About this file
This is a Simplified Acquisition Procedures (SAP) Determination Memorandum for restricting competition under FAR 12.102, issued for Purchase Request Number F7B1FG6225AW01. The government is procuring forty-four (44) Irwin Seating Company cloth auditorium seats with fold-up seats, pull-out tables, and cup holders to be mounted on a flat concrete surface in Building 380. The seating is required to match existing Irwin Seating auditorium installations elsewhere in the building to ensure uniformity in brand, color, and type.
The justification for restricting competition to a single source is based on unique characteristics specific to Building 380, which was recently constructed with Irwin Seating installed in multiple locations. The original seating was installed by a local contractor during construction, and procuring another manufacturer's product would not provide the necessary uniformity. Market research confirmed that the original installer, SP&E, Inc., is not a Small Business Administration (SBA) registered contractor and is therefore ineligible for government contract awards. However, H2I Group, Inc., an authorized dealer and distributor of Irwin Seating located in Minneapolis, Minnesota (CAGE Code VMEHJ29J2LJ4), is identified as a small business source. The contracting officer certifies that this justification is accurate and that executing this purchase as a brand name-only requirement is in the best interest of the government, subject to fund availability.
