Athens Area Schools
ADDENDUM NO. 1
TO REQUEST FOR PROPOSALS DATED September 30, 2024 (the “RFP”)
The following is added to the RFP:
“District” means Athens Area Schools. “Selected Contractor” means the bidder whose bid is accepted by the District to perform the work described in the RFP.
1. A bank money order, certified check or bid bond must accompany all Proposals by a recognized surety company for not less than five percent (5%) of the amount of the Proposal submitted and made payable to the District as required by MCL 380.1267 (“Bid Security’).
The Bid Security is a guarantee the Selected Contractor will, in case its Proposal is accepted, enter into a contract with District within sixty (60) days, unless extended by the District, to complete the Project proposed and to give satisfactory performance and payment bonds in the amount of the contract as specified. The bank money order, certified check or bid bond of the
Selected Contractor will be forfeited to the District upon failure to enter into such contract and to give such bonds. The bank money order, certified check or bid bond of the Selected
Contractor will be returned as soon as the contract is signed by the Selected Contractor and returned to the District.
2. Prior to commencement of the Project, the Selected Contractor shall furnish performance bonds and labor and material payment bonds as required by MCL 129.201, et seq. in such form as the District may require, securing the faithful performance of such contracts and payment of all obligations arising thereunder. Such bonds must be for the full amount of the contract with a surety company in good standing and licensed to do business in the State of Michigan.
The Selected Contractor shall include in the Base Proposal the cost of furnishing such bonds/securities.
3. Each proposal must be accompanied by a sworn and notarized statement [form attached below] certifying that the Bidder is not an “Iran Linked Business” within the meaning of the Iran
Economic Sanctions Act.
4. Each bid received by 1:00 p.m., local time, Friday, October 11, 2024, will be opened and read aloud at that time and date at: 4320 K Drive South; East Leroy, MI 49051.
IRAN ECONOMIC SANCTIONS ACT CERTIFICATION
I am the ___[title] of [name of bidder], or I am bidding in my individual capacity ("Bidder"), with authority to submit a binding bid to
Perry Public Schools. I have personal knowledge of the matters described in this Certification, and I am familiar with the Iran Economic Sanctions Act, MCL 129.311, et seq. ("Act"). I am fully aware that the school district will rely on my representations in evaluating bids.
I certify that Bidder is not an Iran-linked business, as that term is defined in the Act. I understand that submission of a false certification may result in contract termination, ineligibility to bid for three (3) years, and a civil penalty of $250,000 or twice the bid amount, whichever is greater, plus related investigation and legal costs.
