About this file

This document is an Amendment 2 Questions and Answers form issued by the South Carolina Department of Transportation (SCDOT) for a Traditional Mowing solicitation in Dorchester County. The solicitation (Number 5400026152) requests mowing services including routine mowing of ditches, ODA (Other Designated Areas), and bridge ends, with mowable vegetation defined as vegetation up to half inch at 5 feet of height. The pre-bid conference was scheduled for November 15, 2023, at 10:00 A.M. at SCDOT headquarters (955 Park Street, Columbia, SC 29201) with teleconference options. The deadline for submitting questions was November 16, 2023, at 2:30 P.M., and offers were due by January 11, 2024, at 2:30 P.M. through the online procurement portal at www.procurement.sc.gov. Contract award was scheduled for February 14, 2024.

The solicitation requires offerors to submit a signed offer acknowledging receipt of all amendments and agreeing to hold their offer open for a minimum of thirty calendar days after the opening date. A Labor and Material Payment Bond is required, with the bond amount equaling one year's worth of total contract value based on projected acres to be mowed. The solicitation notes that if unmowable acres are subsequently identified and dropped from the contract, different bond issuers may have varying approaches to adjustments; offerors should consult with their bond issuer regarding potential modifications. If contract value changes seasonally, SCDOT will provide a new required bond value reflecting any increase or decrease. State vendor preferences do not apply to this solicitation. Offerors must complete Page Two of the form providing home office address, notice address, payment address, and order address information, along with acknowledgment of any amendments received.

PREFERENCES - A NOTICE TO VENDORS (SEP. 2009): On June 16, 2009, the South Carolina General Assembly rewrote the law governing preferences available to in-state vendors, vendors using in-state subcontractors, and vendors selling in-state or US end products. This law appears in Section 11-35-1524 of the South Carolina Code of Laws. A summary of the new preferences is available at www.procurement.sc.gov/preferences. ALL THE PREFERENCES MUST BE

CLAIMED AND ARE APPLIED BY LINE ITEM, REGARDLESS OF WHETHER AWARD IS MADE BY ITEM OR

LOT. VENDORS ARE CAUTIONED TO CAREFULLY REVIEW THE STATUTE BEFORE CLAIMING ANY

PREFERENCES. THE REQUIREMENTS TO QUALIFY HAVE CHANGED. IF YOU REQUEST A

PREFERENCE, YOU ARE CERTIFYING THAT YOUR OFFER QUALIFIES FOR THE PREFERENCE

YOU'VE CLAIMED. IMPROPERLY REQUESTING A PREFERENCE CAN HAVE SERIOUS

CONSEQUENCES. [11-35-1524(E)(4)&(6)] ***PREFERENCES DO NOT APPLY***

QUESTIONS FROM OFFERORS - AMENDMENT

THE SOLICITATION IS AMENDED AS PROVIDED HEREIN. INFORMATION OR CHANGES

RESULTING FROM QUESTIONS WILL BE SHOWN IN A QUESTION-AND-ANSWER FORMAT.

ALL QUESTIONS RECEIVED HAVE BEEN REPRINTED BELOW. THE “STATE’S RESPONSE”

SHOULD BE READ WITHOUT REFERENCE TO THE QUESTIONS. THE QUESTIONS ARE

INCLUDED SOLELY TO PROVIDE A CROSS-REFERENCE TO THE POTENTIAL OFFEROR THAT

SUBMITTED THE QUESTION. QUESTIONS DO NOT FORM A PART OF THE CONTRACT; THE

“STATE’S RESPONSE” DOES. ANY RESTATEMENT OF PART OR ALL OF AN EXISTING

PROVISION OF THE SOLICITATION IN AN ANSWER DOES NOT MODIFY THE ORIGINAL

PROVISION EXCEPT AS FOLLOWS: UNDERLINED TEXT IS ADDED TO THE ORIGINAL

PROVISON. STRICKEN TEXT IS DELETED.

QUESTIONS AND ANSWERS ARE BELOW. THE SCDOT’S ANSWER APPEARS IN RED.

1. All routine mowing including ditch, ODA and bridge ends will be half inch at 5ft of height? Correct, mowable vegetation is defined as vegetation up to half inch at 5’.

2. When we obtain a bond and pay on the allotted acres per the solicitation and then acres are dropped off because of un-mowable acres, what should we do about the price we paid on our bond? Our bond price is on the acres/money that we are projected to earn. The amount of the Labor and Material Payment Bond shall equal one year’s worth of total contract value. Different bond issuers may have different approaches to how they adjust due to fluctuation, so you should consult with the issuer to determine how any change would be handled. If the amount changes from one season to the next, SCDOT would provide a new value required representing any increase or decrease in total contract value for the upcoming year and mowing season.
