SECTION M - EVALUATION FACTORS FOR AWARD
The following have been modified:
52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
EVALUATION FACTORS
The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Technical Capability Price Past Performance
BASIS FOR AWARD:
Award will be made to a single offeror who is deemed responsible in accordance with the Federal Acquisition Regulation (FAR), whose conforms to the solicitation requirements, and whose proposal, judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation, is the lowest priced technically acceptable (LPTA) offer. A determination of a fair and reasonable price will be conducted. The Federal Acquisition Regulation (FAR), as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS) and the Army Federal Acquisition Regulation Supplement (AFARS) will be used to evaluate the offer and award this requirement. The following factors shall be used to evaluate offers:
As set forth in FAR 52.215-1 (f) (4), the Government intends to evaluate each quote and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a), clarifications and award without discussions). Therefore, the offeror’s initial quote should contain the offeror’s best terms from a cost or price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In the event that discussions are held, a competitive range determination will be made. If the Contracting Officer determines that the number of quotes that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the rated technically acceptable quotes.
Acceptable and Unacceptable Ratings: The ratings to be utilized for evaluations are consistent with the DoD Source Selection Procedures and the Army Source Selection Supplement (AS3). A single rating system will be used to evaluate the Technical Capability and Past Performance (see tables below). The price submission will not be scored or rated. Price will be evaluated for reasonableness, completeness/accuracy, and balance, and will not receive an adjectival rating.
Table One (1): Technically Acceptable or Unacceptable Ratings
Ratings Description
Acceptable Proposal meets the requirements of the solicitation.
Unacceptable Proposal does not meet the requirements of the solicitation.
EVALUATION CRITERIA. Evaluation criteria consist of factors and elements. The proposal will be evaluated under three evaluation factors:
Factor 1: Technical Capability
Sub-factor One (1)---Management Approach Sub-factor Two (2)--Staffing Approach
Factor 2: Price Factor 3: Past Performance
Factor 1 – Technical Capability. The Technical Capability Factor evaluation provides an assessment of the offeror‘s capability to satisfy the Government‘s minimum requirements. The Government will evaluate the Offeror‘s technical proposal to ensure that it reflects a sound understanding of this requirement.
Sub-factor 1: Management Approach: The Government will evaluate responders’ proposed methodology for staffing planning, organizing, directing, and controlling its staff in performance of the tasks identified in the Performance Work Statement (PWS) and associated attachments. The document will be evaluated based on the soundness of the approach, the feasibility of the approach, and the comprehensiveness of the document. An assessment of the proposed management roles, controls, and communications will be evaluated on likelihood of success.
Sub-factor 2: Staffing Approach: The Government will evaluate how the offeror identified personnel/ labor categories (positions essential for contract performance) deemed necessary to satisfy the requirement of the PWS.
The Government will evaluate how proposed personnel fit into the overall organization and how they describe the proposed responsibilities for each position. The Government will evaluate the personnel qualifications to ensure qualifications are commensurate with the size and scope of PWS requirements. The Government will evaluate the offeror‘s key personnel qualifications relevant to ARMAG Gate Maintenance experience, specific experience and other relevant activities and achievements. The Government will evaluate how the offeror is going to ensure that all the requirements of the contract/PWS will be met during vacancies in the offeror’s staff due to resignations, and leave.
Factor 2 –Price. Price will not be scored or rated. Evaluation of price will be performed using one or more of the price analysis techniques in FAR 15.404-1(b). Through these techniques, the Government will determine whether prices are reasonable, complete, and balanced. If adequate price competition is not obtained or if price reasonableness cannot be determined using price analysis of Government-obtained information, additional information IAW FAR 15.4 may be required to support the proposed price.
(a) The Government will evaluate the pricing for each CLIN’s quoted price. The Government will evaluate the price for award purposes by adding the price of the three ordering periods and comparing the total price for balance and against all of the proposals found to be technically acceptable. Price will not be evaluated on those proposals found to be Technically Unacceptable.
(b) The Government may determine that an offer is unacceptable if the base year and option periods are significantly unbalanced. As part of price evaluation, the Government will evaluate its option to extend services (see FAR Clause 52.217-8) by adding one-half of the Offeror’s final option year prices to the Offeror’s total price. Thus, the Offeror’s total price for the purpose of evaluation will include One (1) Twelve (12) Month Base Year with Four (4) Twelve
(12) Month Option Years, and 1/2 of the 4th Option Year. Offerors are not required to enter a price for the six-month period.
Factor 3 – Past Performance. The past performance evaluation will assess the offeror’s probability of meeting the solicitation’s requirements as indicated by that offeror’s record of past performance. Past Performance is assessed at the factor level after evaluating aspects of the offeror’s recent past performance and focusing on performance that is relevant to the services being procured under this solicitation. Offerors are cautioned that in conducting the performance risk assessment, the Government may use data provided in the offeror’s proposal and data obtained from other sources, such as the Past Performance Information Retrieval System (PPIRS) or similar systems and State Department Watch Lists.
(a) Each offeror will receive a performance confidence assessment rating based on the Offeror’s recent past performance, focusing on performance that is relevant to the Contract requirements.
(b) The Past Performance Evaluation Team will review this past performance information and determine the quality and usefulness as it applies to performance confidence assessment.
(c) Assigning Ratings. The Past Performance Factor will be assigned one of the ratings defined below.
Past Performance Evaluation Ratings
Rating Description
Acceptable
Based on the offeror's performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror's performance record is unknown.
Unacceptable
Based on the offeror's performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
Neutral
In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror may not be evaluated favorably or unfavorably on past performance. In the context of acceptability/unacceptability, a "neutral" rating shall be considered "acceptable".
