4. Authority Cited: Simplified Procedures for Certain Commercial Items, 41 U.S.C. 1901 (or 41 U.S.C. 1903 for Special Emergency Procurement) as implemented by FAR Subpart 13.5:
Unusual and compelling urgency Exclusive licensing agreements DAQ Electronics certified Industrial mobilization
5. Reason for Authority Cited:
Per AR 190-13 The Army Physical Security Program, 9-2 Integrated Commercial Intrusion Detection System (ICIDS) is the standardized DOD system that will be used by Army organizations not located on Joint bases supported by another Military Department, or at USACE civil works and like projects.
ICIDS is the Army Program of Record for IDS (Intrusion Detection System) requirements.
ICIDS is procured and installed by PM-FPS (Program Manager Force Protection Systems) and is centrally funded by HQDA OPMG. Once installed PM-FPS retains program ownership for issues such as the Risk Management Framework, Authority to Operate but the local system owner is responsible for maintenance.
The equipment provider is DAQ Electronics with the COTs version of the ICIDS software being called Starwatch SMS. DAQ maintains support for Starwatch SMS through their network of Value Added Resellers (VARs) which is common in the security market. Any contract for maintenance should require both the company any personnel conducting maintenance be a DAQ Electronics ICIDS certified VAR. The company listing can be found at http://www.daq.net/support/resellers---vars/
Because the ICIDS is required per AR 190-13, any updates must be completed by a certified DAQ Electronics Value Added Reseller, if they are not certified, the system will not be updated or work properly, which will leave TYAD vulnerable to security threats as well as non-compliant with Army Regulations.
6. Efforts to Obtain Competition: At this time, there is no action to increase competition. The ICIDS IV system was purchased by Department of Army and requires any maintenance or service to be conducted by DAQ Electronic certified personnel.
7. Actions to Increase Competition: The COR and Tobyhanna Security personnel will continue to monitor the marketplace through market research to determine if any new vendors are available to provide this service at Tobyhanna Army Depot. In addition, a Sources Sought announcement will be posted prior to award of any future requirement to determine if other vendors have become DAQ Certified.
8. Market Research: The COR contacted the Tobyhanna Security Division and discussed the requirement at Tobyhanna as well as the Army requirement to use a DAQ Certified vendor to maintain the ICIDS IV Alarm System at Tobyhanna. Historical documents show that a previous solicitation yielded two (2) vendors being solicited on the Federal Business Opportunities (FBO) page. Because the ICIDS is an Army requirement and there are at least 18 contractors with Category 246 40 Schedule 84 awards, it was determined there would be more competition using GSA and soliciting unrestricted.
In response they questioned the request to provide a firm fixed price for the
CLIN requiring maintenance and repair. After the KO reviewed the requirement again and discussed it with the COR and Contract Specialist, it was determined to be in the best interest of the Government to revise the maintenance and repair CLIN to Time and
Material/Labor Hour and resolicit on betaSAM as a total small business set aside. This is believed to result in at least two or more vendors.
9. Interested Sources: To date, no other sources have written to express interest in the acquisition.
10. Other Facts:
a. Procurement History:
(1) Contract numbers and dates of the last contract for these same requirements.

(3) Authority previously cited if less than full and open competition was used. N/A

(5) If any prior contract for this requirement was accomplished using full and open competition, include a detailed explanation of the changed circumstances causing this action to now limit the sources. The previous contract was solicited as 100% Total Small Business Set Aside on the Federal Business Opportunity (FBO) page, this solicitation will be posted on betaSAM as a 100% Total Small Business Set Aside.

13. Fair and Reasonable Cost Determination: I hereby determine that the anticipated cost or price to the Government for this contract action will be fair and reasonable.
Competition will be used to determine a fair and reasonable price, if there is no competition, a price analysis using historical pricing and the independent Government estimate will be used in determining the price to be fair and reasonable. Also, the proposed labor rates will be justified using the GSA CALC tool; certified cost and pricing data is not required since these services are commercial and it is below the threshold of $2,000,000.00.
This determination will be made using the following: X price analysis – including labor rates X IGCE
As a part of this basis, certified cost or pricing data is not required because the item and/or services being acquired are considered commercial.
