About this file

This document is Amendment 3 issued by the Maryland Department of General Services Office of State Procurement for ITB Number 001IT821310/BPM030356 for a contract titled "Multi Test Diagnostic Equipment". The amendment clarifies several questions from bidders regarding the submission of proposals, shipping arrangements, contract terms, and pricing. Specifically, the amendment confirms that the vendor supplying the diagnostic tests must submit the proposal, not a distributor. It also specifies that the instruments shall be shipped directly to the sites by the vendor, while the arrangement for shipping reagents is between the sites and the vendor. Additionally, the amendment removes the requirement for additional 3 years of mandatory pricing beyond the initial contract term. The related state and local contract opportunity is for the Maryland Department of Health to acquire high-quality diagnostic laboratory multi-test equipment to distribute to Maryland primary care offices for quickly diagnosing respiratory diseases.

The amendment indicates that pricing submissions will not be publicly disclosed, and that the contract does not preclude the awarded vendor from doing future business with the individual sites outside of the products listed in this solicitation. It also encourages proposals that include data sharing, which will be subject to the State of Maryland and Maryland Department of Health's policies and procedures.

AMENDMENT 3

DATE: August 26, 2022

STATE OF MARYLAND

DEPARTMENT OF GENERAL SERVICES

Office of State Procurement

ITB NUMBER: 001IT821310 / BPM030356

CONTRACT TITLE: Multi Test Diagnostic Equipment

ATTENTION ALL BIDDERS:

1. The following questions have been raised in regard to this solicitation:

Q1. The company we distribute for meets the 5 and 3 year business requirements of the

RFP; however, we have not distributed diagnostics equipment for the required 3 years.

As such, can the company bid this opportunity under its name or should the company we represent submit the bid?

A1. Submission of proposals is the responsibility of the vendor with whom the diagnostic tests would be purchased from, not the distributors.

Q2. Shipping: Is the State expecting both instruments and reagent to be shipped directly to sites? Or are instruments going to the State and then reagents being subsequently shipped to sites after being awarded the instrument from the State?

A2. The instruments shall be shipped to the sites by the vendor. The arrangement for shipping reagents shall be between the sites and the vendor.

Q3. Terms: Is there an opportunity to negotiate/redline terms included in the RFP?

A3. Please refer to Section 4 – Procurement Instructions, Section 4.17 – Acceptance of Terms

& Conditions and Section 5 – Proposal Format, Section 5.3.2 (D) – Executive Summary.

Q4. Clarification on 2.3.1.8: Is pricing held for the one year terms of this agreement and then an additional 3 years after the expiration of the agreement?

A4. This section has been amended to remove the additional three (3) years of mandatory pricing. The amended language makes clear the pricing of cartridges is applicable only for the duration of the contract. Please refer to the latest RFP document updated August 26, 2022.

Q5. Are pricing submissions publicly disclosed?

A5. No.

Q6. Does this contract preclude us from future business with the individual sites

(additional/future product offering outside of the products listed on this RFP)?

A6. No.

Q7. Is there opportunity for data sharing between the State and the bid offeror with the information gathered in this study?

A7. Proposals including data sharing are both welcome and encouraged. Any data sharing shall be subject to the State of Maryland and the Maryland Department of Health’s policies and procedures.

For any questions please contact the Procurement Officer.
