About this file

This is a Small Business Set-Aside Program Waiver document from the State of Illinois Chief Procurement Office involving the Department of Corrections and Centralia Correctional Center. The procurement seeks 15,000 yards of 7.5 ounce Kelly Green Twill fabric, which will be used to manufacture level E jumpsuits and coats for individuals in custody and distributed to Illinois Department of Corrections facilities throughout the state. The original BidBuy bid number was B-51444, which was subsequently updated to B-51587. The request was submitted on March 17, 2026, by Kimberly Litteken of Centralia Correctional Center with support from Vanessa Wehking, Business Administrator.

The estimated dollar amount for this procurement is $22,500, classified under NIGP code 850-24. Ten qualified small businesses were solicited for this set-aside procurement; however, the lowest bid received was $28,500, exceeding the pre-established estimate by $6,000. Due to this significant price variance, a waiver of the Small Business Set-Aside Program was requested and approved, allowing the procurement to proceed beyond the small business vendor pool. The waiver justification was based on qualified small business vendors' inability to provide pricing within the budgeted parameters, meeting the established criteria for set-aside exemption under Illinois procurement guidelines.

SMALL BUSINESS SET-ASIDE PROGRAM WAIVER

State of Illinois Chief Procurement Office for General Services Small Business Set-Aside Program Waiver v.25.3

Original BidBuy BID Number: B-51444 Current BidBuy BID Number: B-51587

* Use BidBuy Requisition Numbers when the procurement is Designated to the Agency.

From CPO Notice # 2024.10:

The Chief Procurement Officer has established set-aside categories of construction, supplies and services that are set-aside for small businesses in Illinois. Procurements that are within the listed categories must be set-aside for small businesses, regardless of the dollar value of the contracts. Additionally, all purchases under the small purchase threshold are automatically set-aside for small businesses in Illinois.

Use of a Small Business Set-Aside Program Waiver requires agencies to have clear justification why a SBSP vendor was not appropriate for a set-aside award. The following are examples of guidelines that may be considered:

There is a need for a brand name product and there are no small businesses that provide the product.

Small Business vendors were solicited and no offers were received.

The supply base for the product or service includes several larger diversified vendors that can be counted toward the Business Enterprise for Minorities, Females and Persons with Disabilities Act (30 ILCS 575).

The supply base for the product or service includes several Veteran Owned Small Businesses (VOSB) that can be counted toward the Business Enterprise for Minorities, Females and Persons with Disabilities Act (30 ILCS 575).

The product or service is required to be purchased from Illinois Correctional Industries (30 ILCS 500/45-30).

There is an opportunity to establish a no-bid contract with a State Use vendor (30 ILCS 500/45-35). Provide more detail below.

The prices offered by qualified small businesses are substantially greater than the estimated dollar amount established prior to the solicitation being sent out. Provide more detail below.

Other. Provide more detail below.
