Issuance of First Delivery Order:

The contract minimum guarantee referred to in paragraph (b) of FAR Clause 52.216-22 ‘Indefinite Quantity’ will be issued concurrently with the award of the basic order.

The Minimum Guarantee under this IDIQ is 76 units under CLIN 0001 and 76 units under CLIN 0002, for a total of 152 units.

The Maximum ceiling under this IDIQ is established at 952 units

The Government may evaluate quoted prices by performing a price analysis as specified in FAR 15.404-1(b) procedures.

(1) For CLINs 0001 and 0002: The Government will calculate the total evaluated price for each production year as follows:

• The Government will multiply the unit price by the maximum quantity for each range to derive the extended price for each range.

• Next, the Government will add the extended prices for all ranges of the production year CLIN and divide by the sum of the maximum quantity of all ranges of that CLIN to find the average unit price.

• The Government will multiply the average unit price by the maximum number of units of the highest range of the production year to arrive at a total evaluated price for the production year.

The following is an example:

Production Year 1 CLIN Description From

Quantity To Quantity

Unit Price Extended Price

0001 End Plate 4 10 $6,000 $60,000 11 20 $5,000 $100,000 21 35 $4,000 $140,000 Total 65 $300,000

The total line item amount for CLIN 0001 is $300,000.00.

Average unit price = $300,000/65 = $4,615.38 Total evaluated price for first production year = $4,615.38 * 35 = $161,538.30

The Government will repeat the above for all production years and all ranges for CLINs 0001 and 0002.

TOTAL EVALUATED PRICE:

The Government will add the multiple quantity range CLIN amounts to arrive at the Total Evaluated Price (TEP) for the contract to determine lowest price.

**NOTE: The above prices are examples only. This example does not obligate the Government to purchase these quantities; it is simply to demonstrate the method the Government will use to calculate the total evaluated price.

The Required Delivery is F.O.B. Destination, Naval Station Newport, Rhode Island. Offerors shall include shipping charges in unit prices, if applicable.

In accordance with DFARS Clause 252.211-7003, the contractor shall provide a unique item identifier (UID) for all delivered items for which the Government’s unit acquisition cost is $5,000.00 or more.

The Government’s method of payment will be electronic payment via Wide Area Workflow (WAWF).

(c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.

(d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor's and Government's rights and obligations with respect to that order to the same extent as if the order were completed during the contract's effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after sixty six (66) months from date of award or later if mutually agreed upon by the Contractor and Government.

(End of clause)

CLIN 0003: The delivery schedule for specific CDRL’s will be included in applicable delivery orders.

(b) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed, or otherwise furnished to the successful offeror, results in a binding contract. The Government will mail or otherwise furnish to the offeror an award or notice of award not later than the day award is dated. Therefore, the offeror should compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails. However, the Government will evaluate an offer that proposes delivery based on the Contractor's date of receipt of the contract or notice of award by adding (1) five calendar days for delivery of the award through the ordinary mails, or (2) one working day if the solicitation states that the contract or notice of award will be transmitted electronically.
