Amendment 3 to Sol#140F1B23R0003 Questions and Answers May 1, 2023
1. Is Contractor allowed to remove trees, vegetation, etc., within the Deep Fork National Wildlife Refuge (“refuge”)?
a. If yes, what is the process for such removal? Will Contractor need approval(s) prior to removal? What agencies or departments that will be required to approve removal of vegetation? Will Contractor be required to replace trees and/or vegetation upon completion of plugging operations?
Yes, vegetation removal (site prep) must be reviewed and approved by USFWS COR and technical POC prior to starting. Contractor is not responsible for replanting trees and/or vegetation. Please review Statement of Work sections 4.0, 5.4 F and 8.0.
2. Is Contractor allowed to build roads within the refugee to access the well sites?
a. If yes, what materials will be allowed to be used for road construction? Is there a restriction on the width and depth of roads? Is there a requirement on the size of and type of rock or material to be used within the refuge?
b. Upon completion of the project, will the roads need to be removed? Will Contractor need approval prior to removal? Will there be additional agencies or departments that will be required to approve removal of roads?
The USFWS is the lead federal agency and will be involved and notified on all aspects of this contract. The building of roads or improved access to the well sites will be reviewed and approved by USFWS COR and technical POC prior to starting. This will also be reviewed during the technical review of the proposed plugging plan.
3. Based on the statement of work and site inspection, indication are there could be numerous governmental agencies and representatives involved providing oversight and various approvals.
a. Can you provide a list of government agencies/representatives (including state and federal) that will be part of any requirement and a description of the approvals that you anticipate will be required from each of these agencies?
b. Can you specify if these agencies/representatives will be onsight?
c. How long do you anticipate approvals will take from each agency? If approvals will not be within preset parameters, will the FWS compensate the Contractor for downtime while waiting for approvals?
The USFWS is the lead federal agency and will be involved and notified on all aspects of this contract.
Oklahoma Corporation Commission (OCC) is the lead regulatory agency providing standards for plugging and abandonment of oil and gas wells in Oklahoma. The contractor shall adhere to all OCC standards for completion of work. In accordance with Oklahoma Administrative Code § 165:10-11 (Oklahoma Corporation Commission, Plugging and Abandonment), the contractor will notify OCC and file applicable forms prior to the commencement of plugging operations. OCC inspectors will provide verification that wells have been properly plugged.
USFWS representative(s) will likely be on site and/or readily available during operations. If the period of performance timeline (outlined in SOW) will need to be extended due to government delay, the contractor may submit a request for equitable adjustment to the CO. Refer to the FAR clause outlined in the solicitation; 52.243-4 Changes.
4. Upon inspection, the soil is extremely soft and sandy throughout the refuge. Is Contractor allowed to build well pads to set equipment at each location?
a. If yes, is Contractor allowed to change the grade and slope of the land within a certain radius of the wellhead?
b. Will Contractor be required to remove all materials at the well pad upon completion?
c. During inspection, it was noted that much of the grading that will need to occur includes soil currently saturated with hydrocarbons. What will Contractor be expected to do with this saturated soil? Will the Contractor remove and dispose of the saturated soils outside of the refuge at an approved location?
d. Is there a size requirement/limitation to the pad that may be built?
Please review Statement of Work sections 4.0, 5.1 A, 5.3 A&F and 5.4 E&F.
5. Is Contractor allowed to set rig anchors (aka deadmen) within the refuge?
a. If yes, is there a restriction on the type of anchor that can be used? Is there a restriction on the depth of the anchor?
Please review Statement of Work sections 5.1 and 5.3 A.
6. Which agency will determine plugging methods, standards, and provide all approvals?
a. In the Statement of Work, Paragraph 2.0 states "...OCC is the lead regulatory agency providing the standards for plugging...OCC inspectors will provide verification that wells have been properly plugged." Paragraph 5.1 B.3 states that all changes to the plugging program shall require FWS approval prior to implementation. These two provisions appear to require Contractor to receive approval from both the OCC and FWS for all plugging operations. Normal plugging operations in Oklahoma usually require approval of the field inspector and/or the district manager. Is the Contractor going to answer to FWS or to OCC on plugging operations?
b. If FWS and OCC standards are not in alignment, how does Contractor resolve any disagreement?
c. Nearly all the pipe in the contracted wells is over 100 years old and in an extremely dilapidated condition. It is assumed most of the pipe will need to stay in place and be plugged under some type of alternative method. Is there any level of methane leakage that will be acceptable under the performance of this contract?
The USFWS is the lead federal agency and will be involved and notified on all aspects of this contract. The contractor will coordinate with both the USFWS and OCC during certain points of the contract and if there are unforeseen conflicts the USFWS and OCC will work in a timely manner to resolve any issues.
There should be no detectable methane (or other hydrocarbons, H2S, saltwater, etc) after plugging operations are complete. If an operator anticipates that conditions are such that fluids may still migrate to the surface, the operator must work with the OCC and FWS to define an alternative plugging method that will prevent the migration of oil, gas, saltwater, H2S, or other substances to the surface and/or into oil-, gas-, or treatable water-bearing formations.
7. Is Contractor expected to warrant work after the OCC approval of each contracted well?
a. In the event new wells are drilled under or in the vicinity of the refuge in the future, is
Contractor's workmanship expected to withstand the future effects of offset production/operations?
The contractor is expected to adhere to the SOW. All plugging operations are subject to the appropriate regulations of the Oklahoma Corporation Commission, and all work must be conducted in accordance with the plugging and abandonment standards and procedures set forth by the OCC in coordination with FWS. Damages resulting from failure to comply with OCC and FWS directives will be the responsibility of the operator.
8. What is exactly due 5/2/23?
The RFP deadline of 5/2/23 is extended to May 8, 2023 06:00 pm CDT. Must submit all documents/information outlined in section L.1.1 on page 37.
9. Is it possible to get a waiver on the bid bond prior to bid submittal?
The bid bond is required per the solicitation, and it cannot be waived.
10. Is the magnitude outlined in the solicitation the minimum or maximum amount allowed to bid?
No, submit your proposal based on the actual cost that your firm charges for this type of service.
11. SAM registration is not active yet, will that effect ability to bid on this RFP?
An Offeror is required to be registered in SAM.gov when submitting an offer or quotation and shall continue to be registered until time of award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.
