Statement of Work Orphaned Oil & Gas Well Plugging - Deep Fork National Wildlife Refuge

Okmulgee, OK

1.0 BACKGROUND

Deep Fork National Wildlife Refuge (Refuge) was established in 1993 to protect bottomland hardwood forest habitat along the Deep Fork River in Okmulgee County, Oklahoma. Much of the Refuge’s approximately 10,000 acres was used extensively for oil and gas production throughout the 20th

Century. As a result, there are Orphaned and Abandoned wells spread throughout the Refuge. In an effort to prevent further environmental damage and restore habitat, the U.S. Fish and Wildlife Service

(FWS) targeted 25 of these wells already in Orphaned status for plugging in Fiscal Year 2023. All wells proposed for plugging have been determined by the Oklahoma Corporation Commission (OCC) to be

Orphaned, meaning that no responsible party can be located. National Environmental Policy Act (NEPA) requirements have been completed for this project and are available upon request from Refuge staff.

2.0 SCOPE OF WORK

The contractor shall properly plug and abandon the designated 25 Orphan wells (see Appendix) in a manner which will prevent further environmental damage. This involves placing cement plugs at strategic depths in the well in accordance with OCC standards, cutting off casing at least three feet below soil surface, and capping with a steel plate inscribed with the well number and date of plugging.

The contractor shall remove all equipment and remaining supplies from the site at the end of plugging operations. Surface reclamation is not part of these requirements.

Oklahoma Corporation Commission (OCC) is the lead regulatory agency providing standards for plugging and abandonment of oil and gas wells in Oklahoma. The contractor shall adhere to all OCC standards for completion of work. In accordance with Oklahoma Administrative Code § 165:10-11 (Oklahoma

Corporation Commission, Plugging and Abandonment), the contractor will notify OCC and file applicable forms prior to the commencement of plugging operations. OCC inspectors will provide verification that wells have been properly plugged.

3.0 LOCATION

The orphaned wells are located within Deep Fork National Wildlife Refuge, near Okmulgee, Oklahoma.

See Appendix for list and specific location of each well.

4.0 PERIOD OF PERFORMANCE

All deliverables shall be completed within 120 calendar days of issuance of Notice-to-Proceed. Due to seasonal environmental impacts to threated and endangered species within the work sites, USFWS staff will initiate site prep by April 1, 2023. Any additional site prep needed to complete plugging procedures will be the responsibility of the Contractor and must be reviewed and approved by USFWS COR and technical POC prior to starting.

5.0 CONTRACTOR REQUIREMENTS

The contractor shall analyze existing well data, investigate, visit the job site, and provide plans for plugging the wells at the site. A FWS representative will attend site visits with the contractor. The contractor shall implement the plan and plugging operations per the Statement of Work.

A. Description: The plan submitted by the Contractor shall provide for the plugging and abandonment of an orphaned oil and/or gas well situated in an upland (LeDoux site) or bottomland (other sites) environment.

B. Submittals: All submittals shall be signed and dated by the Contractor. Submittals requiring

FWS approval will be returned to the Contractor within three working days of receipt.

Submittals by the contractor to FWS shall include:

1. Records: A daily tour sheet (driller’s log) shall be kept on the work site. This sheet shall keep a current description of all activities conducted during each 24-hr period. All service company’s reports shall be kept at the work site. All records shall be available for inspection during the job and shall be submitted to the designated FWS representative at the conclusion of the job.

2. Operational Plan: The Contractor shall provide a work schedule with any updated changes weekly.

3. Changes in the Plugging Method: All changes the Contractor proposes to the plugging program shall require FWS approval prior to implementation. If unexpected conditions occur at the time of the plugging, operations shall be immediately shut down and the designated FWS representative notified.

4. Contractor will provide information on number of crew for each day of work (i.e., how many people worked the job each day).

5.2 IDENTIFICATION AND NOTIFICATION FOR ACTIVE UTILITIES

The Contractor shall be responsible for identification of all active subsurface utilities and/or pipelines by notification of appropriate line locator services and all other utility or pipeline operators in the site vicinity no less than 2 working days prior to initiation of any subsurface disturbance at the site.

Notification shall include, but is not limited to, CALL-OKIE, 1-800-522-6543. Additionally, the Contractor shall take appropriate action to identify and notify all other utility or pipeline operators in the site vicinity that are not subscribers to the CALL-OKIE service.

The Contractor shall be responsible for any and all damage to active subsurface utilities and pipelines and any impact to soil, ground water or surface water as the result of the damage. In the event of damage to active utilities or pipelines, the Contractor shall take all appropriate precautions and perform measures to contain any spills and minimize impact to surrounding media. After taking steps to contain any spills and minimize impact, the Contractor shall immediately notify the designated FWS representative of the damage. The Contractor will be required to comply with all applicable laws, rules, regulations, and clean-up standards for any impact caused by damage to active utilities or pipelines.

5.3 PRODUCTS AND EQUIPMENT

The Contractor shall provide all equipment and goods necessary to complete plugging in accordance with OCC standards including:

A. Completion/Work Over Rig: The rig shall have the capacity to operate to a depth of 3,000 feet. The rig shall be furnished with crew and supervision. Since minimizing ground disturbance is a priority, the contractor will use the smallest rig capable of safely and efficiently performing the work. Provide the manufacturer's name, size and capacity for the rig.

5.1 PLUGGING AND ABANDONMENT PLAN

B. Well Control Equipment: The well control equipment shall consist of a full opening valve capable of providing full closure of the wellbore during non-operational periods.

C. Circulating Equipment: The circulating equipment shall consist of the mud pump and mud tanks. The mud pump shall be capable of discharge volumes and discharge pressures required for the individual wells. Enough mud tanks shall be furnished to contain the drilling mud required for plugging operations.

D. Cementing Equipment: The cementing equipment shall be capable of batch mixing of cement slurry. A mud/multi-purpose pump shall be provided that can pump the cement slurry to the plug depths as specified.

E. Water: Water used for cementing shall be from a potable source. Pumping water from the river, streams, ponds, or wetlands on the Refuge is not permitted.

F. Storage Tanks - Well Fluids: Enough storage tanks shall be furnished to contain all well fluids circulated from the well during plugging operations. Hazardous materials or hydrocarbons shall be disposed of in an approved State facility.

G. Plug and Abandonment Marker: Shall be a metal plate at least 1/4" thick and welded in place.

A weep hole shall be in the plate. The following shall be inscribed on the plate:

•Well name and API number

•Location: 1/4, 1/4 Sec., Township, Range

•Date of Plugging

5.4 EXECUTION

A. PLUGGING REQUIREMENTS: The orphan wells shall be plugged in accordance with the minimum standards for processes and materials set forth in Oklahoma Administrative Code §

165:10-11 (Oklahoma Corporation Commission, Plugging and Abandonment). The Contractor is responsible for understanding and complying with these and all other applicable state and federal regulations governing plugging operations.

B. NOTIFICATION AND WITNESS OF PLUGGING: In accordance with Oklahoma Administrative

Code § 165:10-11-4:

1) Wells without production casing. The appropriate Conservation Division District

Office shall be notified at least 12 hours prior to commencement of plugging operations (with additional notification made to the designated FWS representative) and a plugging procedure agreed upon for any well without production casing. Each plugging operation may be witnessed by an authorized representative of the

Conservation Division.

2) Wells with production casing. A separate Notification of Intention to Plug (Form

1001) for each well with production casing shall be filed with the appropriate

Conservation Division District Office at least five days prior to the commencement of plugging operations (with additional notification made to the designated FWS representative). The five day notice requirement may be reduced or waived:

C. ALTERNATIVE PLUGGING PROCEDURES: In plugging a well, if the Contractor encounters a downhole problem which prevents the Contractor from complying with the standards of Okla.

Admin. Code § 165:10-11-6, the designated USFWS representative, in coordination with the OCC

District Manager may prescribe an alternate plugging procedure. Any alternative plugging procedure must prevent the vertical migration in the wellbore of oil, gas, saltwater, H 2 S, or other harmful substance into a formation bearing oil, gas, or treatable water.

D. CUTTING OFF SURFACE PIPE: After setting the top plugs in a well, the Contractor shall cut off the casing left in the wellbore at least three feet below the surface. The Contractor shall cap the casing in the wellbore by welding a steel plate at least 1/4’’ thick. The plate shall include a permanent marker indicating the well number, location, and date of plugging.

E. After the well has been capped and signed off by the OCC inspector, the contractor will backfill the hole and grade similar to immediate surrounding terrain.

F. SITE SPECIFIC REQUIREMENTS: The FWS will provide site specific requirements, as needed, to the contractor via electronic media to ensure preservation of habitat within the work area.

These may include, but are not limited to interior road access procedures, limitations on soil and vegetation disturbance, etc.

G. SALVAGE ITEMS: The contractor shall remove from the location all well bore items not utilized during the plugging operation. This includes salvaged casing, tubing, rods, and any downhole equipment. Contractor shall remove surface production equipment, including barrels, tanks and or pumping units.

H. ANCHORS: Anchors shall be removed or cut off 3 feet below ground level.

6.0 SCHEDULE OF DELIVERABLES

5 Form 1003 Contractor will file Form 1003, Plugging Record, with Conservation District Office with a courtesy copy sent to the designated FWS representative.

Within 30 days after plugging operations are completed.

7.0 SECURITY

A. Authorized Personnel: The Contractor will provide a list of all personnel required to access the well site. The Refuge manager will issue a written permit allowing these individuals access to the federal property at the site for the purpose of completing the plugging work. Any changes to the personnel roster will be communicated to the designated FWS representative within 24 hours.

B. Site Security: The Contractor will be issued gate keys to access Refuge property at designated locations. The Contractor is responsible for security of their own equipment and materials at the site. Any theft or property damage should be reported to the Okmulgee County Sheriff’s

Department and Deep Fork NWR’s Federal Wildlife Officer.

8.0 ENVIRONMENTAL IMPACT

FWS may restrict access to the sites during periods of inclement weather to minimize soil disturbance.

Additional restrictions may be put into place to mitigate impacts to threatened and endangered species.

The Contractor shall take all appropriate precautions to minimize incidental disturbance to soil and vegetation outside the immediate work area(s), and may be held liable for any such damages deemed unnecessary or avoidable by Refuge management.

9.0 OSHA COMPLIANCE/PROJECT SAFETY

The Contractor shall be responsible for strict compliance with all provisions of Occupational Safety and

Health Administration (OSHA) requirements 29 CFR 1910 and 29CFR 1926 during the performance of the work.

10.0 INSPECTION AND ACCEPTANCE CRITERIA

Final inspection and acceptance of work performed is subject approval from OCC Field Inspector and designated FWS representative.

11.0 OTHER REQUIREMENTS

Contractor must be on the Oklahoma Statewide Pluggers List maintained by Oklahoma Corporation
