FMS #4 Emergency Generator - Project Manual Summary
This is a comprehensive project manual issued by the Delaware Army National Guard (DE ARNG) for the design and construction of an emergency generator system at Field Maintenance Shop #4 in Seaford, Delaware. The project involves installation of one new 80-kilowatt natural gas-fired emergency generator, an automatic transfer switch, associated panelboards, and selective upgrades to the building's electrical distribution system to provide 100 percent backup power for the facility located at 23440 Ross Station Road. The mandatory pre-bid meeting is scheduled for Wednesday, May 27, 2026, at 10:00 AM local time at the project site, with sealed bids due by 1:00 PM on Wednesday, June 17, 2026, at the Biden National Guard/Reserve Center in New Castle, Delaware. Attendance at the pre-bid meeting is a prerequisite for bidding. The project is designated as DE ARNG Contract 2024-04 with FE&ES Communication Number 24-1614, prepared by Fayda Engineering & Energy Solutions, LLC.
Contract documents establish a stipulated sum agreement utilizing AIA Document A101-2017 as the standard form, with required performance and payment bonds equal to 100 percent of the contract price. A ten percent bid security is required with bid submission. The contract incorporates Delaware prevailing wage requirements under Title 29, Delaware Code Chapter 69, Section 6960, and mandates compliance with OMB Regulation 4104 regarding mandatory drug testing programs for contractor and subcontractor employees. Contractors must submit a completed subcontractor list with bids identifying all first-tier and third-tier subcontractors and may not substitute listed subcontractors without written agency consent, subject to penalties of up to one percent of the contract amount (not exceeding $10,000). The project includes two allowances totaling $35,000—$20,000 for miscellaneous modifications and $15,000 for utility company costs—and requires compliance with DE ARNG security procedures, including background checks and restricted access for all personnel working on the installation. Contract administration is the responsibility of the Engineer of Record, with final payment contingent upon submission of closeout documentation including as-built drawings, operations and maintenance manuals, warranties, and release of liens.

For clarification, if the Bidder intends to perform the work themselves, the Bidder may not insert “not applicable”, “N/A”, “self” or anything other than its own full name and address (City & State). To do so shall cause the bid to be rejected. In addition, the failure to produce a completed subcontractor list with the bid submittal shall cause the bid to be rejected. If you have more than three (3) third-tier contractors to report in any subcontractor category, print out additional page(s) containing the appropriate category, complete the rest of your list of third-tier contractors for that category, notate the addition in parentheses as (CONTINUATION) next to the subcontractor category and an asterisk (*) next to any additional third-tier contractors, and submit it with your bid.

After a contract has been awarded the successful bidder shall not substitute another subcontractor whose name was submitted on the Subcontractor Form except for the reasons in the statute and not without written consent from the awarding agency. Bidders shall submit the Affidavit of Craft Training Compliance prior to contract execution.
4.6 EQUALITY OF EMPLOYMENT OPPORTUNITY ON PUBLIC WORKS

A. The Contractor will not discriminate against any employee or applicant for employment because of race, creed, sex, color, sexual orientation, gender identity or national origin. The Contractor will take affirmative action to ensure the applicants are employed, and that employees are treated during employment, without regard to their race, creed, sex, color, sexual orientation, gender identity or national origin.
Such action shall include, but not be limited to, the following: Employment, upgrading, demotion or transfer; recruitment or recruitment advertising; layoff or termination;
rates of pay or other forms of compensation; and selection for training, including apprenticeship. The Contractor agrees to post in conspicuous places available to employees and applicants for employment notices to be provided by the contracting agency setting forth this nondiscrimination clause.
B. The Contractor will, in all solicitations or advertisements for employees placed by or on behalf of the Contractor, state that all qualified applicants will receive consideration for employment without regard to race, creed, sex, color, sexual orientation, gender identity or national origin."

FE&ES Comm.: 24-1614 00 21 13-9
4.7.2 The employer shall pay all mechanics and labors employed directly upon the site of work, or engaged in custom fabrication work, as that term is defined in Article 1.23 herein and as also as defined in 29 Del. C § 6902 and described in 29 Del. C. § 6960(b), regardless of where the work is performed, unconditionally and not less often than once a week and without subsequent deduction or rebate on any account, the full amounts accrued at time of payment, computed at wage rates not less than those stated in the specifications, regardless of any contractual relationship which may be alleged to exist between the employer and such laborers and mechanics.
4.7.3 As per 29 Del. C. § 6960(b), the scale of the wages to be paid must be posted by the employer in a prominent and easily accessible place at the site of the work. There may be withheld from the employer so much of accrued payments as may be considered necessary by the Department of Labor to pay laborers and mechanics employed by the employer the difference between the rates of wages required by the contract to be paid laborers and mechanics on the work and rates of wages received by such laborers and mechanics to be remitted to the Department of Labor for distribution upon resolution of any claims.
4.7.4 Every contract based upon these specifications shall contain a stipulation that sworn payroll information, as required by the Department of Labor, be furnished weekly. The Department of Labor shall keep and maintain the sworn payroll information for a period of 6 months from the last day of the work week covered by the payroll.

A request for withdraw by letter or fax, if the Architect is notified in writing prior to receipt of fax, is acceptable. A fax directing a modification in the bid price will render the Bid informal, causing it to be ineligible for consideration of award. Telephone directives for modification of the bid price shall not be permitted and will have no bearing on the submitted proposal in any manner.
4.9.2 Bidders submitting Bids that are late shall be notified as soon as practicable and the bid shall be returned.
00 21 13-10 FE&ES Comm.: 24-1614
