About this file
This is a Workers' Rights Certification document issued by the Washington Department of Fish and Wildlife (WDFW) for the Samish River Unit Tree and Shrub Planting Project. The document establishes compliance requirements related to Executive Order 18-03, which addresses workers' rights in state contracts. Bidders are required to certify whether their firm mandates mandatory individual arbitration clauses or class or collective action waivers as conditions of employment. The project involves establishing native trees, shrubs, and willow whips within designated planting areas to meet Wildlife Restoration Program easement objectives and restore the site to native conditions. Contractors must procure and supply the specified native plant materials from local tree and plant nurseries.
The certification document provides a three percent bid preference to any bidder who certifies that their firm does NOT require employees to sign or agree to mandatory individual arbitration clauses or class or collective action waivers as conditions of employment. Bidders must select one of two certification options and submit the signed certificate under penalty of perjury, including the firm's full legal entity name, authorized signatory information, and certification date. This workers' rights provision is evaluated as part of WDFW's best value procurement criteria, incentivizing compliance with Washington's policy supporting employees' rights to address workplace violations without mandatory arbitration restrictions.
