PERFORMANCE WORK STATEMENT
FOR
PARAMEDICS/AMBULANCE SERVICES
TINKER AFB, OKLAHOMA
72 ABW/CE
Tinker Air Force Base, OK
12 July 2024
1. DESCRIPTION OF SERVICES
The Contractor shall provide 24-hour state certified paramedic level emergency response and patient transport services for all personnel on Tinker AFB to effect a response time of 12 minutes at the 90th percentile for the initial arriving unit.. In addition the Contractor will be responsible for the following off base facilities to include: Area “D” Hilltop Road off of SE 59th , buildings: 4000, 4045, 4002, 4019, 4004, 4005, 4006, 4008, 4044, 4077, 4078, 4023, 4012, 4058, 4079, 4069, 4001, 4068, 4028, 4029, 4032, 4048, 4049, 4057, and 4064, Buildings 4036 and 4031 (satellite compound near Area "D"), located on South Post Road off of SE 59th Street, Fuels
Distribution Area: Bldgs. 3905, 3902, 3907 and 53902, located on Douglas Blvd, The
Twaddle Military Reserve Compound, located on Douglas Blvd. Buildings; 8400, 8430, 8431, 8432, 8433, 8435, 8436, 8437 and 8438, The Glennwood Area, located off of SE 29th Street, MROTC facility located at SW 59th and South Douglas Blvd.
Buildings 2300, 2301, 2302, and 2303. This shall include afterhours flight line response. Contractor shall furnish all labor, management, supervision, vehicles, supplies, equipment, transportation, and reports, except as provided in paragraph 3, Government furnished property and services. Contractor will provide interfacility transportation from Base Outpatient Clinic B1094 & B3334 to receiving hospital.
Contractor care shall cover the range of paramedic and ambulance services provided in the local community. Performance shall be according to the requirements contained in this performance work statement (PWS), DODI 6055.06 DoD Fire and Emergency
Services (F&ES) Program, DAFI 32-2001 Fire and Emergency Services (F&ES)
Program, DAFI 44-102 Medical Care Management, and professional standards of the
Joint Commission on Accreditation of Healthcare Organization (JCAHO), DAFI 44-
119Clinical Performance Improvement, the Department of Transportation (DOT) and the National Registry for Emergency Medical Technicians (NREMT). The Contractor shall participate in flight line hazard or mishap response planning. The Contractor shall provide back-up ambulance support during responses/transports. These services will be paid for by the Government with no-billing of the patients by the Contractor.
Emergency Reporting Fire Department telephone numbers are 911 for emergency and
734-7964/7965 for non-emergency calls.
NOTE: All Tinker AFB organizations that are located outside of Tinker AFB and are in need of Ambulance Services must request 911 emergency call be forwarded to the
Tinker 911 Center for emergency response.
1.1. CONTINUITY OF SERVICES
1.1.1 The Contractor shall ensure that qualified back-up paramedics are available to provide coverage during scheduled and unscheduled absences to primary paramedics. Absences without backup coverage provided will reduce the
Contractor’s invoice at an equivalent amount to the costs incurred by the
Government.
1.2. CONTRACTOR PERSONNEL
1.2.1. Contractor Personnel: The Contractor shall provide the name of the Contract
Manager (CM) and any alternate(s) who shall act for the Contractor when the manager is absent, and they shall be designated in writing to the Contracting
Officer (CO) and the COR within 2 business days after contract award. The
Contractor shall provide telephone numbers of the Contract Manager and alternate(s) where these persons may be contacted at any time. The Contract
Manager or alternate shall have full authority to act for the Contractor on all matters relating to operation of this contract at Tinker AFB. The Contract
Manager or alternate shall be available to meet on the installation with
Government personnel designated by the CO to discuss problem areas. The
Contractor shall provide a Contract Manager who can read, write, speak, and understand English fluently. The CM or alternate point of contact shall be available Monday through Friday, 0700 –1700 hours.
1.2.2. Listing of Contractor Employees: The Contractor shall provide an initial listing of Contractor employees’ names and position titles to the CO and the
COR prior to contract start date. The Contractor shall also provide an updated listing of personnel to the CO and the COR when employees affecting the work of this contract, statuses change, or position changes within 10 calendar days.
1.2.3. The Contractor shall not employ persons on this contract if such employee is identified to the Contractor as a potential threat to the health, safety, security, and/or general well-being or operational mission of the installation and its population. The Contractor shall not employ any person who is an employee of the United States Government if the employment of that person would create a conflict of interest, nor shall the Contractor employ any person who is an employee of the Department of the Air Force, either military or civilian, unless such person seeks and receives approval according to the DoD 5500.7-R Joint
Ethics Regulations (JER). In addition, the Contractor shall not employ any person who is an employee of the Department of the Air Force if such employment would be contrary to the policies contained in AFI 64-106, Air
Force Industrial Labor Relations Activities. The Contractor shall be prohibited from employing off-duty COR’s who are surveilling any contracts/subcontracts awarded to the Contractor. All contract employees depending on condition, occasion or place, or job assignment shall require professional, suitable attire.
All Contractor employees shall conduct themselves in a professional, courteous manner. The selection, assignment, reassignment, transfer, supervision, management, and control of Contractor employees in performance of this PWS shall be the responsibility and prerogative of the Contractor; however, the
Contractor shall comply with the requirements set forth in this PWS and Tinker
AFB regulations concerning conduct of employees as referenced herein. The
Contractor shall employ and maintain a technically trained and experienced work force.
1.2.4. The Contractor shall begin full performance of the contract requirements after phase-in period. It is critical that certifications be granted to a sufficient number of contract paramedics to meet the contract requirements by start of period of performance.
1.2.5. Contractor employees shall identify themselves as Contractor personnel by introducing themselves or being introduced as Contractor personnel and displaying distinguishing badges or other visible identification for meetings with Government personnel. In addition, contracts shall require Contractor personnel to appropriately identify themselves as Contractor employees in telephone conversations and in formal and informal written correspondence.
1.2.6. Process Improvement Plan. The Contractor shall submit a Process
Improvement Plan quarterly to the COR identifying problem areas with corrective actions and follow ups as determined.
1.2.7. Denial/Termination of employee. The CO and the Contractor shall be notified by the COR as soon as possible if performance problems are identified and verified. The COR will also provide the CO and the Contractor with copies of documentation for denial of base access for the employee if such actions become required due to performance or security concerns.
1.3. INDEMNIFICATION AND MEDICAL LIABILITY INSURANCE
1.3.1. The Contractor shall provide and maintain adequate liability insurance coverage consistent with the risks associated with the performance of all services required by this PWS. Refer to Federal Acquisition Regulation (FAR)
Clause 52.237-7, “INDEMNIFICATION AND MEDICAL LIABILITY
INSURANCE”.
1.3.2. Malpractice Insurance Certification. The quoter shall provide proof of
Malpractice Insurance.
1.4. CONTRACTOR FULL-TIME EQUIVALENT REPORTING
1.4.1. The Contractor shall report ALL Contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the USAF via a secure data collection site. The Contractor is required to completely fill in all required data fields at http://www.ecmra.mil.
1.4.2. Reporting inputs will be for the labor executed during the period of performance for each Government fiscal year (FY), which runs 29 September through 30 September the following year. While inputs may be reported any time during the FY, all data shall be reported no later than 31 October* of each calendar year. Contractors may direct questions to the CMRA help desk.
1.5. PROCEDURE GUIDANCE
1.5.1. The Contractor shall perform procedures and care IAW medical standards.
1.6. PROTOCOL
1.6.1. The Contractor shall submit pre-hospital protocols as part of the proposal.
The protocols will be incorporated into the PWS upon review and acceptance of the procedures. At any time during the contract period, the Government retains the right to incorporate additional procedures or remove ineffective procedures, the Contractor shall make the changes at no additional cost to the Government.
1.7. HOURS OF OPERATION
1.7.1. The Contractor shall provide ambulance response services to Tinker Air Force
Base 24 hours per day, seven days per week, to include federal holidays and weekends.
The Contractor shall be required to respond to flight line emergencies, to include in-flight emergencies. The Contractor shall be required to respond to other emergency events at the request of the 72 ABW Commander or his/her designee.
1.8. AMBULANCE RESPONSE
1.8.1. The Contractor shall provide a standard of cover for ambulance response, to affect a response time of 12 minutes at the 90th percentile for the initial arriving unit. Ambulance response shall include but not be limited to the following:
1.8.2. Transport patients from Tinker AFB to the Government designated healthcare organization ensuring that a paramedic is with the patient at all times.
1.8.3. Return any Government equipment used while transporting the patient immediately following the transport to the TAFB Fire Department, B117.
1.8.4. Notify Tinker Fire Department (TFD) dispatch when the ambulance leaves the installation and upon return or out of service.
1.8.5. Notify TFD dispatch when delays are encountered which will result in response times exceeding 12 minutes.
1.9. DOCUMENTATION
1.9.1. Paramedics shall prepare all documentation to meet or exceed established standards of the MTF to include but not limited to: timeliness, legibility, accuracy, content and signature. The paramedic shall ensure complete patient identifying information is on all documentation to be provided to the MTF relating to the transport. Contractor shall be required to complete run sheets on each response and forward to the COR. The Contractor shall be required to complete the DD Form 2569 Third Party Collections (TPC) form for all personnel transported.

1.10. RECORDS
1.10.1. The Contractor shall be responsible for creating, maintaining, and disposing of only those Government required records which are specifically cited in this
PWS or as may be required by the provisions of a mandatory directive listed in appendix B of this PWS. If requested by the Government, the Contractor shall provide the original record or a reproducible copy of any such records within five working days of receipt of the request. All run report/dispatch numbers must be emailed to the TFD and the COR at the end of each shift. The
Contractor shall integrate patient care reporting forms or automated systems with the Tinker Fire Department in order to affect a comprehensive team approach to patient care.
1.11. PATIENT INFORMATION
1.11.1. Patient information, shall be treated as privileged information under the privacy act and applicable release of information guidelines. Lists and/or names of patients shall not be disclosed to or revealed in any way for any use outside the MTF without prior written permission by the Chief of Medical Staff.
1.12. RELEASE OF MEDICALINFORMATION
1.12.1. The paramedics shall release medical information obtained during the course of this contract to other MTF staff involved in the care and treatment of that individual patient.
1.13. PATIENT SENSITIVITY
1.13.1. Contract paramedics shall respect and maintain the basic rights of patients, demonstrating concern for personal dignity and human relationships.
Paramedics receiving complaints validated by the COR and Contracting Officer shall be subject to counseling and, depending on the nature and severity of the complaint, separation from performing services under this contract.
1.14. COMMUNICATION
The Contractor shall ensure contract paramedics maintain an open and professional communication with members of the MTF. Complaints validated by the COR and the
Contracting Officer shall be reported in writing to the contract administrator and the
Contractor for action. Failure of the Contractor to correct validated complaints raised by the MTF staff and the CO will be considered a failure to perform. Vehicles will be be equipped with Government provided communication equipment compatible with other base operations, including, but not limited to control tower, base and fire rescue units, security forces, command post, MTF and major civilian referral facilities with mutual aid frequency.
1.14.1. Quarterly meeting with Contractor point of contact, TFD and MTF personnel are required to address any concerns.
1.15. ORIENTATION PERIOD
1.15.1. Contractor Phase-In: To ensure a smooth changeover from a current contract to a new Contractor, up to a thirty (30) calendar day phase-in period is required.
The current Contractor shall be cooperative to ensure a smooth changeover is accomplished during the phase-in and phase-out periods. During the phase-in period, the new Contractor shall hire a workforce to assure satisfactory performance beginning on the contract start date. The Contractor, after coordination with the COR, shall allow the successor to conduct on-site interviews with employees. The Contractor shall obtain security clearance(s) for
Common Access Card(s) (CAC) or Contractor badge(s) for the newly hired employee(s). The Contractor shall ensure that all training requirements for the newly hired employee(s) are completed before contract start date.
1.15.2. Contractor Phase-out Requirements: During the phase-out period, the incumbent Contractor shall be fully responsible for all work performed under this PWS. The incumbent Contractor shall cooperate fully to permit an orderly changeover of workload. The incumbent Contractor shall allow the new
Contractor and Government personnel access on a non-interference basis, to observe the day-to-day operations and to become familiar with the work requirements and procedures.
1.15.3. The Contractor shall begin the orientation as required by the MTF. During the orientation period, the Contractor shall complete the following:
1.15.3.1. Ambulance service provider must have a license to provide ambulance services on and around Tinker AFB from the Oklahoma State
Department of Health, EMS Division.
1.15.3.2. Access Government facilities in order to familiarize supervisors, key personnel, and staff with equipment, reporting, work schedules and procedures.
However, such access will not interfere with the production efforts of current work force. To preclude such interference, arrangements for access to
Government facilities will be made with the CO or COR.
1.15.3.3. A Contractor must provide an Entry Access List (EAL) for all personnel and a Vehicle Entry Access List (VEAL) for approval prior to commencing the contract. Contractual work may not commence until the EAL and VEAL are approved.
1.15.3.4. For work to be performed that will take more than 59 days the
Contractor shall complete a "Request for Identification Credential" (AFMC
Form 496) for each employee of the Contractor requiring access to Tinker Air
Force Base. The requests shall be submitted to Pass and Registration (Building
6611). Upon meeting access requirements, the Government will provide a completed "Identification Credential" (DBIDS ID/Contractor Badge) which shall be issued, displayed, and surrendered as directed in DAFI 31-101, Integrated Defense Plan. The Contractor shall ensure that all employees have the proper identification credentials prior to entering Tinker AFB, OK. There will be a replacement fee for any lost badges, payable by the Contractor employee.
1.15.3.5. In conjunction with the MTF, request an alternate staffing pattern from the Oklahoma State Department of Health, EMS division, which outlines the plan to use flight line ambulance support as backup, which does not alleviate the requirement for the Contractor to provide secondary response.
1.15.3.6. Must maintain and have access to current Government provided maps of Tinker AFB in every ambulance.
1.15.3.7. Provide EMT-Paramedic, State of Oklahoma license, etc. within 5 working days before period of performance begins.
1.16. LICENSE/REGISTRATION
1.16.1. The contract paramedic shall possess a valid unrestricted EMT-Paramedic license to provide paramedic services in Oklahoma.
1.17. EXPERIENCE
1.17.1. The paramedic shall have provided services a minimum of six months within the past twelve months.
1.18. EDUCATION AND TRAINING REQUIREMENTS, FORMAL
EDUCATION
1.18.1. The contract paramedic must have completed all courses required to obtain and maintain certification as an EMT-paramedic. Additionally, continuing medical education (CME) (Contractor provided) will be accomplished as required. Provide certifications as requested by the COR.
1.19. REQUIRED TRAINING
1.19.1. The Contractor shall be available to conduct or participate in training in conjunction with the Tinker Fire Department TFD as required by Tinker AFB.
1.19.2. All flight line drivers must be escorted by authorized Government personnel. Escort shall be provided by the TAFB Fire Department.
1.20. HEALTH REQUIREMENTS
1.20.1. Contract personnel providing services under this contract shall have current immunizations and testing IAW pre-hospital care immunization standards in
Oklahoma.
1.20.2. Not later than five (5) working days prior to commencement of work, certification shall be provided to the COR that paramedics have completed medical evaluation required above. This certification shall state the date on which the examination was completed, the doctor’s name that performed the examination, and a statement concerning the physical health of the individual.
The certification shall also contain the following statement: “(name of contract employee) is suffering from no contagious diseases to include but not limited to
Tuberculosis, Hepatitis, and Sexually Transmitted Diseases.”
1.20.3. Also, as a condition of employment, OSHA requires that all contract personnel who will have occupational exposure to blood or body fluids, or other potentially infectious materials, shall show proof of Hepatitis B vaccine, sign a voluntary declination, or have documented proof of immunity to Hepatitis B infection. Personnel who sign declinations may change their minds at any time and receive the Hepatitis B vaccine without penalty. Immunizations are the responsibility of the Contractor.
1.20.4. The Contractor shall report to the MTF Director or his/her designee all information necessary to assure medical records can be maintained correctly, and therefore comply with the TJC, OSHA, and CDC health records requirements within 5 business days of any MTF request.
1.21. SECURITY
1.21.1. The Contractor shall ensure all employees have the ability to pass a security background check, IAW TAFB 31-101, Integrated Defense Plan, for access to the installation. If access to restricted areas, Air Force/DOD networks or other
Government furnished systems the contracted employees shall be required, at a minimum, to obtain a Tier 1, favorable background check (HSPD-12).
1.21.2. Defense Biometric Identification System (DBIDS) ID. The contract manager or alternate shall complete a “request for identification credential”
(AFMC Form 496) for each employee of the Contractor requiring access to
Tinker AFB. The request shall be submitted to pass and registration (Bldg.
6611). Upon meeting all access requirements, the Government will provide a complete “identification credential” (DBIDS/Contractor Badge), which shall be issued, displayed and surrendered as directed in TAFBI 31-101, Integrated
Defense Plan. The Contractor shall ensure that all employees have the proper identification credentials prior to entering TAFB.
1.21.3. Operations Security (OPSEC). While working this contract, personnel will be in view of aircraft assigned to the installation and observe their daily operations. No photographs of aircraft or personnel shall be taken. No photos shall appear on any public facing site to include social media sites. Personnel are not authorized make any comments or public posts on social media on aircraft movement or base operations. l IAW Tinker AFB Plan 31-101, Annex
C, Appendix 22, paragraph 3.5. through 3.5.1.7.
1.22. QUALITY CONTROL (QC)
1.22.1. The Contractor shall develop, submit for contracting office acceptance, and maintain a quality control program to ensure the requirements of this contract are performed in accordance with established standards. The Contractor shall develop and implement procedures to identify, prevent and ensure non-recurrence of defective services. As a minimum the Contractor shall develop quality control procedures (QCP) addressing the areas identified in the service summary. The Contractor shall make appropriate modifications (at no additional costs to the Government) and obtain acceptance of the plan by the CO. The Air
Force shall reserve the right to determine Contractor QCPs unacceptable at any time during contract performance. If a QCP is found to be unacceptable, the
Contractor shall be notified, and the CO will take action to enforce the inspection of services clause requiring an inspection system acceptable to the
Government.
1.23. QUALITY ASSURANCE
1.23.1. According to the contract’s inspection clause, the Government will evaluate the Contractor’s performance under this contract. The COR is a representative of the CO and will participate in the administration of this contract. Any matter concerning a change to the scope, prices, terms, or conditions of this contract shall be referred to the CO. All services to be performed by the Contractor during the period of this contract will be subject to review by the CO or the
COR.
1.23.2. Contractor Response Time: The Contractor shall provide written response addressing the root cause, corrective action and preventive action(s). The Contractor will be given up to 48 hours to answer a submitted Corrective Action Report (CAR), Performance Action Report (PAR) and Customer Complaint.
1.24. QUALITY IMPROVEMENT
1.24.1. The Contractor will continuously monitor, assess, and internally report, at least monthly, on the ability of the existing delivery system to meet expected outcomes and identify the remedial actions most in need of attention.
1.24.2. The Contractor will conduct a formal and documented appraisal, at least quarterly, to determine the effectiveness of the EMS program and its impact on meeting the contract’s goals and objectives. This should include an evaluation of the Contractor’s response time, standard operating procedures, protocols, and equipment.
1.25. MISSION ESSENTIAL.
1.25.1. Continuation of Essential DoD Contractor services During Crisis. The following requirements have been determined to be essential in accordance with
DODI 3020.37, E 2.1.1 and E 2.1.3. The Contractor shall establish and provide a written plan to ensure continued support during a crisis IAW Defense Federal
Acquisition Regulation Supplement (DFARS) Clause 252.237-7023 incorporated in full text in the contract. This plan shall be submitted with the
Contractor's proposal.
1.26. KEY CONTROL
1.26.1. The Contractor shall establish and implement methods of ensuring that all keys/key cards issued to the Contractor by the Government are not lost or misplaced and are not used by unauthorized persons. NOTE: All references to keys include key cards. No keys issued to the Contractor by the Government will be duplicated. The Contractor shall develop procedures covering key control that shall be included in the QCP, if a QCP is required in the PWS. If a
QCP is not required in the PWS the Contractor shall develop a written procedure for key control. The Contractor shall turn in the written procedures to the CO and the COR within 5 calendar days of contract award. Such procedures shall include turn-in of any issued keys by personnel who no longer require access to locked areas. The Contractor shall immediately report the occurrences of lost or duplicate keys to the CO and the COR. When the Government performs the replacement of locks or rekeying, the total cost of rekeying or the replacement of the lock or locks shall be deducted from the monthly payment due the Contractor. In the event a master key is lost or duplicated, the
Government will replace all locks and keys for that system and the total cost deducted from the monthly payment due the Contractor. The Contractor shall prohibit the use of Government issued keys by any persons other than the
Contractor's employees. The Contractor shall ensure entrance into locked areas is by only Contractor personnel performing work under the contract, or personnel authorized by the CO.
1.27. ENVIRONMENTAL PROTECTION & SAFETY
1.27.1. Environmental Protection & Safety: The Contractor shall be knowledgeable of and comply with all applicable federal, state, and local laws, regulations, instructions, and requirements regarding environmental protection and occupational safety and health. The Contractor shall com- ply with any laws, instructions, or regulation changes during the term of this contract. The Con-tractor shall be responsible for work requirements and work in progress at the start of the Period of Performance. 1.27.2. Hazardous Material: Contractors shall be compliant with the Tinker Air
Force Base Supplement to Air Force Manual (AFMAN) 32-7002, “Environmental Compliance and Pollution Prevention”, Tinker AFB procedures per Tinker Air Force Base Instruction “Waste Management” (TAFBI 32-7002
), Publications are available digitally on e-Publishing website at www.e-publishing.af.mil for downloading or ordering.
1.27.3. The Contractor shall comply with Installation hazardous materials management program, including tracking authorized hazardous materials through a Hazardous Material Tracking Activity (HTA) and pollution prevention programs. Provide all information necessary to assist the installation
Hazardous Materials Management Program in determining storage and disposal requirements of any hazardous/non-hazardous materials under contractor control in accordance with AFMAN 32-7002 – Environmental Compliance and
Pollution Prevention and the TAFB Supplement.
1.27.4. Discharges: Any discharges into industrial waste treatment plant (IWTP) or sanitary sewer shall be done in accordance with Tinker Industrial Wastewater
Discharge Permit as instructed by 72 ABW/CE. The Contractor shall maintain records of written authorization issued by 72 ABW/CE for discharges into
IWTP and sanitary sewer.
1.27.5. Spills: Upon occurrence of any spills that could enter the storm system or cause any harmful environment effects, the Contractor shall immediately call
911 to report the incident. When possible, the Contractor shall use a base telephone to receive help from Tinker AFB 911. If using a cell phone, request
Tinker AFB 911. The Contractor shall report all environmental violations to the
COR. The Contractor shall submit a typed or written report about the incident within four (4) clock hours. The Contractor shall provide five (5) copies of the written report. The Contractor shall provide one copy to the CO, two copies to the COR, a copy for Unit Environment Coordinator (UEC) and a copy for record. The format of the report shall be left up to the Contractor, but the report shall contain the following information.
1.) Name and contact number of person reporting the spill
2.) Date and time of incident
3.) Location and source of spill
4.) Substance or pollutant spilled
5.) Amount spilled and rate of discharge
6.) Any damages or injuries involved
7.) Extent of area impacted
8.) Potential hazards
9.) Actions taken
10.) Organizations contacted
11.) Remarks Section - that addresses the cause of the spill (e.g. human error, equipment, etc.) and whether 911 was called and which agencies responded.
1.27.6. The Contractor shall be knowledgeable of and comply with all applicable federal, state, and local laws, regulations, and requirements regarding environmental protection. In the event environmental laws or regulations change during the term of this contract, the Contractor shall comply as such laws come into effect.
1.28. VEHICLE EQUIPMENT
1.28.1. Contractor shall be required to provide all emergency vehicles equipped with the required medical equipment to provide health care services IAW this
PWS.
1.28.2. Privately Owned Motor Vehicles (POV): Contractor personnel shall comply with the directives pertaining to operation of POVs on Tinker AFB OK per AFI 31- 204 (in its entirety), Motor Vehicle Traffic supervision. The Contractor shall comply with
TAFBI 24-301 (in its entirety) for the operation of POVs within B3001.
1.28.3. FOD Training for Vehicle Operations: Vehicle operators shall complete all
FOD awareness/prevention training and testing requirements before driving any vehicle on the flight line (Reference TINKER AFBI 13-202 In Its Entirety).
1.29. HEALTH INSURANCE PORTABILITY AND ACCOUNTABILITY
ACT (HIPAA) OF 1996
1.29.1. The contractor shall provide proof of training completion on HIPAA Act of
1996 Privacy Rules.
1.29.2. PRIVACY AND SECURITY OF PROTECTED HEALTH
INFORMATION (PHI): Introduction.
1.29.2.1. In Accordance With (IAW) DoD 6025.18R “Department of Defense
Health Information Privacy Regulation” the Contractor meets the definition of
Business Associate. Therefore, a Business Associate Agreement is required to comply with both the HIPAA Privacy and Security regulations. This clause serves as that agreement whereby the Contractor agrees to abide by all applicable HIPAA Privacy and security requirements regarding health information as defined in this clause, and DoD 6025.18R, as amended.
Additional requirements will be addressed when implemented.
1.29.3. DEFINITIONS.
1.29.3.1. As used in this clause generally refer to the Code of Federal
Regulations (CFR) definition unless a more specific provision exists in DoD
6025.18R.
1.29.3.2. Individual has the same meaning as the term “individual”' in 45 CFR
164.501 and 164.103 and shall include a person who qualifies as a personal representative in accordance with 45 CFR 164.502(g).
1.29.3.3. Privacy Rule means the Standards for Privacy of Individually Identifiable
Health Information at 45 CFR part 160 and part 164, subparts A and E.
1.29.3.4. PHI has the same meaning as the term “protected health information” in 45 CFR 164.501, limited to the information created or received by the Contractor from or on behalf of The Government.
1.29.3.5. Electronic PHI has the same meaning as the term “electronic protected health information” in 45 CFR 160.103.
1.29.3.6. Required by Law has the same meaning as the term “required by law” in 45 CFR 164.501 and 164.103.
1.29.3.7. Secretary means the Secretary of the Department of Health and
Human Services or his/her designee.
1.29.3.8. Security Rule means the Health Insurance Reform: Security
Standards at 45 CFR part 160, 162 and part 164, subpart C.
1.29.3.9. Terms used, but not otherwise defined, in this Agreement shall have the same meaning as those terms in 45 CFR 160.103, 164.501 and 164.304.
1.29.3.10. The Contractor agrees to not use or further disclose PHI other than as permitted or required by the contract or as required by law.
1.29.3.11. The Contractor agrees to use appropriate safeguards to prevent use or disclosure of the PHI other than as provided for by this contract.
1.29.3.12. The Contractor agrees to use administrative, physical, and technical safeguards that reasonably and appropriately protect the confidentiality, integrity, and availability of the electronic PHI that it creates, receives, maintains, or transmits in the execution of this Contract.
1.29.3.13. The Contractor agrees to mitigate, to the extent practicable, any harmful effect that is known to the Contractor of a use or disclosure of PHI by the Contractor in violation of the requirements of this contract.
1.29.3.14. The Contractor agrees to report to the Government any security incident involving PHI of which it becomes aware.
1.29.3.15. The Contractor agrees to report to the Government any use or disclosure of the PHI not provided for by this contract of which the Contractor becomes aware of.
1.29.3.16. The Contractor agrees to ensure that any agent, including a subContractor, to whom it provides PHI, or created or received, by the Contractor on behalf of the
Government agrees to the same restrictions and conditions that apply through this contract to the Contractor with respect to such information.
1.29.3.17. The Contractor agrees to ensure that any agent, including a subcontractor, to whom it provides electronic PHI, agrees to implement reasonable and appropriate safeguards to protect it.
1.29.3.18. The Contractor agrees to provide access, at the request of the
Government, and in the time and manner designated by the Government to PHI in a designated record set, to the Government or, as directed by the
Government, to an Individual to meet the requirements under 45 CFR 164.524.
1.29.3.19. The Contractor agrees to make any amendment(s) to PHI in a designated record set that the Government directs or agrees to pursuant to 45
CFR 164.526 at the request of the Government or an individual, and in the time and manner designated by the Government.
1.29.3.20. The Contractor agrees to make internal practices, books, and records relating to the use and disclosure of PHI received from, or created or received by the Contractor on behalf of, the Government, available to the Government, or at the request of the Government to the secretary, in a time and manner designated by the Government or the secretary, for purposes of the secretary determining the Government’s compliance with the privacy rule.
1.29.3.21. The Contractor agrees to document such disclosures of PHI and information related to such disclosures as would be required for the Government to respond to a request by an Individual for an accounting of disclosures of PHI in accordance with 45 CFR 164.528.
1.29.3.22. The Contractor agrees to provide to the Government or an
Individual, in time and manner designated by the Government, information collected in accordance with this clause of the contract, to permit the
Government to respond to a request by an Individual for an accounting of disclosures of PHI in accordance with 45 CFR 164.528.
1.29.4. GENERAL USE AND DISCLOSURE PROVISIONS
1.29.4.1. Except as otherwise limited in this agreement, the Contractor shall use or disclose PHI on behalf of, or to provide services to, the Government for treatment, payment, or healthcare operations purposes, in accordance with the specific use and disclosure provisions below, if such use or disclosure of PHI would not violate the privacy rule, the security rule or DOD 6025.18R if done by the Government.
1.29.5. SPECIFIC USE AND DISCLOSURE PROVISIONS
1.29.5.1. Except as otherwise limited in this agreement, the Contractor shall use PHI for the proper management and administration of the Contractor or to carry out the legal responsibilities of the Contractor.
1.29.5.2. Except as otherwise limited in this agreement, the Contractor shall disclose PHI for the proper management and administration of the Contractor, provided that disclosures are required by law, or the Contractor obtains reasonable assurances from the person to whom the information is disclosed that it will remain confidential and used or further disclosed only as required by law or for the purpose for which it was disclosed to the person, and the person notifies the Contractor of any instances of which it is aware in which the confidentiality of the information has been breached.
1.29.5.3. Except as otherwise limited in this agreement, the Contractor shall use PHI to provide data aggregation services to the Government as permitted by
45 CFR 164.504(e)(2)(i)(B).
1.29.5.4. Contractor may use PHI to report violations of law to appropriate
Federal and State authorities, consistent with 45 CFR 164.502(j)(1).
1.29.6. OBLIGATIONS OF THE GOVERNMENT
1.29.6.1. Provisions for the Government to inform the Contractor of privacy practices and restrictions.
1.29.6.2. Upon request the Government will provide the Contractor with the notice of privacy practices that the Government produces in accordance with 45
CFR 164.520, as well as any changes to such notice.
1.29.6.3. The Government will provide the Contractor with any changes in, or revocation of, permission by Individual to use or disclose PHI, if such changes affect the Contractor's permitted or required uses and disclosures.
1.29.6.4. The Government will notify the Contractor of any restriction to the use or disclosure of PHI that the Government has agreed to in accordance with
45 CFR 164.522.
1.29.7. PERMISSIBLE REQUESTS BY THE GOVERNMENT
1.29.7.1. The Government will not request the Contractor to use or disclose
PHI in any manner that would not be permissible under the privacy rule if done by the Government, except for providing data aggregation services to the
Government and for management and administrative activities of the Contractor as otherwise permitted by this clause.
1.29.8. TERMINATION
1.29.8.1. Termination. A breach by the Contractor of this clause, may subject the Contractor to termination under any applicable default or termination provision of this Contract.
1.29.9. EFFECT OF TERMINATION.
1.29.9.1. If this contract has records management requirements, the records subject to the clause should be handled in accordance with the records management requirements. If this contract does not have records management requirements, the records should be handled in accordance with paragraphs
1.32.9.2. and 1.32.9.3. below.
1.29.9.2. If this contract does not have records management requirements, upon termination of this contract, for any reason, the Contractor shall return or destroy all PHI received from the Government or created or received by the
Contractor on behalf of the Government. This provision shall apply to PHI that is in the possession of subcontractors or agents of the Contractor. The
Contractor shall retain no copies of the PHI.
1.29.9.3. If this contract does not have records management provisions and the
Contractor determines that returning or destroying the PHI is infeasible, the
Contractor shall provide to the Government notification of the conditions that make return or destruction infeasible. Upon mutual agreement of the
Government and the Contractor that return, or destruction of PHI is infeasible, the Contractor shall extend the protections of this contract to such PHI and limit further uses and disclosures of such PHI to those purposes that make the return or destruction infeasible, for so long as the Contractor maintains such PHI.
1.30. MISCELLANEOUS
1.30.1. REGULATORY REFERENCES.
1.30.1.1. A reference in this clause to a section in DoD 6025.18R, privacy rule or security rule means the section as in effect or as amended, and for which compliance is required.
1.30.2. SURVIVAL
1.30.2.1. The respective rights and obligations of business associate under the
“Effect of Termination”' provision of this clause shall survive the termination of this contract.
1.30.3. INTERPRETATION
1.30.3.1. Any ambiguity in this clause shall be resolved in favor of a meaning that permits the Government to comply with DoD 6025.18R, privacy rule or security rule.
1.31. EMERGENCY PROCEDURES:
1.31.1. Contractor employees shall follow the direction of Government employees in regard to emergency procedures, i.e. fire, tornado, active shooter, bomb threats. It is the responsibility of the Contractor to provide guidance and establish procedures for responding to emergencies for their employees. It is the
Contractors' responsibility to account for their employees following an emergency evacuation. Contractor Personnel shall participate with Government personnel in all fire and tornado drills and no additional cost to the Government.
1.32. HEALTH AND SAFETY ON GOVERNMENT INSTALLATIONS:
1.32.1. In performing work under this contract on a Government installation, the
Contractor shall comply with the specific health and safety requirements established by this contract and Appendix C.
2. SUPPORT FOR SPECIAL EVENTS (Air Show)
2.1. The Contractor shall provide primary medical response, transport, and climate controlled triage and rehabilitation for all medical incidents in support of approximately 300,000 attendees during the two day Air Show Event within Tinker
AFB.
2.1.2. The Contractor shall provide additional personnel (EMTs & Paramedics) and two (2) each additional transport units during the two day Air Show Event.
2.1.3. The Contractor shall provide a Medical Branch Director (SME) and support staff to Incident Management Team/NIMS ICS Structure for the Air Show Event.
2.1.4. The Contractor shall participate in planning committees and pre-air show exercises for the Air Show Event.
2.1.5. The Contractor shall provide liaison support with the base Field Response
Team (FRT), Survival Flight Operations, and Medical Emergency Response Center
(MERC).
2.1.6. The Contractor shall provide and staff climate controlled areas for high acuity patient triage and rehabilitation areas to accommodate presenting lower acuity patients.
2.1.7. The Contractor shall provide and staff to transport patients from the main
Air Show venue area and screening locations to triage and rehabilitation areas.
2.1.8. The Contractor shall document encounters to provide data at the conclusion of Medical Operations and submit data to the event coordinators.

4. GOVERNMENT FURNISHED PROPERTY AND SERVICES
4.1. GENERAL. The Government will provide the following equipment, supplies, and services listed below:
4.1.1 The Government will provide the contractor living and operating facilities and living quarters to enable the Contractor to successfully meet the requirements of this contract to include quality of life elements such as beds, recliners, cooking appliances, refrigerators, tables, chairs, televisions and other elements common to alert quarters. The government will provide furnishings necessary for performing services required by this contract, however the Government will not provide any supplies or equipment.
Provided living and operating facilities will be sufficient in producing a working environment conducive to effective performance of the task required under this contract. Contract personnel shall present an orderly appearance with operating facilities area. Any decorative items displayed within office space area shall present a professional, respectful, modest appearance in keeping with Air Force and MTF standards. The government will maintain, repair and replace government-owned equipment and facilities in compliance with procedures established in AFM 67- 1, vol 5. The
Government will not be responsible for the loss or damage of personal items.
The Government will provide sufficient space in accordance with DoD Space
Planning Criteria Chapter 350: Emergency and Ambulance Services and
UFC 4- 510-01, Design: Military Medical Facilities.
4.1.2 FORMS AND PUBLICATIONS.
4.1.2.1 The MTF will provide required Government forms and publications used in the performance of services. The Government will be responsible for update of all forms and publications. In the event that a federal form publication is not available via Internet at http://www.e-publishing.af.mil., the Government will provide the federal forms or publications.
4.1.3 LAND/MOBLE RADIOS (LMR).
4.1.3.1 The Tinker Fire Department will provide the Contractor with three (3)
Hand-held Portable Land Mobile Radios (LMRs). LMRs will have the same interoperable and airfield communications capabilities of other installation emergency responders (Police/Fire/Medical)
4.1.3.2 The 72d ABW will supply the Contractor with DoD Defense Biometrics
Identification System (DBIDS) for base access.
5 GOVERNMENT FURNISHED SERVICES. The Government will furnish the following services:
5.1 HOUSEKEEPING SERVICES
5.1.1 Housekeeping: The Contractor shall keep the work areas clean and neat in accordance with Industry Standards, Occupational, Safety and Health
Administration (OSHA), fire and safety standards and this PWS. Foreign
Object Damage (FOD) and Dropped Object Prevention (DOP): Contractor personnel who, in performance of their assigned duties on this contract, work in or travel though areas near operational and production aircraft, engines, munitions, missiles, drones, space systems, support equipment, Aerospace
Ground Equipment (AGE), trainers and the contactor personnel operating vehicles and equipment on flight lines, runways, taxiways, parking ramps and in aircraft hangers and maintenance areas are required to receive FOD and DOP training and to comply with Air Force Instruction (AFI) 21-101, Air Force Materiel Command (AFCM) Sup1, Chapter 14, paragraph 14.41 and Tinker AFBI 21-449 (in its entirety). The Contractor and personnel can request a copy of the FOD Training and Prevention DVD to the assigned
COR. The Contractor shall contact the COR in the event FOD POC is unavailable to obtain the FOD Training information.
5.2 REFUSE COLLECTION
5.2.1 The Government will provide refuse collection services limited to the extent provided in the Base Refuse Collection Contract(s) for the Government provided facilities. The Government will only allow non-hazardous refuse to be emptied into the nearest authorized refuse dumpster for trash collection.
Do not use Government dumpsters to dispose of construction debris.
5.3 REAL PROPERTY MAINTENANCE
5.3.1 The Government will provide maintenance and repair of real property. The
Contractor shall follow 72d ABW/CE established procedures for identifying and reporting real property repair and maintenance requirements and report requests to the COR.
5.4 FIRE & EMERGENCY SERVICES
5.4.1 The Government will provide general on-base fire protection services. The
Contractor shall comply with fire prevention rules and regulations enforced by the Tinker AFB Fire Prevention Branch. Call 911 for emergencies. For routine fire prevention matters call 734-3981. For routine calls to dispatch call734-7964.
5.5 SECURITY POLICE
5.5.1 The Government will provide general on-base security police service; 911 is for emergencies, 734-2000 for crime in progress and 734-3737 for non-emergency calls.
5.6 RECORDS, FILES, DOCUMENTS AND WORK PAPERS
5.6.1 All records, files, documents and work papers provided by the Government remain Government property and shall be maintained and disposed of per Air
Force regulations.
5.6.2 The Government will provide access to the equipment and adequate workspace around the equipment.
APPENDIX A
ESTIMATED WORKLOAD DATA
The following data is provided for information only:
a. Present department staff consists of one emergency medical technician and one paramedic on duty at all times.
b. Runs for the past 12 months: approximately 425 runs.
APPENDIX B
APPLICABLE PUBLICATIONS AND FORMS
Publications and forms applicable to the PWS are listed below. The Contractor is obligated to follow those publications. These publications are available in the MTF and maintained by the
Government. Supplements or amendments to listed publications from any organizational level may be issued during the life of the contract. The Contractor shall immediately implement those changes in publications which result in a decrease or no change in the price and notify the CO in writing of such change. Should a decrease in contract price result, the Contractor shall provide a proposal for reduction in the price to the CO.
