Justification for an Exception to Fair Opportunity or to Use Brand-Name Restriction

In order for installed IDS to operate and communicate with 502 SFS PMC, which notifies them of any alerts, the IDS must be Vindicator certified. Honeywell manufacture all Vindicator compatible software and hardware to communicate with the 802 SFS PMC at BDOC. Additionally, installation will require Honeywell or a Honeywell certified reseller (off their Value Added Reseller list) to properly install and configure its equipment to the appropriate 802 SFS PMC. An IDS that is not Vindicator or manufacture by Honeywell and installed by Honeywell or certified reseller will not be able to communicate or route alerts to 802 SFS when the alarm systems are triggered.

(5) Contracting Officer's determination that the anticipated cost to the Government will be fair and reasonable:

Previous Market research conducted by 502 CONS for previous similar requirements concludes that there is a reasonable expectation that at least two small business contractors that are Honeywell Vindicator Certified vendors are capable of providing the required services to support competitive pricing; therefore, the Contracting Officer has determined that the anticipated cost to the Government will be reflective of competitive pricing in the market place resulting in fair and reasonable pricing.

(6) Other facts supporting the justification:

Honewell Vindicator System is the current system in use by the base Security Forces Squadron for immediate threat response.

Failure to install this brand name equipment will result in communication failure with base Security Forces Squadron in the event of a threat. Moreover, substitution of this brand name equipment will result in a complete overhaul of all base installation systems. The currently installed and approved system for the facility is Honeywell Vindicator. Per the manufacture and based on personal knowledge/experience from the CO, only authorized resellers of Honeywell Vindicator products are capable of performing maintenance and/or upgrades on the current Honeywell Vindicator system. In addition, an upgrade of the current system necessitates Honeywell Vindicator products for a proper integration into the current existing system. Replacement of the existing system would cause an undue burden to the Government, result in a duplication of cost and effort, and cause a gap in continuity of service that would not likely be recovered by eliminating the need for a brand-name only requirement.

(7) Actions the agency may take to remove or overcome any barriers to decreasing the use of brand-name items before any subsequent acquisition of the supplies or services:

The 502 CONS will make every practicable effort to maximize the range of competitive offers received on subsequent acquisitions for similar supplies or services. However, allowing competition from contractors other than authorized resellers of Honeywell Vindicator products on this particular acquisition would result in a duplication of costs to the Government that would not be outweighed by the benefits of increased competition as a result of replacing the existing alarm system with other than Honeywell Vindicator or may result in a loss of warranty coverage on the existing system. Moreover, there are no compatible devices that can be installed or modified for compatibility on the Honeywell Vindicator System from other companies to meet the agency's needs.

(8) Program Manager's certification that supporting data is accurate and complete:
