About this file

This is Amendment 1 to a Request for Proposal issued by the North Dakota Department of Environmental Quality for the remediation of a former M&H Gas Station in Wahpeton, ND. The amendment, issued on February 12, 2025, addresses four questions submitted regarding the original RFP (303-23-013) issued on February 4, 2025, with proposals due February 24, 2025, by 2:00 PM CT. The project involves two areas requiring partial excavation, with a maximum vertical extent of 13 feet and a total area of approximately 10,000 square feet. The scope includes backfilling excavated areas with uncontaminated materials, providing topsoil, and seeding the entire site lot (90' x 100') with a specified grass seed mix consisting of 30% glade Kentucky blue, 30% park Kentucky bluegrass, 30% creeping red fescue, and 10% annual rye or approved equivalent.

The amendment clarifies technical requirements and specifications but does not include any modifications to pricing terms or funding sources. Key clarifications include the requirement for a communication plan as part of the Remedial Action Plan, specifications for backfill materials, and detailed seeding requirements for both excavated and non-excavated areas. The priority target areas for excavation are identified as SB-4 and SB-2, as indicated in the 2023 Risk Assessment document.

SOLICITATION AMENDMENT 1

February 12, 2025

Solicitation Number: 303-23-013 Title: Remediation of Former M&H Gas Station in Wahpeton, ND Deadline for Receipt of Proposals: February 24, 2025 by 2:00 PM, CT Solicitation Issued: February 4, 2025

Section 1.10 of the Request for Proposal established a Deadline for Questions and Objections. The responses, including any necessary amendments, are as follows:

1. Question: Is there a square footage for the anticipated excavation? As the lot is over 9,000 sq ft I’d like to make sure we have an idea of how much topsoil versus fill we’d need to bring in. This would also give us a more accurate idea of reseeding costs.

Response:

There are two areas identified for partial excavation. An unknown quantity of material needs to be excavated, but priority target areas are SB-4 and SB-2 as indicated on pages 40-41 of Attachment 2 - 2023 Risk Assessment. The impacted interval has a maximum vertical extent of approximately 13’, with horizontal estimates currently unknown. The total area is approximately 10,000 square feet. This number was obtained using satellite imagery from Google Earth Web App and the area calculation measurement tool.

No amendment necessary.

2. Question: How extensive is the State planning for the Communication Plan to be? Will the Communication Plan be an email, or a formal submittal? Does the State have an example to provide? Comment by Cannon, Amy L.: @Kannenberg, Derek P. - Please answer Questions 2-4.

Response: The communication plan identified in RFP Section 3.3, G. - PROJECT MANAGEMENT PLAN may be included as part of the Remedial Action Plan (See Attachment 8). The STATE does not have a specific example, but the Offer should plan for typical industry standards. For example, unexpected discoveries, delays, or other needs for communication should be identified in the communication plan.

No amendment necessary.

3. Question: Does the entire lot have topsoil for the grass seeding?

Response: The areas that are not being excavated have topsoil for grass seeding. The areas that will be excavated will need topsoil to be provided by the Offeror for seeding.

RFP Section 3.3, B - DELIVERABLES, 3. Backfill and Regrading is amended and replaced as follows.

3. Backfill and Regrading. The Offeror will backfill and regrade the excavated areas with uncontaminated, geologically similar materials. The topsoil needed for seeding of the excavated areas will be provided by the Offeror.

4. Question: Does the State want the entire Site lot to be seeded (approximately 90’ x 100’) or just seed the excavation areas? Does the State have an example of the type of “cool season” grass seed that was requested?

Response: Yes, the entire site lot should be seeded which includes the excavated areas. The entire site lot will be seeded with a grass seed mix of 30% glade Kentucky blue, 30% park Kentucky bluegrass, 30% creeping red fescue, and 10% annual rye or approved equivalent during planning.

RFP Section 3.3, B - DELIVERABLES, 4. Seeding is amended and replaced as follows.

4. Seeding. The Offeror will seed the entire site lot which includes excavated areas with a grass seed mix of 30% glade Kentucky blue, 30% park Kentucky bluegrass, 30% creeping red fescue, and 10% annual rye or approved equivalent during planning.

Questions regarding this amendment must be submitted in writing to the Procurement Officer.
