The pricing structure requires vendors to establish a minimum order threshold not exceeding 24,000 pounds for which no freight charges apply; smaller orders will be charged at actual ground shipment costs. Prices must remain firm for at least 90 days after contract execution. Price adjustment requests are permitted only if submitted at least 75 days in advance of quarterly order dates and must be substantiated with documentation showing actual cost increases or decreases of feed ingredients or freight costs, with market fluctuations exceeding 5% required. All fish food must comply with FDA Good Manufacturing Practices and Association of American Feed Control Officials standards, contain fish meal and fish oil as primary ingredients with no mammalian meals, meet specific proximate analysis requirements for protein, fat, fiber, and ash content, and be manufactured no more than 30 days prior to delivery with a minimum shelf life of 120 days. INDIANA DEPARTMENT OF NATURAL RESOURCE

FISH FEED SPECIFICATION

Purpose and Scope of the Request for Bid

The Department of Natural Resources is requesting bids for the purchase of Fish Food for the Fish Hatcheries raising Coldwater Fish (Salmon & Steelhead Trout) as per Specifications, Terms and Conditions attached and intends to use the results of this process to award a Contract.

Bids that require a minimum number of commodities or services to be ordered will be rejected. There will be no guarantee to purchase any specific quantity or pay any minimum contract price during the term of the Contract.

Section 1. General Specifications.

A. The Indiana State Chemist Office administers laws and regulates the use of commercial feed in Indiana. Feed manufacturing, distribution, labeling and packaging must be consistent with the following commercial feed regulations:

B. Fish Food provided under this Contract maybe closed (proprietary) or open formula, as long as the requirements for each of the diets requested are met in the specification in the following sections of this document.

C. Fish Food shall be milled no more than 30 days prior to delivery. Production information will be maintained as outlined in: Section 6, Part B (2A) of the Association of American Feed Control Officials, Guidance/Framework for Best Management Practices for Manufacturing, Packaging and Distributing Animal Feeds and Feed Ingredients.

D. Good Manufacturing Practices: The Contractor’s mill, equipment and manufacturing procedure must comply with all Food and Drug Administration requirements. The Contractor will follow the Association of American Feed Control Officials Guidance/Framework for Best Management Practices for Manufacturing, Packaging and Distributing Animal Feeds and Feed Ingredients.

E. All Fish Food provided will have mineral levels at or below those published in, National Research Council of the National Academies. (2005) Mineral Tolerance of Animals 2nd addition. Washington D.C. The National Academies Press. Table 2-1, pages 13-14.

F. All raw agricultural commodities will not exceed the tolerance for pesticides and industrial chemicals published in Title 40 of the Code of Federal Regulations Part 180. All raw agricultural commodities will not exceed the FDA action levels for unavoidable residues of pesticides whose tolerance have been revoked by EPA. Please reference FDA Compliance Policy Guide Sec. 575.100.

G. Minimum Nutrient Requirements: All Fish Feeds shall contain the amount of Amino Acids, Fatty Acids, Marco Minerals, Micro Minerals, Fat Soluble Vitamins and Water-soluble Vitamins as recommended for Rainbow Trout and Pacific Salmon. In the book National Research Council of the National Academies, (2011) Nutrient Requirements of Fish and Shrimp. Washington D.C.: The National Academies Press, Table 18-1, pages 327-328. The nutrient levels referenced above shall be available for the entire shelf life of the product when stored under the recommended conditions by the feed manufacturer. Shelf life will be at least four months.

H. The following ingredients are prohibited from use or inclusion in manufacturing any fish food under this contract.

1. Cottonseed Meal

2. Mammalian Meals are prohibited because of BSE.

Section 2. Pacific Salmon and Steelhead Diet Proximate Analysis.

Both open and closed formula feeds shall meet the following minimum guaranteed analysis:

Starter Sizes: #01 and #2 (0.7 mm and 1.0 mm respectively)

Pellet or Production and Broodstock Sizes: 2.5 mm to 6.0 mm

Minimum Guaranteed Analysis

Moisture, not more than 9.0%

Crude Protein, not less than 42%

Crude Fat, not less than 16%

Crude Fiber, not more than 3.0%

Ash, not more than 11%

Total phosphorous content not to exceed 1.0 to 1.2% total Phosphorus (0.6 to 0.7% available Phosphorus)

Special Notation:

The Pacific Salmon and Steelhead diet must contain Fish Meal and Fish Oil as the primary ingredients. No Mammalian Meals may be used to make up any of the protein content of feed being offered for the Pacific Salmon and Steelhead diet.

Moisture Content: Will be measured as described in 930.15 of the Official Methods for Analysis of the Association of Official Analytical Chemists, 481 N. Frederick Avenue, Suite 500 Gaithersburg, MD 28077-2417.

Crude Protein: Will be measured as described in 984.13 of the Official Methods for Analysis of the Association of Official Analytical Chemists, 481 N. Frederick Avenue, Suite 500 Gaithersburg, MD 20877-2417.

Fish Protein: All Fish Meal utilized in these specifications shall:

Be stabilized

Moisture, not more than 10%

Ash, not more than 17%

Salt, not more than 5%

Stored at the manufacturer’s plant no longer than 30 days as indicated by Bill of Lading

Pepsin in digestibility, not less than 92.5%

Minimum protein content (depending on source): Herring meal @ 65%, Anchovy fish carcass meal @ 65%, Menhaden fish carcass meal @ 60%)

Crude Fat: will be determined by using the ether extraction, Direct Method as described in Method 920.39 of the Official Methods for Analysis of the Association of Official Analytical Chemists 481 N. Frederick Avenue Suite 500, Gaithersburg, MD 20877-2417.

Ash Content: will be measured as described in 942.05 of, 481 N. Frederick Avenue Suite 500, Gaithersburg, MD 20877-2417.

Astaxanthin must be FDA approved for use in food fish not to exceed 80 ppm.

Section 3. Feed sizes and consistency for Pacific Salmon and Steelhead Diet. (Described in Section 2.)

*For Fish Feed larger than 4.0 mm separate quotes shall be submitted for sinking and floating pellets. Floating Feed shall have a density of between 22 and 29 pounds per cubic foot; slow sinking feed shall have a density of between 28 and 34 pounds per cubic foot.

Section 4. General.

*Granules and Pellets shall have a texture that is palatable to Trout and Salmon and be round in shape.

*All Fish Feed are to be screen for size as specified. At least 85% of the feed must meet sieve or pellet size.

*The Fish Feed shall be a negative buoyancy for sinking type, with a sinking rate that allows adequate utilization by the fish under normal feeding conditions and practices.

*The Fish Feed shall possess sufficient durability and water stability to maintain its integrity during packaging, transportation, storage, and feeding while submerged in water.

*The dust content of individual containers (bags or boxes) of Fish Feed should not exceed 1% by weight at the point of delivery for use. Dust is defined as particles that would pass through a 0.42 mm screen.

*Vendors warrant the feed contaminant levels are below thresholds for producing healthy Pacific Salmon capable of thriving after release in the wild and feed contaminant levels do not present a human health fish consumption risk.

*Vendor must immediately notify the Statewide Hatchery Secretary if Fish Feed problems are detected through internal quality monitoring at the factory or reported to the contractor by other feed users.

*Feed shall conform to Indiana Feed Laws: IC 15-19-7 and 355 IAC Article 6.

Section 5. Packaging and Labeling.

Packaging:

*The Fish Feed shall be packaged in new, multi-wall bags or cardboard boxes, with a moisture proof liner. After being filled, the containers are to be sewn or sealed closed. The net weight of the Fish Feed in each container shall not exceed 55 pounds. The net weight of the feed in each container is to be the same and shall be marked on the container.

*The Fish Feed is not to be bagged or boxed until properly cooled and adjusted to a moisture content as specified.

Labeling:

*Each bag or box shall be stamped or tagged to show in an uncoded or readily understood format: diet identified, size of feed, date milled or manufactured and batch identification.

*Label will contain guaranteed minimum analysis for Crude Protein, Crude Fat, and Crude Fiber.

*Labeling must conform to Indiana Feed Law as administered by the Indiana State Chemical Office IC 15-19-7 and 355 IAC Article 6.

Section 6. Fish Food Orders and Shipping:

Delivery to be as required based on quarterly shipments with six (6) destinations:

*All invoices for quarterly orders are to be sent to State Hatchery Headquarters, Driftwood State Fish Hatchery, 4931 S. C.R. 250 W. Vallonia, IN 47281. Vendor should submit one single invoice that includes all feed sizes. A separate invoice for each drop point or hatchery is not required. Vendor invoice must match the feed size groups on the QPA contract and the invoice unit of measure to be in pounds NOT bags.

*Deliveries are to be made Monday through Friday, except State and Federal Holidays, between the hours of 8:00 a.m. and 2:30 p.m. local time unless approval is granted by the Hatchery Manager prior to delivery. The contractor should notify the Hatchery Manager at least 24 hours prior to delivery.

*All deliveries of Fish Feed made under the contract shall be made by authorized carriers or contractor-owned trucks holding permits or certificates from appropriate regulatory bodies.

*All Fish Feed shall be loaded on suitable trucks at the feed mill and delivered directly to the Fish Hatchery on the same truck unless otherwise specified in the bidding scheduled.

*The contractor shall be responsible for replacing any Fish Feed received in damaged condition at no cost to the State.

*Delivery shall be made within twenty-one (21) days after notification of order. Exceptions may be with prior approval of the Statewide Hatchery Secretary. Delivery must be made within thirty (60) days of feed mixing date. Unopened bags of feed that have been properly stored shall have a shelf life of not less than 120 days.

Fish Feed Delivery Estimated Timeframes are as follows:

*Spring Feed Order Early to Mid-February
*Summer Feed Order Early to Mid-June
*Fall Feed Order Early to Mid- September
*Winter Feed Order Early to Mid- December

Cost Specifications and Adjustments.

Shipping Cost:

Feed Orders may be requested for small quantities of Fish Feed between the large quarterly orders. Vendor shall establish minimum order, not greater than 24,000 pounds, for which no freight or shipping charges will be applied. Vendors will still accept smaller orders but will charge the actual cost for ground shipment.

Price adjustments or Escalation Clause:

Prices shall remain unchanged and firm for at least ninety (90) calendar days after the effective date of the contract. The State of Indiana will consider written requests for price adjustments only if the finalization of the contract exceeds the 90 days allowed. Adjustments may be considered provided that such price adjustment covers both upward and downward movement of commodity prices and that adjustment is based only on the increase and decrease of feed ingredients or changes in freight costs.

An increase will be based on the vendor/contractor’s actual cost increase only, as shown in written documentation, and must not constitute increases in profit. All requests for price increase/decreases must be in writing and must contain adequate documentation to justify said increase/decrease (dated Manufacturer Price Lists, Industry Publications, catalogs, etc.) Any adjustment considered will be based on the actual dollar figure. All price adjustment requests must be substantiated in a manner acceptable to the Indiana Department of Natural Resources Director and must be received seventy-five (75) days in advance of each quarterly order date. Any time the vendor requests a price adjustment, the Indiana Department of Natural Resources Director may either accept the price adjustment and amend the contract accordingly or reject the adjustment in its entirety. Approved price adjustment shall remain unchanged for at least ninety (90) calendar days.

*Price adjustments will be permitted provided the increase or decrease reflects actual market fluctuations that can be documented for feed ingredients, energy changes or other appropriate reasons.

*Adjustments in contract pricing may be allowed only if the market structure has variances of more than 5%.

*Requests for price adjustments will be submitted at least seventy-five (75) days prior to the actual order date for a specified quarterly feed order. Vendor must contact Indiana Department of Natural Resources to determine requirements for justifying an adjustment and appropriate documentation for the change. Vendor must notify the Statewide Hatchery Secretary when a price change is requested.

*Any requested price increase must be based upon a cost increase that was clearly unpredictable at the time of the bid and can be shown to directly affect the price of the item contracted.

*The State Purchasing Office will determine, though market review, trade publications, independent price indices, and/or other means, whether the requested price increase or an alternative option is in the best interest of the State. The vendor shall likewise offer any published price reductions to the State Concurrent with its announcement to other customers.
