About this file
This is an Annual Affidavit form required by the Commonwealth of Kentucky for bidders, offerors, and contractors participating in state procurement opportunities. The affidavit serves as a compliance certification document with a maximum effective period of one year. All bidders and offerors must complete and notarize this form, affirming under penalty of perjury that they and their entities comply with Kentucky's campaign finance laws, have not violated provisions outlined in KRS 45A.485, are properly registered with the Kentucky Department of Revenue for sales and use tax collection, are not delinquent on state taxes or fees, are not engaged in boycotts of entities in jurisdictions with which Kentucky maintains open trade, and have not violated prohibitions in KRS 11A.236 during the previous ten years. The affidavit must be signed by a duly authorized representative of the bidding entity and sworn before a notary public.
For non-bid contracts including sole-source, non-practical-to-bid, or emergency contracts, contractors must provide additional certifications regarding campaign contributions. These include confirming that neither the contractor nor immediate family members with 10% or greater business interest have contributed more than amounts specified in KRS 121.150 to the gubernatorial slate's campaign preceding the contract award date; that officers, employees, and affiliated entities have not contributed more than $5,000 in aggregate to elected candidates with jurisdiction over the contract; and that neither the contractor nor affiliated individuals have directly solicited contributions exceeding $30,000 in aggregate for such campaigns. Non-compliance during the affidavit effective period must be reported immediately to the Finance and Administration Cabinet, Office of Procurement Services, and failure to accurately disclose information may result in contract termination, fund repayment, and other available legal remedies.
