOR’s Reclamation Safety and Health Standards, the more stringent requirement will prevail.

d. Quote Prices. The cost of reducing any oversized material (existing and produced during the quarrying operations) to designated size, maintaining access roads in the quarry, and adhering to the safety requirements shall be included in the respective unit prices per ton quote in the schedule for processing gravel base and 1- to 4-inch materials.

6. Gravel Base and 1- To 4-Inch Material Source

a. General. Material for the gravel base and 1- to 4-inch stockpile shall be obtained by the Contractor by processing quarry material, including existing material remaining from previous quarry operations. The Contractor’s operation at the material source shall be such as shall result in the best practicable production of the required material and shall at all-time be subject to the approval of the Contracting Officer. The Contractor assumes all responsibility for any conclusions as to the nature of the material to be excavated and the difficulties of the excavation.

Gravel may be the result of sieving or may be 1- to 4-inch material processed through a rock crusher. The means proposed for the production of the material will be shown on the contract.

Approval of a deposit is not an approval of all materials taken from the deposit. The Contractor shall be responsible for the specified quality of all such materials used in the work. No payment will be made for any material which does not meet the specification requirements.

b. Costs. The cost of processing and/or development of gravel sources shall be included in the unit price per ton quote in the schedule for processing of gravel base per the requirements of paragraph 3 (Measurement and Payment for Processing Gravel Base Material). Contractor may seek approval from the Contracting Officer to furnish gravel from sources other than from the quarry designated in the SOW, or from other commercial suppliers as long as the Contractor pays all royalties or other charges required for these materials and the delivered per ton cost does not exceed the cost excavating, processing, loading, weighing, hauling and stockpiling the material from the designated material site.

7. Gravel Stockpile

a. General. The Contractor shall place gravel at the stockpile site(s) designated. The gravel used shall be material obtained from the approved source in accordance with Section 5 (Rock Sources) or 6 (Gravel Base and 1- to 4-Inch Material Sources.)

b. Gravel. Aggregate Base Course. ABC fine aggregate shall consist of screenings, angular sand, crushed fines, or other finely divided mineral matter processed or naturally combined with the coarse aggregate.

c. ABC coarse aggregate shall not show more than 50% loss when subjected to the Los

Angeles abrasion test in accordance with ASTM C 131 (2010). The amount of flat and elongated particles shall not exceed 30 percent. A flat particle is defined as one having a ratio of width to thickness greater than 3. An elongated particle is defined as having a ratio of length to width greater than 3.

d. The specified gradation requirements shall apply to the completed ABC. The aggregates shall have a maximum size of 1 inch and shall be continuously well graded with the limits specified in the table below. Sieves shall conform to ASTM E 11 (2022).

e. Liquid limit and plasticity index requirements shall apply to the completed ABC and shall also apply to any component that is blended to meet the required gradation. The portion of any component or of the completed course passing the No. 40 sieve shall a liquid less than or equal to 25 and a plasticity index less no more than 6.

f. Stockpile. Dimensions for gravel stockpiles shall be provided with the contract under which the stockpile is to be completed.

Gravel stockpiles shall be built as compactly as practicable. Gravel stockpiles shall have an average uniform height of 12 feet and shall have no noticeable peaks or valleys.

It is not required that gravel and clay binder be mixed prior to placement in the stockpile. If the Contractor chooses to do so, the stockpile shall be built by alternating layers consisting of gravel and clay binder material so that mixing shall occur with normal removal from the stockpile, provided that the bottom and top layers consist of at least 2 feet thickness of gravel and the total gradation of all materials placed in the stockpile conforms with the grading requirements specified in subparagraph b. Hauling equipment shall be routed over the entire area of each layer of the stockpile so as to distribute the compacting effect uniformly over the stockpile.

g. Cost. The cost for stockpiling gravel at the designated stockpile sites shall be made in accordance with Section 4 (Measurement and Payment for Processing Gravel Base Materials).

8. Use and Maintenance of Access Roads, and the furnishing, placement, blading, and compacting of Levees and Bankline Roads

a. General. Access roads will be established prior to the commencing of work on site.

These existing access roads shall be available for use by the Contractor for the Contractor's operations under this contract and subject to the existing restrictions. The Contractor shall be responsible for grading and watering the road as necessary for his hauling requirements. At the end of the contract period the access roads shall be left in at least as good of condition as they were when the work under this contract commenced.

Routine maintenance work shall include grubbing, blading, and watering the gravel surface, repairing small washed-out areas and controlling dust.

b. General. Contractor will furnish, haul, place, blade, and compact, existing levees and bankline roads as indicated in this SOW. Maintenance work shall include but not limited to grubbing, blading, and watering the existing, and new gravel surface, repairing washed out areas and controlling dust.

c. Water for dust abatement may be obtained from the Colorado River (at no cost to the

Contractor) or other approved source. The Contractor shall make all arrangements for obtaining water and provide all means for conveying water to points of use. Contractor will be responsible for filing a separate application with YAO Water Contracts department 6-weeks prior to water needs; there will be no cost associated with application

d. Dust Abatement. During the performance of work required by these specifications, or any operations appurtenant thereto, and whether on rights-of-way provided by the Government or elsewhere, the Contractor shall comply with applicable Federal, State, and local laws and regulations, with applicable requirements of Bureau of Reclamation’s Reclamation Safety and Health Standards, and with the requirements of this paragraph regarding the prevention, control, and abatement of dust pollution. Should a conflict exist in the requirements for dust abatement, the most stringent requirement shall apply.

The Contractor shall be responsible for all damages resulting from dust originating from Contractor operations under these specifications.

The Contractor shall provide all labor, equipment, and materials, and shall prevent dust nuisance or damage to persons, property, or activities, including, but not limited to, crops, orchards, cultivated fields, wildlife habitats, dwellings and residences, agricultural activities, recreational activities, traffic, and similar conditions.

The Contracting Officer has the authority to stop any construction activity contributing to dust levels which are excessive or in violation of Federal, State, or local laws. All expenses resulting from such a work stoppage shall be the responsibility of the Contractor.

e. Costs. The cost of upgrading, and maintaining roads inside the quarry, furnishing, delivering, and applying water as described in this paragraph shall be included in the prices quoted in the schedule for maintaining roads inside the quarry that need routine blading and water.

f. Costs. The cost of upgrading, and maintaining access roads, furnishing, delivering, and applying water as described in this paragraph shall be included in the prices quoted in the schedule for maintaining access roads, and haul roads, that need blading, and watering.

g. Costs. Haul cost distance will be determined by the center of the designated levee or bankline road that is in the SOW.

9. Environmental Controls

a. All quarrying operations performed by the Contractor and any associated subcontractors shall comply with all applicable Federal, State, and local laws, regulations and Water Quality Standards concerning the control and abatement of water pollution and all the terms and conditions of any applicable permits issued by the permitting authority.

b. The Contractor shall complete a Notice of Intent (NOI) forms for the proposed quarrying operation. The NOI’s shall be submitted to the ADEQ prior to the start of any quarrying operation.

10. Safety

The contractor shall develop and submit a Health and Safety Plan (HASP) written and implemented for the proposed demolition operation. The proposed HASP shall be submitted and approved per the requirements of Table 3 – List of Submittals under the “Submittals” Section.

The program shall identify, evaluate, and control safety and health hazards for the demolition operation. The contractor’s submitted HASP shall be reviewed and approved by the COR and approved by the appropriate State agencies prior to the start of any onsite work. All site workers shall be familiar with the HASP and shall be given training on its contents. The contractor shall document all training of all site workers in the HASP plan. Standards of approval will be determined by compliance with all RSHS, MSHA, and OSHA regulations.

The contractor shall be cognizant of and ensure compliance with all requirements of RSHS, OSHA, and MSHA general industry safety regulations. Such responsibilities shall apply to the contractor’s operation as well as any subcontractor operations. When safety or health violations are called to the contractor’s attention by the CO or Contracting Officer Representative (COR) the contractor shall immediately correct the condition. Such notice, either orally or in writing, when served on the contractor or the contractor’s designated on-site representative shall be deemed sufficient. Oral notices will be confirmed to the contractor in writing by the CO within 7 calendar days.

The contractor shall indemnify and hold the Government harmless for any and all losses, damages or liability on account of personal injury, death or property damage of any nature whatsoever and by whomsoever made, arising out of the activities of the contractor, employees, limited to, failure of the contractor, employees, subcontractors, or agents to comply with the safety and health provisions contained in these specifications.

The contractor shall be responsible for any equipment or property left on site. The contractor shall indemnify and hold the Government harmless for any, and all losses, damages or liability.

Roads subject to interference by the work shall be kept open or suitable detours shall be provided and maintained by the contractor. The contractor shall provide, erect, and maintain all necessary barricades, suitable and sufficient flasher lights, flag persons, danger signals and signs, and shall take all necessary precautions for the protection of the work and safety of the public.

Roads closed to traffic shall be protected by effective barricades, warning, and detour signs. All barricades and obstructions shall be illuminated from sunset until sunrise.

Specific signs, barricades, and flagmen requirements are detailed in RSHS and the American National Standards Institute’s “Manual on Uniform Traffic Control Devices for Streets and Highways” (ANSI D6.1).

In the event the contractor fails or refuses to promptly comply with all Federal, state, and local safety and health laws, regulations, codes and standards the CO may issue an order to suspend all or any part of the work. When satisfactory corrective action is taken, an order to resume work will be issued. The contractor shall not be entitled to any extension of time, nor to any claim for damage or to additional costs by reason of either the directive or the suspension order. Failure of the CO or COR to order discontinuance of any or all of the contractor’s operations shall not relieve the contractor of the responsibility for the safety of the personnel and property.

11. As-built Drawings

The contractor shall maintain two sets of full-size prints of contract drawings marked to show accurate and complete records of as-built conditions. Keep drawings at the jobsite and mark as work progresses.

a. Mark and dimension to show variations between actual construction and that indicated or specified in contract documents.

Include buried or concealed construction and utilities. Include existing items, topographic features, and utility lines revealed during construction which differ from those shown on contract drawings.

b. Mark to define construction actually provided where choice of materials or methods is permitted in specifications, or where variations in scope or character of work from that of the original contract are authorized.

Use standard drafting practice to represent changes and include supplementary notes, legends, and details necessary to clearly portray as-built construction.

Mark as-built drawings in the following colors:

Red - Additions to original drawings.

Green - Deletions to original drawings.

Blue - Notations necessary for explanation of as-built markings.

Allow the Government to review the drawings at all times. Upon completion of work, sign marked prints as certified correct. In addition, an electronic copy of all as-built drawings will be required at the end of the project. Acceptable formats are in AutoCAD 2018 or latest version.

12. Miscellaneous Requirements

a. Key Personnel, and Equipment: Not later than 14 days after notice of award and prior to beginning work at the site, the contractor shall submit a list of key personnel (Project manager, Office manager, Superintendent, Foreman, Equipment Operators, Laborer and any other personnel working within the quarry and contract) including their responsibilities and training certifications. Contractor shall also submit all equipment and certifications for the equipment that will be on site.

b. Permits, General: The contractor shall obtain all permits, licenses, and regulatory approvals that may be required by, but not limited to, Federal, state, county, and city.

Within 7 days of hauling materials to an approved off-site waste disposal (landfill) site, the contractor shall submit record copies of the waste disposal manifests for both hazardous and non-hazardous waste materials.

13. Submittals

The following items shall be submitted to the Contracting Officer for approval.

a. Weighmaster credentials. Include licenses and experience of the proposed weighmaster.

b. Scale Certification and calibration.

c. Weigh tickets. Submit weigh tickets weekly. Weigh tickets shall clearly show the type of material on the truck, where the truck was weighed, and the final destination of the truck. Show the tare weight of the truck, loaded weight of the truck, and the weight of material being transported.

d. Distance to Unlisted Delivery Locations. Measure the distance from the source (quarry or stockpile) to the delivery location (stockpile or placement location) to the nearest 0.1 miles. Show the proposed delivery route with mileage for each segment.

e. Air Quality Management plan for the following equipment Rock Crusher and Grizzly rock processing equipment.

f. Equipment proposed for use.

g. List of key personnel and certifications.

h. List of subcontractors and certifications.

i. General safety plan and site specific per SOW.

j. Traffic control, and haul signage per SOW

The contractor shall furnish all materials and perform all work required for furnishing submittals to the Government, in accordance with this paragraph, Table 3– List of Submittals, and the requirements in the provisions, clauses, and paragraphs of the SOW.
