About this file

This is a federal contracting representation form regarding covered telecommunications and video surveillance services and equipment, effective October 2020.

The form requires members to complete two mandatory representations: (1) whether they will provide covered telecommunications equipment or services to the Government in performance of any resulting contract, subcontract, or other contractual instrument, and (2) after conducting reasonable inquiry, whether they currently use or possess any covered telecommunications equipment or services. Members must review the System for Award Management (SAM) exclusion list at https://www.sam.gov for entities excluded for covered telecommunications equipment or services. The prohibitions derive from Section 889 of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232), which prohibits federal agencies from procuring, obtaining, or renewing contracts for equipment, systems, or services using covered telecommunications equipment or services as substantial, essential components or critical technology as of August 13, 2019 (for direct procurement) and August 13, 2020 (for contracts with entities). Exceptions exist for third-party connectivity services such as backhaul, roaming, and interconnection arrangements, and for telecommunications equipment that cannot route or redirect user data traffic or permit visibility into user data.

If a member responds affirmatively to either representation, detailed disclosures are required, including: the producing entity name, unique entity identifier, CAGE code, and manufacturer status; complete equipment descriptions including brand, model numbers, and item descriptions; and explanations of proposed use with relevant factors for determining permissibility under the applicable prohibition. For services, members must provide maintenance-related item descriptions or the Product Service Code (PSC) for non-maintenance services. The form concludes with signature, typed name, date, member legal name, and Unique Entity Identifier (UEI) fields.
