About this file
This is an Annual Affidavit for Bidders, Offerors and Contractors required by the Commonwealth of Kentucky for state and local contract opportunities. The affidavit is effective for a maximum length of one year and applies to all bids and contracts awarded by Kentucky state agencies. Bidders and offerors must affirm compliance with Kentucky campaign finance laws under KRS 45A.110 and 45A.115, confirm awareness of requirements and penalties outlined in KRS 45A.485, and certify proper disclosure of all required information. Additionally, bidders must verify that they and all subcontractors are duly registered with the Kentucky Department of Revenue for sales and use tax collection and remittance, are not delinquent on state taxes or fees owed to the Commonwealth, and have not violated prohibitions set forth in KRS 11A.236 during the previous ten years.
For non-bid contracts, including sole-source, non-practical-to-bid, or emergency contracts, contractors must make additional affirmations regarding campaign contributions. These include confirming that neither the contractor nor immediate family members with 10 percent or more interest in involved business entities have contributed more than amounts specified in KRS 121.150 to the gubernatorial slate campaign preceding contract award. Contractors must also certify that neither they nor their officers, employees, affiliated entities, or respective spouses have knowingly contributed more than $5,000 in aggregate to elected candidates with jurisdiction over the contract award, and that no direct solicitation of contributions exceeding $30,000 in aggregate has occurred on behalf of such candidates. The affidavit must be notarized and signed by a duly authorized representative, who acknowledges that the Commonwealth is relying on the accuracy of the statements and that non-compliance may result in contract termination, fund repayment, and other legal remedies.
