About this file

This is an annual affidavit form required by the Commonwealth of Kentucky for bidders, offerors, and contractors seeking to be awarded or renew state contracts. The affidavit is mandated under Kentucky Revised Statutes 45A.110 and 45A.115 and remains effective for one year from the date of execution. An authorized representative of the contracting party must complete the attestation, obtain notarization, and submit the completed affidavit to the Commonwealth to satisfy contract award or renewal requirements. The form requires the authorized representative to swear under penalty of perjury that the contractor has not knowingly violated Kentucky's campaign finance laws and that contract award will not violate any provisions of those laws. For purposes of the attestation, "knowingly" is defined as the bidder or offeror being aware or reasonably should have been aware of the existence of a violation.

The affidavit form includes signature blocks for the authorized representative's name, title, and date of execution, as well as fields for the bidder or offeror's name, address, and Commonwealth of Kentucky vendor code if known. The document must be subscribed and sworn before a notary public, with the notary providing their signature, the date of notarization, state and county information, and notary commission expiration date. The Commonwealth retains the right to request an updated affidavit at any time during the contract period. This requirement applies uniformly to all bidders and offerors regardless of contract value or type.
